of mass shootings this summer in states including California, Texas and Ohio.
With uncertainty about whether Congress will do anything this fall in response
to the massacres, the private sector has started taking action to address gun
violence.

'Open-Carry Texas' Doesn't Care What Retailers Want
38,000 in Texas in Open Defiance to Walmart
Retailers Walk Thin Line by Asking, Not Telling, Shoppers Not to Carry Guns
David Amad, a gun rights activist and the vice president of Open Carry Texas, is
not especially bothered by Walmart’s recent announcement that it is
“respectfully requesting” that customers not openly carry guns into its stores.
Mr. Amad said many of his group’s
38,000 members had carried their guns openly into Walmart stores since the
retailer made the policy public last Tuesday.
None have been asked to leave.
“They are ducking the issue,” Mr. Amad said of Walmart. “They are trying to get
the gun haters to leave them alone, while at the same time leave us alone when
we carry in their stores.”
But none of the retailers have banned guns in their stores outright,
even though legal experts say that is something they could do.
“It’s a private property,” said Adam Winkler, a law professor at the University
of California, Los Angeles. “A retailer can refuse service to anyone so long as
it is not on the basis of race, religion or another protected group.
That does not apply to gun owners.”
In some places, where gun rights are paramount, retailers said they might have a
hard time enforcing a ban because local officials might believe that open-carry
rights superseded store policies.
The new policies appear to be achieving something that have been elusive in the
nation’s long-running gun debate:
some form of middle ground.
Walmart employees are instructed not to obstruct peaceful shoppers from openly
carrying guns in the stores. In some stores, a Walmart spokesman said, employees
are used to seeing some customers with guns during hunting season. But if an
employee or customer feels unsafe, the store workers should call law
enforcement.
More than 40 states allow open carry in some form.

AI & Impacting The Employment Process
Illinois Gov. Pritzker signs 1st-of-its-kind law regulating use of artificial
intelligence (AI) in Illinois - Effective Jan. 1, 2020
While the use of AI in the employment decision-making process might sound
futuristic, many U.S. companies already use AI to streamline hiring and
make the process more objective. They use AI to scan resumes, schedule
interviews, and recently, to actually conduct the first round of job interviews.
These AI interviewing programs have different algorithms and methods, but
essentially,
they measure an applicant's facial expression, word choice, body language,
and vocal tone, among other factors.
In response to the evolution of AI in the hiring context, Illinois legislators
unanimously passed
HB 2557, The Artificial Intelligence Video Interview Act. Employers should
take note that the law now requires employers who use artificial intelligence to
analyze video interviews to do the following:
•
Provide notice: Employers must inform applicants that AI will be used to
analyze their interview videos. (A provision requiring written notice was
removed from the bill.)
•
Provide an explanation: Employers must explain to the applicant how their
artificial intelligence program works and what characteristics the AI uses to
evaluate an applicant's fitness for the position.
•
Obtain consent: Employers must obtain the applicant's consent to be
evaluated by AI before the video interview and may not use AI to evaluate a
video interview without consent.
•
Maintain confidentiality: Employers will be permitted to share the videos
only with persons whose expertise or technology is needed to evaluate the
applicant.
•
Destroy copies: Employers must destroy both the video and all copies
within 30 days after an applicant requests such destruction (and instruct any
other persons who have copies of the video to destroy their copies as well).
While the act is set to take effect at the beginning of 2020, questions
regarding the interpretation of the legislation are still unanswered:
What kind of "explanation" is sufficient? - Will there be a private right of
action? - What type of damages and how much? - What is the scope?

Storing Large Sums of Cash - 'Public Safety Risks'
'Cannabis Banking: The Prospects for Legal Protection'
The trend of states legalizing cannabis – 33 Medical Marijuana states plus the
District of Columbia and 10 Adult-Use states and counting – while it remains
illegal under federal law poses a dilemma for U.S. financial institutions. While
some banks and credit unions have chosen to serve cannabis businesses, most
refuse to do so given the ongoing legal uncertainty. With limited banking
access, many cannabis businesses are forced to operate with, and store large
sums of cash, which can create public safety risks. In recognition of this
situation, there is a growing consensus that, regardless of one’s views about
legalization itself, the problem of cannabis banking must be addressed.
On July 23, the Senate Banking Committee held an important hearing on the Secure
and Fair Enforcement (SAFE) Banking Act, which would provide a level of legal
protection for financial institutions serving marijuana-related businesses (MRBs).

UK: Violent retail crime leading to PTSD for shop staff
The report by City, University of London, says a rise in violent retail crime is
causing "long-lasting anxiety and post-traumatic stress disorder" among workers
in the sector. More than 42,000 assaults or threats were recorded in the
industry in 2018. Dr Emmeline Taylor, the report's author, says government
action is "urgently needed" to protect staff.
"All too frequently, shop workers are suffering physical injuries, as well as
chronic and life changing mental health consequences of violence, such as
long-term anxiety and post-traumatic stress disorder," the report states.
According to the research, the four main scenarios that lead to violent
interactions are: encountering shoplifters, enforcing age-restrictions on the
sale of goods, hate-crime related incidents and armed and unarmed robberies.

U.S. Files Criminal Charges Against Chinese Professor Tied to Huawei
Chinese professor in Texas who had earlier been accused in a civil suit of
stealing a U.S. startup’s technology for China’s Huawei Technologies Co.,
marking an escalation of the Justice Department investigations into issues
related to the telecom giant.
The charging document describes the company identifiable as Huawei as having
“attempted to misappropriate” technology from a company identifiable as CNEX
since 2016, and it says Mr. Mao worked with the company “as part of this
fraudulent scheme.”

Walmart AP & AI Combating Shrink
Retailers Are Getting Smarter About Artificial Intelligence
Artificial intelligence (AI) and machine learning (ML) are starting to play a
bigger role in retail, foreshadowing what’s to come in the new decade of the
2020s.
Walmart, for instance, hopes to reduce checkout theft by turning to cameras
powered by AI, with deployments underway in some 1,000 stores. “The retailer
began investing in the surveillance program, dubbed Missed Scan Detection,
several years ago in an effort to combat shrinkage – loss due to several
causes including theft, scanning errors, waste and fraud,” the report
stated. “The AI-powered cameras were rolled out to more than 1,000 stores about
two years ago, and the retail giant has seen positive results since then,
according to [Walmart spokeswoman LeMia] Jenkins, who said shrinkage has
reduced in stores where the cameras have been added.”
By incorporating visual recognition technology and artificial intelligence into
their business models, retailers such as Neiman Marcus, IKEA, H&M and west elm
are leveraging mobile devices and AI to provide advanced customer services.
Those services include visual searches, hyper-personalization and seamless
omnichannel functionality – all woven together, across online and
brick-and-mortar channels, to enhance the consumer experience.
Blurring the Divide
According to
PYMNTS research, AI and ML are blurring the divide between online and
in-store shopping, and bringing an all-new human element into retail.

Amazon Among 51 CEOs Petitioning For Privacy Laws
An open letter to Congress asking for a consumer data privacy law was signed by
51 CEOs across tech and other industries, CNBC reported on Tuesday (Sept. 10).
Executives from the
Business
Roundtable said in the letter that putting a federal law in place is
important and necessary to protect American consumers while also ensuring that
the U.S. continues to lead the competitive global market.
“We are committed to protecting consumer privacy and want consumers to have
confidence that companies treat their personal information responsibly. We
urgently need a comprehensive federal consumer
data privacy law to strengthen consumer trust and establish a stable policy
environment where new services and technologies can flourish within a
well-understood legal and regulatory framework,” the letter said.

More Than 99% of Cyberattacks Need Victims' Help
Research highlights how most criminals exploit human curiosity and trust to
click, download, install, open, and send money or information.
Most cybercriminals target people, not infrastructure:
More than 99% of emails distributing malware from 2018 into 2019 required human
interaction to click links, open documents, accept security warnings, or
complete other tasks to effectively compromise an organization. Instead of
targeting systems, criminals focus on people, their roles, and data they can
access.
The data comes from Proofpoint, where for 18 months researchers observed attack
trends to compile the "Human
Factor 2019" report. What they found
was an increasing sophistication and prevalence of social engineering across
businesses as attackers shift from smash-and-grab ransomware campaigns to
well-crafted business email compromise schemes and domain fraud.
Generic email harvesting made up nearly 25% of all phishing schemes in 2018,
Proofpoint reports. Credential collection remains a strong focus this year, with
techniques pivoting to
Microsoft Office 365 phishing schemes and impostor attacks. Cloud storage,
DocuSign, and Microsoft cloud service phishing are this year's hottest phishing
lures,
replacing last year's trend of "Brain Food," a botnet used to distribute
diet-related spam to capture victims' credit cards.

Software Bugs: Gotta Catch 'Em All?
Beyond 'Patch or Perish' - CISOs' Risk-Based Approach to Fixing Vulnerabilities
For those not in the know, that vulnerability cat-and-mouse game goes like this:
IT teams race to test and apply newly released, critical updates to software and
systems - under cover of mitigating or compensating controls - before hackers
create and field working exploits for the flaws the patches fix.
Such efforts continue nonstop.
Risk Based Security's VulnDB team, for example,
counted 11,092 newly disclosed vulnerabilities
during the first half of 2019. Public exploits existed for 34 percent of those
flaws, 53 percent of all of the vulnerabilities could be exploited remotely and
nearly 5 percent of all of the bugs also affected security software.
Risk-Management Challenge
Security experts warn that patch management, or the larger question of
vulnerability management, must be part of a much bigger-picture approach to
managing risk.
"I don't see much written on vulnerability management in more holistic terms
versus patch/bug fixing," says
Phil Venables, a board director and senior adviser for risk and
cybersecurity at Goldman Sachs Bank, via Twitter. "I've always found it
immensely useful to think of vulnerability management as four layers, building
on each other and in turn becoming more powerful as a risk mitigation approach."

Amazon Employees Will Walk Out Over the Company's Climate Change Inaction
1st Time Workers at Seattle HQ Participate in Planned Strike
Over 900 Amazon employees have signed an internal petition pledging to
walk out over their employer’s lack of action on
climate change. The
demonstration, scheduled to start at 11:30 am Pacific time on September 20,
will mark the first time in Amazon’s 25-year history that workers at its Seattle
headquarters have walked off the job, though many are taking paid vacation to do
so. Most of the workers who have signed on so far work in Seattle, but employees
in other offices, including in Europe, have indicated an interest in the event
as well. The protest is part of a global
general strike
led by 16-year-old climate change activist Greta Thunberg taking place ahead of
the United
Nations Climate Action Summit on September 23.

"The State of Online Returns in 2019: A Global Study"
Narvar Global Study Finds Consumers Expect Easier Returns than Retailers Are
Delivering
Frictionless returns are not yet a reality for today's consumers, according to a
new report published today by
Narvar, an intelligent customer engagement platform. The report, "The
State of Online Returns in 2019: A Global Study," analyzes the sentiments of
3,519 online shoppers in five markets including the U.S., U.K., France, Germany
and Australia. The study found that a substantial portion of online shoppers
globally do not find the returns process easy—only 60 percent of respondents
said they were satisfied with their most recent return.
Friction in the online returns process is hurting retailers, particularly when
it comes to retaining customers. Thirteen percent of shoppers said they wouldn't
shop with a retailer again after their negative returns experience, and this
number was four times higher for first-time shoppers (31 percent) as for
returning customers (8 percent). By removing friction, retailers stand to recoup
sales via exchanges and encouraging repeat purchases. A third of consumers were
open to making an online exchange versus requesting a refund when presented with
options ranging from easy swaps for different colors or sizes to free shipping.
Ecommerce returns are on the rise as
online sales grow: Returns of online purchases are expected to cost U.S.
retailers
$550 billion by next year, which is 75 percent more than years prior.

Four Suspected In Three-State $1 Million Burglary Ring Arrested After Police
Chase In Wisconsin
Four men suspected of $1 million worth of burglaries in Illinois, Indiana, and
Wisconsin were arrested in the Milwaukee suburbs Sunday morning after a
high-speed chase. The four men are from Illinois and Indiana, and police have
been trying to catch them for months. They are suspected in more than 25
burglaries in at least three states.
Sunday morning, they were caught on surveillance video as they removed
electronics from display cases at a Best Buy in Greenfield, Wisconsin, around 4
a.m. on Sunday. One of them used a ladder to pull items from a shelf. The men
were leaving the store when Greenfield police arrived. A police chase ensued,
reaching speeds of up to 70 mph on Interstate 43. Officers used a PIT maneuver
to stop the burglars’ van, which had been stolen in Milwaukee. The driver lost
control and the van flipped. Police said the men are between the ages of 18 and
41. They also allegedly broke into Ulta Beauty, Kohl’s, and Art’s Camera stores
in the area. Police said a large amount of stolen items was found inside the
burglars’ van. Some of the men were still wearing masks and gloves when they
were arrested.
Charges likely will be filed later this week. Authorities have not said where
else the burglars struck outside of Wisconsin.

Oswego, IL: $75,000 in jewelry stolen from Kohl's store
Jewelry worth $75,000 was stolen Sept. 9 from the Oswego Kohl's store at 2500
Route 34, according to Oswego police. Police said the burglary occurred after
store business hours. The investigation into the burglary is continuing, police
said.

Robbery suspect fights with employee at West L.A. Best Buy, threatens with
pepper spray
The incident happened Sept. 5 at the Best Buy in West Los Angeles in the 11300
block of West Pico Boulevard. The suspect walked toward the cellphone counter
and said he wanted to purchase two phones, police say. The employee placed the
cellphones on the counter and the suspect grabbed them, placed them inside a bag
and tried to run out the door. Another store employee tried to stop the suspect.
They struggled and continued fighting outside the store as the employee tried to
tackle the suspect and hold on to his bag. Outside, the suspect pulls out a
knife and pepper spray and is able to get away.

San Antonio, TX: Men threaten Home Depot employee while fleeing with stolen
merchandise
San Antonio police and Crime Stoppers are looking for the people responsible for
a robbery of a Home Depot on the city's North Side. According to police, on Aug.
9 two men were seen on surveillance video loading a cart with cordless hand
tools before one of the men left the store. That's when, police said, the man
with the merchandise attempted to walk out of the store with the items without
paying. Police said an employee asked to see his receipt but instead was shown a
knife. The man then left the store with the stolen property.

Watertown, NY: Man charged with the theft of $2,300 of Flea Medication from 3
stores
Brian D. Laprade, was charged by state police with first-degree scheme to
defraud, a class “E” felony, and petit larceny, a class “A” misdemeanor. On
Saturday, Sept. 7, Laprade was caught by loss prevention leaving the Hannaford
Store in Watertown with $313 worth of merchandise without paying. Laprade is
also accused of stealing boxes of flea medication from the Hannaford stores in
Plattsburgh, and in Saratoga, totaling an amount of $2,359, troopers said.

Clearwater, FL: Walmart Fishing gear thief fled empty handed; over $1,000 in
merchandise recovered
Clearwater police are asking for your help in identifying a suspect who stole
fishing gear from a Walmart. Police say he loaded more than $1,000 in fishing
equipment in his cart and then walked out the front doors. Store security
followed the suspect into the parking lot, where he then grabbed some of the

Dallas, TX: Good Samaritan Shot & Killed Near Dallas Convenience Store
A Good Samaritan in Dallas is dead after trying to come to the aid of a woman
having some type of altercation with a man near a convenience store. The
incident happened just outside TMA Grocery, near 2nd Avenue and Metropolitan.
When police initially arrived they found a man injured and laying in the grass.
He was taken to a local hospital, but died from his injuries. Police later
viewed surveillance camera video from the store and say the shooting actually
happened across the street. Investigators say the video shows the victim being
hit by gunfire, running to the grocery store and collapsing in the lot behind
the building. After the shooting the suspect drove away from the scene, but was
pulled over by police and is being held as a person of interest.

Phoenix, AZ: Man facing 5 charges following Accidental Discharge of a weapon
inside Walmart
An 18-year-old man was arrested Sunday after a gun he was allegedly carrying in
his pocket went off in a West Valley Walmart, authorities said Monday. Maurice
Eugene Weaver Jr. was booked on five charges, including felony counts of
discharging a firearm within city limits, disorderly conduct involving a weapon
and endangerment.

Atlanta, GA: Search for gunman who ran over, robbed shopper in Metro Mart USA
parking lot
Atlanta police are looking for the robber and driver who mowed down a pedestrian
in a flea market parking lot in southwest Atlanta before robbing him at
gunpoint. It was all caught on surveillance video on August 30 at the Metro Mart
USA parking lot on Metropolitan Parkway. The surveillance video shows the
Cadillac was initially parked out in front of the store. When the victim comes
out with his shopping bags, he passes in front of the car. Moments later, you
see the Cadillac pull out and drive towards him. Investigators are not releasing
the portion of the video that shows the moment he was hit, pinning his legs
under the car.

Tavares, FL: Police release new video of AT&T Armed Robbery
Newly released video is showing the dramatic moments last week when an employee
was held at gunpoint during a robbery at a Lake County AT&T store. Police said
two men robbed the store before leading las enforcement on a high-speed chase

Japan: Supermarket cashier Memorizes card details of 1,300 customers, used to
shop online
A cashier working at a part-time supermarket in Tokyo has been arrested for
allegedly memorizing card details of 1,300 customers and using them to buy
things online. The man, identified as Yasuke Taniguchi, has an eidetic memory
(photographic memory) and was able to memorize card details such as the
16-digit-number, name, expiry date and security code without any trouble,
Japanese media reported. According to the police, the 34-year-old, while working
at a supermarket in Koto Ward. The police were alerted when Yasuke used the card
details to buy two shoulder bags worth $2,500 in the month of March. After a
thorough investigation of all purchases made by Yasuke, the cops tracked him
down and arrested him on charges of fraud.

Perth, Australia: 100 Stolen guns seized by WA Police after robbery and
kidnapping at Beckenham Firearms shop
Police investigating the alleged kidnapping of an 81-year-old man during a
robbery of a firearms store have uncovered a huge cache of weapons. The
Beckenham store was held up on September 4, with more than 100 guns taken during
the robbery.

Progress or moving forward has as much to do with which way you're facing as
anything else. If you stay focused on facing your customer and not your internal
team then you might find success is a little closer than you think. This goes
for the vendor and for the retailer, as we all have customers to serve both
internally and externally. And while it's impossible to always stay facing them
the mere thought of it will bring you back a little faster if you just remember
that your ultimate success is driven by your customers whether its individual
stores or companies. Much too often we all tend to get lost in the politics of
our inner group and use it as a means of avoiding having to accomplish difficult
tasks. But all you've got to remember is to turn around and face the customer
and then you'll be back on track getting things done and moving forward.
