Security Will Remain High in D.C. Due to Ongoing Threats

Capitol Police chief says extremists have discussed attack on Congress during Biden’s first joint address
The acting chief of the U.S. Capitol Police warned lawmakers Thursday that militia members involved in the Jan. 6 riot “want to blow up the Capitol and kill as many members as possible” during President Biden’s first congressional address.

The stark warning about another potential threat to Congress — which has not been corroborated by other law enforcement agencies — comes as a date for Biden’s first address on Capitol Hill has not been set. New presidents typically deliver a speech to a joint session of Congress in February.

Acting chief Yogananda D. Pittman told lawmakers there was “a direct nexus” between the threats and a Biden speech. She cited that intelligence to explain why National Guard members who were deployed and the tall security barriers that were erected around the Capitol after the insurrection have not yet been removed.

“Based on that information, we think that it’s prudent that Capitol Police maintain its enhanced and robust security posture until we address those vulnerabilities going forward,” Pittman said. washingtonpost.com

States move in opposite directions on guns in capitols after armed protests

In the past year, insurrectionists have breached the U.S. Capitol and armed protesters have forced their way into statehouses around the country. But the question of whether guns should be allowed in capitol buildings remains political, and states are going in opposite directions.

In Montana, a new state law signed allows anyone with a permit to bring a concealed firearm into the statehouse. GOP-dominated Utah passed a law this month allowing people to carry concealed weapons into its Capitol building and elsewhere in the state without a permit.

Guns are allowed in statehouses in some form in 21 states, according to a review by The Associated Press. Eight states allow only concealed firearms inside their capitols, while two states allow only open carry.

Montana and Utah are two of at least 13 states that do not have metal detectors at the entrance to their capitols. The statehouses are open to the public even as many have closed because of the coronavirus pandemic.

Several other states, though, are moving to restrict guns inside their capitols. In Michigan, where armed protesters forced their way inside the statehouse last year and the FBI said it uncovered a plot to kidnap the governor, a state panel banned the open carry of guns after the Jan. 6 riots in Washington, D.C.

Vermont lawmakers, meanwhile, are considering expanding their statehouse ban on guns to other government buildings. In Washington state, a bill that would ban open carry of guns in the statehouse and near permitted demonstrations has won early approval.

In nearby Oregon, crowds opposed to the building’s public closure during a pandemic-related session stormed the state Capitol, including at least one person armed with an AR-15. And in Idaho, self-styled “patriots,” anti-vaccination groups and others forced their way past police in August at the Capitol, shattering a window as they pushed and shoved into a gallery. nbcnews.com

Major pharmacy chains said they had hundreds of thousands more vaccines for a handful of states, while the Biden administration said it is doubling the amount of doses being sent to them.

CVS has around 570,000 doses of the vaccine that they sent out to 17 different states to be distributed this week. Walgreens has around 480,00 doses of the vaccine sent to 2 different states and jurisdictions.

There is a new tool available for eligible people, a website called Vaccine Finder. People can type in their zip code and it lists locations where vaccines are being offered and whether or not they have any in stock. CDC Is Depending on Employers to Encourage Worker Vaccinations
Vaccination is an important tool in controlling the pandemic, say public health leaders, who are asking employers to encourage and make it easy for workers to get vaccinated. Speaking Feb. 25 during a webcast for members of the Society for Human Resource Management (SHRM), U.S. Centers for Disease Control and Prevention (CDC) officials explained what employers can do to promote efforts to vaccinate employees.

Dr. Nancy Messonnier, director of the National Center for Immunization and Respiratory Diseases and lead for the CDC's efforts on COVID-19 vaccines, said, "It's going to take all of us working together to use the vaccines in the best way possible."

Messonnier emphasized the importance of safety and equity with the vaccines. "These vaccines are safe and effective, but that won't matter if people do not take them," she said. "It's essential people have confidence in the vaccination program, including trust in the vaccines, vaccinator and the system that produced" the vaccines. She said the CDC is working with communities to build trust in the midst of a pandemic, especially in communities of color that have been disproportionately impacted.

Kitt noted that there is a new CDC smartphone-based monitoring program for COVID-19 vaccine safety called V-safe. V-safe:

● Uses text messaging and Web surveys to check in with vaccine recipients after vaccination.
● Enables participants to report any side effects or health problems after COVID-19 vaccination.
● Helps the CDC call vaccine recipients to follow up on reports of significant health impact.

Employers wanting to require workers to get a COVID-19 vaccination should be prepared to respond to workers' concerns and make reasonable accommodations under federal and state law.

According to research by the Society for Human Resource Management (SHRM), 60 percent of U.S. workers said they will probably or definitely get the vaccine once it becomes available to them. However, 28 percent of respondents said they are willing to lose their jobs if their employer requires the COVID-19 vaccine.

After abandoning its plans for a centralized Bellevue headquarters last year, REI has picked Issaquah for one of its several planned satellite offices.

REI’s shift to satellite work sites embodies what some predict could happen to traditional offices as work-from-home policies became commonplace. Demand for office space has dropped, especially in downtown Seattle, as some companies offer up their office space for sublease.

In August, REI said it would sell the never-used campus in Bellevue in favor of dispersing its headquarters to several offices, including an existing site in Seattle’s Georgetown neighborhood.

The company said it also plans to “test a model” allowing headquarters employees to work from home up to five days a week.

Schnucks deploys new tool against in-store coupon fraud

Midwestern grocery retailer successfully detecting counterfeit coupons at the point-of-sale with a new, free solution.

St. Louis-based Schnuck Markets Inc. is the first retailer to roll out the Inmar Intelligence CNFRM tool, which is free for retailers and prevents the redemption of counterfeit coupons in real-time at the register. Schnucks says it has already begun intercepting fake coupons at the POS in the first week of deployment.

The retailer can instantaneously identify valid and invalid offers at the POS through CNFRM’s cloud-based decision engine that leverages both positive and negative offer file data. This real-time process is designed to allow cashiers to accept or reject manufacturer coupons without slowing shoppers down in the lane. Moreover, CNFRM enables accelerated detection and arbitration of new unknown offers that may be counterfeit, resolving them within hours.

According to Inmar Intelligence, CNFRM’s cloud-based architecture validates scans within 50-200 milliseconds. The solution also provides access to a comprehensive coupon database maintained by Inmar Intelligence, which it says represents 90% of the offers in market.

San Francisco DA’s office tackles rampant shoplifting at Walgreens

Shoplifting has closed at least one store in the city. Could it close even more?


Shoplifting incidents at Walgreens and similar retail stores have become almost commonplace, perhaps especially so in the pandemic. The Walgreens at 30th and Mission reported 16 shoplifting incidents, including the one above, between early November, 2020, and early February, 2021, according to the Ingleside Police Station newsletter, compiled by Capt. Christopher Woon. Another Walgreens in the district, at 965 Geneva Ave., reported 30 incidents in the same time period.

Walgreens reportedly takes a hands-off approach to shoplifting. Interfering with a would-be shoplifter can lead to assaults, injuries and insurance liability; instead, employees are encouraged to call the police only after suspects have left the store, according to their posts on Reddit. But when rampant shoplifting has forced other San Francisco Walgreens stores to close, and so many residents rely on their local Walgreens for vaccinations and medications, that policy could leave customers scrambling.

Matthew Donahue, an assistant district attorney in the San Francisco District Attorney’s Office, has been working for the past few months with the ALTO Alliance, a consulting firm that helps retailers like Walgreens figure out how to deter shoplifting. Together they are working through a list of more than 100 shoplifting cases in San Francisco, some with identified suspects and many without, to support some of the hardest-hit stores and begin to prosecute repeat shoplifters. missionlocal.org

United Airlines to Pay $49 Million to Resolve Criminal Fraud Charges and Civil Claims
United Airlines Inc. (United), the world’s third largest airline, has agreed to pay over $49 million to resolve criminal charges and civil claims relating to fraud on postal service contracts for transportation of international mail.

Between 2012 and 2015, United's Cargo Division engaged in a scheme to defraud USPS by submitting false delivery scan data to make it appear that United and partner airlines with which it worked were complying with the ICAIR requirements, when in fact they were not. Instead of providing USPS accurate delivery scans based on the movement of the mail, United submitted automated delivery scans based on aspirational delivery times. These automated scans did not correspond to the actual movement of the mail, as mandated by the contracts. Because this scan data was not tethered to the actual delivery of mail to the foreign recipients, payment was inappropriate under the ICAIR contracts. Through this data automation scheme, United secured millions of dollars in payments from the USPS to which United was not entitled under the ICAIR contacts.

United further admitted that it concealed problems related to scanning and mail movements that, if known, would have subjected United to financial penalties under the ICAIR contracts. Certain individuals at United worked to conceal United’s automation efforts from the USPS, as they knew that the data being transmitted was fabricated. These individuals further knew that the transmission of false data violated the terms of the ICAIR contracts. The attempts to hide the automation practices included efforts to revise the falsified delivery times to make the automated scans appear less suspicious to USPS.

United has further agreed to strengthen its compliance program and to specific reporting requirements, which require United to submit yearly reports to the Fraud Section regarding the status of its remediation and implementation of United’s compliance program and internal controls, policies, and procedures aimed at deterring and detecting violations of U.S. fraud laws in connection with government contracting. justice.gov

Retailers Calling for Federal ORC Law
Charlotte, NC: Retailers want law to help stop stolen merchandise from being sold online
A Fox 46 investigation is sparking new calls for a law that would help curb organized retail crime. The Buy Safe America Coalition says it’s sharing a FOX 46 investigation into retail racketeering with North Carolina’s Congressional delegation. The group, which advocates for tougher measures to stop the sale of stolen and counterfeit items, says lawmakers plan to reintroduce a bill this year that would provide more transparency when you shop online.

“The story, Matt, that you ran before, I’m going to send that up to Capitol Hill to show how big this issue is from your reporting and how it affects businesses,” Buy Safe America Coalition spokesperson Michael Hanson told FOX 46 investigative reporter Matt Grant.

The INFORM Consumers Act, which was introduced last year but did not get a vote, would make online marketplaces like Amazon, eBay and Facebook Marketplace verify the identities of high-volume sellers by requiring photo IDs, addresses, phone numbers and bank account information. The goal is to make sure sellers are legitimate and stop the stolen and counterfeit merchandise from being sold to bargain hunters, who don’t have a clue they’re being products that could be on a police report.

“Providing this kind of transparency online would protect consumers,” said Hanson. “And stop criminals from hiding behind anonymous accounts and selling stolen and counterfeit goods to consumers.”

Home Depot says a federal law is needed. “I do think a piece of legislation, federal legislation, in the area of organized retail crime,” said Home Depot spokesperson Christina Cornell, “is absolutely necessary to combat this problem.” Professional organized shoplifting rings cost retailers more than $700,000 for every $1 billion in sales, according to the National Retail Federation. wnct.com

Calif. Supreme Court upholds law ending adult trials for 14- & 15-year-olds
The California Supreme Court on Thursday upheld the state’s 2018 law barring 14- and 15-year-olds from being tried as adults and sent to adult prisons even for serious crimes such as murder, arson, robbery, rape or kidnapping. The ruling cements California’s status as the first state to take the step, said The Sentencing Project, an advocacy group. The high court found the law did not conflict with Proposition 57, approved by voters two years earlier, that allowed judges to decide whether young suspects should be tried in adult court. “The amendment is fully consistent with and furthers Proposition 57’s fundamental purposes of promoting rehabilitation of youthful offenders and reducing the prison population,” Associate Justice Joshua Groban wrote in the unanimous decision. Five lower appellate courts previously found that there was no conflict, but a sixth appellate panel ruled in 2019 that SB1391 was superseded by the ballot measure and therefore was unconstitutional. Chicago: Orland Square mall new policy restricts access to unaccompanied youth
Orland Square mall in Orland Park, Ill. is putting a policy in place that will ban some unaccompanied teens from being in the shopping center. The shopping center will require those under 18 to be accompanied by a parent or adult, 21 or older, after 3 p.m. on Fridays and Saturdays beginning March 12. Unsupervised guests under 18 will have to either leave the mall by 3 p.m. those days or be joined by a parent or adult. The report mapped 84 DE&I practices to determine the five essential strategies and 15 practices that have the greatest impact on business, organizational and workforce outcomes across all industries, geographies and company sizes.

The survey found that:

76 percent of companies have no diversity or inclusion goals.

75 percent of companies do not have DE&I included in the company's leadership development or overall learning and development curricula.

40 percent of companies view diversity work as a way to mitigate legal, compliance or reputational risks, with HR in an enforcer role.

32 percent of companies require some form of DE&I training for employees; 34 percent offer training to managers. shrm.org

More States May Follow Virginia in Trend to Pass Consumer Privacy Laws
Virginia may be the first state to follow California's lead on consumer privacy legislation, but it certainly will not be the last. The International Association of Privacy Professionals (IAPP) observed, "State-Level momentum for comprehensive privacy bills is at an all-time high." The IAPP maintains a map of state consumer privacy legislative activity, with in-depth analysis comparing key provisions.

We discuss the Virginia legislation here, along with legislative activity in several other states that seem likely to pass. It was California that enacted the first data-breach notification law, which became effective in 2003. In about 15 years' time, all U.S. states have such a law, as well as many jurisdictions around the world.

Whether it is the pending Virginia Consumer Data Protection Act (VCDPA), the California Consumer Privacy Act (CCPA), or a similar framework, there are several features that should be considered when examining the effects of such laws on an organization. shrm.org


New Minnesota Consumer Data Privacy Act is introduced

Tech Execs Call for Improved Public-Private Coordination After SolarWinds Hack
A wide-ranging hack of U.S. agencies and businesses last year highlights the need for the public and private sectors to coordinate more closely on cybersecurity, technology company executives told lawmakers.

The response to the attack on Austin, Texas-based software provider SolarWinds Corp. and other organizations was at times hindered by a lack of communication between businesses and federal departments, the executives said Tuesday at a hearing before the Senate Select Committee on Intelligence.

“That information too often exists in silos,” said Microsoft Corp. President Brad Smith. “It exists in silos in the government, it exists in different companies, it doesn’t come together.”

The tech executives called on security teams to share more information about threats in real time, with some urging lawmakers to create federal requirements for victims to notify authorities and create a single government body to collect cyber intelligence. wsj.com

Wawa Agrees to Pay Customers Up to $9 Million Over Data Breach
Wawa has agreed to pay customers up to $9 million and spend $35 million upgrading its cybersecurity to settle a class-action lawsuit stemming from a massive 2019 data breach that exposed customers’ credit and debit card information for over nine months.

Under a proposed settlement filed in federal court Friday, the convenience store chain would provide customers with up to $8 million in Wawa gift cards and pay up to $1 million in cash payments to affected consumers. The agreement must still be approved by a judge overseeing the case. inquirer.com

$140M E-Commerce Hub - 1M Packages Per Day
Gap to invest $140 million to build Texas warehouse as online sales swell
Gap said Wednesday it will invest $140 million to construct a distribution center in Longview, Texas, as part of its effort to double its online business over the next two years.

Upon completion, Gap said the 850,000-square-foot facility will be able to process 1 million packages per day. Initially, it will be used for Old Navy’s burgeoning e-commerce business, then expand to other parts of Gap’s business.

Gap expects the facility will create more than 500 full-time jobs by the end of 2023, and more than 1,000 over the next five years. It also should bring more than 1,000 part-time and seasonal jobs to the area by 2026.

Construction will begin in April. Gap expects it to be fully operational by August 2022.

The Covid health crisis has accelerated the shift to e-commerce and has forced many retailers to rethink their investments, and pour more money into supply chains and logistics. The e-commerce giant Amazon has announced several investments in its warehouses, including building new ones, as its retail business has boomed over the past year. Big-box chains Walmart and Target have found ways to utilize their stores as mini fulfillment centers, while Macy’s took two of its department stores late last year and converted them into pint-sized distribution centers.

While Gap’s sales have slumped from 2019 levels during the health crisis, with fewer Americans visiting malls and shopping for apparel, the company has seen rampant growth online. And it expects that to stick around.

Exton, PA: Pennsylvania State Troopers recover and donate stolen items to Chester County foster closet
The tiny offices at MAZI Adoption and Family Services looked more like a shopping mall today. "This is a result of a traffic stop in 2019," said Pennsylvania State Trooper Kevin Kochka. "The items that you see here were recovered as a result of an investigation done by our trooper that revealed a retail theft ring." Roughly 300 articles of clothing, 45 pairs of shoes, and 17 handbags have been idly waiting for a new home after they were recovered by Trooper Matthew Dwyer. The items were unable to be touched until a court arrived at final disposition for the offenders. "It would either be destroyed, donated, or given back to the original owner," said Trooper Kochka, who is a community service and public information officer with Troop J in Avondale. In this case, the items were collected from various outlets which had already received restitution. That left the troopers in a perfect position to make a donation to a brand new foster closet. "It's always been something that has been on our wishlist," said Simi Riesner, the Executive Director at MAZI, about starting a foster closet. "And just something that we didn't really have the means to do." This morning, that changed thanks to the Pennsylvania State Troopers' donation. Berks County, PA: Man wanted in check-fraud ring arrested
Muhlenberg Township man sought by Spring Township police as a leader of a check-fraud ring was apprehended Wednesday morning in Kenhorst. Isaiah Egziabher, 20, was found in a parked vehicle with two other people on Fern Avenue, Spring Criminal Investigator Cory Huntsinger said. The arrest came five days after Spring police, assisted by Muhlenberg police, went to Egziabher's residence after getting arrest and search warrants, as part of a yearlong investigation. Investigators seized a laptop, printers, check paper, a victim's checkbook and additional computer-related items. Some of the checks fraudulently produced were reproductions of legitimate checks of businesses and individuals, and the total loss in the case was in excess of $150,000, police said. In such a scheme, perpetrators attract partners through social media advertisements, targeting vulnerable people, such as those who are unemployed, with offers of quick cash in return for their participation, Huntsinger explained. The partners are paid to provide their debit card account information so bogus checks can be electronically deposited, then quickly withdrawn through an ATM or a money-transfer app such as PayPal, he said. news.yahoo.com

Erie, PA: 3 years later, duo arrested in $20K jewelry heist at Millcreek Kmart during 4-state spree
Two men wearing ball caps walked into the Kmart store on West 26th Street in Millcreek Township on the evening of April 22, 2018, and headed toward the jewelry counter. They walked out of the now-closed Kmart minutes later with more than $20,000 worth of stolen jewelry that one of the men stuffed into his pocket, according to Millcreek police. Township police issued an appeal to the public days after the theft, asking for help in identifying the suspects. Detectives released a portion of surveillance video from the store in hopes that someone would recognize the men and report what they knew.

A viable tip never came in, as Millcreek police never identified or charged any suspects in the crime. But the case would soon be resolved. And would grow. By October of 2018, a federal grand jury had indicted two men that federal investigators believe are responsible for stealing valuables from not only the Millcreek Kmart but from antique stores, a bowling alley and another Kmart store in four states. The crime spree that 38-year-old Shawn A. Pena and 54-year-old Michael Kiser are accused of committing stretched over 25 days and took them from Illinois to New Jersey, according to information in their indictments. Authorities charge that their crime spree netted the pair more than $88,000 in stolen cash and goods. The charges against Pena and Kiser and the details of their accused crime spree were revealed in an indictment that was unsealed in late January, once both men were in custody, according to court records. goerie.com

A New York man accused of being part of an identity theft ring faces up to 40 years in prison if he fails to pay back more than $10,000 in restitution and fines. Update: Peoria, IL: Two teens arrested in Peoria on Homicide charges related to Galesburg Gun Shop break-in
Two minors were arrested here this week in connection with the death of a Peoria teen during a botched robbery last month at a gun store in Galesburg. One of the teens, 17, was arrested on Tuesday, while the other, 15, was arrested on Thursday. Both were initially taken to the Peoria County Juvenile Detention Center, according to Peoria police spokeswoman Amy Dotson. Galesburg Police Chief Russ Idle said the teens are facing charges of burglary and first-degree murder in connection with the Jan. 6 incident at Galesburg Guns and Ammo.

The boys are charged under the state's felony murder provision, which holds that they are legally responsible for 17-year-old Daryl Keller's death even though they didn't shoot him. It was the shop owner who fired several shots at the group of teens who allegedly broke into the business late at night, but under that portion of state law, because the death occurred while the teens allegedly were committing a crime they bear responsibility for the death as a result. pjstar.com

A man was hospitalized Thursday morning with gunshot wounds he sustained following a fight with another man at a Target store in Gardena. The men began arguing around 10 p.m. Wednesday inside the store on W. Redondo Beach Blvd., and then started fighting, which alerted store security, according to Lt. Christopher Cuff of the Gardena Police. During the fight, one of the men pulled a gun and fired twice, striking the victim with both shots, then ran from the store in an unknown direction, Cuff said. A detailed description of the shooter was not immediately available. The victim was taken to a hospital in unknown condition and underwent surgery overnight. Handling the big question - Why did you leave? is the hardest of them all if, in fact, your departure was involuntary. Like Bum Phillips, the old Houston Oilers coach, once said at a luncheon I attended, "There's two types of coaches - those that have been fired and those who are waiting to be fired." And quit frankly he was almost dead-on as over 70% of executives will face involuntary departures from an employer during their career. The best position to take is one of absolute straightforwardness. Be open - be honest - and be reflective right from the beginning. But get it over quick and deal with it right at the beginning of the interview and don't make it a long-winded response. Certainly review it - rehearse it - make sure it answers the question. But get it out of the way and move on in your own mind. Look to the future and leave it behind you.
