Bay Area prosecutors have filed more than 1,200 felony petty theft cases under a tough-on-crime measure California voters overwhelmingly approved last year — but charging rates vary widely across the region as some counties more aggressively employ the new penalties.

Frustrated by viral smash-and-grab robberies, store closures and locked-up merchandise in the wake of the COVID-19 pandemic, nearly 70% of voters backed Proposition 36, which carried majorities in each of the state’s 58 counties.

The new law’s stricter penalties are proving helpful in combating retail theft, according to local prosecutors, law enforcement and retailers. But experts say it’s too early to judge whether it’s succeeding in reducing crime.

“We don’t have data yet that can seek to determine whether Prop. 36 has had any effect on retail theft,” said Magnus Lofstrom, a policy director with the Public Policy Institute of California, which closely tracks crime data across the state.

Proposition 36, which took effect in mid-December, empowers prosecutors to bring felony charges against repeat petty theft and drug offenders. It reversed a key facet of a landmark crime reform measure voters passed in 2014 that had reduced simple drug possession and most thefts of less than $950 to misdemeanors, which generally carry little jail time.

In San Mateo County — which experienced some of the largest spikes in shoplifting in the state during the pandemic — prosecutors filed 365 felony theft cases during the law’s first six months, according to the county district attorney’s office. No district attorney’s office in the nine-county region filed more. At 50 cases per 100,000 residents, the county had the highest charging rate in the region, according to a review of charging data by this news organization.

A permanent retail crime task force is proposed in King County to tackle retail theft, following Kroger's closure of six Fred Meyer stores.

A permanent retail crime task force is being proposed to address retail theft in King County, in response to Kroger shutting down grocery stores in western Washington. King County Council member Claudia Balducci, Kent Mayor Dana Ralph and former King County Sheriff Sue Rahr held a joint press conference on Thursday to unveil the proposal.

The task force would include two detectives and one prosecuting attorney dedicated to directly addressing the causes and responding to retail theft. Balducci says funding would come from the recently adopted county sales tax, and she estimates the program would cost $600,000.

The backstory: This comes after Kroger recently announced plans to close six Fred Meyer locations in western Washington, including in Kent, Everett, Tacoma, Redmond and Seattle.

The company cited "a steady rise in theft" as one of its reasons for shutting down the stores, despite crime data showing a decline in shoplifting at some of the closing locations.

The announcement of the closures has some in disbelief. "It's sad," said Joseph Rodgers, who lives near the Fred Meyer in Kent. "It's the only store convenient to us." fox13seattle.com

Retail theft, often referred to as “shoplifting,” has gained greater prominence in recent years due to increased media coverage. It has also become more salient in the national political debate. Most recently, the government has launched the National Retail Crime Strategy Delivery Plan (RCSDP) under the auspices of the National Business Crime Centre (NBCC). This is because the problem has become so significant, it can no longer be ignored.

361 IT and cybersecurity leaders reveal the ransomware realities for retail businesses today.

For the third year running, retail victims identified exploited vulnerabilities as the most common technical root cause of attack, used in 30% of incidents.

Multiple organizational factors contribute to retail organizations falling victim to ransomware, with the most common being unknown security gaps named by close to half (46%) of victims. It is followed in very close succession by a lack of expertise, which was a contributing factor in 45% of attacks — the highest rate recorded of any sector surveyed.

Data encryption in the retail sector has dropped to its lowest level in five years, with fewer than half (48%) of attacks resulting in encryption, down from a peak of 71% in 2023. In line with this trend, the percentage of attacks stopped before encryption reached a five-year high, indicating that retail organizations are strengthening their defenses.

However, adversaries are adapting: the proportion of retailers hit by extortion-only attacks (where data wasn’t encrypted but a ransom was still demanded) has tripled, rising from 2% in 2023 to 6% in 2025.

Rising ransom payment rates and declining backup use signal a shift in retail data recovery strategies

The percentage of retailers paying the ransom to recover data has nearly doubled since 2021 (from 32% to 58% in 2025, well above the 49% cross-sector average). Ransomware gangs maintain pressure on victims

From January to June 2025, the number of publicly reported ransomware victims jumped 70% compared to the same period in both 2023 and 2024. February stood out as the worst month, with 955 reported cases.

Cl0p alone was responsible for 335 of those cases, a 300% month-over-month surge that leveraged the mass exploitation of high-severity vulnerabilities in CLEO MFT platforms (Harmony, VLTrader, Lexicom), CVE-2024-50623 (remote code execution) and CVE-2024-55956 (command injection).

The pace of attacks slowed in Q2 2025, with 1,522 victims compared to 2,120 in Q1. This drop was likely the result of law enforcement crackdowns, rebranding pauses by major groups, and stronger corporate defenses.

New data from Adobe reveals the extent to which U.S. consumers are using generative AI to assist their e-commerce efforts. One of the major trends Adobe observed during the 2024 holiday shopping season was the usage of generative AI-based chat services and browsers.

Data from Adobe showed a major increase in AI-driven traffic to U.S. retail sites, during the 2024 holiday season. New data tracking U.S. online shopping through July 2025, based on direct transactions online and covering more than 1 trillion visits to U.S. retail sites, shows that generative AI traffic rose 4,700% year-over-year in July 2025.

Growth remained strong in the beginning of the year according to Adobe analysis, with generative AI traffic up 1,100% in January 2025 and up 3,100% in April 2025 as compared to July 2024, with Adobe determining generative AI traffic was too minimal to serve as a baseline before that time.

In an Adobe survey of 5,000 U.S. consumers, 38% reported having used generative AI for online shopping, with 52% planning to do so this year. Walmart’s eCommerce momentum continues unabated, as price-conscious customers pivot to digital channels for everyday items, notably grocery.

The company’s Thursday (Aug. 21) earnings release indicated that eCommerce sales were 26% higher than a year ago and digital sales for grocery were up double digits. Store-fulfilled delivery of grocery items were up 50%.

Las Vegas, NV: Suspect in retail theft arrested; taken into custody by ICE after posting bail

The Las Vegas Metropolitan Police Department's Organized Retail Crimes Unit concluded a three-month investigation with the arrest of Javier Becerril-Solis, 49, in connection with an illegal fencing operation. Detectives determined that Becerril-Solis was purchasing stolen items from individuals who had taken them from local retail stores. He allegedly resold these items at a discounted price at a local swap meet. On August 21, investigators executed search warrants at multiple locations, recovering $100,280 worth of shoes, purses, designer clothes, toys, and over-the-counter medications. Becerril-Solis was arrested and booked into the Clark County Detention Center on charges of participating in an organized retail theft ring involving more than $10,000, burglary, and grand larceny of $3,500 or greater. Becerril-Solis was released on bail but was immediately taken into custody by Immigration and Customs Enforcement on August 22. news3lv.com

Athens, GA: Private investigators discover stolen goods using RFID scanners at flea market
Athens-Clarke police said Thursday that more than $100,000 worth of stolen merchandise was recovered recently following an investigation that began after three private investigators located stolen clothing being sold at a flea market in Athens. The investigation led to the arrests of an Athens couple, 34-year-old Carlos Alfredo Analco Lopez, and his 29-year-old wife, on felony charges of theft by receiving property. A hold was placed on Lopez by the U.S. Immigration Customs Enforcement due to his immigration status. The arrests followed an investigation by private investigators hired to search for items stolen from Lululemon, a store that sells athletic wear, according to an Athens-Clarke police report. The three investigators were at the J&J Flea Market on Aug. 9, where they used an RFID scanner (radio frequency identification) on some goods being sold by a woman at the market, according to the report. onlineathens.com

Montgomery County, PA: Regional High Value Retail Theft Ring Busted In Montgomery County
According to authorities in Montgomery County Pa, Balvin Greene,32; Terrell Jackson, 39; and Kristopher Heard, 38, all of Philadelphia allegedly operated a retail theft crew that targeted Home Dept stores in Philly, Bucks and Montgomery Counties. According to court records, the trio would to the stores, grab high-value goods including Ryobi pressure washers, air conditioners, battery starter kits, Shark vacuum cleaners and Milwaukee Battery Chainsaws. They walked out of the store without paying for anything and then sold the items to a fence in Philly who placed the items for sale at below market prices. Police said the trio was responsible for 38 thefts that exceeded $50,000. On Aug. 14, 2025, search warrants and arrest warrants were executed in multiple locations in Philadelphia. These operations led to the recovery of approximately $10,000 in stolen goods, $2,000 in cash and illegal drugs.   delawarevalleynews.com

Burglars broke into an East Memphis shop and stole $6,000 worth of smoke and vape products along with $300 in cash, the Memphis Police Department (MPD) said. Officers responded to the burglary at a Vapor Wize store on Poplar Avenue just before 4:30 a.m. Saturday. Police said Sunday's break-in and burglary happened in the 3300-block of South Martin Luther King Drive just after 6 a.m. A suspect drove a Jeep SUV through the business' front entrance, police said. A group of thieves then got out of the SUV and took property from inside, specifically track suits and Nike Air Jordans. The suspects got back into the SUV and fled the scene in an unknown direction. No injuries were reported. Burglars also used a Jeep to smash into the Foot Locker on South Martin Luther King Drive back in August 2024. The Foot Locker location remained closed Sunday and it was unclear when they would reopen.   abc7chicago.com

Milledgeville, GA: Buffalo Wild Wings manager shot and killed
The manager of Buffalo Wild Wings in Milledgeville was shot to death during a fight with an employee outside the restaurant Saturday night, The Union-Recorder has learned. The case is under investigation as a homicide. The employee reportedly involved in the fight and his brother are being detained and questioned about the fatal shooting. Milledgeville Police Department Road Patrol Commander Maj. Linc Boyer said the police received a telephone call about 6 p.m. in reference to an altercation at Buffalo Wild Wings, located in the Milledgeville Mall shopping center off North Columbia Street. unionrecorder.com

Columbia, SC: Man killed in late-night shooting at Columbia C-Store
Authorities say one person has died following a shooting at a Columbia gas station on Friday night. A Columbia Police spokesperson said the shooting happened around 10 p.m. at 3213 Farrow Road. Officers arrived to find the victim, a man, with one or more gunshot wounds to the upper body. Police said he was taken to an area hospital but died from his injuries. wltx.com

Shelby County, TN: 18-year-old killed in Cordova shooting outside Tobacco shop
The Shelby County Sheriff’s Office says an 18-year-old was shot to death outside of a store in Cordova on Friday evening. The sheriff’s office says deputies found a man who had been shot in his vehicle at around 5:40 p.m. in a parking lot at the intersection of Berryhill Road and Chimneyrock Boulevard. The sheriff’s office later identified the victim as 18-year-old Antonio Sykes, Jr. The shooting is being investigated as a homicide. The Shelby County Sheriff’s Office has not released information on a possible suspect, but says the investigation is ongoing. localmemphis.com

Pico Rivera, CA: 13-year-old boy killed at Pico Rivera gas station, gunman at large
A 13-year-old boy was shot and killed late Saturday at a gas station in Pico Rivera while waiting for his relative to get off work, and Los Angeles County Sheriff’s Department homicide detectives are searching for the gunman. The shooting was reported around 11:45 p.m. on Aug. 23 in the 8800 block of Whittier Boulevard, according to LASD. The victim, described only as a 13-year-old male, was pronounced dead at the scene. ktla.com

Milwaukee, WI: Gas Station shooting at 91st and Silver Spring; 19-year-old charged
A 19-year-old Milwaukee man is accused of shooting and wounding another person at a gas station near 91st and Silver Spring. The accused is Kemonte Jefferson, – and he faces the following criminal counts: According to the criminal complaint, Milwaukee police were dispatched on Friday night, Aug. 15 to investigate a shooting complaint near 91st and Silver Spring Drive. When officers arrived on the scene, they made contact with a person who was shot and wounded. That person was taken to Children's Wisconsin for treatment of a gunshot wound. fox6now.com

Memphis, TN: Man arrested after shooting seriously injures man outside store
Police arrested a man in connection with a North Memphis shooting that critically injured another man outside of a store, records show. Officers responded to the shooting at the 1200 block of Hunter Avenue just after 9 p.m. The victim told police his friend was about to fight another man. Guns were drawn, but the victim's friend told him to put his gun away because only a fistfight would to occur. When the victim placed his gun in his truck, the other man pulled out a pistol and started shooting at him and his friend. The victim was shot four times in the back and once in each leg, records show. According to the police report, he returned fire before being transported to Regional One in critical condition. fox13memphis.com
