The
implications of organized retail crime are far-reaching, and the urgency of
addressing ORC has never been greater. In recent years, retailers across the
United States have reported a sharp increase in the frequency and scale of
retail crimes involving or associated with ORC groups.
What's even more concerning is the increase in violence tied to these crimes.
More than two-thirds of respondents to NRF's 2023 National Retail Security
Survey said they had seen even more violence and aggression from ORC
perpetrators compared with a year ago.
"The ORC problem we have in the U.S. has certainly grown," says
Scott McBride, chief global asset protection officer
with American Eagle Outfitters, "and it's affecting every single
community that we operate in as a collective group of retailers."
A unified approach
Addressing this issue requires a multifaceted approach that includes enhanced
security measures, legislative action and collaborative efforts between
retailers, law enforcement and policymakers - a need lawmakers answered by
introducing the
Combating Organized Retail Crime Act (H.R. 895/ S. 140).
Facilitating information exchange
One of CORCA's central provisions is the establishment of a new Organized Retail
Crime Coordination Center within the Department of Homeland Security. This
center would serve as a hub for information sharing and coordination between
local, state and federal law enforcement agencies, retail businesses and other
stakeholders.
Retailers' need for the advancement of the Combating
Organized Retail Crime Act is urgent, and the continued denial of
ORC's existence has done nothing to make the problem disappear. Retailers,
states and localities have invested billions into curbing these crimes, but
stalled federal solutions have allowed this stubborn challenge to metastasize.

Shoplifting Up 15%, Despite Violent Crime &
Property Crime Decrease
Murder and other violent crime dropped across the U.S. last year, FBI data shows
Murder dropped 11.6% from 2022 to 2023, the
largest single-year decline in the last 20 years. Property crime was also down
overall, while shoplifting rose.
Crime, including serious violent incidents like murder and rape, dropped
nationally from 2022 to 2023, according to new data released by the FBI on
Monday.
Violent crime was down about 3% from 2022 to 2023, and
property crime took a similar drop of 2.4%, the FBI reported in its
annual "Summary
of Crime in the Nation." The most serious crimes went down
significantly: murder and non-negligent manslaughter were down an estimated
11.6% - the largest single year decline in two decades - while rape decreased by
an estimated 9.4%.
Preliminary numbers showed that 2024 crime numbers were also dropping for
the early part of this year, continuing a
trend of easing crime as the U.S. has come out of the pandemic.
Among property crimes, burglary decreased by an
estimated 7.6%. Motor vehicle theft, however, was up by an estimated
12.6% between 2022 and 2023. Recorded incidents of shoplifting were also up:
from 999,394 in 2022 to 1,149,336 in 2023 (a 15% increase),
which is roughly the same level of incidents reported in 2019, before the
pandemic. (Store closures and COVID-19 security measures likely decreased
shoplifting in 2020 and 2021, and may have affected 2022 incidents as well.)
Monday's data collection pulls from the National Incident-Based Reporting System
(NIBRS) and covers more than 315 million people - or 94.3% of the US.

Poll: Most Californians favor Proposition
36, theft and drug crimes measure
Proposition 36, which restores felonies for some thefts under $950, has
won support from 71% of Californians in a new poll.
The
Californians and Their Governments survey was conducted Aug. 29 to Sept. 4
by the Public Policy Institute of California. According to the nonpartisan think
tank, 26% of respondents said they would vote against Proposition 36, which
increases prison and jail sentences for certain drug and theft crimes.
What would Proposition 36 do?
Proposition 36 would undo some of the punishment reductions from Proposition
47, according to the
nonpartisan Legislative Analyst's Office.
Passed in 2014, Proposition 47 turned thefts worth $950 or less and some
drug-related charges into misdemeanors. Proposition 36 allows felony charges for
thefts under $950 and the possession of certain drugs if the defendant has
had two prior theft or drug convictions, according to the
Secretary of State Office's voter guide.
If passed, Proposition 36 would mean longer sentences for people convicted of
certain drug or theft crimes. "In certain cases, people who possess illegal
drugs would be required to complete treatment or serve up to three years," the
Secretary of State Office said.

Shrink Mentions Dropping on Earnings Calls
Is the shoplifting "crisis" over?
Is the shoplifting "crisis" over? Last year, retail executives were sounding the
alarm about shoplifting cutting into profits. This year, there's been less
hullabaloo. CNN reported that mentions of "shrink" on
companies' earnings calls dropped 20% in the first half of 2024.
Shoplifting is shrink, but not all shrink is shoplifting.
Shrink refers to all inventory losses, including theft by customers and
employees, but also damage, errors, returns and vendor fraud. Experts told
Marketplace about 40% of store losses are due to customers liberating products
from shelves.
Foiling thieves may cost stores loyal customers. Plexiglass barriers
reduce shoplifting but increase friction for paying customers. For instance,
shoppers are less likely to make impulse purchases when they have to wait for an
employee to unlock a cabinet. It appears that brick-and-mortar stores could win
a short-term battle against shoplifting, but at the expense of hard-earned foot
traffic. Making the shopping experience inconvenient and hostile has already
prompted some customers to buy online instead of in person.
Retail theft panic during the pandemic was
based on sloppy number crunching. The National Retail Federation claimed
in 2021 that theft by organized crime rings had skyrocketed and used inaccurate
data to lobby lawmakers to crack down on theft. The NRF retracted those claims
last year and acknowledged that "quantifying the scope of organized retail crime
is challenging." Experts told Retail Dive that some companies may have inflated
their theft problem to justify store closures and staff reductions.

and elsewhere has led law enforcement officials to strategize how to stem the
gang's growth.
At the country's southern border, U.S. Border Patrol agents have been on the
lookout for members of a notorious Venezuelan gang. In the nation's
heartland, police officers from Denver to Chicago have made dozens of
arrests for alleged crimes linked to the group, from
retail theft to murder and prostitution.
And in New York City, police detectives have spent months interviewing
informants - including confessed gang members - to identify gang leaders and
gather information on robbery patterns and recruitment efforts.
The gang in question is Tren de Aragua, which sprang from a Venezuelan prison
and developed into a feared criminal organization focused on sex
trafficking, human smuggling and the drug trade.
Its widening presence in the United States has become a political
lightning rod for Republicans, especially former President Donald J. Trump, as
they seek to blame the Biden administration's border policy for allowing
criminals into the country.

Rite Aid's answer to retail theft at California store: Lock up all its products
For years, stores across Southern California have been putting high-priced
items behind lock and key to deter thieves.
The Rite Aid on the corner of Long Beach and Compton boulevards, though, takes
this approach to security to a new extreme. Customers there are greeted by
rows and rows of shelved items - makeup, chips, baby formula, paper towels,
lotion and juice - that are locked behind plexiglass.
Most of the items in the store are accessible only after clicking a button that
will summon an employee to come over, open the case and retrieve what the
customer is interested in (and put it back if the interest fades).
The community is split on the store's move, and employees are speaking out
about how disruptive the change has been to their workday.

Retail and hospitality sectors reported the lowest
levels in workplace well-being.
Workplace Well-Being is Worsening
All is not well at work, according to recent
findings.
The workplace has undergone significant changes in the past five years. So, too,
has worker well-being.
An annual survey of more than 1.5 million workers has found that between 2019
and 2023, workplace well-being has declined. There was a noticeable
improvement in 2020, but that has since eroded as
workers have returned to the office and lost the flexibility that
improved work-life balance.
All surveyed industries saw the same decline, but health care, retail and
hospitality sectors reported the lowest levels in workplace well-being.
The survey is part of the "Well-Being at Work: Fostering a Healthy Climate for
All" report from the Johns Hopkins Carey Business School and Great Place to
Work.
Companies with high levels of well-being show the substantial businesses cost of
not providing psychological safety at the workplace in the form of lower
profits, decreased engagment, higher turnover, poorer customer service and
increased health care costs.

DEI Isn't Going Anywhere
No, not all companies are abandoning diversity, equity and inclusion. Here's
why.
Amid a high-profile backlash, many
businesses are scrutinizing their policies. But the vast majority end up
sticking with DEI, in part because it's key to growth.
A December 2023 survey by the Conference Board of nearly 200 chief human
resources officers found "unanimous support for maintaining, if not
intensifying, DEI efforts into 2024, with 63% actively seeking to further
diversify their workforce." Some companies are ducking the current spotlight
on DEI by renaming their initiatives while keeping their substance intact,
several experts said. Those that take this route should evaluate changes to be
sure they align with business strategies and the interests of stakeholders,
according to a recent report from the think tank on "repositioning DEI."
Because companies have diverse stakeholders, including employees, customers and
shareholders, and because it's their business to be profitable, it's not just
acceptable but necessary for them to question their DEI programs'
effectiveness and evolve them as necessary, according to Diana Scott, who
leads the nonprofit's U.S. Human Capital Center.
In all, though, some 90% of those working with the Conference Board remain
committed to DEI after doing so, Scott said by video call.

Restructuring Microsoft's Security Culture
Microsoft names deputy CISOs, flushes dead accounts as part of internal security
overhaul
The company released a progress report on
efforts to revamp its internal security culture and governance.
Microsoft said it launched a Cybersecurity Governance Council as part of a
larger restructuring of its internal security culture following a scathing
report from the federal Cyber Safety Review Board.
The council will take ownership over ongoing compliance, implementing
regulatory requirements and identifying the architecture required to reach its
security goals. The governance changes were listed in a progress report
released Monday showing how Microsoft revamped its security practices and raised
accountability since
launching the Secure Future Initiative in November.
As part of the effort, Microsoft has named 13 deputy CISOs that will each be
responsible for specific product segments within the company, including
Azure, Microsoft 365, AI and gaming.
Under the new structure, the company's senior leadership team is reviewing
progress made under SFI on a weekly basis, Microsoft said. It will, in turn,
provide updates to the company board of directors every quarter.

Organizations are changing cybersecurity providers in wake of Crowdstrike outage

often than not, a cyber attack or a cyber incident that results in business
disruption will spur organizations to make changes to improve their
cybersecurity and cyber resilience - and sometimes that means changing
cybersecurity providers.
The recent massive worldwide outage caused by a faulty Crowdstrike sensor
content update has had a similar effect on many German organizations, a
recent report by the German Federal Office for Information Security (BSI) and
Germany's digital association Bitkom has revealed.
"The survey is not representative, but it does provide a meaningful picture of
the mood for affected companies in Germany," the BSI noted.
Of the 311 German companies polled, 62% were directly affected by the faulty
CrowdStrike update (i.e., their PCs or servers were paralyzed), and 48% were
indirectly affected (i.e., because their suppliers, business partners, and/or
customers were affected).
40% of the 205 companies that were affected directly were unable to
collaborate with or provide services to customers for a time. 48% had to
cease operations - either completely or partially - due to the problems that
arose, and it took them (on average) 10 hours to resume operations in their
entirety

the situation.

Amazon Still Has a Counterfeit Problem
Hundreds of generic ink cartridges are
listed on the site with the same packaging look as brand-name competitors.
Independent ink and toner cartridge makers have a difficult time getting into
retail stores; a much simpler way for them to challenge incumbents is online,
particularly through the leading marketplace, Amazon. There, the incentives
are less toward selling a better product at a lower price, and more toward
capitalizing on inattentive consumers.
This is facilitated by a vast third-party marketplace on Amazon that makes it
simple for millions of people to sell on the site. It's essentially impossible
for Amazon to know what's being sold at any one time, and as a result a major
counterfeit market, largely produced in China, has sprung up. In the past,
brands like Birkenstock and Nike have fled the site
rather than see their products continuously knocked off, and thousands of
products have been posted for sale that are not only fake but deemed unsafe or
banned by federal regulators. In response, Amazon created a
Counterfeit Crimes Unit and claims to have seized over seven million counterfeit
products from its marketplace in 2023.
These two monopoly problems-user lock-in and unpoliceable, potentially
hazardous marketplaces-collide in the listings for replacement ink
cartridges on Amazon.
A review conducted by the Prospect found 131 different ink cartridge
replacements for home printers whose packaging looks identical to brand-name
products for HP, Epson, Canon, and Brother. By using pay-per-click
advertising campaigns, these generics can achieve a higher page rank than the
brand names.
The problem persists despite the fact that HP successfully went to court and
secured an injunction against third-party sellers that mimicked its packaging
for ink cartridges. And it's happening even though Amazon's Counterfeit Crimes
Unit is separately working with Canon to prevent knock-offs in another business
line.

Amazon offers sellers 'fully managed' supply chain solution
The new Supply Chain by Amazon features will
be available to U.S. sellers in October, and roll out globally by the end of the
year.
Amazon will soon offer sellers a "fully managed" option using its existing
Supply Chain by Amazon solution that automates logistics, warehousing and
distribution decision making, according to a Sept. 18 blog post.
Previously, sellers had to individually choose which services to use and manage
all product movement decisions, Dharmesh Mehta, VP of worldwide selling partner
services, told Supply Chain Dive. Now, the company just has to specify
product quantity and the desired pickup location.
Once that seller information is processed, "we pick [the product] up, we move
it across borders and customs, deal with the port and warehousing, and then we
optimize how much product to move, where [and] when to move it," Mehta said
at Amazon's annual third-party seller conference Tuesday.

Concord, CA: Brazen' break-in at Concord mall jewelry store
Police in Concord are investigating what they describe as a "brazen"
smash-and-grab robbery at a jewelry store Sunday. In the middle of a crowded day
at Sun Valley Mall, police say thieves took off with an unknown amount of
jewelry from Kay Jewelers. Panels of shattered glass could be seen in the store
Sunday afternoon as police began investigating. "It was five suspects who
went in, [a] brazen act, some were armed with sledgehammers and other tools and
started smashing the glass," explained Cpl. Chris Blakely with Concord police.
Police say just after 1 p.m. Sunday, five men wearing dark clothing ran into the
Kay Jewelers store and started smashing the cases. The thieves were in and out
in less than two minutes, police said.

Redwood City, CA: Alleged Thrift Shop Burglar Caught Wearing Stolen Clothes
A man accused of breaking into a Redwood City thrift store and stealing
thousands of dollars in merchandise was arrested while wearing some of the items
he stole, according to police. Officers arrived at the Savers on Main Street a
few minutes before 6 a.m. Thursday to investigate a reported burglary. According
to investigators, someone smashed a window and entered the store overnight,
taking an estimated $7,500 in inventory. According to police, the suspect
was caught on video surveillance and was easy to identify despite attempts to
conceal his appearance. Police said they arrested the suspect a few hours later
at a nearby encampment, and additional stolen items were recovered nearby.

Lincoln Police catch suspect fleeing GameStop during burglary attempt
20-year-old man was arrested after breaking into a GameStop and attempting to
steal nearly $3,000 worth of gaming equipment, according to Lincoln Police. At
4:37 a.m. Sunday, Lincoln Police responded to a burglar alarm at the GameStop in
SouthPointe Pavilions. Officers found a shattered window and a man inside the
store. The suspect fled through the broken window after briefly running inside
the store, according to police. After a short foot chase, officers arrested
Zaiden Hoffman, 20, near 29th and Zermatt Drive. Hoffman was arrested on
suspicion of burglary, possession of burglar tools, and obstructing a peace
officer. The damage to the store's window is estimated at $3,500. Police
recovered $2,961.71 worth of gaming equipment.

Boulder, CO: Update: Colorado jurors find Boulder grocery store shooting gunman
guilty of 10 counts of first-degree murder
Jurors reached a verdict Monday afternoon in the Boulder grocery store shooting
trial. The jury found Ahmad Al Aliwi Alissa guilty of shooting and killing 10
people at the South Table Mesa King Soopers on March 22, 2021, in addition to
guilty verdicts on dozens of other charges. Jurors had to determine whether
Alissa, the gunman who admitted to the shooting, was legally sane at the time of
the attack. In addition to the guilty verdict on 10 counts of first-degree
murder, the jury also found the gunman guilty on 38 counts of attempted
first-degree murder, guilty of one count of assault in the first degree and
guilty on six counts of possession of a large-capacity magazine during the
commission of a felony.

A jukebox song selection reportedly led to a deadly shooting at a restaurant in
a Fort Lauderdale strip mall. It happened overnight at the shopping plaza on
Davie Road near State Road 7. Mauro Bonilla, who frequents Antojitos Mexicanos,
said friends who were inside told him it began when a man started playing a song
on the jukebox. He said that's when another customer came up to the man and said
"you're not a real Mexican if you play that music." Bonilla said the argument
then escalated. "The guy who got insulted pulled his weapon and started
shooting, you know, to the other guy, didn't give him the chance," said Bonilla.

Atlanta, GA: 1 dead, 1 injured after shooting at neighborhood grocery store
One man is dead and another wounded after police say the two got into a gun
battle inside a popular neighborhood store. It happened inside the Grocery
Brothers store on Metropolitan Parkway around noon. People who frequent the
business saw police and crime scene tape and initially thought something had
happened to the owners. It was a sense of relief when they learned the workers

Georgetown County, SC: Coroner IDs teen killed in Georgetown County shooting;
suspect in custody
The Georgetown County Coroner's Office released the name of the teen who died in
a Sunday shooting. Natiya Browne, 16, of Charlotte, N.C., was pronounced dead at
the scene, according to Coroner Chase Ridgeway. The Georgetown County Sheriff's
Office said 20-year-old Daemon Sanders was arrested Sunday night in connection
to Browne's death. He's the suspect deputies named after the shooting at a store

Police are investigating an attempted robbery that left a man with a gunshot
wound in a parking lot at South Coast Plaza in Costa Mesa Sunday night. Officers

Ridge on Class X felony charges of armed robbery with a firearm. Two accomplices
are also alleged to be involved. On July 23, 2023, police said Elayyan robbed
the Jawahir Jewelry store at gunpoint, 8454 S. Harlem Ave. Elayyan is alleged to
have hit a second jewelry store, Jerusalem Jewelry, 9070 S. Harlem Ave. on Jan.
9. Bridgeview police, along with the FBI and Illinois Attorney General's office,
executed multiple search and arrest warrants in the 10600 block of South Major
Avenue in Chicago Ridge, where Elayyan was taken into custody.

Los Angeles County, CA: Recent Female Parolee Arrested for Strong Arm Robbery at
Lakewood Mall Macy's
Lakewood Sheriff's Station officials report that Deputies responded to Macy's at
the Lakewood mall regarding a robbery in progress. Deputies arrived and detained
the female suspect. During the investigation, deputies learned that the female
stole some high value items and fought with loss prevention when they attempted
to detain her. The female was placed under arrest for felony strong arm robbery.
During the booking process, deputies learned that the female suspect was just
released from prison with parole conditions for a separate robbery conviction.
The suspect will remain in custody pending court and a hearing from the parole
board.

Montreal, Canada: $25,000 worth of PGA merchandise stolen from a Montreal Hotel
Thousands of dollars worth of PGA merchandise was stolen from a downtown
Montreal hotel over the weekend. Montreal police (SPVM) says they received a 911
call on Sept. 21 regarding the theft at a hotel on René-Lévesque Blvd. "Officers
[went to the location] to meet the complainant for a theft of more than $5,000,"
said Anthony Dorélas, a SPVM spokesperson. "The complaint was taken from by our
officer and right now is under investigation." According to TVA Nouvelles, the
incident took place at Montreal's Queen Elizabeth Hotel and the stolen items
included official clothing, like polo shirts, caps, jackets and shoes that
tournament players were set to wear for the Presidents Cup. They reported that
the merchandise's total value is over $25,000 - which the SPVM would not
confirm to CityNews.
