The Cost of Unfinished Retail Crime Cases

know all too well that a shoplifter walking out the door isn’t the end
of the story. What often goes unseen are the cases that never truly
reach a conclusion in court. These are the “unfinished cases”, incidents
where an arrest is made, but the follow-through falls short.

Why Cases Collapse
From my years as a prosecutor, I saw it happen repeatedly: incomplete
evidence, missing witness statements, or inconsistent communication
between store teams, law enforcement, and prosecutors. When that
happens, cases stall. Charges get reduced or dismissed. Offenders are
released, sometimes the very same day. And the cycle of crime continues,
often escalating.
The collapse isn’t usually due to lack of effort, it’s due to a lack of
complete, consistent, and usable information. Without it, even the
strongest suspicions or clearest admissions may not hold up in court.
This problem is magnified by the scale of retail crime today.
The National Retail
Federation reports that retail losses reached $112.1 billion in
2022, up from $93.9 billion the year prior, shoplifting incidents
have nearly doubled since 2019, and according to
Pinkerton organized
retail crime (ORC) now accounts for roughly 36% of those losses
each year.
When cases collapse, the deterrent effect collapses with them. Offenders
learn that the system is overloaded, evidence is incomplete, and
consequences are unlikely.

As
President Donald Trump calls for military intervention in cities
across the nation, gun violence and major
crime are at a record low in America's largest city, the New
York Police Department announced Wednesday.
There were fewer shootings in NYC during the first nine months of the
year than in the same time period of any prior year, officials said
in a press release sharing third-quarter crime data. The record-low
number of shootings coincided with a broader drop in crime, including in
the subways, officials said.
"This is not a coincidence -- it’s the result of an unprecedented,
data-driven deployment of thousands of officers to the areas they are
needed most," Police Commissioner Jessica Tisch said in a statement.
The NYPD's announcement comes amid Trump's crackdown on crime in
major American cities, deploying National Guard troops to Los
Angeles, Washington, D.C., and Portland, with plans to expand to more
"one by one."
Breaking down the crime data from the first nine months of 2025, the
NYPD reported that citywide shooting incidents
are down more than 20% (553 vs. 693) to their lowest level
ever, and down 15.6% (216 vs. 256) for the third quarter.
Murders are down citywide by more than 17.7%
(241 vs. 293) year-to-date and 17.5% (85 vs. 103) for the quarter,
bringing them both to their second-lowest levels ever.
Burglaries dropped 3.8% (9,410 vs.
9,783) for the year and more than 9% (3,100 vs. 3,419) in the third
quarter, the second-lowest level in recorded history.
Robberies declined 9.8% (11,402 vs.
12,639) year-to-date and more than 5% (4,166 vs. 4,396) for the quarter.

Another State's ORC Law Takes Effect
New Maryland law allows prosecutors to combine retail theft charges
across counties
Prosecutors and retailers say the
law strengthens partnerships and sends a broader message about tackling
crime.
Retailers and prosecutors have high hopes that a new Maryland law in
effect October 1 will deter thefts. The new law
allows for prosecutors to charge thefts in
separate areas as one larger crime.
Let’s say, as part of an organized theft ring, someone steals $15,000
dollars worth of merchandise from a store in Montgomery County, then the
same amount in Prince George’s County. It’s charged as two, separate,
often less severe crimes. This new law means it can now be charged as
a more severe $30,000 crime.
Not only can they combine the value of the stolen items, but the
State’s Attorney from Montgomery County can prosecute the Prince
George’s County case, as long as it’s deemed organized theft
occurring within a 90-day span.
Montgomery County prosecutors say they’re in close contact with
retailers and other state’s attorney’s offices constantly, and
expect that to be the case as they look to build these cases.
Nolan Rodman, the president of Rodman’s, a drug and grocery store in DC
and Montgomery County, says he deals mainly with petty theft, but has
noticed a concerted effort recently by police and prosecutors to
bolster partnerships across jurisdictions.
"Reducing that kind of crime sends a bigger message about the sincerity
of crime in general, which I think overall reduces the crime,"
said Rodman.

ACT Policing launches Operation RETAIL
ACT Policing has launched Operation
RETAIL, a month-long campaign to address anti-social behaviour and
retail theft within Canberra’s shopping precincts.
This week, members from ACT Policing as well as retail managers,
security providers and external agencies launched the operation at
the Canberra Outlet in Fyshwick.
Devised by ACT Policing and retailers, the operation will focus on
deterring anti-social behaviour, reducing retail theft, enhancing public
perceptions of safety and improving business safety and security.
The operation has been established in response to intelligence and
stakeholder feedback identifying an increase in thefts particularly
of alcohol, spray paint and retail goods alongside instances of
disorderly conduct. In some cases, staff are being physically assaulted
and verbally abused when challenging alleged offenders.
During October, Canberrans can expect to see increased patrols of
shopping centres and other retail outlets, police working with loss
prevention officers, and engagement with business owners and operators
to provide crime prevention advice.
Detective Acting Superintendent Anthony Brown said that the campaign
launch serves as a good reminder that retail theft is a continuing issue
and that criminal activity will not be tolerated.

Retailer Sees Financial Impact of
Cyberattack
UNFI reports solid results as it recovers from cyberattack
The grocery retailer and wholesaler
has raised its sales expectations to reflect strong performance in
recent months, CEO Sandy Douglas said during an earnings call.
United Natural Foods, Inc. on Tuesday reported
net sales of $7.7 billion for the fourth quarter of fiscal 2025,
down 5.6% from the same period last year.
The grocery retailer and wholesaler believes its sales for the
quarter would have increased were it not for the
cyberattack it experienced in June, which brought down its sales
growth rate by about 5%, President and CFO Matteo Tarditi said during an
earnings call. The fact that the quarter had an additional week last
year also played a role in the decline, he said.
UNFI posted quarterly and full-year financial results that met or
exceeded its expectations, as a multiyear plan to drive growth it
announced last October has borne fruit, CEO Sandy Douglas said during
the call.
UNFI has raised its expectations after recording better organic
growth in recent months than the company had projected, according to
Douglas. The grocer and wholesaler now expects net sales during the
period that will end in fiscal 2027 to grow in the low single digits, a
change from its earlier expectation that sales during the period would
be flat, he said.
The improved outlook reflects UNFI’s ability to expand its
relationships with existing customers and add new customers, Douglas
said. The company has also benefited from “enduring consumer tailwinds
towards health, wellness and differentiated products,” he said.

The email-based campaign purports to
have sensitive data from breached Oracle E-Business Suite applications.
Corporate executives are being targeted in an email-based extortion
campaign by a threat actor claiming affiliation with the notorious
Clop ransomware gang, according to security researchers from Google
Threat Intelligence Group and Kroll.
The hacker claims to have data stolen from breached Oracle E-Business
Suite applications and has been demanding payment from various
corporate executives, according to a LinkedIn post from Austin Larsen,
principal threat analyst at GTIG.
While researchers have not been able to substantiate the claims of a
data breach, they have confirmed important links to a financially
motivated threat group tracked under the name FIN11, which has prior
associations with Clop.
“We are currently observing a high-volume email campaign being
launched from hundreds of compromised accounts, and our initial
analysis confirms that at least one of these accounts has been
previously associated with activity from FIN11,” Charles Carmakal, CTO
Mandiant Consulting, the incident response unit of GTIG, told
Cybersecurity Dive via email.
The extortion note from the hackers includes two contact emails where
the targeted executives can reply to the threat demands, and
researchers have confirmed that those specific contact addresses are
publicly listed on the Clop data leak site, according to Carmakal. The
extortion demands began earlier this week, on Monday.

ProSpy and ToSpy: New spyware families impersonating secure messaging
apps
ESET researchers have found two Android spyware campaigns aimed at
people looking for secure messaging apps such as Signal and ToTok.
The attackers spread the spyware through fake websites and social
engineering.
Researchers identified two previously unknown spyware families. Android/Spy.ProSpy
poses as upgrades or add-ons for the Signal app and the discontinued
ToTok app, while Android/Spy.ToSpy pretends to be the ToTok app itself.
The ToSpy campaign is still active, supported by command-and-control
servers that remain online.

Amazon Drone Disaster:
Two Prime Air Drones Slam Into Crane, Operations Halted Again
Two Amazon Prime Air delivery drones collided with a construction crane
in Tolleson, Arizona on Wednesday morning, prompting the e-commerce
giant to temporarily pause its drone delivery operations for the second
time this year. No injuries were reported, but the incident has
triggered investigations by both the National Transportation Safety
Board and the Federal Aviation Administration.
This latest setback comes just months after Amazon resumed operations
following a January pause for sensor upgrades, raising fresh
questions about the company’s ability to scale its ambitious drone
delivery program safely.
The Crane Collision: What Happened
The incident occurred just after 10 a.m. near Roosevelt Street and 97th
Avenue in Tolleson, about 2 miles (3.2 km) from Amazon’s fulfillment
center where the drones operate.
According to Tolleson Police Sgt. Erik Mendez, “It is believed Amazon
Air had two unmanned aerial delivery systems flying northeast back to
back when they both impacted an extended crane” that was conducting roof
work on a business.
The two MK30 drones landed in separate parking lots after striking the
crane. One crashed near the crane itself, while the second came down in
a different parking lot near Roosevelt Street and 96th Avenue. Tolleson
Police, along with fire departments from Tolleson and Avondale,
responded to the scene. Phoenix Hazmat also deployed due to reported
smoke and damaged lithium-ion batteries.
NTSB and FAA Launch Investigation
Both federal agencies are now investigating the collision. The
FAA confirmed in a statement that “Two MK30 drones collided with the
boom of a crane in Tolleson, Arizona, around 10 a.m. local time on
Wednesday, Oct. 1. No injuries were reported. The FAA will investigate.”
Amazon spokesperson Terrence Clark acknowledged the incident, stating
the company is “aware of an incident involving two Prime Air drones in
Tolleson, Arizona” and is “currently working with the relevant
authorities to investigate.”

Goodbye to Subscription Traps
Amazon must refund $1.5 billion to millions of Prime customers following
historic agreement with the FTC
Amazon subscribers have received good news. Nearly 35 million people
will receive a refund for their Amazon Prime subscriptions, after
Amazon was accused by the Federal Trade Commission (FTC) of using
deceptive methods to enroll customers in the Prime service. FTC Chairman
Andrew Ferguson explained in a statement that Amazon not only
manipulated users into subscribing to Prime but also made it overly
difficult to cancel this service. As a result, it will have to return a
total of $1.5 billion directly to customers.
According to information provided by CNN, to be eligible for the
refund, the customer must reside in the United States and have
subscribed to Amazon Prime between 2019 and 2025. For its part,
Amazon maintains and asserts that it has always acted within the law and
that its subscription policies were clear, as stated by spokesperson
Mark Blafkin. However, there are internal documents that show that this
was not the common sentiment, and that the process was even referred to
as ‘Iliad’ because of how it confused and frustrated clients.

San Antonio, TX: 2 men accused of repeatedly breaking into SA Bath and
Body Works store, stealing more than $11,000 in merchandise
Two San Antonio men are facing charges months after allegedly breaking
into Bath and Body Works on back-to-back days and making off with more
than $11,000 in stolen merchandise. According to online court records,
40-year-old Jose Enrique Medina had just started a prison sentence for
other burglary crimes when investigators connected him to those Bath and
Body Works break-ins that happened in May. His criminal history goes
back over a decade, and includes previous 12 and 14-month sentences for
burglary. On May 14, they allegedly made off with $6,728 dollars in
products. The following day, authorities say they stole $4,735.95 in
goods. It's unclear if the same Bath and Body Works was targeted both
times, but the suspects' vehicle was captured leaving the seen on
surveillance footage.

Findlay, OH: Police capture suspects who allegedly stole $6500 from
Dick’s
Four people were arrested for allegedly stealing about $6,500 in
merchandise from a sporting goods store. The Findlay Police Department
says Shanae Grier, 22, of Toledo; Antionna Boone, 19, of Sylvania; and
two unnamed juveniles were arrested Monday evening for taking items from
Dick’s Sporting Goods on Tiffin Avenue just before 6 p.m. Store
employees tried to take a picture of the suspects inside the store, and
one of the suspects "threatened to shoot the employee," police said. The
group then got into an SUV and fled the scene. Officers located the
vehicle before it reached I-75 and took the four suspects into custody.
Authorities recovered the stolen property and found a tool to remove
security tags.

Charlotte, NC: Shooting at busy shopping center in Charlotte leaves 1 teen dead
A teenager died after he was shot at a busy shopping center Wednesday night,
right outside Uptown Charlotte. The Oct. 1 shooting happened just before 8 p.m.
at the Target shopping center on Metropolitan Avenue, near the intersection of
Charlottetowne Avenue and South Kings Drive. Charlotte-Mecklenburg police said
an off-duty officer was listening to his radio and was in the area when the
shooting happened. After he heard the call come across, he went straight to
where the shooting took place and found a 16-year-old, later identified as
Alexander Cruz Martinez, with gunshot wounds. Police said the off-duty officer
treated Martinez until paramedics arrived and took the teen to the hospital,
where he died.

Los Angeles, CA: Suspect wounded in liquor store shootout with LAPD
The Los Angeles Police Department released bodycam video Wednesday of a dramatic
shootout at a liquor store in Jefferson Park. The gun battle happened Aug. 31
around 1:10 a.m. near 9th Avenue and West Jefferson Boulevard. Two officers
tried to detain a man they thought was concealing a weapon, according to the
LAPD. Footage shows the suspect was indeed armed with a handgun. Police
identified the suspect as 33-year-old Malik Salaah. Surveillance video from the
store shows the moment Salaah shot at the officers, who were able to get out of
the store and call for backup. But the gun battle didn't end there. Salaah then
went to the store entrance and opened fire again. The shootout continued outside
the store. At one point, officers were taking cover behind their patrol car.
Salaah eventually took off but was later found hiding behind a parked vehicle.
His left arm was bloodied after he was struck by officers' gunfire. As Salaah
was transported to a hospital for treatment, investigators recovered an unloaded
9mm handgun with a high-capacity magazine underneath a parked car, police said.
The liquor store, patrol vehicle and other cars nearby were left peppered with
bullet holes.

Peoria, IL: One person injured in shooting at Peoria c-store on University
Street
A 19-year-old man was hospitalized Thursday after he was shot at a convenience
store along University Street. The Peoria Police Department said that at 12:52
p.m., they received a call of shots fired in the 2600 block of North University
Street, where University Convenience Foodmart and Fresh Deli is located. When
officers arrived, they found the man with a gunshot wound to the leg. He was
transported to a local hospital with non-life-threatening injuries.

around the corner on Osceola Ave. Both victims were taken to University Hospital
by Cleveland EMS. A 32-year-old man was in serious condition, and an 18-year-old
male was in critical condition; they were both taken to University Hospital.
