What's gained and lost when retailers drop firearms sales
Two of the nation's largest retailers in the category, Dick's Sporting Goods and Walmart, reduced the retail availability of guns this year when they began to limit or eliminate firearms and ammunitions from their retail floors ahead of the holiday shopping season. The end result may be that the impact of Walmart's and Dick's firearms retailing decisions on both their holiday sales and the sales of rival stores such as Cabela's may be negligible. But that doesn’t mean it's not instructional. retaildive.com

Sensormatic Solutions releases its ShopperTrak 2019 Black Friday weekend shopper traffic recap

Data indicates winter storm and buy online, pick up in store (BOPIS) trend impacted shopper traffic for Black Friday weekend and Cyber Monday

Johnson Controls today announced that Sensormatic Solutions, its leading global retail solutions portfolio, released a comprehensive ShopperTrak recap of shopper traffic during Black Friday weekend 2019, the period spanning Thanksgiving Day, Nov. 28, 2019, through Sunday, Dec. 1, 2019.

After all data was tallied, the final results found that store traffic on Thanksgiving resulted in a 0.8% decrease and store traffic on Black Friday resulted in a 4.4% decrease. Uber Releases 1st Ever 2 Yr. Safety Report
5,981 Sexual Assaults & 9 Murders in 2 Years

Uber said it received 5,981 reports of sexual assault involving U.S. passengers or drivers during 2017 and 2018, underscoring the risk that has been a chief criticism of ride-hailing companies around the world.

In 2018 more than 3,000 sexual assaults were reported during its U.S. rides in 2018. Nonconsensual touching was the most prevalent type of sexual assault that occurred.

There were 515 incidents of rape or attempted rape in 2018.

The Thursday report, which the company hailed as the first of its kind. It is part of the company's effort to be more transparent after years of criticism over its safety record.

In 2017, the company counted 2,936 reported sexual assaults — including 229 rapes — during 1 billion U.S. trips. Uber bases its numbers on reports from riders and drivers, meaning the actual numbers could be much higher. Sexual assaults commonly go unreported.

Uber and Lyft have both formed partnerships with sexual assault prevention networks and other safety groups, and have touted their background check policies for drivers. But many say they haven't gone far enough to protect passengers and drivers, who are contract workers for the companies.

Bomberger, a lawyer representing more than 100 victims of sexual assault in lawsuits against Uber and Lyft, said he believes 80% to 90% of the assaults in the Uber report could have been prevented by measures such as cameras in the cars recording rides and the companies reporting every assault they learn of to the police.

The company also said Uber rides were involved in nine murders during 2018, and 10 during 2017. Uber noted that the vast majority — 99.9% — of its rides had no reported safety issues.

Uber said in its report that during 2017 and 2018, more than a million prospective drivers didn’t make it through Uber’s screening process. wsj.com

U.S. Department of Labor Posts Retail-Focused Blog
"Tips for Protecting Workers’ Safety and Pay This Holiday Season"

Young & New Retail Workers - Simple But Critical to Repeat Every Year
As an increase in hiring for the coming holiday season is upon us, there are a few things to remember to ensure that workers go home safe and healthy at the end of their shift and receive the wages that they’ve earned.

If you're not familiar with hiring seasonal workers, you should know that employment rules under federal labor law apply to all workers. The U.S. Department of Labor’s Office of Compliance Initiatives offers compliance assistance through Worker.gov and Employer.gov, which give an overview of rights and responsibilities regarding federal labor laws, as well as where to go for help. Here are some tips to keep in mind:

Safety and Health Tips

All workers – especially young employees and those new to the work environment – need to know they have the right to report safety concerns at any time, without retaliation. Safety takes teamwork, which means everyone needs to know the rules and feel comfortable speaking up. Employers should also know that certain hazardous jobs are prohibited for young workers.

Whether workers are stocking shelves, packing boxes, delivering products, or selling merchandise, it’s important to give clear instructions for each task. New or seasonal workers may be unfamiliar with seemingly common tasks. OSHA can help employers and workers understand the requirements to provide hands-on training for using equipment, how to recognize hazards, and what to do in an emergency. dol.gov

FaceFirst, the leading U.S. computer vision company, is working closely with D.C. lawmakers to influence future facial recognition regulations.

A team of FaceFirst executives, led by FaceFirst President and CEO Peter Trepp, recently traveled to Capitol Hill to help the bipartisan Commercial Facial Recognition Privacy Act of 2019 (S. 847) move forward. The FaceFirst team briefed bill co-sponsor Senator Roy Blunt's office on the need to protect consumer privacy while still allowing the public to benefit from this transformative technology.

Since the meeting, FaceFirst has continued to work actively with Congress, making comments to the bill to ensure its language is very clear and specifically carved out for retail loss prevention use, while protecting honest consumers' privacy in an opt-in-only scenario for personalization.

"While we're seeing rapid market adoption of facial recognition technology, there remain valid concerns that this technology needs to be regulated and used responsibly," stated Trepp. "Regulations are necessary guardrails for protecting privacy, but it's essential that they don't unduly compromise public safety or stifle innovation."

"Congressional lawmakers see and understand that retailers need facial recognition technology to combat organized retail crime, shoplifter recidivism, and to keep their employees and customers safe," stated FaceFirst Chief Revenue Officer Dara Riordan. Due to high levels of recidivism, ORC costs the U.S. retail industry $46.8 billion every year according to the National Retail Federation.

7 in 10 Cameras Are Running Outdated Firmware
According to research conducted by Genetec, outdated camera firmware, and failing to change default passwords present some of the biggest weaknesses in cybersecurity defense and as the number of interconnected security devices keeps on growing, keeping pace with the latest updates can be tricky and very time-consuming.

Installing the latest firmware is not just about accessing exciting new features, warns the research: "It ensures the latest cybersecurity protection measures are implemented as soon as they become available, a crucial step in ensuring an organization’s resilience against cyber-attacks."

“Our primary research data points to the fact that more than half of the cameras with out of date firmware (53.9 percent) contain known cybersecurity vulnerabilities. By extrapolating this to an average security network, nearly 4 out of every 10 cameras are vulnerable to a cyber-attack,” said Mathieu Chevalier, Lead Security Architect at Genetec.

“Unfortunately, our research shows that the “set it and forget it” mentality remains prevalent putting an entire organization’s security and people’s privacy at risk. All it takes is one camera with obsolete firmware or a default password to create a foothold for an attacker to compromise the whole network,” securitymagazine.com

Proposed GOP Federal Privacy Bill Would Supersede All Existing State Laws
After several moves by Democrats to introduce federal privacy legislation, Republican Senator Roger Wicker of Mississippi on Tuesday unveiled a draft consumer privacy bill, the United States Consumer Data Privacy Act of 2019, that would override various state laws on privacy, including the California Consumer Privacy Act.

Wicker claims that compared with California's law, which goes into effect in January, his proposed federal legislation has more detailed consumer protections, covers more companies and has more explicit requirements that companies collect the minimum amount of personal data needed for their purpose, according to Reuters.

Last week, U.S. Sen. Maria Cantwell, D-Wash., introduced another federal privacy bill, the Consumer Online Privacy Rights Act, which intends to expand the rights of individuals when it comes to how their personal data is collected, shared and used. Unlike Wicker's bill, however, Cantwell's would not pre-empt state privacy laws, including CCPA. govinfosecurity.com

Chinese hackers dominating online attacks, holiday-shopping fraud

A quarter of Black Friday purchases suspected to be fraudulent – and China blamed for 57 percent of them

China continues to cement its reputation as a global epicentre of online crime, with new analysis blaming Chinese and Russian hackers for most of this year’s attacks, and Chinese cybercriminals driving a 60 percent surge in Black Friday weekend fraud over the last two years.

Fully 63 percent of online retail transactions were completed using a mobile phone over the four-day shopping weekend and suspected online retail fraud increased 29 percent compared with a year ago, according to new research from TransUnion fraud-detection subsidiary Iovation that also found that suspected e-commerce fraud had increased by 60 percent since 2017.

The figures validated concerns identified in TransUnion’s recent 2019 Holiday Retail Fraud Survey, in which 46 percent of surveyed consumers said they were concerned with being victimised by fraudsters this holiday season. Fully 25 percent of Black Friday purchases were suspected of being fraudulent, as were 21 percent of Cyber Monday purchases – compared with 19 percent and 17 percent, respectively, on the intervening Saturday and Sunday.

The most common source of suspected fraudulent traffic was China, which was flagged as the source of 57 percent of suspected fraud – equal with the Central African Republic (57 percent) and handily ahead of Lebanon (45 percent). cso.com

How Amazon Dodges Responsibility for Unsafe Products:
The Case of the Hoverboard

Courts are starting to challenge the idea that big tech companies are mere platforms connecting buyers and sellers

The Wall Street Journal obtained government investigation reports for that and 56 other hoverboard fires, explosions and similar issues from the end of 2015 to the first few months of 2016, household disasters that were a bleak feature of that Christmas season. Together the fires caused at least $2.3 million in property damage and a handful of minor injuries.

What followed were at least 17 lawsuits against Amazon.com Inc. from insurance companies and families, including the Foxes, relating to problems with hoverboards largely shipped from unknown factories in China. Around half of those legal battles are still active.

The cases are testing a longtime argument made by Amazon and other internet companies, one that underpins the modern tech industry. We are just operating a platform that connects buyers and sellers, the argument goes. It’s up to the sellers who use our site to make sure that they meet proper safety standards. A similar argument is made by ride-sharing companies, online babysitting services and social-media platforms. wsj.com

$10 Million Best Buy Burglary Ring
Tulsa, OK: Burglary Ring Suspects Accused Of Crimes Across The State, Arrested
Police arrested a team of suspected burglars after a break-in at a Best Buy, Sunday in Tulsa. Officers said they're part of a burglary ring that stretches from Texas to the Canadian border. Tulsa police said they're responsible for break-ins across the state, and the country. Authorities said Aaron Davis, Dequincy Dunn and Jevonte Morgan have hit Best Buys in Oklahoma before. In August, Best Buy stores in Tulsa were burglarized. Then, last week the three targeted the Owasso Best Buy. And just a couple days ago, an Oklahoma City Best Buy was broken into.

They're allegedly responsible for about $10 million of stolen merchandise from Best Buys across the nation. Sunday morning, the Tulsa Police Burglary Unit set up a sting at three Best Buy stores in town. They said Aaron Davis was caught on surveillance camera breaking the glass at one of the locations. Davis, along with the other three, went in and stole all the Apple products from the display, about $20,000 worth of merchandise. Tulsa police caught him as he was running from the store. Investigators went to the hotel he was staying at and found Dunn and Morgan in the room with more loot from Best Buy.

Officers said Morgan confessed to the Oklahoma City Best Buy burglary. Davis has previous felony convictions. Dunn has an outstanding warrant for his arrest and will be moved to Texas. The three are waiting for their day in court. News On 6 is still waiting for information about the fourth suspect. newson6.com

(Update) Former CVS Employee Gets 30 Months For Stealing Over $2 Million Worth Of Diabetic Test Strips
Antonio Rivera, 36, of Williamsville, NY, who was convicted of wire fraud, was sentenced to serve 30 months in federal prison.

In July, 2018, CVS's internal systems red flagged the purchasing of diabetic test strips at a CVS located in Rochester, NY. A package located in the store’s shipping area did not have a CVS label, included Rivera’s return address, and came from a company with which CVS does not do business. A subsequent internal investigation by CVS determined that Rivera routinely purchased diabetic test strips in excessive amounts, well over the need for that CVS location. The audit could not account for 20,203 boxes purchased by Rivera, for a total financial loss of approximately $2,535,307.62.

The defendant ordered surplus diabetic test strips and then intercepted the shipments once they arrived. He then sold the stolen product to a third party located in the State of Florida. A forensic accounting of Rivera’s bank accounts identified deposits which represented payments for the fraudulently obtained diabetic test strips that he sold. justice.gov

A South Carolina deputy accidentally shot a shoplifting suspect's mother
A South Carolina sheriff's deputy is under investigation after she unintentionally shot the mother of a shoplifting suspect while attempting to make an arrest, officials said. The October 20 incident occurred after the deputy recognized the suspect in a shoplifting video from a convenience store and went to his home in Greer, South Carolina, to arrest him. The sheriff's office has identified the shoplifting suspect as Sean Theodore Kaiser.

The encounter between Kaiser and the deputy, who has not been identified, was captured by her body camera and released by the sheriff's office Wednesday. Video from the camera shows the deputy arriving at Kaiser's home in, where he is standing outside and confirms that he had been at the store where the shoplifting took place. As the deputy begins reading Kaiser his rights, he goes inside the home and she grabs his sleeve and follows him, the video shows. Inside the house, the deputy tries to negotiate Kaiser's surrender for several minutes, while his mother pleads for him to comply.

At one point, Kaiser grabs the deputy's wrists as she tries to take him into custody, the video shows. Later, his distraught mother can be seen attempting to hold Kaiser back, but he gets away and charges at the officer. She fires and misses him but strikes his mother, who was standing behind him, the video shows. A neighbor can also be seen in the video. Kaiser was arrested by another deputy who responded to a call for backup. rockdalenewtoncitizen.com

Delaware County, PA: Kim Kardashian Calls for Release of Man Being Held on Nearly 30-Year-Old Shoplifting Charge
Kim Kardashian continues to crusade for criminal justice reform by seeking the release of a Pennsylvania man. On Thursday, Governor Tom Wolf commuted David Sheppard's life sentence. Sheppard served 25 years in prison for his role in a 1992 robbery during which his accomplice shot and killed a man. Yet instead of living his life as a free man, Sheppard was re-arrested upon his release and sent to the Delaware County jail. Authorities in Delaware County are holding Sheppard because of an outstanding warrant that stems from a shoplifting incident. Sheppard is accused of stealing five pairs of jeans worth $324.95 from the Jeans West store in 1992. This was prior to him being sentenced to life in prison. And to make matters worse, the store has been out of business for a while. complex.com

When you think you've got your job mastered think again. That's usually when something bad happens in ones career or company. If you reach that point, and most everyone does, its time to re-evaluate everything you're doing. Go on the hunt for new technology, new ideas, rewrite your program, take a fresh look at every aspect of your department and maybe even bring in a consultant you don't know or have ties to. Someone who will challenge you and debate with you, and won't be there to merely confirm what you're doing and agree with your approach. But someone who will test you and force you to grow someone who you may even be uncomfortable with. Get out of your comfort zone and have some fun!

Just a Thought,
Gus
