More than 5,000 NYPD members have tested positive for the coronavirus, and at least 38 have died.

NYPD Deputy Commissioner of Intelligence and Counterterrorism John Miller has returned to work on the force after being hospitalized with COVID-19.

OSHA Issues Industry-Specific COVID -19 Guidance for
Construction, Manufacturing, Restaurant, Retail, and Meatpacking Businesses

As the discussion about reopening workplaces continues, employers are facing questions of how to deal with employees refusing to return, how to remain compliant with federal anti-discrimination laws, and how (or whether) to require employees to undergo temperature screening or even COVID-19 diagnostic testing. While these latter efforts to screen out sick employees can play a role in keeping workplaces safe, employers still face the logistical challenges of ensuring employee safety for those on the job.

OSHA has recently issued guidance tailored to the restaurant (takeout/pickup), and retail industries - as part of what the agency indicated will be a series of industry-specific alerts designed to keep workplaces safe. How to Practice COVID-19 Safety When Reopening Your Retail Business

Brick and-mortar retailers were already struggling before COVID-19. Now, as states slowly begin to reopen, these businesses must figure out how to keep workers and customers safe while simultaneously adhering to government guidelines and employment laws and trying to maximize profits.

"As those retailers who were deemed nonessential during the stay-at-home orders begin the process of reopening, they will need to be prepared to face a number of unique employment law challenges."

For those reopening their retail stores soon, here are some tips to ensure that the process goes as smoothly as possible.

Follow Government-Mandated Health and Safety Guidelines

You can't open until you have the right procedures in place to protect employees and customers. Rosenthal said every state and some cities are likely to present their own standards for what retailers must do to safely reopen.

Bringing Them Back: Questions for HR from Returning Workers
Be prepared by considering these six things employment attorneys and human resource experts say workers will want to know right from the start.

1. Do I have to come in?
The short answer is yes, with caveats, "What we've been advising clients is 'You have the right to order your employees back to work. If they have accrued leave, they can burn that. Kohl's Prioritizes Safety
Kohl's begins reopening stores in some states

The Menomonee Falls-based retailer announced it decided to open in Arkansas, Oklahoma, South Carolina and Utah starting Monday. It has not re-opened any stores in Wisconsin.

To improve safety inside the stores, Kohl's said it is limiting store hours and dedicating shopping hours for at-risk individuals. In addition, the retailer is implementing social distancing measures, elevated cleaning procedures and using a new returns process.

"We've created new safety protocols to make sure that product is handled appropriately - safe for customers, safe for associates," Gass said

Kohl's will require all store employees to wear masks and gloves while inside, according to the retailer. The business said it is excited to welcome associates back "on a volunteer basis" to serve customers.

"We will continue to assess these new measures on an ongoing basis and apply our learnings and insights to our future store openings, when we make the decision to open additional stores," the company said in a statement. bizjournals.com

HSI Announces New Public-Private Partnership in Fight Against COVID-19 Fraud
Industry experts from Pfizer, 3M, Citi, Alibaba, Amazon and Merck have joined forces with the Homeland Security Investigations (HSI)-led National Intellectual Property Rights Coordination Center (IPR Center) and its criminal investigators in an unprecedented public-private partnership to combat fraud and other illegal activity surrounding COVID-19.

"Scammers and other criminals are exploiting this time of anxiety and uncertainty to take advantage of consumers' fears, and HSI has made it a top priority to investigate anyone attempting to use the COVID-19 pandemic to defraud other people," said HSI Acting Executive Associate Director Alysa D. Erichs. "A robust partnership with the private sector is an absolute requirement to effectively disrupt and dismantle COVID-19 criminal networks and strengthen global supply-chain security."

Since the start of the pandemic, HSI and other law enforcement agencies have seen a significant increase in criminals attempting to capitalize and profit from the fear and anxiety surrounding the virus, including the sale of counterfeit pharmaceuticals and medical equipment and illicit online sales and trade importation violations of products claiming to be treatment options.

"At 3M, we play a unique and critical role in pandemic preparedness and response. As a result, we are attacking the pandemic from all angles, which includes mobilizing all our resources and rapidly increasing output of critical supplies to healthcare workers and first responders. These efforts also include combating fraud and protecting the public against those who seek to exploit the pandemic using 3M's name connected with price gouging and counterfeiting. We are partnering with national and international law enforcement, tech companies and online retailers to prevent fraud before it starts and stop it where it is happening," said Mike Roman, 3M chairman and chief executive officer.

In April, HSI launched Operation Stolen Promise, a component of U.S. Immigration and Customs Enforcement (ICE) and the largest investigative arm of the Department of Homeland Security, to prevent and investigate illegal criminal activity surrounding the pandemic.

As of May 4, HSI special agents have opened over 315 investigations nationwide; seized over $3.2 million dollars in illicit proceeds; made 11 arrests; executed 21 search warrants; analyzed over 19,000 COVID-19 domain names; and worked alongside U.S. Customs and Border Protection officials to seize 494 shipments of mislabeled, fraudulent, unauthorized or prohibited COVID-19 test kits, treatment kits, homeopathic remedies, purported anti-viral products and personal protective equipment (PPE). iprcenter.gov

Sephora Fires Back At Penney's Court Filing


"No part of JCP's fanciful, one-sided narrative was or is true."

Sephora claimed in its argument that J.C. Penney was the one aiming to gain negotiating leverage with its actions, "so that JCP can take advantage of an impending bankruptcy." The beauty retailer also disputes claims that it threatened to drop its partnership with J.C. Penney. 

"Despite JCPenney's claims, we did not threaten any action that would have impacted SiJCP operations in the near-term or JCPenney's ability to sell beauty products in its stores," a Sephora spokesperson said in a statement. "While we understand that JCPenney has put itself in a tough position in recent years, this is a very unfortunate development that we hope to resolve quickly."

J.C. Penney and Sephora are squabbling in court over their decade-old branded beauty shop-in-shops after the department store says the beauty retailer threatened to end the partnership.

In court documents dated May 4, J.C. Penney says Sephora in late April threatened to abandon the partnership unless the department store agrees to shorten its contract term. J.C. Penney requested a temporary restraining order that would keep Sephora from terminating their agreement. retaildive.com

Retailers Canceling Apparel Orders Amid Coronavirus Torments Clothes Makers
The current plummet in apparel demand, caused by the coronavirus pandemic, is ricocheting across the supply chain. Apparel factories often pay for labor and material costs out of pocket or with debt. "Big companies don't pay upfront. Disputes like these have exploded across the garment industry as payments are delayed and orders are canceled by retailers dealing with closed stores and plunging sales.

Factory owners in Bangladesh said they accepted the shift because they worried that if they didn't go along, a competitor from India or Latin America would. The Necessity of an ERM Approach - Risk's Evolution
Governance, Risk, Compliance and Security: Together or Apart?


Organizational risks are expanding with digital transformation, so enterprise risk management has become essential.

The interconnected nature of modern business necessitates a holistic approach to risk. When an organization's governance, risk, compliance (GRC) and security functions are siloed, it's difficult to deal effectively with the total scope and potentially cascading effects of that which can harm the company, its customers and partners. As the pace of business accelerates and operations become increasingly digital, more organizations are forming enterprise risk management (ERM) groups or committees. Not surprisingly, new platforms are helping to facilitate the shift.

"Digital transformation requires a very tightly knit coordination between all of these functions," said Forrester Research Analyst Alla Valente. "We're seeing the growth of an enterprise risk management function and they're taking on responsibility for operational risk, for financial risks, in many cases compliance, and business continuity as well."

Why the various risk functions are fragmented


Company structures tend to differ based on the industry in which they operate, their size and their organizational philosophy. Many businesses have expanded the C-suite over the past couple of decades to include some combination of chief security officer (CSO)/chief information security officer (CISO) chief privacy officer (CPO) and chief risk officer (CRO).

Whom those positions report to also varies. For example, the CPO may report to the chief legal officer (CLO) or the CSO/CISO. The CSO/CISO may report to the CIO, COO or CEO.

Many risk functions were created in response to a major event like the 2008 financial crisis or a regulation such as Sarbanes-Oxley (SOX) or GDPR. Similarly, computer, network and cybersecurity were created as the result of technologically enabled threats. Now, companies without ERM groups or committees are feeling the effects of organizationally and technologically siloed efforts. Specifically, each risk-related function is using its own GRC system when the effects of many risks are cross-functional. For example, when a hacker steals data, the security team probably isn't the only team impacted. Other groups may include compliance, governance, legal and traditional risk management (financial risks).

"[P]articularly between compliance, privacy and security there's sometimes an underlying assumption that a specific area is being covered by one of the others and sometimes we see things slip through the cracks," said Joe Nocera, a principal in PwC's Cybersecurity and Privacy practice. "They tend to use different scales of measuring risks and they tend to use different workflows and mechanisms for risk acceptance and mitigation activities."

Google, Apple Reveal More Contact-Tracing Details

Describe Limits on How APIs Can Be Put to Use for Apps

Google and Apple on Monday released privacy and security guidelines for their jointly developed contact-tracing infrastructure. The tech companies note that apps developed using their APIs can only be developed by or for public health authorities - and solely to collect limited information to help trace COVID-19 infections.

The APIs developed by Google and Apple will not use location tracking data, according to the developer guidelines released Monday. Users of the apps buit with the APIs will be able to turn off the contact-tracing technology at any time. Plus, the apps must limit how much data they can collect from the physical contacts of other app users who report that they are infected.

The two tech giants have been jointly developing their contact-tracing infrastructure, now called Exposure Notification, since March. On Monday, they released the first samples of the APIs to developers, who will use them to create apps.

From traditional advocacy on specific bills to advising lawmakers on the security dimensions of current events, including the coronavirus pandemic.

As the cybersecurity industry has grown, these companies have increasingly sought to get time with lawmakers and help shape bills and issues in their early stages, including standards for the security of the Internet of Things, a potential federal privacy law and the rollout of 5G networks.

The uptick in lobbying by the industry appears designed to capture commercial opportunities stemming from heightened awareness of cybersecurity threats, said John Pescatore, director of emerging security trends at the SANS Institute, a cybersecurity research and training organization.

Attackers Adapt Techniques to Pandemic Reality

U.S. is Getting Pounded By 1/3 of All Malicious Domains

Over the past several months, threat actors have quickly shifted their tactics to take advantage of interest in the coronavirus, two studies find.

Attackers continue to use the theme of the coronavirus pandemic to create more convincing phishing lures and impersonate legitimate domains in an attempt to get past the strained cybersecurity of work-from-home employees, according to two reports released this week.

On average, almost 1,800 malicious or risky domains with coronavirus-related names have been registered every day. A third of the malicious domains - by far the largest share - targeted the United States, while other countries each accounted for less than 4% of the total.

With coronavirus themed spam and impersonation attacks having more success with remote workers. The number of URLs that were blocked following a user click rose 56% over the period, he says.

From fake Microsoft Teams e-mails to massive COVID-19-related domain registration, cybercriminals and fraudsters are betting that remote workers will be more likely to click on coronavirus-themed content. "With COVID-19 driving a surge in cloud adoption, we see not only attacks targeting the cloud users but also threats originating from the cloud," the report stated, adding that "[t]hreats originating from the cloud can be more difficult to defend because malicious actors leverage the cloud resources to evade detection and amplify the attack."

SAP notifying 9% of customers about security bugs in some cloud products

SAP says an internal security review found issues with seven of its cloud products.

Quebec City Sees 50% Increase in Business Burglaries & Theft
As of April 24, the police in Quebec City had already noted a 50% increase in break-ins and thefts in businesses compared to the same period last year. The police reported 48 cases this year compared with 32 in 2019.

Cafés, corner stores, jewelry stores and other businesses have been targeted. Store windows have also been smashed by vandals. Montreal has not provided any precise numbers.

In Ottawa, the local police have noticed a strong upward trend in break-ins and robberies in businesses. In a press release on April 9, the police in Ottawa reported a 70 per cent increase in break-ins during the preceding month (March), in both homes and businesses.

Canadians have been defrauded out of at least $1.2 million in coronavirus-related scams during the pandemic, according to the Canadian Anti-Fraud Centre. Between March 6 and May 1, the centre has received 766 reports related to the pandemic, with 188 of those fraud attempts succeeding. There appears to be some light at the end of the tunnel for retailers and small businesses in Canada struggling to survive during the COVID-19 (coronavirus) crisis.

The Retail Council of Canada has a list of the reopening dates in the provinces for non-essential retailers which can be found here. Also on its website the Council has a retail recovery checklist for retailers which can be found here.

In a Facebook post, Larry Rosen, Chairman and CEO of leading Toronto-based menswear retailer Harry Rosen, said the company’s first store reopened in Winnipeg at CF Polo Park. Dan Kelly, President of the Canadian Federation of Independent Business, said the organization welcomes the careful, phased approach to the reopening of the economy which began Monday in several provinces.

As Canadian provinces prepare to relax their COVID-19 lockdown restrictions it could be well into this summer before consumers will feel completely comfortable venturing out again for non-essential shopping and restaurant dining, said Michael Kehoe, Lead Ambassador in Canada for the New-York based International Council of Shopping Centers.

Touch-Free Retail to be the New Norm in Canada

Retail 'never going to be the same again' after COVID-19

Hands-free shopping will not be a luxury, but a necessity, as stores reopen. The intrinsic problem with stores isn’t that they're crowded; it’s that hundreds or thousands of people are required to all touch the same surfaces and objects. Cash is already banned in many outlets, and Canadian banks have upped the limit on PIN-less transactions to minimize physical contact with payment pads. But even that reduction in touch points may not be enough to ensure public safety. And as long as retail stores are not seen as safe, they won’t be able to fully reopen and get back into the world of black ink.

So, what does a touch-free retail experience look like? Simply put, every physical interaction involving technology needs to be replaced with one that can be done at a safe distance. Mississauga Businesses Fined for Continuing to Operate During Pandemic
In an interview with CP24 on Wednesday morning, Crombie said that there have been 95 tickets issued in Mississauga so far in relation to the violation of various orders put into place to limit the spread of COVID-19.

Companies went into receivership after sexual assault allegations; lawsuit now includes 46 women

Manitoba's Court of Queen's Bench has approved the liquidation sale of assets and inventory belonging to a group of companies owned by Winnipeg fashion mogul Peter Nygard.

Nine Nygard companies went into receivership on March 18 and are under the control of Richter Advisory Group Inc. Forty-six women have filed a class-action lawsuit against Peter Nygard, alleging he raped them and was running what they called a "sex trafficking ring." cbc.ca

 

Nanaimo, BC: Teen shoplifters shoot flare into Nanaimo store, causing fire
Police say the lone employee of the store told them two young men entered the business, selected a few items and left without paying. As they were leaving, one of the suspects shot a tube flare in the direction of the employee, police said.

Officers went looking for the suspects after the incident, but were unable to find them. They were, however, able to identify both suspects from video surveillance footage. Investigators are currently looking for the two teenagers, and O'Brien said he expects it's only a matter of time before they are brought to justice.

Ottawa Police say employee punched, kicked after asking customers to physical distance
Police say when an employee asked four females entering the business to respect physical distancing measures, they started to kick and punch the employee. “The females then took items from the store and threw them at the employee, continuing the assault,” police said in a statement Friday afternoon. The employee suffered minor injuries. Police say the suspects fled the scene, but responding officers located all four suspects and arrested them without incident.

Amazon, Alibaba team with Homeland Security to prevent COVID-19 fraud

The world’s two biggest e-tailers are cooperating with a new partner in response to pandemic-related e-commerce crime.

Amazon and Alibaba are working with Homeland Security Investigations (HSI) National Intellectual Property Rights Coordination Center (IPR Center) criminal investigators in a new public-private partnership to combat fraud and other illegal activity surrounding COVID-19.

“Since the beginning of the COVID-19 crisis, Amazon has proactively stopped more than 6.5 million products with inaccurate claims, removed over 1 million offers for suspected price gouging, suspended more than 10,000 selling accounts for suspected price gouging and referred the most egregious offenders to federal and state law enforcement across the country,” said Dharmesh Mehta, Amazon VP, customer trust and partner support.

Police said a thief broke into a store on the city’s West side and filled up a garbage can with stolen cigarettes. According to officers, the man entered the Dollar General in the 3000 block of Fulton Road on April 21. Officers said the thief climbed through a store window to get inside. Milwaukee, WI: Police shot and wounded man suspected of killing a Walgreens employee outside her store (domestic violence)
Milwaukee police shot and injured a man Tuesday afternoon who they say fatally shot a 48-year-old woman outside a Walgreens on Milwaukee's north side, where she worked, in an apparent act of domestic violence. The man police shot, a 51-year-old Milwaukee resident, suffered serious injuries and is expected to survive. No officers were injured, and police recovered the man's gun. jsonline.com

Authorities are investigating the fiery crash of an armored truck on a Phoenix freeway that left one person dead and two others injured. Napa, CA: Update: Man Police Shot, Killed After Walmart Burglary Wanted To Commit ‘Suicide By Cop’
A man apparently intended to commit “suicide by cop” following a burglary last month at a Walmart store, Napa County sheriff’s officials said Tuesday. Brandan Nylander, 24, of Napa, broke a glass display case with a hammer in a Napa Walmart store to steal shotgun shells, then threw a hammer that struck a Walmart employee and then led police on a three-minute vehicle pursuit.

The sheriff’s office on Tuesday released the last 20 seconds of the video of the pursuit that started after the 2 p.m. burglary on April 24. The video shows Nylander stopping his car at a locked gate at the Napa County Airport at 2030 Airport Road. Nashville, TN: Fire Department seeks help finding Dollar General Arsonist
Investigators are trying to identify the people who set fire inside a Dollar General Store in Antioch in March. Several persons of interest were caught on surveillance cameras before the fire was set inside the Dollar Store located at 2285 Murfreesboro Pk. on March 31. The Nashville Fire Department responded to a fire call in the clothing aisle at the Dollar General in the Mt. Zion Shopping Center at the corner of Una and Murfreesboro pikes. Store employees told Nashville firefighters that several people were seen in and around where the fire started. The fire was contained to the store and did not spread. Chilean police have nabbed nine suspects involved in one of the country's biggest heists, the theft of US$15 million in cash from Santiago airport in March, the interior minister announced Tuesday. Gonzalo Blumel praised the police for "serious and professional work that allowed these people to be brought to justice in less than two months."
