Protests & Violence

'Million MAGA March' in DC this Weekend
Far-right protesters, counterdemonstrators plan to gather Saturday in D.C.

Demonstrations in support of President Trump will descend on downtown Washington this weekend. The demonstration is expected to draw various conservative and far right groups, as well as nearby counter-protests organized by anti-fascist and anti-racism groups.

The rallies, which include a Women for Trump event, a "Million MAGA March" and a "Stop the Steal" demonstration will begin Saturday morning in and around Freedom Plaza.

D.C. police were put on high alert last week with fears of unrest and violent protests that many cities expected could follow Election Day. Although those fears didn't materialize, many downtown D.C. businesses remained boarded up through the weekend - and the raucous celebrations that followed Biden's victory.

The mayor said she is still urging businesses to remove the boards, even with the Saturday rallies in mind. washingtonpost.com cbsnews.com

Ohio bill would create new criminal charges to 'combat rioting, looting'
Two Ohio republican lawmakers introduced a bill this week that would create new criminal offenses "in an effort to combat rioting, looting and violence" in the state. State Reps. Cindy Abrams (R-Harrison) and Sara Carruthers (R-Hamilton) introduced House Bill 784 Tuesday. The bill would create a new riot assault charge if any person "engaged in an aggravated riot recklessly causes physical harm that is punishable by a fifth-degree felony. The charge would be a fourth-degree felony if the assault is against a peace officer and a third-degree felony if the peace officer sustains serious physical harm. Penalties would also be increased for "vandalizing public and private property and obstructing roadways during a disorderly assembly." wlwt.com

An Unlikely Bond:
Miami cop becomes mentor to teen who attacked him during BLM protest

The moment seemed to capture the super-heated emotions of a summer of national protest: A young Black teenager whacked a Miami police officer over the head with a skateboard during a chaotic demonstration. But five months later, maybe a lesson - and a little hope - has emerged from the violent clash between 17-year-old Michael Marshall and Miami Police Office Raymon Washington. A few weeks ago, Washington agreed to meet Marshall in a conference room at the Miami-Dade Children's Courthouse.

Marshall, a standout Northwestern High football player who had never before been in trouble, wept as he read a letter of apology, then peppered the officer with questions about police work. Washington, at 27 just a decade older, shared that he had suffered a major concussion in the attack, only the latest in over a dozen dating back to his own days of playing football.

They talked. They listened. They found some common ground. And against the odds, Washington and Marshall have since formed a friendship and bond, the officer now a mentor to the kid that struck him. miamiherald.com

Chicago police the target of 520 complaints since May protests;
8 officers stripped of powers

The Chicago Police Department has received hundreds of complaints against its officers since late May, when demonstrations broke out in the wake of the death of George Floyd in Minneapolis, according to police officials. Eight officers have been stripped of their police powers since that time due to the complaints. Details of the conduct that led to the actions against the officers were not immediately available. However, officials say some officers working the demonstrations were accused of verbally abusing protesters, denying them access to attorneys, and carrying out improper searches among other allegations. abc7chicago.com

Seattle releases police body camera footage of clash with protesters
Seattle released several lengthy police body camera videos this week revealing the police response to recent demonstrations that saw law enforcement officers repeatedly clash with protesters. The footage -- which runs nearly four hours -- is part of a federal lawsuit against the city by Black Lives Matter activists and the American Civil Liberties Union that alleges the Seattle Police Department violated a judge's order regarding the use of crowd control-tactics, a police spokesman told Fox News. foxnews.com

Flash Report: Here Are the Emergency COVID Regs

The Cal/OSHA Standards Board has published an extensive, 21-page emergency regulation regarding the spread of COVID-19 in workplaces. But the proposal, which the board will vote on November 19th, goes beyond workplaces to include employer-provided housing and transportation. It has new ominous reporting requirements.

The proposal comes in response to a request by Worksafe and the plaintiff's lawyers. There are sure to be plenty of stakeholder comments at next week's meeting. With the advent and expected delivery of a vaccine by the Trump administration, there are many questions about the need for this regulation.

If, as expected, it is approved by the board, it will go to the Office of Administrative Law and is projected to become effective by the end of November.

According to sources, changes are unlikely to be made no matter what the comments are from the business community.

Note: The Board has provided only a couple of days for comments. Cal-OSHA Reporter is making the full proposed reg available for download.

Click here to see the entire proposal. You can comment to the board at OSHSB@dir.ca.gov.

HHS enlists food and drug chains to boost COVID-19 vaccine access

About 60% of U.S. pharmacies could administer free coronavirus immunizations under partnership program

With several COVID-19 vaccines on the way, the U.S. Department of Health and Human Services (HHS) is partnering with large chain pharmacies across the food, drug and mass retail channel and independent pharmacy networks to ensure wide consumer access to the eagerly awaited immunizations.

HHS said yesterday the Federal Pharmacy Partnership Strategy for COVID-19 Vaccination program will provide coronavirus vaccine coverage across about 60% of pharmacies in 50 states, the District of Columbia, Puerto Rico and the U.S. Virgin Islands. Via partnerships with network administrators, independent pharmacies and regional chains will also be part of the federal pharmacy program, which HHS noted will help provide COVID-19 vaccination access in traditionally underserved areas. supermarketnews.com

Covid-19 Vaccine Makers Face Russian, North Korean Cyberattacks, Microsoft Says

Hacking efforts appear to have compromised online accounts
of some of the targeted drug researchers

Cyberattacks originating in Russia and North Korea in recent months have targeted online accounts at seven companies researching Covid-19 drugs and vaccines, according to Microsoft and in some cases successfully.

Microsoft declined to name the targets or say what information may have been gleaned, but said the seven are leading pharmaceutical companies and vaccine researchers operating in the U.S., Canada, France, India and South Korea.

The pandemic has exposed computer security as a serious and potentially life-threatening problem. Last month, hospitals across the U.S. were knocked offline by a ransomware attack that forced doctors and nurses to use pen and paper instead of computerized systems and delayed procedures. wsj.com

National Safety Council (NSC) Publishes Benchmarking Report on COVID-19 Safety Practices Implemented in Business and Industry

A new report from the National Safety Council (NSC), State of the Response: Employer Actions to Address the Pandemic, provides an overview of how employers have been responding to the COVID-19 pandemic.

The NSC survey sought to understand which COVID-19-related safety practices were being implemented in different organizations across different industries and operations types. The NSC created a list of 23 pandemic-related safety precautions that were recommended through its SAFER effort and included many best practices recommended by the CDC and other public health organizations.

The NSC also provided an infographic for a summary of its findings.

Overall, the most commonly implemented safety practices were "making hand sanitizers available throughout facilities; requiring mandatory face masks, shields, and/or other PPE; and requiring workers to clean and sanitize workstations before and after use (see Report Figure 7 (shown here below) for list of top 10 implemented practices)."

The least implemented COVID-19-related safety practices included increasing pay for frontline workers and instilling coronavirus testing either at home or at the worksite.

McKinsey and Company:
A Bad Week. U.S. Hospitalizations Reach All-Time High - 60,000+
It's different this time. In the spring and summer, hospitalizations were concentrated in a few northeastern cities and some areas of the South. Now rates are up across the country. And in 18 states, mostly in the Midwest, more than 10% of hospital beds are filled by COVID-19 patients. That's the threshold that signals the healthcare system may soon be overwhelmed - with respect to space, staff capacity, and availability of equipment such as ventilators. npr.org

In the US, hospitals have reported a fivefold increase in demand for isolation gowns, a sixfold increase for nasal swabs, and a 17-fold increase for N95 respirators. mckinsey.com

Robust OSHA Enforcement Coming in 2021
OSHA Fines for COVID-19 Safety Violations Reach Nearly $2.5 Million

OSHA announced on Nov. 6 that the agency has cited 179 worksites for coronavirus-related violations and proposed a total of $2,496,768 in penalties since the pandemic began, through Oct. 29.

Although the agency hasn't implemented any coronavirus-specific workplace safety standards, employers still must comply with existing standards that cover pandemic-related safety risks and the agency has released guidelines for limiting workers' exposure to the coronavirus.

OSHA has cited employers for failing to take the following coronavirus-related actions:

● Implement a written respiratory protection program.
● Provide a medical evaluation, respirator fit test, training on the proper use of a respirator and PPE.
Report an injury, illness or fatality.
● Properly record an injury or illness.
● Comply with the general duty clause.

Priorities Expected to Shift Under New Administration
President-elect Joe Biden will appoint a new DOL leadership team, and the department may focus on more-stringent workplace-safety standards for employers. The Biden campaign's goals include a robust plan for OSHA to carryout pandemic-related enforcement. shrm.org

Stressed employees behind 4 in 10 data breaches
A recent Outbound Email Security Report from Egress has revealed that stressed, tired employees are behind four in 10 of the most severe data breach incidents. As stress levels rise, rushed employees are more likely to make simple mistakes such as sending an email to the wrong person, or attaching the wrong file.

With remote workers facing distractions from childcare to delivery drivers ringing the doorbell, and stress levels spiking as we head into new lockdowns around the world, employees are likely to make simple mistakes such as sending an email to the wrong person, possibly exposing sensitive data.

In fact, the research found that 80% of organizations have had sensitive data put at risk because of an employee sending an email to the wrong person.

Remote working  & surging email volumes increasing the risk.

Due to the pandemic, 93% of businesses have reported an increase in outbound emails, with one-in-two IT leaders reporting an increase of over 50%.

With this surge in email activity looking set to continue as new restrictions mean many will be working remotely for longer, the surface area for risk of an outbound email data breach is growing. securitymagazine.com

US Retail Sites, Like Walmart and Costco, Are More at Risk
to Cyber Attacks Than EU Retailers

Outpost24, an innovator in identifying and managing cybersecurity exposure, has announced the results of the '2020 Web Application Security for Retail & E-commerce Report', which analysed the web applications of the top 20 retailers in the US and EU. Research shows exploits targeted at web applications remain one of e-commerce's most significant threats. Using an average risk exposure score based on Outpost24's multi-layered attack surface discovery tool, Scout, the findings revealed that web applications used by US retailers were more at risk with an aggregated average risk score of 35 against a maximum score of 42.33, which was higher than their EU counterparts at 31.

On average, the report found US retailers to be running more publicly exposed web applications (3,357) compared to EU retailers, which ran fewer applications (2,799). Yet, despite having a smaller attack surface, EU retailers had a higher percentage of applications using old components that contained vulnerabilities (27%) as opposed to their American rivals (22%).

Nonetheless, all retailers had security risks within their web environments that could expose them and their customer data they hold to potential exploitation and compromise.

The list of retailers were chosen based on Deloitte's 'Global Powers of Retailing Report 2019' and had their public-facing web security environments analysed against the seven most common attack vectors used by hackers during reconnaissance, to ascertain the risk score, including Security Mechanisms, Page Creations Methods, Degree of Distribution, Authentication, Input Vectors, Active Contents and Cookies (score 1-100 each). thefintechtimes.com

Price Gouging on the Horizon?
It Could Get Bumpy - Amazon Preparing for Panic Buying

Sellers are trying to prepare for any big changes on the horizon. According to Amazon experts, things likely won't be as extreme as they were last spring. But with the holidays in tow - and
Amazon preparing for increased panic buying - it may get a bit bumpy.

Neither Amazon itself nor its sellers want a repeat of the spring. But while the risks of panic buying on that scale are small, there's reason to worry about a lower-level surge.

But if panic buying does happen again, Amazon seems more prepared to handle it - and to neutralize a subsequent rush of price gouging. While Amazon experts Modern Retail spoke with are not concerned about unfair prices resurfacing in large numbers, they do worry about Amazon suspending more sellers. The problem for Amazon is twofold: on one hand, Amazon can't possibly catch all bad actors on its platform. But on the other, its algorithms will continue to accidentally suspend some sellers who had nothing to do with price gouging at all. modernretail.co

LinkedIn Discovers Ad Metric Error, Overcharging Over 400k Advertisers
LinkedIn has reported a significant error in its ad reporting, which has caused many LinkedIn advertisers to be
overcharged for their campaigns over the past two years.

The error, reportedly, relates to campaigns that ran on iOS devices, and was triggered when users rotated their phones to watch videos. When this occurred, LinkedIn's system counted these as additional video views, which were then listed within your campaign metrics.

"More than 90% of customers saw an impact of less than US $25, and we are currently working with all customers who were impacted to provide full credit to their accounts."

Moving forward, LinkedIn says that it's working with the Media Rating Council (MRC) to conduct an audit of its metrics, while it's also collaborating with Moat to improve its video measurement systems. socialmediatoday.com

Fired Amazon worker sues over pandemic working conditions
Alleging that Amazon violated federal civil rights law by terminating his employment and by
allegedly putting thousands of other minority Amazon workers at risk during the pandemic.

The suit, filed in US district court in the Eastern District of New York, calls for compensation for Smalls and more protective measures for Amazon workers who continue to handle packages in the company's facilities amid a worsening health crisis.

In October,
Amazon confirmed that nearly 20,000 of its workers had tested positive or been presumed positive for the coronavirus, highlighting the toll that the pandemic has taken on the company's workforce even as Americans have come to depend more heavily on the platform for rapid delivery of everyday necessities.

Smalls was fired by Amazon earlier this year
after organizing a protest outside his workplace, the JFK8 fulfillment center in Staten Island, to highlight what Smalls said were unsafe working conditions at the start of the pandemic.

At the time of his firing and on Thursday, Amazon said it had placed Smalls under coronavirus quarantine and that by showing up to the JFK8 facility for the protest, Smalls had violated the terms of that quarantine. cnn.com

New Orleans, LA: Two Women Sentenced In Credit Card Fraud Conspiracy Case
U.S. Attorney Peter G. Strasser announced that two women, KEYIRA GABLE, age 33, of Harvey and BRITTANY WHITE, age 34, of New Orleans, were sentenced today by U.S. District Judge Barry W. Ashe for their participation in a years-long credit card fraud conspiracy. Judge Ashe sentenced GABLE to a total of 61 months in prison. Judge Ashe sentenced WHITE to a total of 37 months in prison based on her previous guilty plea to conspiracy to commit access device fraud and possession of fifteen or more counterfeit or unauthorized access devices.

GABLE and WHITE were the second and third defendants to be sentenced in this seven-defendant conspiracy case. According to court documents, GABLE, WHITE, and their co-conspirators engaged in a scheme to obtain merchandise and cash from stores through fraud. The defendants obtained stolen credit and debit card information, encoded it onto cards, and then used that information to purchase items at stores. The defendants would then return the items at a different store of the same chain, but they would deceive store workers in order to have the chargeback credited to their own bank accounts. Federal agents were able to determine that members of this conspiracy took flights around the country to execute the scheme, including Oregon, South Carolina, Illinois, Tennessee, Missouri, and Florida. justice.gov

When anyone goes for an interview you've got to play to win. You should not allow: any outside variable, any future promotion thoughts or promises, your guilt feelings towards your current employer or boss, your preconceived opinions of the possible future employer, or any miss-step in the process on the part of the future employer disrupt or impact your performance. All interviews have long range implications on your career. The executives interviewing you are part of a community and you'll run into them again at another company. So if you do get involved and go for an interview, commit yourself all the way and play to win. It doesn't mean you've got to take the job. It just means you have to perform at 100%.

Just a Thought,
Gus
