The U.S. Crime Surge
The Retail Impact

Facial Recognition is a Proactive Defense Against ORC
How Facial Recognition Helps Stores Combat Organized Retail Theft

By the D&D Daily staff

Retailers are facing a surge in organized retail crime (ORC), costing billions annually. To combat this, many are turning to facial recognition technology, which helps identify repeat offenders and deter theft.

How It Works

Facial recognition scans individuals and compares them to databases of known shoplifters. If a match is found, store security is alerted in real time, allowing swift action. Unlike traditional cameras, this AI-driven system automates detection, reducing response time.

Stopping Repeat Offenders

ORC groups often target multiple stores. Facial recognition helps track suspects across locations, alerting staff when a known thief enters. Some retailers also share this data with law enforcement or security networks, making it harder for criminals to evade detection.

Security Without Profiling

Ethical use ensures facial recognition is only applied to known offenders, not general shoppers. Many retailers follow strict policies to prevent misuse.

A Strong Deterrent

Beyond catching thieves, facial recognition deters crime. Stores displaying signs about its use discourage criminals from attempting theft. When combined with license plate readers and predictive analytics, it creates a proactive defense against ORC.

Facial recognition is proving to be a powerful tool in retail security, helping businesses protect inventory, employees, and customers.

Updates to New York's Retail Workplace Violence Law
'Panic buttons' changed to 'silent response buttons' & more time to comply

NY Set to Amend Law Addressing Retail Employee Workplace Violence Prevention

Seyfarth Synopsis: A workplace violence prevention law passed by the New York State legislature in June 2024 and signed into law by the Governor in September 2024 with certain provisions set to take effect in March 2025 has been amended. Although the amended legislation will still require that employers establish a "workplace violence prevention policy" and provide workplace violence training to covered employees remains, the previous requirement to provide employees with a "panic button" that dials 9-1-1 has been replaced with a provision instead requiring only that the buttons alert workers' supervisors or a security officer.

As previously detailed here, on September 5, 2024, New York Governor Kathy Hochul signed a bill (Assembly Bill A8947C) that would have imposed significant workplace violence prevention requirements on retail employers effective March 3, 2025. The law specifically indicated a separate effective date-January 1, 2027-for the "panic button" requirement to allow employers more time to prepare for implementation.

Recently, the legislature passed amendments to the forthcoming law, changing all references from "panic" buttons to "silent response" buttons and removing the requirement that the buttons must immediately dial 9-1-1, instead requiring that the buttons reach covered employees' supervisors or on-site security staff.

The amended law, which is now pending Governor Hochul's signature, will be effective 270 days following enactment-a change from the initial 180-day period before effectiveness. Thus, the law will be effective on June 2, 2025.

The pending amendments do not meaningfully change most employers' obligations under the forthcoming law. However, the change from "panic" buttons to "silent response" buttons provide covered employers with a few options that did not exist before, removing the requirement to dial 9-1-1. The amendments also provide employers with three more months to prepare for compliance with the policy and training requirements of the forthcoming law. seyfarth.com

Banking Exec Turned LEGO 'Fencing' Ringleader?
Ex-Wells Fargo banker accused of 'fencing' LEGOs stolen from Charlotte-area Walmart & Target Stores
A former Wells Fargo banker is accused of "fencing" hundreds of thousands of dollars of "highly lucrative" LEGO products stolen from Charlotte-area Walmart and Target stores, federal investigators say in a recently unsealed search warrant. A "fence" is a middleman who quickly resells stolen items, investigators say in the warrant filed by a U.S. Department of Homeland Security agent against 45-year-old Charlotte resident Ryan Thomas Cahill.

Two other men are accused of stealing the LEGOs and delivering them to Cahill in his northwest Charlotte driveway hundreds of times in recent years, according to the warrant unsealed by a U.S. District Court judge in Asheville on Friday. LEGOs also were stolen from the Arboretum Barnes & Noble book store in south Charlotte, court records show.

U.S. Attorney Dena King asked the judge Friday to unseal the nearly year-old warrant. That way, state prosecutors could use information in the document in a related case against Cahill in Cabarrus County Superior Court, King's written filing shows.

No one has been charged in the case in federal court, King said in her request. On Oct. 28, 2024, Concord Police charged Cahill with felony organized retail theft - receive/possess, according to Cabarrus County Court records. He was released on a $500,000 secured bond pending trial. Cahill pleaded not guilty and "has rejected all plea offers," his lawyer, John Dowling III of Charlotte told The Charlotte Observer on Wednesday.

"Mr. Cahill is an upstanding member of the community who worked at a well-respected global bank for 25 years before he was charged," Dowling said in a statement. Dowling called Cahill "an avid LEGO enthusiast who has been falsely accused of wrongdoing in this case."

Cahill is accused of selling the LEGOS on eCommerce platforms in North Carolina and other states, including Marketplace, the agent said. Cahill was familiar with electronic fund transfers and other wire transfers through his job at Wells Fargo, according to the warrant. In his driveway, the warrant says, Cahill directed the men who delivered the LEGOs to remove their anti-theft "spider wrapping" before placing the products in plastic totes. charlotteobserver.com

Retail Crime-Fighting App Wins Award for Making Shopping Safer
Stockton, CA: App meant to fight retail theft in San Joaquin County sees early success

The free 'STAART' app won an award Thursday from the Western Association of Chamber Executives.

It's been five months since Stockton took action against retail theft, and leaders of the business group that launched the "Stockton Takes Action Against Retail Theft (STAART)" program say shopping is becoming safer.

"You see those billboards, you see the marketing," said Timm Quinn, CEO of the Greater Stockton Chamber of Commerce. "There's eyes watching, there's people watching." Now, there are also people reporting. One of the program's key elements is a free app allowing shoppers to send in photos and videos of retail thefts in progress.

Store owners have their own dashboards to track their cases and evidence, and so does law enforcement. "The community has really embraced it," said Quinn. "We've got over 1,300 users, active users on the app right now. Over 390 submissions so far." It's not just Chamber of Commerce officials hoping the app is successful. San Joaquin County leaders are counting on it. They poured nearly $1.2M into the program just months ago.

Clash Between Stores & Hands-Off Security Policies
Uptown store manager disappointed after security doesn't help with shoplifting
An Albuquerque business said they lost merchandise worth hundreds of dollars after a man shoplifted from their store on Thursday.

"A guy approached the store, masked himself with a bandana. He came into the store, proceeded to grab him jeans from our front table, approximately like 8 to 10 pairs. So, $800 worth of jeans," said Jason, a manager of a clothing store in Uptown.

He said as the man ran out of the store; he ran past a security guard who didn't stop him. Jason eventually stopped chasing the suspect after he was threatened.

"You think that security's here for safety, to help you, to protect you. That's not the case that I found out as soon as I got back and spoke to the head of security, who informed me that it's the mall management's policy that they don't approach, they don't interrupt what's going on," Jason said.

He said the security guards walk around the stores and scan a barcode at each door, showing they've made their rounds. "So, it's now really increased to having to really pay attention to what is happening outside your store because now that we have no protection, we're the only ones left to do it," said Jason. koat.com

OSHA Workplace Safety Council 'Indefinitely Paused'
The Trump Admin Paused Workplace Safety Council Established Under Federal Law

The indefinite stop-work order was news to the Republican chair of the subcommittee on Health, Employment, Labor and Pensions. "We've got to be notified, and we've got to follow the law," Rep. Rick Allen said.

The Trump administration has told a council of agency heads and union leaders established under federal law to help prevent and reduce workplace injuries that it can no longer meet, according to an email to members obtained by NOTUS.

The directive is yet another move from the Trump administration to consolidate the power of political appointees in the executive branch, which experts say enters a legal gray area.

President Donald Trump's Department of Labor issued a memo putting a pause on the Federal Advisory Council on Occupational Safety and Health's activities indefinitely, according to the email circulated to its members. The council is intended to give recommendations to the secretary of labor and help develop and maintain programs across agencies to keep workers safe on the job. notus.org

2nd Bankruptcy in 5 Years
Forever 21 weighs repeat bankruptcy filing

The company is struggling with competitive pressure in the apparel sector.

Fast-fashion retailer Forever 21 is considering filing for bankruptcy after exiting its last chapter 11 roughly five years ago, according to people familiar with the matter.

The company, with over 500 stores, is working with restructuring adviser BRG to assess possible paths to address its financial challenges, the people said. The company is also trying to find a buyer that could help the chain avoid bankruptcy, one of them said.

Mall owners Simon Property Group and Brookfield Corporation teamed up with brand licensing company Authentic Brands Group to buy Forever 21 out of bankruptcy in 2020, saving the chain from liquidation.

Owners of the Forever 21 chain announced last month that they are exploring strategic options for its operations. The retailer has faced fierce competition from China-founded online discount retailers Shein and Temu.

In a bankruptcy, the risk that Forever 21 would liquidate and shut down is high, as it is for most retailers. livemint.com

Corporate Walmart Job Cuts
Walmart cuts some corporate jobs, will close North Carolina office

The retailer is asking some of its employees to relocate to offices in Arkansas or California as it works to return more staff to in-person teams.

Walmart has eliminated an undisclosed number of roles in a series of moves that will reshape the retailer's national corporate office footprint. The company is asking some office-based employees in Hoboken, New Jersey, and in smaller offices to relocate closer to their teams in California or Arkansas, Chief People Officer Donna Morris said in a Tuesday memo to associates shared with Retail Dive.

As part of the retailer's location strategy, Walmart plans to close its Charlotte, North Carolina, office. The company notified all affected employees and will provide individuals relocation support or severance.

Morris said the retailer plans to open new office spaces in Sunnyvale, California, and Bellevue, Washington. It also plans to expand and upgrade offices in Hoboken and New York City. retaildive.com

Using AI in the Supply Chain
Supply chain execs see opportunity, challenge in AI
A new survey indicates many supply chain executives are using artificial intelligence, but some face limitations.

Four-in-10 (41%) of supply chain executives surveyed for the new Kenco "2025 Supply Chain Innovation" study are making AI a key part of their innovation strategy. Of these, one-third already are leveraging it for data visibility, 29% for quality control and 26% for labor optimization.

However, more than one-in-three (35%) respondents said they are largely prevented from using AI because of company policy. The top two issues respondents hope to address with new innovations (which include but are not limited to AI) this year include inflation (68%) and labor shortages (50%).

Fifty-one percent of respondents with existing innovation budgets saw an increase earmarked for 2025. chainstoreage.com

'Our Personal Information is Being Sent to China'
DeepSeek Faces Ban on US Government Devices

U.S. lawmakers are set to introduce legislation outlawing DeepSeek's AI chatbot on government devices.

The bill, written by Rep. Darin LaHood (R-IL) and Rep. Josh Gottheimer (D-NJ), is being driven by the type of national security concerns that led Congress to ban China-owned TikTok last year, the Wall Street Journal (WSJ) reported Thursday (Feb. 6)

DeepSeek, also based in China, rocked the artificial intelligence (AI) world last month with the release of an AI model it said can perform as well as its U.S.-built counterparts at a fraction of the cost. As the WSJ notes, its chatbot is now the most downloaded app in America. And because it is an open-source model, it has been widely embraced by consumers, businesses and developers.

However, the app has intentionally hidden code that could transmit user login information to China Mobile, a state-owned telecommunications company barred from operating in the U.S., according to an analysis by Ivan Tsarynny, CEO of data protection/cybersecurity company Feroot Security.

"Our personal information is being sent to China, there is no denial, and the DeepSeek tool is collecting everything that American users connect to it," Tsarynny told the WSJ.

His analysis drove LaHood and Gottheimer to draft their bill, set to be introduced Thursday. The lawmakers are the top Republican and Democrat on a subcommittee of the House Select Committee on Intelligence, the report added.

"Under no circumstances can we allow a CCP company to obtain sensitive government or personal data," said LaHood, in reference to the Chinese Communist Party.   pymnts.com

Strong Data Hygiene More Important Than Ever
The overlooked risks of poor data hygiene in AI-driven organizations
In this Help Net Security interview, Oliver Friedrichs, CEO at Pangea, discusses why strong data hygiene is more important than ever as companies integrate AI into their operations. With AI-driven applications handling sensitive enterprise data, poor access controls and outdated security practices can lead to serious risks.

Friedrichs shares key best practices to mitigate risks, ensure data reliability, and adapt security strategies for the AI landscape.

How do data hygiene practices align with broader cybersecurity strategies?

Enterprises adopting AI face an entirely new set of data and privacy challenges as they combine internal enterprise data with large language models (LLMs). This challenge is critical, as estimates show that we'll see over one million software companies by 2027, many of them leveraging AI, and creating an expansive attack surface that traditional security tools aren't equipped to protect.

The focus has shifted from securing static data to protecting information as it enters the AI pipeline. Organizations must consider how sensitive data flows between traditional data sources, such as document stores and databases, and AI applications. This requires a new approach to access control and guardrails and demands security teams evolve beyond conventional data protection methods to address the unique challenges of AI-driven environments. helpnetsecurity.com

How AI 'Raises the Stakes for Security'
AI agents spark interest, concern for businesses in 2025

Leaders have high hopes for autonomous capabilities, but adding the technology will raise the stakes for security and governance.

Technology leaders entered 2025 with agentic AI on their to-do lists. Enterprises have high hopes for the technology, and some are positioning their business to adopt AI agents in the coming year.

"In today's world, without agentic AI, no AI conversation is complete," Arnab Chakraborty, chief responsible AI officer at Accenture, told CIO Dive. The shift to focus on agents, which extends to academia, vendors and their customers, is pronounced.

Research papers on agentic systems increased exponentially between 2022 and 2024, according to Accenture analysis. Plus, Forrester found around 400 vendors offering new agent platforms during its market analysis.

Some analysts expect organizations to quickly reap value from agents given the resources poured into strengthening governance and modernizing processes for generative AI. Other experts have raised security concerns, pointing to readiness gaps and immature foundations as pivotal adoption roadblocks. The consensus: success isn't guaranteed. cybersecuritydive.com

Turning Point in Amazon's War on Walmart?

Amazon Finally Passes Walmart in Revenue

The two titans are poised to continue to do battle for the foreseeable future

The clash of the retail titans has entered a new phase: for the first time, Amazon has surpassed Walmart in annual revenue. The online retailer famously founded by Jeff Bezos in his garage during the 1990s has long led Walmart in market capitalization but hadn't passed Walmart in earnings. Until now. In its earnings release after the close of trading today, Amazon is expected to report revenue of $187 billion, according to analysts. Walmart reports on Feb. 20, and is projected to announce sales of $180 billion.

Still, the increase in revenue isn't necessarily because Amazon is selling more paper towels or hoodies than Walmart.

"Amazon has moved ahead primarily because of the increase in its web-based services," says Albert Williams, Chair and associate professor of finance at Nova Southeastern University. He added that when it comes to retail sales the two giants are pretty evenly matched.

"Amazon is similar in revenue with Walmart with regards to its normal online retail business. But its web-based services now include AI opportunities, the latest major technology being used in business," Williams said, and that is driving growth.

While Walmart doesn't have anything comparable to Amazon's web services, they do have Walmart Cloud Native Platform, an in-house supply chain and distribution technology. And Walmart has attempted to compete with Amazon on the technological front with consumer-level technologies. Walmart launched Realm in 2024, which provides a completely immersive 3-D shopping experience. qz.com

Knowing the basic interview questions is one thing. Having the answers is another. What's more important is communicating openly and honestly in a professional manner that shows thought, vision and your business knowledge. Try to apply your background to the interviewer's business and how you can impact it and add value. The key to a successful interview is bridging the gap between your background and the prospective employer's company and needs. Preparation-preparation-preparation!

Just a Thought,
Gus
