Report Says Amazon Abuses Market Power, Bullies Competitors, Misused Data
Amazon Accused of Using Monopoly Power as E-Commerce ‘Gatekeeper’
A congressional panel took direct aim at one of Amazon.com Inc.’s defenses
against antitrust scrutiny of its retail dominance and detailed allegations
about how the company wields its market power.
In a
report issued Tuesday, the Democratic-led House Antitrust Subcommittee
challenged the company’s stance that its share of total U.S. retail shopping is
the most relevant way to understand its size. The committee asserted
repeatedly that Amazon dominates U.S. e-commerce.
The company’s market share of U.S. online sales is often said to be about
39%, but the figure is as high as 74% across a range of product categories,
according to the report, which also called out practices of other large tech
companies.
“Amazon functions as a gatekeeper for e-commerce,” the report said. The
subcommittee provided details that it says shows how Amazon uses its size and
platform to thwart competitors, dedicating more pages to its findings about the
Seattle-based technology giant than the other subjects of the probe.
Amazon addressed the findings in a blog post. “All large organizations attract
the attention of regulators, and we welcome that scrutiny. But large companies
are not dominant by definition, and the presumption that success can only be the
result of anti-competitive behavior is simply wrong.”
The House panel argued that Amazon has amassed “monopoly power” over sellers on
its site, bullied retail partners and improperly used seller data to compete
with rivals. The subcommittee cited examples that it said showed how Amazon has
launched copycat versions of products sold by third-party merchants on its
platform. The report also accused the company of blocking search advertising on
its site for competitors and attempting to “replicate some of the startups it
meets with or invests in.”
Several
investigative articles by The Wall Street Journal published this year
accused the company of similar actions. Amazon launched an internal
investigation following one story about whether its employees used seller data
to inform the company’s private-label strategy.

How Coronavirus Changed the Retail Landscape
From foot traffic to profit margins, the
story of the retail reckoning in charts
The coronavirus pandemic accelerated a major shift in the retail industry.
Traffic to stores evaporated. Online credit-card transactions soared. E-commerce
sales in the second quarter rose by 44.5% compared with the same period in 2019
and they now make up 16% of all U.S. retail sales, according to the Commerce
Department.
Consumer spending has picked up since many cities and states began lifting
lockdown restrictions and allowing stores to reopen in May, but only some
sectors have regained lost ground. Sales, profits and hiring at many grocers and
home-improvement retailers are up. Many apparel sellers have slashed staff and
closed stores for good. Weekly foot traffic from July until the second week of
September is down by an average of 14% compared with the same period a year ago,
according to mobile-device location data from foot-traffic analytics firm
Placer.ai.
Online Shopping: The pandemic pushed many of the last online-shopping
holdouts over the e-commerce hump. Online transactions with credit and debit
cards have increased an average of 88% each month since the beginning of April.
Store Closures: Since April some 5,000 stores in the U.S. have shut their
doors for good. In the same period only about 680 new stores were opened. In
August alone, almost 2,200 retail stores closed while only 14 opened.
Retail Sales: U.S. retail sales have been climbing steadily since late
May, though several categories are still struggling. The nonstore retailer
category, which includes online merchants, maintained the highest growth rate
since the beginning of the pandemic. Grocery stores had a huge sales uptick in
March, but growth has slowed since then. Sporting-goods stores recovered faster
than most. And clothing stores suffered the most.
Employment: Initial claims for jobless benefits held steady at 870,000
last week, revealing a loss of momentum in the recovery of the labor market.
Retail is one area where job losses could be permanent.
Profit Margins: eBay Inc. by far had the biggest increase in its profit
margin in the second quarter compared with the same period last year. Other
winners were automotive and discount chains, which managed to boost
profitability despite the higher costs of operating in a pandemic.

Deloitte Study: Virtual deal-making will continue post-pandemic,
regardless of cybersecurity concerns
Despite ongoing economic uncertainty amidst a global pandemic, many dealmakers
remain optimistic about the outlook for the year ahead as they increasingly
pursue alternative merger and acquisition (M&A) methods to navigate the crisis
and pursue new disruptive business growth strategies. According to Deloitte’s
new “Future
of M&A Trends Survey” of 1,000 U.S. corporate M&A executives and private
equity firm professionals, more than 6 in 10 survey respondents (61%) expect
U.S. M&A activity to return to pre-COVID-19 levels within the next 12 months.
Soon after the World Health Organization declared COVID-19 a pandemic on March
11, deal activity in the U.S. plunged — most notably during April and May.
Responding M&A executives say they tentatively paused (92%) or abandoned (78%)
at least one transaction as a result of the pandemic outbreak. However, since
March 2020, possibly aiming to take advantage of pandemic-driven business
disruptions, 60% say their organizations have been more focused on pursuing new
deals.

New York Gov. Cuomo unveiled a plan to combat coronavirus “clusters” Tuesday
that includes closing businesses and limiting religious gatherings in areas
seeing a surge in cases.
The governor called the measure a “last resort” and blamed the uptick in
infections in the city on Mayor de Blasio failing to enforce social distancing
and mask-wearing mandates.
The new restrictions, which include limits on religious services, barring mass
gatherings and stopping indoor and outdoor dining in affected areas, come
a day after the governor dismissed the city’s proposal to close businesses and
Cuomo knocked de Blasio on enforcement and defining hotspots by zip code.

Corporate America Condemns Trump Move to Halt Stimulus Talks
Business leaders across America expressed dismay after President Donald Trump
announced that his team will halt stimulus talks until after next month’s
election, with executives from the retail and air-travel industries saying
more jobs will be lost if the economy doesn’t get immediate aid.
“This is very unfortunate. The economy is not something that can be put on hold
until a time that might be more convenient,” Steve Lamar, the head of the
American Apparel & Footwear Association, said in a statement to Bloomberg News.
“People are suffering today.”
Delays in further stimulus measures are a blow to sectors such as retail,
restaurants and air travel, which have borne the brunt of the Covid-19 economic
downturn. Bankruptcies has swelled this year as consumers rapidly overhaul their
spending and travel habits.
Stimulus efforts earlier in the pandemic helped soften the blow of widespread
job losses and economic shutdowns, but the effects have faded. In September, the
U.S. unemployment rate was 7.9% -- more than double what it was this time last
year, according to data from the Labor Department released Friday.

NRF: Retailers say White House and Congress cannot wait on new pandemic recovery
legislation
The
National Retail Federation expressed concern over President Trump’s decision
today to stop negotiating with congressional leaders on new legislation intended
to help the economy recover from the impact of the coronavirus pandemic.
“The pandemic isn’t over and neither is the economic crisis it has created,” NRF
President and CEO Matthew Shay said. “There are many families still struggling
to make ends meet and businesses facing obstacles to putting workers back on the
payroll. We need a vaccine to ensure our personal health. And we need further
stimulus to ensure we can fix an ailing economy, bring people back to work and
spur growth in communities large and small.”
NRF has led the retail industry’s call for economic relief, setting out
priorities including expansion of the Paycheck Protection Program, tax
credits for the cost of personal protective equipment and protection against
lawsuits for businesses that follow safety guidelines set by public health
agencies.
NRF last week joined more than 200 trade associations to form the COVID Relief
Now coalition, which
sent a letter to Congress urging immediate and meaningful economic support.

Wildfires have gotten so extreme in recent years that experts have had to coin
new terms to describe their increasingly massive scale.
Enter the "gigafire" -- a term for a blaze that burns at least a million acres
of land and a level above the "megafire," which burns more than 100,000 acres.
California recorded its first gigafire in modern history on Monday, after the
expansive August Complex in the northern part of the state scorched more than a
million acres.
The
August Complex is now the largest fire in California's history, according to
Cal Fire.
The fire, which is now burning across several counties, began as a series of
separate fires sparked by lightning strikes in August. Those smaller fires later
morphed into the larger complex that firefighters are now battling. The blaze is
58% contained as of Tuesday morning.
Blazes across the state have burned four million acres so far, more than double
the previous record set in 2018, the state's fire agency said Sunday. This fire
season has also produced five of the six largest wildfires in California's
history.

Online order fulfillment is this year’s hot holiday retail job
Big-box retailers are starting to announce their holiday hiring plans. Most
share a similar mandate: hire more people to help them fulfill online orders.
Target, Walmart, Kohl’s, Gap, Michael’s and Dollar General are among the
retailers who have announced within the past two weeks plans to start hiring in
preparation for the holidays, with an emphasis on hiring for roles in its
e-commerce fulfillment centers, or to fulfill orders in stores that were
placed online.
Walmart said in a press release at the end of September that it plans to
hire for 20,000 workers specifically at its e-commerce fulfillment centers.
Target said in its announcement that it would be training existing team
members on “areas that are in higher demand during the holiday season, such as
order pickup and drive up,” and plans to have double the number of store
employees working on these services compared to last year.

What is popular in stores today is also popular with thieves today. Like any
other businesses, underground markets depend on the law of Supply & Demand.
Professional thieves will only steal merchandise they can quickly sell, and only
things in high demand sell quickly. Equally similar to legitimate businesses,
professional thieves tend to specialize in certain merchandise. Some only steal
from Home Improvement stores because they have an outlet, or fence, who is ready
and willing to take tools and equipment off their hands quickly. Some
professional thieves specialize in the theft of jewelry, electronics, or health
& beauty products for the same reasons. Their contacts and distribution channels
are mostly equipped to only handle those specific commodities. Because these
vast fencing networks can move large amounts of stolen merchandise quickly,
professional thieves do not hesitate to steal cartloads of these commodities in
a single incident. The more they can steal each time, the less risk of getting
caught. That may seem counterintuitive, but most professional thieves would
rather steal thousands of dollars’ worth of merchandise by shoplifting once per
day than stealing that same amount over the course of several store visits per
day. This is why shopping cart-based retailers are a favorite target of
professional thieves. It is also important to note that professional fencing
networks are not necessarily needed anymore. With the development of faceless
apps and online commerce sites, it is not uncommon for illicit transactions to
take place in the vary parking lots of the victim retailers.
So, what happens when professional thieves specializing in the theft of toys,
for example, find themselves with limited access to their chosen commodity?
This is precisely what happened on September 18, 2017, when Toys R Us filed for
Chapter 11 bankruptcy. Almost instantly, Toys R Us had to clearance-out their
inventory and shutter their stores. For professional thieves specializing in the
theft of toys, a decision had to be made. They either had to find a job or find
a new commodity to steal.

PCI DSS Compliance Slumps 28% Since 2016
Compliance with the Payment Card Industry Data Security Standard (PCI DSS) has
declined for the third year in a row,
with organizations failing in their long-term planning, according to Verizon.
The tech giant compiled its Verizon Business 2020 Payment Security Report based
as usual on data gathered by its own PCI DSS qualified security assessors (QSAs)
and those of other providers. It revealed that on average
only 27.9% of global organizations maintained full compliance with the PCI DSS,
a drop of over 27% since compliance peaked in 2016.
The report highlighted other concerns: just half (52%) of assessed organizations
successfully test security systems and processes and unmonitored system access,
and around two-thirds monitor access to business-critical systems effectively.

Canada 'going in the wrong direction' on COVID-19, Trudeau says as cases rise
through most of country
Prime Minister Justin Trudeau admitted Monday that
efforts to prepare Canada for
a second wave of COVID-19 have fallen short
and Canadians need to take
matters into their own hands to help reduce cases.
Monday brought another grim tally with nearly
1,800 new cases in Ontario and
Quebec.
Hospitalizations are also starting to rise in both provinces and outside of
Atlantic Canada,
all parts of the country are
seeing rising levels of new cases.
Predictions of a second wave of the virus in the fall have been made for months,
and the federal government gave provinces $19 billion in June to try and get
ready, increasing contact tracing and testing resources.

Too Scared to Shop
30 percent of Canadians now nervous to shop-in store
With the end of the year fast
approaching, Google has revealed new data on Canadians shopping habits amid the
COVID-19 pandemic and leading up to the holidays.
Most notably, Google found that
30 percent of Canadians say they’re currently nervous to shop in-store,
given the global health crisis. Further,
35 percent of Canadians noted
that they feel social distancing measures make it harder to shop.
Those that are still turning to brick-and-mortar stores to shop have driven
searches for “curbside pick up” to increase by over 3000 percent year-over-year.
What’s more, 33 percent of Canadian shoppers who normally go to stores for
Black Friday are saying
they won’t do that this year. Nearly
30 percent of Canadians are
also even planning to order gifts online
and have them shipped directly to friends and family.
Interestingly, though, Google found that 33 percent of Canadian consumers have
shopped with a store/retailer that they hadn’t before tried prior to the
pandemic.

Winnipeg police warning of COVID-19-related frauds and scams
Winnipeg police are warning about a number of scams and frauds that have popped
up due to COVID-19.
In some cases, there are
people going door-to-door
trying to sell household decontamination services and companies offering fast
COVID-19 tests for
sale. However, only health-care providers can perform the tests and no other
tests are genuine or guaranteed to provide accurate results.
In the health scams, police warn of those
selling fraudulent products
that claim to treat or prevent COVID-19.
Police say many people fall victim to frauds and scams, but far too many people
never report it.

Accused of COVID price gouging, Calgary company pleads guilty and admits to
'grossly excessive' prices
A Calgary company accused of COVID-related price-gouging has been fined after
pleading guilty to a charge under the Consumer Protection Act. Following an
anonymous complaint in April, investigators found CCA Logistics was charging
"grossly excessive" prices on
COVID-related items like personal protective equipment and hand sanitizer.
The company was initially ordered to remove the items —
$120 masks and $39 hand sanitizer
— but when undercover investigators returned to the store, they discovered CCA
had not fully complied.

What to expect during Amazon Prime Day 2020
Amazon’s sixth-annual Prime
Day will be Tuesday and Wednesday, Oct. 13-14. This year's event may cut into
Black Friday and Cyber Monday holiday shopping sales.
Prime Day 2019, Amazon’s fifth such event, generated a Digital Commerce
360-estimated $7.16 billion globally over the 48-hour period between July 15-16,
2019. That was an increase of 71% from the $4.19 billion during the 36-hour
sales event in 2018.
How does Prime Day compare
with other online shopping holidays?
Based on Digital Commerce 360’s estimates, the 2019 Prime Day sales event still
lags behind larger shopping events such as the Cyber 5 (the five-day shopping
period Thanksgiving Day through Cyber Monday) or Chinese ecommerce giant
Alibaba’s Singles’ Day event held on Nov. 11 each year.

Prime Day will affect Cyber 5 and holiday shopping.

Amazon, Whole Foods merger saved the grocery chain, according to CEO
Mackey wrote that while "with any marriage there are challenges," Amazon's
purchase of Whole Foods has proven to be a "win-win-win solution" for the
brand's customers, employees, and other stakeholders. He wrote that Amazon's
Prime Now services are "revolutionizing our business" and the e-commerce
giant is ensuring "richer and more seamless" shopping experience at the
grocery chain.
Meanwhile, the acquisition has also helped safeguard the "unique culture at
Whole Foods" and shelter the brand from Wall Street expectations.
"I truly believe the Amazon merger was the best alternative for Whole Foods
and the ideal win-win-win solution to the problems we faced with shareholder
activists and new competitive challenges," Mackey wrote.

$8 Million In Stolen Merchandise Recovered
Five
suspects were facing a variety of charges and approximately $8 million in stolen
merchandise has been recovered after state and local law enforcement officers
busted a
major retail theft ring,
California Attorney General Xavier Becerra announced Tuesday. Becerra said Edgar
Geovany Robles Morales, Isis Vasquez Villanueva, Jose Villatoro, Danny Louis
Drago and Michelle Renee Fowler had been arrested and faced charges for
allegedly buying stolen
goods and reselling them for profit.
Trailer after trailer, bin after bin, sack after sack — stored on pallets,
stacked floor to ceiling, two stories tall. It took a team of 30 people two days
to catalog it, mostly
merchandise from CVS,
as part of ‘Operation Proof’ of Purchase, $8 million dollars worth in all. "It’s
a lot of stuff, sure is,” said Ben Dugan.
Dugan is one of CVS’s top experts on organized crime, and says they’ve been
tracking the so-called boosters, professional shoplifters, as they enter their
stores and stuff bags with merchandise. The boosters then met up in the
Tenderloin and according to investigators, sold the items to so-called “crew
leaders” or “street fences”, Villanueva, Villatoro and Morales.

The California Highway Patrol-Golden Gate Division’s multi-agency Organized
Retail Crime Task Force made up of investigators from CHP, SFDA, SFPD and the
United States Postal Inspection Service along with CHP Cargo Theft Interdiction
Program investigators. CHP Lt. Kevin Domby heads it up.
“Any one of these police departments is not going to be able to connect the dots
on their under-$1000 theft. Retailers know they’ve had ten stores hit throughout
Northern California. They might have 10 different law enforcement agencies
working on those smaller crimes, but the retailer knows they’re connected to
something larger,” said Lt. Domby. Working with the task force, investigators
tracked the stolen goods to 16 different storage lockers, warehouses and homes
across the Bay Area. Much of the goods were then sold online through what law
enforcement says was a shell company run by Drago, called D-Luxe OTC.

Chicago, IL: Convicted felon ‘busy little bee’ during his alleged looting spree
Lee Mitchell, 28, allegedly ransacked seven Near North Side stores in over a
two-hour period during the city’s second wave of widespread looting over the
summer. “It appears [Lee] Mitchell was a busy little bee. I was tired just
listening to the work he put in,” Judge John Lyke Jr. said of the 28-year-old’s
alleged criminal activities in the early morning hours of Aug. 10. “He put in a
lot of work that night allegedly. Wow.” Mitchell had just been released from the
Illinois Department of Corrections less than two weeks before he looted the
businesses in the Gold Coast and Ranch Triangle neighborhoods, prosecutors said.

San Angelo, TX: Galveston man wanted in 12 counties, stole over $23k from San
Angelo Walmart
A
Galveston man wanted in 12 counties was arrested Friday after Walmart Global
recognized a man recorded stealing from a San Angelo Walmart, according to
arrest affidavits obtained Tuesday. On Sept. 23, 2020, a San Angelo police
officer responded to a burglary at Walmart, 5501 Sherwood Way. Video footage
showed people force entry into display cases containing various cellphones,
Apple AirPods and Beats headphones, according to the affidavits. The people put
$23,115 worth of electronics into a "carseat box" and left the store. One of the
stolen items had an active GPS, which alerted the store to the burglary, records
state. Walmart Global Investigations told investigators one of the people "has
vast numbers of other burglaries in a similar fashion all across the state,"
according to the arrest affidavit.

Sacramento, CA: Father Killed Inside Market While Shopping With 4-Year-Old
Daughter
Sheriff’s
deputies continue to investigate a shooting rampage inside a local grocery store
that happened Saturday in the Arden-Arcade area. A gunman shot three people
Saturday afternoon at East Market and Restaurant off El Camino Avenue, before
turning the gun on himself – and now deputies are focused on determining a
motive. A witness said Shujauudin Omerkheil and his daughter Bushra were buying
food for Saturday night dinner when he was shot while holding bread, rice and
his daughter’s hand. Yousafzai said the two other men who were shot have serious
injuries. One is in critical condition and the other still has a bullet lodged
in his shoulder. Survivors told Yousafzai that the shooter walked into the store
looking angry. A spokesperson for the Sacramento County Sheriff’s Department
said the attack appears random. They said the suspect is of Afghan descent.

Blackville, SC: Two men charged in the September murder of C-store owner
Agents
from the S.C. Law Enforcement Division arrested two men on Tuesday in connection
to the robbery and shooting at a convenience store in Blackville, South
Carolina. The first suspect, Jason Jarmez Smith, 23, was charged with Murder,
Armed Robbery, and Possession of a Weapon during a Violent Crime. Both men were
booked at the Barnwell County Detention Center. Ashwinbhai “Andy” Patel, 60, who
owned Corner Stop 10 Convenience Store, was shot to death during a robbery
before 7 a.m. on Sept. 8.

quick-thinking employee at a Pizza Hut in Houston turned the tables on a group
of robbers by chasing them out of the store with a rather large, rather
intimidating-looking pizza cutter. The police are now hoping to charge the
criminals with aggravated robbery. On Tuesday, the department’s Robbery Division
released surveillance footage from the Aug. 29 incident on YouTube, asking for
the public’s assistance in identifying the fleeing suspects.
