Wisc. Supreme Court Rules Multiple Shoplifting Cases Can Count as Single Felony
The Associated Press reports that the ruling stems from a case in Green County. Prosecutors there charged Autumn Marie Love Lopez and Amy Rodriguez with a felony in 2017 in connection with seven incidents of shoplifting at a Monroe Wal-Mart. According to court documents, Lopez worked at the Wal-Mart and voided out purchases Rodriguez made at a self-checkout register. They allegedly stole $1,452 worth of merchandise.

The women argued that prosecutors can't combine shoplifting counts into a single charge and they should instead face multiple misdemeanor counts. The Supreme Court disagreed, ruling 5-2 on Thursday that Wisconsin statutes allow for multiple thefts to be prosecuted as a single crime and the definition of the crime includes retail theft. The women's attorney didn't immediately return a message. cwbradio.com

Anchorage retailers & PD take new measures to discourage shoplifters
Shoplifting Increase Questioned by Anchorage PD

That spike isn't necessarily because more shoplifting is happening as much as
"it's about more people getting caught due to more officers on the street," APD spokesman MJ Thim said in an email.

Some Anchorage retailers, like Andy's, have cracked down on shoplifting over the last few years. Stores are putting more merchandise under lock and key and examining customer traffic patterns in stores. The Fred Meyer store in Midtown closed off one of its entrances in an effort to curb the problem. The Anchorage Police Department has also
stepped up enforcement. Arrests for shoplifting have spiked since 2016.

Shoplifting arrests by the Anchorage Police Department dipped in 2016 and then spiked the next two years. In
2015, the city made 2,263 arrests for shoplifting, and that dropped to 2,030 the following year. In 2017 there were 2,406 arrests, and last year 2,504. Up 23% Over 2016.

"The increased enforcement will certainly increase arrests in the short term, and
we expect it to decrease overall theft in the long term," Thim said.

Another major effort from Anchorage police is what the department calls its
"retail blitz" or "retail detail" program, which started in late 2017. Two of those blitzes last year at Fred Meyer stores - in Midtown and East Anchorage - resulted in dozens of arrests through sting operations. stockdailydish.com

Walnut Creek, CA: Black Friday Fur Protest Inside Store Following Statewide Ban on Fur Sale
Direct Action Everywhere (DxE) animal rights activists demonstrated at a Walnut Creek fur store on Black Friday, less than a week after the store's opening. A woman, Cassie King, masqueraded as a manager, welcoming customers into the store with satirical enthusiasm, describing the violent, cruel ways animals in the fur industry are treated and killed.

This comes amid a
wave of retailers, fashion designers and celebrities dropping fur, and as California became the first state to ban fur sales just last month. (The California ban is set to go into effect on January 1, 2023.) indybay.org

Thanksgiving Weekend Sales Performance

Black Friday shopping at brick-and-mortar stores dropped by 6% as consumers spent record online
Black Friday sales for brick-and-mortar stores dropped 6.2% after shopping on Thanksgiving Day rose 2.3%, according to ShopperTrak data.

The pullback in brick-and-mortar stores mirrored a surge in Black Friday online shopping, which hit $7.4 billion, an all-time record for the day, according to Adobe Analytics.

Sensormatic Solutions Releases Black Friday Results
from ShopperTrak Traffic Data Analytics

Johnson Controls announced that Sensormatic Solutions, its leading global retail solutions portfolio, released preliminary shopper visit data for brick-and-mortar retail stores and shopping centers on Thanksgiving Day and Black Friday. Findings indicate that shopper visits resulted in a combined 3 percent decline for the two-day period compared to last year. However, we saw a shift that included a
2.3 percent increase in traffic on Thanksgiving Day and a 6.2 percent decline in traffic on Black Friday versus 2018. Additionally, there was a small shift of in-store traffic away from the beginning of the week and into both Thanksgiving and Black Friday, dispelling the idea that in-store traffic is moving away from the holiday and farther into November.

"There is no longer one way to shop on Thanksgiving Day and Black Friday. As omnichannel retail and online shopping continue to grow in popularity, consumers turned to emerging fulfillment solutions, like buy online, pick up in store (BOPIS), this year," said Brian Field, senior director of global retail consulting for ShopperTrak. "As a result of these shopping options, there is a rise of intentional shoppers in-store. During exceptionally busy times, these customers are more intent on purchasing and less on just browsing, making their BOPIS pickup when the stores aren't as crowded."

"Black Friday continues to remain the busiest shopping day of the year by a long shot," said Field. "Shopping in physical stores during the holidays continues to be an exciting annual event for consumers. With
eight of the 10 predicted busiest shopping days still to come, including Super Saturday, which will fall on Dec. 21 this year, retailers are in for a successful holiday season." businesswire.com

Black Friday - Winners & Losers
2019 The Tipping Point Between Digital & Real World

Adobe Analytics estimates that the sales for the full weekend (Thanksgiving through Cyber Monday) will top
$29 billion, or 20% of total revenue for the full holiday season, up from 19% last year.

By the end of Black Friday, retailers had rung up a record
$7.4 billion in online sales alone, just shy of the record $7.9 billion during last year's Cyber Monday event, according to Adobe Analytics.

It's a marked shift, seen especially on mobile, that underscores how retailers have finally caught up to consumers when it comes to seeing no daylight between online and offline channels. "This is the year that will go down in the
history books as the tipping point between digital and real world," Jon Reily, head of global commerce strategy at Publicis Sapient, told Retail Dive in an interview. "We knew it was coming and 2019 is the year."

Winner: Mobile

U.S. digital sales grew 17% to $4.1 billion, according to Salesforce on Thanksgiving Day. Mobile orders increased 35% on Black Friday this year, with 65% of all e-commerce flowing through a mobile device, Salesforce also found. Of the more than $900 million total sales made by Shopify merchants, 69% of purchases were made on mobile, with the remaining 31% on desktop.

Winner: Stores with pickup services

One out of every five online purchases will be picked up in the store.

Loser: Retail margins

Of the 32 retailers visited by Coresight this past weekend, 25 offered promotions, with discounts averaging 37% to 47%. "Shoppers seemed motivated by Black Friday deals this year." retaildive.com

Coresight Research: Holiday 2019: US Black Friday Insights
On November 29, the Coresight Research team undertook its
annual tour of stores for Black Friday. We visited 65 stores of 32 different retailers in the US. We had shoppers in New York, New Jersey, Hawaii and Illinois, at outlets, luxury malls, downtown locations, neighborhood centers and regional malls. In this report, we analyze each store according our proprietary BEST framework for physical retail.

Store activity varied greatly: There were long lines at American Eagle Outfitters, Bed Bath and Beyond, the Nike Outlet, Old Navy and Target; but there were no wait times at Costco and drugstores.

Ann Taylor, Bed Bath & Beyond, Bloomingdale's, Ulta Beauty and Walmart were the top five retailers this Black Friday, ranked according to Coresight Research's BEST framework.

Of the 32 retailers visited, 25 offered promotions, with discounts averaging 37-47%.

Houston, TX: Target customer files federal discrimination lawsuit after she's wrongly accused of stealing
Newly released security video shows man filling $300 vacuum box with junk

A woman filed a federal lawsuit against Target after she says she was discriminated against and accused of stealing. Annie Banerjee, an Indian born Houston immigration attorney, bought what she thought was a $300 brand new Dyson vacuum cleaner from Target on San Felipe Street in the Galleria area. But what she ended up with was a box full of junk, including dirty towels, rocks and a can of chili.

In
newly released security video from inside the store released by Target, you see a man with a small child in his shopping cart entering the store. That same man is then seen taking off the anti-theft device on a brand new Dyson vacuum cleaner. Also, in his shopping cart, you see what Banerjee's attorney calls a "dummy Dyson box," full of junk. The video shows him placing the dummy box on the floor and paying for some other merchandise before leaving the store. The video also shows an employee wrapping the dummy box with the junk inside with the anti-theft device before putting it back on a store shelf. click2houston.com

Leftovers

As I’m still recovering from Thanksgiving weekend which included endless amounts of turkey, potatoes and desserts I thought that writing about the importance of “leftovers” would be fitting. The dramatic event of a Thanksgiving dinner is the highlight of the weekend (and a few football games), but I think most would agree that leftovers from that meal are on another level. Now this may be a stretch (similar to the pants I prefer to wear on Thanksgiving day), but I think we can compare an investigative interview to this illustrious meal. The preparation and planning, the stress and drama, the awkward feeling at the end when nobody is sure when to leave – all direct translations. Truth be told, I think the leftovers of an interview are often underappreciated.

Let’s take a look at what’s still in the fridge after the interview took place: Read more here

Joker's Stash Advertises More Stolen Payment Card Data
Tis The Season - Bad Cards Hitting the Market Just in Time for Xmas
4 Million Stolen Cards Hitting the Market

Carder Forum Listing Appears Tied to Breaches at Four Restaurant Chains

A new batch of stolen payment card data has appeared on the notorious Joker's Stash underground marketplace. The new listing appears related to breaches at four different restaurant chains in the U.S. over the last several months, according to a security analysis published this week.

The new breach listing, dubbed "New World Order," first appeared on the Joker's Stash marketplace on Nov. 22, and the batch of data appears to include credit and debit card data stolen from four different restaurant chains that include fast-food chain Krystal, Moe's Southwest Grill, McAlister's Deli, and Schlotzsky's, according to the analysis by Gemini Advisory, which tracks stolen payment card data.

One reason that this new listing may have appeared at the end of November is that its coinciding with the holiday shopping season, which starts on Black Friday, Nov. 29. Alforov notes that cybercriminals might be looking for new batches of stolen payment card data in order to take advantage of this burst of commercial activity.

In previous reports, other security researchers find that Joker's Stash remains one of the major underground sites specializing in the sale of stolen payment card data. These security analysts have also come across large data dumps periodically on the forum.

How much stolen credit card is now for sale on Joker's Stash remains in dispute. Security blogger Brian Krebs, who first reported the new batch of payment card data, writes that there are at least 4 million credit and debit card numbers for sale on the underground forum. bankinfosecurity.asia

New US Federal Privacy Bill Proposed
Legislation Designed Along the Same Lines as CCPA

U.S. Sen. Maria Cantwell, D-Wash., has introduced federal privacy bill called the Consumer Online Privacy Rights Act, or COPRA, which would expand the rights of people when it comes to how personal data is collected, shared and used. Senators Amy Klobuchar, D-Minn..; Ed Markey D-Mass.; and Brian Schatz, D-Hawaii, co-sponsored the bill.

"Privacy rights should be like your Miranda rights-clear as a bell as to what they are and what constitutes a violation," Cantwell said in a statement. The bill received statement of support from privacy advocacy groups, such as Consumer Reports, the Electronic Privacy Information Center (EPIC), and the Georgetown Law Center on Privacy & Technology.

According to data available with National Conference of State Legislatures there are about 110 privacy bills pending for various states in the U.S.

As proposed, COPRA has broad applicability to businesses, individuals and personal data across the United States. The proposed bill excludes small businesses with revenue of less than $25 million per year. Companies who are deriving less than 50% of their revenue from transferring covered data for valuable consideration would also be unaffected.

COPRA has designed rights for citizens much the same way as the CCPA, with a few additions. govinfosecurity.com

Here Comes DPO's - Data Protection Officers
How to Get Prepared for Privacy Legislation
Getting privacy basics right is a solid foundation

On January 1, 2020, California will step on the world stage of privacy when the California Consumer Privacy Act (CCPA) takes effect. It follows the European Union's General Data Protection Regulation (GDPR) and other regional legislative controls that are designed to protect the personal data of consumers.

There may be requirements to update privacy policies, third-party, and service provider contracts and any other terms that cover the collection, retention, and protection of personal data held by the company. It's important that all businesses review their status and establish if they need to comply with the legislation.

As with other privacy legislation, the fines for noncompliance could be significant. Under GDPR, we have recently witnessed British Airways being fined $230 million and Marriott Hotel Group $123 million for data breaches. The CCPA legislation allows for fines by the attorney general of up to $7,500 per incident and gives individual consumers the right to file a lawsuit for up to $700 each. I expect once the legislation takes effect that we will see some considerable legal action with class action lawsuits filed against companies that suffer data breaches

Complying with the legislation requires companies to adopt policies for the collection and retention of the data. It also requires companies to provide "reasonable security" to protect the personal data. darkreading.com

GDPR compliance benefits emerge a year and a half later; Correlation between compliance and improved security
Results from a Cisco survey indicated GDPR-compliant organizations are safer from breaches than noncompliant organizations: The percentage of GDPR-ready organizations affected by data breaches was 74% in 2018, compared to 89% of non-GDPR-ready companies. In addition, fewer records were affected, system downtime was shorter and monetary costs were lower in GDPR-ready organizations.

With data breach consequences ranging from fines to lost clients to public relations disasters, there are many reasons for businesses to focus on and prioritize GDPR compliance.

Many GDPR components can only help an organization's security posture. For example, mandates surrounding privileged access management, which audits user access to critical data, reduce the chances that high-risk privileged accounts become compromised. GDPR's 72-hour breach notification is also a considerable deterrent because it criminalizes cover-ups to force accountability. Additionally, GDPR mandates institutions that handle large amounts of sensitive data employ a data protection officer who is responsible for enforcing GDPR compliance along with the general data protection strategy of the organization. techtarget.com

Cyber Criminal Gang RAT busted by cops
A website that sold more than 14,500 copies of a remote access trojan (RAT) to cyber criminals in 124 countries has been taken down, and nine people arrested in the UK, following an international effort spearheaded by the UK's North West Regional Organized Crime Unit (NWROCU) with support from the National Crime Agency (NCA) and Australia's Federal Police force (AFP).

The Imminent Monitor RAT was sold for as little as $25 and gave full remote control of the endpoint if installed on a victim's computer, enabling cyber criminals to disable other cyber security protections, steal data or passwords, record keystrokes, and activate webcams. A total of 85 warrants were executed and 14 people taken into custody, with more than 400 pieces of equipment seized. computerweekly.com

Cyber Monday poised to net record $9.4B in the US
Cyber Monday online sales globally are on pace to rise 12% above last year to $30 billion (from $26 billion last year), according to Salesforce research. In the U.S., the day's digital sales are expected to grow 15% year over year to $8 billion from $7 billion last year, according to the report.

Adobe Analytics, which measures transactions from 80 of 100 major U.S. online retailers, tops that, forecasting a new record of $9.4 billion in sales, an 18.9% increase over last year. By 9 a.m. Eastern time Cyber Monday, merchants had already done $473 million in online business, Adobe said. retaildive.com

Cyber Monday Stacks Up as a Battle Between Amazon & Everybody Else
Target, Walmart & Major Retailers Threaten Amazon

"The gap that Amazon had as an advantage over other retailers is starting to close," said Monisha De La Rocha, a partner at Bain & Company.

Amazon has become a huge threat to big-box stores in recent years, but those retailers may be making a comeback this Cyber Monday.

Walmart and Target had bigger jumps than Amazon in online customer spending during the first two weeks of November compared with the same period last year, according research firm Edison Trends, which looked at more than 1.2 million transactions. Walmart took in 51% more than last year, while Target followed close behind with a 47% increase. While Amazon only grew 32%.

The big stores are realizing they can compete with Amazon and win back market share. cnbc.com

3 Things Employers Should Consider On Cyber Monday
Over two-thirds of employees plan to shop online while at work during the holiday season. This means employers should have a plan to navigate the next few weeks to maintain productivity and minimize disruption. Here are three things employers should consider.

1. Online Shopping May Not Be a Big Deal
In reality, Cyber Monday may not be any different than an average day. Employees might already spend time on non-work-related Internet activities during their typical workday.
● Enforce productivity and quality standards on Cyber Monday - just as they would any other day - to ensure that online shopping does not sidetrack employees from completing their appointed work.
● Remind employees to avoid suspicious websites or applications to prevent potential data breaches.

2. Communication Is Crucial
Regardless of how employers choose to proceed, they should make sure that the organization's handbook and policies are in order. First, make sure the rules are provided to all employees. Have workers provide an electronic signature or signed acknowledgement page for their employee file as proof that they received a copy of the policies.

3. Consistency Is Key
As always, one of the best ways to avoid legal troubles is to be consistent with the enforcement of policies. Put another way, if an employer drops the hammer on one employee for breaking a specific rule, it must drop the hammer on any other employee that also breaks that same rule. shrm.org

While some may believe LP may be wearing too many hats, take a look at your counterpart in operations and ask them the same question – are they? Retail has changed and everyone in it has expanded their responsibilities. But expanding one's responsibilities is in actuality a good thing, because it forces growth and gets people out of their comfort zones and sometimes it's the only way people will grow. The path of least resistance always leads to the least amount of effort and in these times there are no paths of least resistance. So next time someone asks are we wearing too many hats, the answer should be Yes and thank God we have one to wear!

Just a Thought,
Gus
