Voters May Approve Even Tougher Anti-Theft
Measure in California
Are California's new anti-theft laws enough to defeat Prop. 36? Don't bet on it
Gov. Gavin Newsom may have placated some big retailers when he signed a
package of bills last week that aims to deter retail thefts, including the
"smash and grab" robberies that have shocked and disgusted so many Californians.
But that may not be enough to turn the tide against Proposition 36, the
contentious measure on the November ballot that Newsom and some other top
Democrats oppose.
For that, Newsom and company have no one to blame but themselves.
Had they responded more quickly to the rise in property
crimes, the public might have less of an appetite for rolling back some of the
elements of Proposition 47, the 2014 voter-approved initiative that
downgraded certain drug and property crimes from felonies to misdemeanors.
Prop. 36 - backed by a growing coalition of law enforcement agencies,
Republican lawmakers and some Democrats - takes a tougher approach,
especially on repeat offenders. It includes many measures contained in the
legislative package signed by Newsom, but it's much broader in scope. It
increases penalties not just for thefts, but also for drug offenses. .
Newsom's office described the anti-theft bills he signed as "the most
significant legislation to address property crime in modern California history."
Voters should view such hyperbole with some skepticism. The 10 bills will make
it easier to prosecute and punish property crimes. They would allow thefts
occurring at multiple locations by the same suspect or suspects to be counted
together instead of separately. That's important because, in California, a
felony grand theft charge is triggered by the theft of $950 in property or more.
Prop. 36 would make a third petty theft a potential felony, which is
disallowed under Prop. 47 (it requires a follow-up proposition, such as 36,
to amend any of the specific sentencing reforms contained within it).
Legislation can amend sentencing approaches not contained in the voter-approved
measure. In addition, the bills that Newsom signed added sentencing enhancements
for large-scale theft operations. They add penalties when a business is damaged
during a theft and allow for the prosecution of property stolen from locked or
unlocked vehicles. Targeting organized retail theft rings rather than
shoplifters stealing out of need is the right approach. Yet if this
legislation is so significant, why wasn't it passed months ago? Instead, Newsom
and some Democratic leaders wasted time trying to kill Prop. 36.

Alanis' cargo theft bill signed by Governor Newsom
Assemblyman Juan Alanis' bill to provide additional resources and equipment
to jurisdictions identified with high levels of cargo theft, through the
California Organized Retail Crime Task Force, was signed into law by Governor
Newsom on Friday. The bill went into immediate effect upon the governor's
signature.
"I'm proud of the work my team and I have done to build consensus around a
solution to an issue that has continued to decimate our communities," said Assemblymember Alanis.
"As part of the larger bipartisan legislative retail
theft package, AB 1972 moves the needle toward
protecting our businesses and the critical shipping routes they depend on."
Existing law authorizes the Governor to appoint and commission individuals
designated by a railroad company to serve as police officers. Existing law,
until January 1, 2026, requires the Department of the California Highway Patrol
to coordinate with the Department of Justice to convene a regional property
crimes task force to identify geographic areas experiencing increased levels of
property crimes and assist local law enforcement with resources, such as
personnel and equipment.
This bill would require the task force to assist railroad police and would
specify cargo theft as a property crime for consideration by the regional
property crimes task force. AB 1972 was signed alongside other retail theft
package bills.

Area Giant stores implementing new policy on unaccompanied minors
A
new policy is coming to select Giant Food locations: stores will not allow any
unaccompanied minors in the evenings. The new policy states that shoppers
under the age of 18 may not enter without an adult after 6 p.m. A
spokesperson with Giant released the following statement:
"Giant Food has initiated a new policy at select stores that are experiencing
high shrink to mitigate the unprecedented levels of product theft that have
become unsustainable for our business. Starting August 22nd at select
stores, shoppers under the age of 18 may not enter without an adult after 6 p.m.
"Retail theft in our market area affects everyone. It limits product
availability, creates a less convenient shopping experience, and, most
critically, puts our associates and customers in harm's way. Still, we continue
to invest in improving safety for our associates and customers and reducing
theft. At Giant Food, the well-being of our community, customers, and associates
is paramount. We sincerely appreciate your understanding and cooperation as we
work together to create a more secure shopping environment for everyone."
Two Baltimore locations will implement the new policy, with the Waverly
location (33rd Street) and the location at 5150 Sinclair Lane, starting on Aug.
22. This change comes months after the store implemented a "no bags or
backpacks" policy at the same locations.
Several Giant locations in the Washington, D.C., area are also using similar
policies, with some stores allowing backpacks as long as customers allow
them to be searched.

Product Lockups Prevent Theft But Also Lead to
Sales Drop
Shoppers turn away from stores that lock up toiletries and other items due to
theft
Walgreens, CVS, Target, Walmart and other
stores see drop in sales after locking items in plastic cabinets
Retailers like Walgreens and CVS are losing less merchandise, but are also
losing money by keeping basic toiletries like deodorant and toothpaste
locked up in those plastic cabinets.
Both Walgreens and Target stores in downtown Minneapolis now lock up the
majority of their toiletries. One anonymous worker at Walgreens told WCCO
Radio that any toiletry item they don't lock up is almost guaranteed to be
stolen, and that most of it gets resold on the street. The same worker pointed
out toothpaste that was not locked up, and the shelves were virtually empty due
to theft.
According to a story in Axios, secured cases can
cause sales to drop 15% to 25%.
There could be a technology-based solution for stories however. CNN says stores
are now testing a security tool that lets customers use their cell phone to
unlock products on the shelf. It's essentially self-service for unlocking
display cases in exchange for a customer's phone number.

It is very sad to see the last local Hi-School Pharmacy close. A year ago, I was
shopping at Safeway in Salmon Creek. Within three minutes of entering the
store, I was robbed by two women and I was targeted because I am old. I
finished my shopping, got ready to pay and my purse had been stolen, so I was in
a panic, everything gone in a flash, even my car keys. The credit cards were
used within 15 minutes of the robbery. The video showed the two women jumping
for joy as they ran out of the store.
This is not about the stand-up citizens, this is about the amount of theft that
retailers have to deal with on a daily basis, which is out of control. It is the
reason that products are in locked glass cases and why retail stores have to
close their stores. Personally, I am glad that stores have made this decision
to lock up products. I feel much safer.

How J.C. Penney is using AI and machine learning in its supply chain
The department store retailer is investing
heavily in new technology to improve productivity and upgrade its legacy
systems.
J.C. Penney is focused on protecting its future since emerging from bankruptcy
under new ownership in 2020. It's in the midst of a plan to invest more than
$1 billion into its business by fiscal year 2025.
One of the central pillars of the retailer's long-term improvement strategy
is implementing more advanced technology, including artificial intelligence
and machine learning, into its supply chain operations.
Chief Information Officer Sharmeelee Bala, who joined J.C. Penney in January
2022, has been a key leader behind the company's technology upgrade strategy,
noting that such initiatives are now being looked at as enablers for the company
rather than afterthoughts.
"J.C. Penney has been very strategic in ways to invest and how to invest and
prioritize the investments in technology, especially," Bala told sister
publication Supply Chain Dive in an interview. She added that the company is
focused on improving customer and employee experience through its technology
investments.
On the customer side, Bala says J.C. Penney has begun implementing newer
tools, some homegrown and others from third parties, across pricing and
assortment planning, among other functions.

Time
Facial recognition software leads to arrest at Tampa International Airport
A woman was arrested Thursday after the Transportation Security Administration's
facial recognition devices detected a passenger trying to use someone else's
ID and boarding pass at Tampa International Airport, the agency said.
A transportation security officer was working at Airside A when Brittany Lynn
Anderson, 38, of Tampa, inserted a driver's license into the credential
authentication technology machine, officials said.
The machine flagged a mismatch, leading to a manual inspection by the officer.
Anderson allegedly showed the officer an ID and a Spirit Airlines boarding
pass that belonged to someone else, according to an arrest report obtained
by News Channel 8. She allegedly told the officer "she was going through some
rough times" and "that's why she looks different" on the ID.
Anderson reportedly told the officer that her ID was expired and that she had
asked a friend to purchase her ticket under someone else's name so she could fly
to Las Vegas, according to the report. The boarding pass and ID card belonged
to a person who is currently in jail.

Walmart and Target are cutting prices to entice customers
Walmart hinted that it will issue even more
price reductions
Two of the biggest retailers, Target and Walmart, have recently reported a
jump in traffic due to the reduction in prices in recent months.
On Wednesday, Target CEO Brian Cornell told
analysts during an earnings call that the company reduced prices on about
5,000 frequently purchased items in many markets during the summer. In turn,
it "saw an acceleration" in unit and dollar sales trends in these businesses in
the second quarter, or the three-month period ending June 30, according to
Cornell.
During the last quarter, Walmart U.S. also
rolled out more than 7,200 rollbacks across categories. This includes a 35%
increase in the number of rollbacks in food, which has particularly been a pain
point for households.

Insurance coverage drives cyber risk reduction for companies, researchers say
Companies with cyber coverage are better
able to detect and respond to attacks, according to a Forrester report.
Companies with cyber insurance coverage are reducing risk and are more likely
to detect, respond and recover from data breaches and malicious attacks,
compared to organizations without coverage, according to two reports released
this week.
An At-Bay commissioned survey conducted by Omdia shows cyber insurance is
helping to drive proactive security measures, mitigation strategies and targeted
spending. More than 7 in 10 respondents said they view cyber coverage as
important or critical to their company, and reported increased spending on
proactive security solutions over the past 12 months.
A separate report from Forrester showed 1 in 4 global companies with
standalone cyber insurance coverage were able to detect and respond to incidents
in seven days or less, compared with 19% of businesses with no coverage or
18% with cyber coverage bundled into another policy.
The reports highlight the important role insurance coverage plays in
cyber mitigation efforts and risk reduction.

"The Company expects to record a one-time pre-tax charge of approximately $60
million for the unrecovered fraudulent wire transfers. ... The Company's

internal controls, remains ongoing. The business and operations were not
affected," the filing added.
Unlike other forms of cyberattacks, BEC scams do not rely on malware or
phishing links; instead, they exploit the human element by preying on the
trust that exists in established business relationships. They are particularly
effective in the B2B context due to the high-transaction value, complex
communication chains, and global reach, as well as other factors including time
sensitivity.

The FTC's New Crackdown of Fake Reviews
In Case You Missed It: We'll pay you to give our new rule a good review
The
FTC issued a new rule striking against the persistent problem of fake and
false consumer reviews and testimonials. Consumers should be able to trust
the authenticity of feedback they read, hear, or see about a product or service.
But digital content - including reviews and testimonials - has always been easy
to fake, and with generative AI tools it's now even easier. That makes our new
rule even more significant.
Fake reviews and testimonials have polluted the marketplace. They harm
the many consumers relying on them to pick products and providers, subverting
people's ability to make informed decisions. They also hurt competitors who work
hard to comply with the law.
The FTC has challenged illegal practices regarding reviews and testimonials for
several decades. Along with numerous law enforcement actions, we've also issued
guidance to help businesses do the right thing. We're not alone. Other
regulators in the states and abroad have been trying hard to attack the problem.
And whether protected from liability or not, online marketplaces and social
media companies also have a crucial role to play, and they could and should
do more to stem the tide of deceptive commercial conduct that they've allowed to
fester on their platforms.
But altogether it has not been enough. That's why, in 2022, we started the
process for developing a new federal rule spelling out clearly deceptive
practices in this area, authorizing courts to impose civil penalties for knowing
violations, strengthening our enforcement actions, and imposing a deterrent
effect on bad actors. The final Rule on the Use of Consumer Reviews and
Testimonials reflects the great benefits of the public comment process. We heard
a broad range of perspectives from consumers, small businesses, advocacy
organizations, trade associations, review platform operators, researchers, and
others with an interest in the area. As a result of their comments, we've made
some clarifications and adjustments to the initially proposed version of the
rule, which you can read all about in the lengthy statement accompanying the new
rule.
Just as originally intended, the new rule remains focused on fighting clearly
deceptive practices involving reviews and testimonials and not burdening honest
businesses. Any deceptive or unfair practice involving reviews or
testimonials which the rule does not cover is still subject to the FTC Act.

Investigation Into Amazon Driver Killing
Amazon delivery driver killed during 'vanjacking'
A delivery driver has been killed as he tried to stop a thief stealing his
van in Leeds. The victim was found seriously injured in Heights Drive,
Wortley, just before 19:00 BST on Tuesday, and later died.
West Yorkshire Police said the van was driven off at speed with the man "still
partly inside the passenger door". The courier, aged in his 40s, had
returned to his Ford Transit after delivering an Amazon package nearby.
Detectives said the victim had dropped a parcel off at a house half a mile away
in Alliance Street around 15 minutes earlier, then returned to discover the
attempted vanjacking. As the thief drove away at speed, with the courier in
the door, the van struck two parked cars on Heights Drive and the man was
left at the junction of Heights Way and Heights Bank.
Members of the public gave first aid and the Transit was recovered about four
miles away in Highlands Walk, Belle Isle, a short time later.

Torrance, CA: Nearly $400,000 in stolen retail merchandise recovered following
arrests in Southern California
Three people have been charged with stealing nearly $400,000 in goods and
selling counterfeit items at a swap meet in Southern California, a California
Highway Patrol taskforce announced on Tuesday. Jose Cuadra, 41, was charged with
two felony counts of receiving stolen property, one felony count of organized
retail theft in concert with two or more persons and one felony count of the
manufacture and sale of counterfeit mark. Cuadra was arrested at his Los Angeles
home after investigators with the California Highway Patrol's Organized Retail
Crime Taskforce identified him as the leader of the fence operation, or an
operation that deals in stolen goods. The stolen merchandise was being sold at
an "open-air market in Torrance."

Boston, MA: Update: Man sentenced to prison for stealing $32,000 in merchandise
from Gucci store at Wrentham outlets
A
Washington, D.C., man was sentenced Tuesday in federal court in Boston to
stealing $32,000 worth of merchandise from a Gucci store in Massachusetts back
in 2021. Linworth Hayes Crawford III, 30, was sentenced in U.S. District
Court to eight months in federal prison, to be followed by two years of
supervised release. He must also pay $32,000 in restitution to the Gucci store
at the Wrentham Village Premium Outlets. He had pleaded not guilty in February
to one count of conspiracy to transport stolen goods in interstate commerce and
one count of interstate transportation of stolen goods. Prosecutors say on the
night of Sept. 16, 2021, Crawford and several other co-defendants traveled from
the Washington, D.C., area to the Wrentham outlets and smashed the glass front
door of the Gucci store, stealing $32,000 in high-end merchandise, including
handbags, duffle bags, backpacks and sunglasses. The day after the theft, one of
the co-defendants allegedly posted on his Instagram account that he had Gucci
bags available for sale. Images of the bags appeared to be identical to the ones
stolen from the Wrentham store.

Las Cruces, NM: Las Cruces business steals more than $8K of merchandise as part
of retail crime operation
A woman was recently arrested after a Las Cruces business was discovered to be
running an organized retail crime operation that stole more than $8,000 in
merchandise, according to the Las Cruces Police Department. The woman was
charged under the state's Organized Retail Crime Act after investigators
executed search warrants where merchandise that was stolen had been sold or
stored as part of an organized retail crime operation run through a local
business, police said. The woman has not been identified and the business
involved will also not be identified as the investigation is ongoing, police
said. The recovered stolen property included clothing, cleaning supplies, health
and beauty supplies, hardware, electronics, general household goods and building
supplies. Police say the investigation began in May with the Police Department's
Community Outreach and Street Crimes units and agents with Homeland Security
investigators and loss prevention investigators from retail stores.

Kansas City, MO: 1 person fatally shot Wednesday at Northland Walmart
An
argument between two people led to a fatal shooting Wednesday afternoon in the
parking lot of a Northland Walmart. The shooting happened at about 4:20 p.m. in
the parking lot of the store at 8551 N. Boardwalk Avenue. The victim and suspect
got into an argument, which led to the victim being shot at least one time,
police said. The victim was declared dead at an area hospital. Off-duty officers
working at the store were able to alert other officers, and a suspect was
quickly arrested, police said. Homicide detectives and crime scene technicians
were on the scene Wednesday evening gathering evidence. The store closed for the
day after the shooting.

arrived, police said. First responders with the Los Angeles Fire Department
later pronounced them dead at the scene. They were inside the shop near South
LA's Westmont neighborhood when the suspects entered and opened fire, shooting
multiple rounds, LAPD said. The suspects fled the scene in a vehicle, according
to LAPD, and remained at large the following day.

San Leandro, CA: 7-Eleven clerk shot, hospitalized in San Leandro store robbery
A 7-Eleven employee was shot in the stomach during a store robbery early
Wednesday morning. The San Leandro Police Department said the robbery occurred
at a 7-Eleven store on Williams Street and San Leandro Boulevard at about 5:15
a.m. San Leandro police received calls of shots fired and that a 7-Eleven store
clerk had been shot. Responding police officers arrived to find the store clerk
suffering from a gunshot wound to the stomach. Initial investigations allowed
police to assume the shooting happened following an attempted robbery. Police
said the alleged robber tried to rob the store clerk and that he and the store
clerk got into "a brief struggle" before the suspect shot the clerk in the
stomach.

Philadelphia, PA: 4 shot outside West Philadelphia convenience store
Police are investigating a quadruple shooting that happened outside a West
Philadelphia convenience store Wednesday night. It was close to 11 p.m. on
Lancaster Avenue, near Fairmount Avenue, when police said gunmen ran down the
block and fired dozens of shots at a group standing by the store entrance. The
unidentified shooters got away. A motive was not immediately clear, police said.
Responding officers and medics initially found three wounded men at the scene
and took them to the hospital. Later, another victim showed up at the hospital.
All four were in critical condition but were expected to survive. Police plan to
canvass the neighborhood for surveillance footage. No one has been arrested.

San Diego, CA: Store owner fires shot to stop smash-and-grab robbery
On Tuesday someone attempted a smash-and-grab robbery at KZ Jewelry Designs in
Rancho Bernardo. So the owner grabbed a gun and fired a shot into the ceiling to
scare him off. According to San Diego Police, the robbery attempt happened at
4:45 Tuesday when JZ Jewelry Designs was still open. The owners snapped videos
showing glass all over the store, and the hammer used to smash it. Security
camera images show the would-be thief wearing a black ski mask.

New York, NY: 6-Man Crew Nabbed, Pulled Off 40 Burglaries Across NYC
A group of thieves responsible for as many as 40 burglaries throughout New York
City have been apprehended and are facing charges. The final member of the crew,
Jose Montenegro, 39, was arrested last Friday, police announced. Authorities had
been slowly taking down the crew, beginning with the arrests of Alexandar Medine,
52, and Steven Perez, 35. Ivelisse Rodriguez, 32, Isaaahiah Rodriguez, 22 and
Jesse Pinales, 30, were arrested last Wednesday, police said. The six men face
numerous burglary charges, police sa id. The thieves mostly targeted
laundromats and other businesses in Queens, Brooklyn and the Bronx, police said.
The robbery spree began back in March, with the most recent incident believed to
have taken place in June, police said.

the phone said that the woman had a knife and a gun. She even showed that
message to another worker. After a short discussion, she took her phone back.

Four Venezuelan nationals were indicted on federal charges in connection with an
