FDA Escalates Enforcement Actions
After Youth Tobacco Survey

Historic Milestone - One Million Retailer Inspections
FDA Will Be Inspecting Your Stores

FDA outlines data from FDA/CDC 2018 National Youth Tobacco Survey showing rise in under-aged tobacco use and hints at next steps.

On Monday, Feb. 11, FDA Commissioner Scott Gottlieb, M.D. released a statement on new data demonstrating rising youth use of tobacco products and the agency's ongoing actions to confront the epidemic of youth e-cigarette use.

Gottlieb's statement is as follows:

Today, the U.S. Centers for Disease Control and Prevention (CDC) released additional data from our joint FDA/CDC 2018 National Youth Tobacco Survey. These data are a sobering reminder of the initial results we shared last fall indicating a rampant rise of youth e-cigarette use, which has prompted the FDA to take a series of escalating regulatory actions as part of our Youth Tobacco Prevention Plan. We are advancing those actions, and committing to some new steps.

The epidemic use of e-cigarettes among children is one of the biggest public health challenges currently facing the FDA.

FDA pulls up Walgreens & Circle K:

1,500 Warning Letters - 240 Fines - Threatens to Shut Down Cig. Sales

Walgreens is currently the top violator among pharmacies that sell tobacco products, with 22% of stores inspected selling to minors.

"I will be writing (to) the corporate management of Walgreens and requesting a meeting with them to discuss whether there
is a corporate-wide issue related to their stores' non-compliance," FDA Commissioner Scott Gottlieb said.

The agency
filed complaints seeking to bar a Walgreens store in Miami, Florida and a Circle K store
in Charleston, South Carolina, owned by Alimentation Couche-Tard Inc, from selling tobacco products for 30 days.

Thursday’s action against Walgreens follows over
1,550 warning letters and 240 civil money penalty actions against its stores nationwide for unlawful tobacco product sales to minors, the agency said. reuters.com

Intellicheck's ID Authentication Solutions Prove Effective in Stopping Use of High-Tech Fake IDs

The FDA crackdown on retailers selling e-cigarettes and vaping products is the latest step in national efforts to curb what the Surgeon General has declared an epidemic of e-cigarette use among youth nationwide. The growing scrutiny of minor's access to age-restricted products comes as retailers across the country are facing serious challenges from the widespread use of fake IDs. Inexpensive and readily available, these sophisticated fakes are helping young people gain access to age-restricted products, venues and events, in addition to aiding criminals with identity theft in instant credit applications, non-receipted returns, or when returning stolen merchandise.

Intellicheck CEO Bryan Lewis explained that the only way to curb the surge in underage use of vaping products is to stop underage access. "Fake IDs are far too easy to get and technology has made old-school methods of spotting fake IDs ineffective. The manufacturers of these fake IDs excel at the physical security features such as holograms, so they will pass the black light test and other visual checks, and can be scanned using industry scanners with limited functionality. Age ID is a cutting-edge technology solution. It doesn't just scan IDs, it actually authenticates these IDs."

Using Age ID, retailers and law enforcement agencies nationwide are authenticating millions of IDs, including driver licenses and other government-issued, bar-coded identification credentials. Intellicheck's 2018 metrics on Age ID scans by retailers selling alcohol, tobacco and cannabis stopped an overwhelming 2.5% of IDs identified as fakes.

More than fifty law enforcement and compliance agencies across the country are currently using Age ID on their mobile devices. The 2018 data on law enforcement or agency use of Age ID shows 6.94% of IDs scanned were found to be fake. These higher numbers reflect the fact enforcement agencies scan all ID holders in their compliance checks.

"Loss prevention or asset protection is about much more than items walking out of the store. It is also about protecting yourself from fine or censure, or a potential loss of a revenue stream. Retailers are under daily assault, and that's why whether the challenge is stopping the use of fake IDs for age-restricted product purchases, preventing the use of fake IDs to establish or use credit, protecting your brand from fraudulent returns, or stopping fraudulent in-store or card-not-present purchases, retailers need state-of-the-art technology to protect the bottom line," said Lewis. "Honestly, how many of us can say they really know what the driver's license from a neighboring state looks like? Criminal technology has outpaced the human eye."

Intellicheck's proven technology solutions for a retail environment include a comprehensive suite of Retail ID products that are equally effective in store at the point-of-sale, online or for mobile devices. Retail ID is not only easy to implement and frictionless to the consumer, it is also seamless and frictionless for the staff scanning the ID. Budget friendly and easy to adopt, Retail ID solutions avoid the concerns that come with complex multilayered requirements requiring high IT development costs. Like Age ID, Retail ID authenticates the ID in real time and has proven 99.9% effective. Retail ID will immediately alert the user if an ID is fake. Intellicheck technologists are constantly evaluating fake barcodes and responding with software updates to defeat new threats as they continually evolve.

Numerous studies show consumers closing accounts, changing stores, and even reducing their payment card usage in response to fraud. Those same studies show consumers don't blame the fraudsters, they blame the retailer.

Age ID's real-time, accurate results, and simplicity in adoption and use, have made it an effective solution to the problem of young people seeking access to age restricted- products and venues. The innovative technology solution is being used nationally by businesses of all sizes including bars, restaurants, alcoholic retail outlets, vape and tobacco stores, cannabis stores, at sporting and concert events where age-restricted products are sold, and at age-restricted venues, as well as by enforcement agencies. Retail ID product solutions are preventing fraud for Fortune 100 and Fortune 500 retailers including nationally recognized department stores, jewelry, furniture, and tools and equipment retailers across the country.

Using Intellicheck's "Law ID" app on Investigator's Smartphones

On August 3, 2018, Governor Cuomo announced the launch of a new DMV pilot program using state-of-the-art technology to crack down on underage drinking and the use of fake IDs. The new technology, developed by New York-based company Intellicheck Inc., allows law enforcement to scan a license or ID using the Intellicheck "Law ID" app on the investigator's smartphone and match it against driving records from all 50 states. Within seconds, investigators know if an ID is authentic or not. New York's is the first DMV in the nation to pilot the Law ID app. Later this month, additional DMV investigators will begin using this technology in the field.

DMV Executive Deputy Commissioner and GTSC Acting Chair Terri Egan said, "With the help of new technology, our investigators can detect even the most sophisticated fake IDs."

On May 9, Governor Cuomo announced that during underage drinking sweeps conducted in April 2018, the State Liquor Authority charged 200 businesses with selling to a minor, and DMV made 48 arrests of persons under 21 attempting to use false identification to purchase alcohol.

NY will be conducting statewide sweeps of locations holding liquor licenses, including bars, restaurants, liquor stores and grocery stores, looking for fake IDs and illegal sales to minors.

"Underage drinking can lead to bad decisions that could have lifelong consequences, or worse, and this administration is committed to taking proactive measures to prevent young New Yorkers from purchasing and abusing alcohol," Governor Cuomo said. ny.gov
