some people believe the level of theft noise
is just that: a distraction from poorly performing brands.

Door #1: Crime Stories
Theft in stores is up.
How much? Bad enough that the National Retail Federation declared Oct. 26 Fight
Retail Crime Day and urged its members to come to Washington, D.C., to
advocate for passage of the Combating Organized Retail
Crime Act.
Door #2: Other Stories
Given all of the attention paid to retail theft – something that has been a fact
of life in the industry since dry goods stores opened in lower Manhattan 200
years ago –
some people are suggesting that perhaps if retailers are not crying wolf, they
are at least showing modest wolf-crying tendencies.
Buried in all the press about significant store closings in downtown San
Francisco by Nordstrom, Gap and Whole Foods blamed on crime was the fact that
these stores were
taking big hits from the lack of office workers in downtown.
The Intelligencer story in New York raised the point that “reliable
data on shoplifting is extremely difficult to come by”
given the fact that many such crimes are never reported to the police so they
can’t be attributed to a specific occurrence.
Door #3: All of the Above
So, who’s right? Neil Saunders, the well-known retail consultant from GlobalData,
told Intelligencer, “I think there is
a theft problem that has to be recognized but I think there is a bit of a
bandwagon effect.” In a
statement that, probably unintentionally called attention to retailer’s
lemming-like tendencies to copy one another, he said “Once one retailer
discusses shrink, it becomes a buzzword and then investors start asking
questions about it, so other executives on calls start addressing it.
Store theft is bad…really bad, and don’t let anybody tell you otherwise.
But it doesn’t tell the whole story and like retailers who perpetually blame the
weather, the calendar, and the stars for their underperforming business,
it is only the latest rationalization.

Nationwide 'Crash-and-Grab' Epidemic
Crash-and-grabs on the rise as thieves use cars to break into stores
Crash-and-grab crimes emerge as new trend in theft across the U.S.
While
Americans have witnessed an uptick in criminals wreaking havoc on retail
establishments and
using cars to breach buildings or steal ATMs, crash-and-grab incidents are now
emerging as the latest trend
in theft taking place across the country.
Criminals are now using vehicles as weapons to steal merchandise from stores and
this trend has spiked, particularly in locations like Chicago. Consequently,
law enforcement is issuing community alerts to address these crimes.
In just the last week, six crash-and-grab incidents
have occurred in vintage and sneaker stores across Chicago — thieves use SUVs or
cars to smash through store doors and swipe merchandise.
“Pretty quick thing, they were in here for about four or five minutes but they
were able to make off with a few handfuls of stuff,” said Jeff, co-owner of
Urban Jungle.
Retail crimes have spiked nationwide —
Los Angeles, the San Francisco Bay Area and Houston are ranked the top three
worst cities for theft,
according to the National Retail Federation. Chicago is ranked eighth.
The new crash-and-grab trend has business owners and shoppers on edge. “All
these robberies and stuff is scary;
I don’t feel safe anymore,”
a Chicago resident said.

Stores frantically shopping for solutions to cart thefts
An
answer? Invisible fence that locks their wheels
The city of Bremerton and surrounding jurisdictions have become
hubs for unregulated and unprosecuted shopping cart thefts,
leaving customers and retailers more often than not playing the least fun game
of scavenger hunt imaginable.
Unfortunately, the majority of what they are looking for is no longer on site,
with
carts scattered across public roads, parks, trails and private property.
Identification tags showing what store they belong to are often stripped off,
and either occupied or not, it’s not uncommon to find plenty of unpleasantries
inside the baskets.
Cart theft was already an issue growing out of control in 2022,
linked to a similarly growing homelessness crisis,
and both have ballooned over the past year. Why the proliferation? Officials
said shoppers simply are not returning carts,
there is a lack of security and state law makes it nearly impossible to
prosecute offenders.
With no changes in sight,
businesses are left picking up the bill,
and customers pay more at the register to make up the difference.
The crisis has led some companies to explore
investing in cart security systems.
Paul Morgan, general manager for Bremerton’s Grocery Outlet, has been OK’d to
install an invisible fence and locking wheels on carts would be triggered when
taken outside established boundaries.
Locking wheels have already seemed to have some effect at stores like Winco, its
Silverdale property often seen with carts right at the edge of the parking lot.
Morgan expects his store to not be the only one to make the move in future
months, saying
he believes it could cease the majority of cart thefts.
Until then, however, it’s a frustrating game for everybody, especially those not
in a position to purchase the anti-theft technology.

Is Self-Checkout Adding Fuel to the Theft Fire?
Why self-checkout has become controversial
The self-checkout has become a point of controversy for many shoppers. Some
love it for the solitude, and others hate it for the frequent technical errors.
As
Wal-Mart begins to remove some self-checkout
lanes in response to growing incidents of theft, others, like
Kroger, are doubling down on the technology,
converting some of its locations to entirely self-checkout sites. The
cost-saving approach has backfired
a bit.
"The issue that's getting a lot of traction right now is
the issue of theft.
And what stores found was that not only do many customers require assistance to
complete their transactions, if they do not staff the self-checkout lanes,
customers will exit with the goods,"
Andrews said. "So, in a sense, stores thought they were going to save money on
labor costs by adding these. And instead,
they're losing money through theft and shoplifting,
and then they're having to put stuff back there. Just to help address that."
The situation with theft has gotten so bad at self-checkouts that
it's become a joke on social media.
In an effort to crackdown on theft, some stores are even changing how they
confront people at self-checkout.
"So,
some stores will wait until you have stolen a certain amount of merchandise so
they can charge you with an elevated charge,"
Andrews said. But that doesn't change the fact that the technology itself needs
some work.
"I actually think that the technology
has to be much more intuitive and error-free,"
Sylvain Charlebois said. Charlebois doesn't believe cashiers will completely
disappear, but says that kind of service may come with a price.

Another State Proposes ORC Legislation
Ohio State Representative Set to Introduce Bill Addressing ORC
Ohio State Representative Haraz N. Ghanbari (R-Perrysburg) recently announced
his intent to introduce legislation
focused on combating rising losses from organized retail crime
in the Buckeye State.
Ghanbari’s
Fight Organized Retail Crime & Empower Law Enforcement (FORCE) Act
will “protect the safety and well-being of Ohio retailers and consumers while
simultaneously targeting Organized Retail Crime (ORC) theft rings.”
Specifically, the bill, if enacted,
would update Ohio laws and policies to “empower local law enforcement and
prosecutors to respond to these incidents accordingly.”
Ghanbari’s bill comes as organized retail crime has skyrocketed across the
nation in recent years. Data from the National Retail Federation shows retailer
losses amounted to $112.1 billion billion dollars last year, of which organized
retail crime was a significant driver.
A total of
3.59 percent of all U.S. retail crime in 2021 took place in Ohio
costing businesses in the state approximately $3,944,650,700, according to the
U.S. Chamber of Commerce.
Gordon Gough, the President and CEO of the Ohio Council of Retail Merchants,
applauded Ghanbari for his plan to introduce the FORCE Act, saying, “Far more
than this financial impact, the
FORCE Act also addresses Ohioans’ growing concern over
violence and safety for customers and store associates.
This legislation will give Ohio law enforcement officials and our judicial
system more tools to apprehend and punish criminals while protecting consumers
and retailers. We look forward to working with Ohio leaders to tackle this
problem effectively.”

UK's New "Zero Tolerance" Plan on Shoplifting &
ORC
Police will pledge to attend every shop robbery
A
new “zero-tolerance” plan will be agreed between ministers, police and retailers
to crack down on shoplifting and the organized crime gangs fuelling the problem.
At a summit in Downing Street,
police chiefs will unveil plans for how they intend to tackle shoplifting, which
has soared by a quarter of the last year to reach more
than 1,000 per day.
Police have been accused of not taking the crime seriously enough as the number
of cases solved has fallen over the same period, with
just one in eight shoplifters caught and charged.
For the first time,
shoplifting will have a dedicated national unit
that will investigate the crime from an organised crime perspective. Six new
intelligence analysts will be employed within Operation Opal, the National
Police Chiefs’ Council’s (NPCC) unit for tackling serious organized acquisitive
crime.

UK police minister calls for more live facial recognition
In a
letter to police chiefs published on Sunday, the country’s Policing Minister
Chris Philp said that the UK police should use live recognition more widely to
quickly identify suspects and deter crime.
“AI technology is a powerful tool for good, with huge opportunities to advance
policing and cut crime,” says Philp.
The call came after police caught three at-large suspects using live facial
recognition technology during last month’s Arsenal vs. Tottenham football match
in London, including one wanted for sexual offenses.

The downsides of self-checkout, and why retailers aren't expected to pull them
out anytime soon
Although
opinions on self-checkout are mixed,
many retailers are leaning into the technology. Some Kroger supermarkets
are operating entirely via self-checkout. Kohl’s earlier this year announced
plans to add self-checkout kiosks to 250 stores. And fast-fashion brands like
Zara are rolling out self-checkouts at select stores.
But
other chains appear to be reconsidering their approach, with certain
stores removing the technology or staffing up self-checkout lanes to prevent
theft. The shift comes amid reports that raise questions about just how much
value self-checkouts bring to retailers and shoppers.
The share of transactions through self-checkout lanes hit 30% in 2021, almost
double that from 2018, according to data from the Food Industry
Association.
But there are also concerns. Failures aren’t uncommon with the devices, despite
their high price tags. And while self-checkout is meant to help cut down labor
costs, this has yet to pan out in the data.
“I think many companies believe they've saved their money with self-checkout,
but it’s going to vary by store. And
the stores that have tried to go all the way, I think they've realized that it’s
not a good idea," Larson said. "The key is to give people an option.”
Theft concerns around self-checkout
Self-checkout kiosks are also
known to contribute to shrinkage. Retailers have been sounding alarms on
shrink recently, with a number of companies putting the blame on a spike in
organized retail crime. Self-checkout isn't often brought up as a concern,
despite data that
shows it can have an effect on shrinkage.
A 2018 report authored by Adrian Beck, emeritus professor at the University of
Leicester's Department of Criminology and academic adviser to the
ECR Retail Loss Group, found that stores with the average number of
self-checkout machines could expect to see shrinkage losses 31% higher than the
industry average, and those relying on an above-average number of
unmanned kiosks could see shrink rates 60% higher.

DHS Responds to Biden's AI Executive Order
Statement from DHS Secretary Mayorkas on President Biden’s Executive Order on
Artificial Intelligence
Today,
Secretary of Homeland Security Alejandro N. Mayorkas
released the following statement regarding the Biden-Harris Administration
Executive Order on Artificial Intelligence:
“I was proud to join President Biden at the White House today to mark the
signing of his Executive Order on Artificial Intelligence (AI).
The President has asked the
Department of Homeland Security (DHS) to play a critical role
in ensuring that AI is used safely and securely. This is a top priority for our
Department.
“The
unprecedented speed of AI’s
development and adoption presents significant risks we must quickly mitigate,
along with opportunities to advance and improve our work on behalf of the
American people. The President’s Executive Order defines a seminal path for the
safe and secure use of AI. It directs DHS to manage AI in critical
infrastructure and cyberspace, promote the adoption of AI safety standards
globally, reduce the risk of AI’s use to create weapons of mass destruction,
combat AI-related intellectual property theft, and ensure our immigration system
attracts talent to develop responsible AI in the United States. The AI Safety
and Security Advisory Board, which I look forward to chairing, will bring
together industry experts, leading academics, and government leaders to help
guide the responsible development and safe deployment of AI.
“DHS is already deploying AI responsibly to achieve our missions, and
this Executive Order will build on that leadership.
In April 2023, I established the Department’s first AI Task Force to drive
specific applications of AI and, since then, we have quickly developed guidance

The AI Chess Match Heats Up
Fraudsters using generative AI to exploit gaps between customers' touchpoints
Organizations need to take a strategic and seamless approach to
mitigating expanding fraud risks
Consumers interact with brands and organizations through many different
touchpoints that include online transactions via a website or mobile app,
in-branch or in-person at a brick-and-mortar location, call centers, mall
kiosks, and much more. While these interactions offer strong customer service
opportunities, they represent
potential gaps in fraud
defense and identity protection.
At
a soberingly fast pace,
fraudsters are using
generative AI to exploit gaps
between these touchpoints, and bad actors are looking
to take
advantage of “moments of value” across a brand’s sales or consumer-engagement
channels, product offerings, or vertical markets.
And they may also go after a business’ consumers directly.
Expanding Array of Tools Available for Fraudsters
Publicly available tools like ChatGPT, Bard, and other generative artificial
intelligence (AI) solutions can be
used by fraudsters to build
deceptive, misleading identity artifacts.
In some cases, fraudsters use these tools to build scripts for sophisticated and
well-articulated social‑engineering schemes that appear to come from legitimate
brands that render goods or services
to swindle unsuspecting people out of their money.
Fraud Challenges Will Only Get Worse
But the effort doesn’t stop there. Beyond the speed of operations that
generative AI empowers, along with the many
consumer touchpoints and
threat vectors that fraudsters use to attack a business today,
bad actors haven’t yet fully begun to employ the more sophisticated attacks that
generative AI may enable. These may include generating deep-fake voice, image,
and video artifacts to pass facial or voice biometric checks. As businesses add
layered controls for identity verification, authentication, and transactional
risk, fraudsters will trend toward
using these types of attacks,
advancing an ongoing chess match: threat versus countermeasure.

AI is Catching Up to Humans on Phishing Emails
Humans are still better than AI at crafting phishing emails, but for how long?
Humans are still better at crafting phishing emails compared to AI,
but not by far and likely not for long, according to research conducted by IBM
X-Force Red.
Creating phishing emails: Humans vs. AI
The researchers wanted to see
whether ChatGPT is as capable of writing a “good” phishing email as attackers
are. The researchers
experimented with various prompts and refined them to finally come up with a
list of just five that were enough for ChatGPT to produce the phishing email.
After
prompting ChatGPT to chose the ideal sender to impersonate,
they instructed it to draft the phishing email. Concurrently, X-Force Red social
engineers
crafted their own phishing email, after using OSINT techniques
to gather information that would help them choose the sender to impersonate and
decide on the lure (an internal company survey).
But – and this is important –
it took five minutes for ChatGPT to generate the email, while the researchers
spent 16 hours on the task.
The final test
“After an intense round of A/B testing, the results were clear: humans emerged

failed to disclose known risks, according to a complaint.
The Securities and Exchange Commission charged SolarWinds and its CISO Timothy
Brown with fraud and internal control failures for allegedly misleading
investors about its cybersecurity practices leading up to the Sunburst attack
discovered in December 2020.
The SEC on Monday alleged the company
overstated its cybersecurity practices and failed to disclose known risks

Forever 21 to expand global reach in new deal with Shein
Authentic Brands Group has signed a long-term
agreement for its Forever 21 banner with Singapore-based Shein.
Under the terms of the deal,
the global online
retailer of value-priced fashions will design, manufacture and distribute a line
of Forever 21 apparel and accessories for men and women.
The categories will include sportswear, activewear and swimwear and others.
Items from the collection, dubbed Forever 21 x Shein, will be available
for sale online
exclusively on Shein sites in the U.S. and parts of Europe and Australia.
The Shein platform has approximately 154 million users.
The partnership comes after Shein, in August,
acquired an approximate
one-third interest in SPARC Group, a joint venture between Authentic and Simon
Property Group. (SPARC
is the core operating partner of Forever 21 in the U.S.) At the same time, SPARC
became a minority shareholder in Shein. As part of the deal between the two
companies, Shein has the opportunity to test customer-focused experiences in
Forever 21 U.S. locations, including shop-in-shops.

Sunbelt Rental Burglary in Indiana leads to high-speed police chase ending in
Chicago
Around 2 a.m., Hobart police were pursuing a U-Haul van that fled from the scene
of a reported burglary at Sunbelt Rentals, located at 1851 Northwind Parkway.
The van eventually exited the Dan Ryan Expressway at 71st Street and came to a
stop near 71st and South Perry Street in Chicago, police said. The driver and
passenger fled on foot. The passenger jumped a fence near 70th and Wentworth,
but was later taken into custody. The driver, for now, got away. The passenger
hails from Florida and is 31 years old. He's currently booked into an Illinois
jail. Police recovered a book bag from the passenger which
had almost $10,000 inside of it. They also seized loose cash
from the passenger's shirt, police said.
Inside the U-Haul van, police recovered about $75,000 in stolen tools and
equipment. The vehicle
was taken to the Hobart Police Department.

Collier County, FL: Shoplifting Operation spanning three days lands nearly 20
arrests in Collier County
A
shoplifting operation spanning three days led to 18 arrests in Collier County.
According to the Collier County Sheriff’s Office, six convicted felons were
among the 18 arrested. One of the suspected shoplifters is accused of stealing
thousands of dollars worth of items from the same store. “As is the case across
the nation, shoplifting is an issue for businesses in Collier County, and we are
committed to continuing to address this problem in partnership with our
community,” Sheriff Rambosk said. Deputies continue working closely with store
loss prevention professionals, helping to identify shoplifting suspects. Several
notable arrests, among the dozen and a half total arrests, were made. They
include 52-year-old convicted felon David Dominguez. Dominguez is accused of
bringing a child to Walmart. to steal an iPhone case. Domingez faces charges
including petty theft and contributing to the delinquency of a minor. Dominguez
was on an 18-month probation for multiple prior retail thefts when he was
arrested. Also arrested during the shoplifting investigation was 36-year-old
convicted felon Jonathan Deak, accused of stealing several thousand dollars’
worth of batteries from Home Depot in Naples on Wednesday. A short two days
later, Deak went back to the same Home Depot, attempting to steal more than
$1,000 worth of tools before deputies took him into custody. Deak used bolt
cutters as a means to break locks of high-value items at Home Depot on both
days.

Macon, GA: Group of Ga. women shoplift costumes from two Halloween stores
Four women and a teenage girl were arrested for shoplifting Halloween costumes
from two Macon stores. On Friday, October 27, just after 10:30 a.m., deputies
responded to Spirit Halloween on Tom Hill Sr. Boulevard in Macon for a reported
shoplifting incident. Store employees said several women entered the store, took
several costumes, and left the store without paying for them. They were seen
leaving in a silver Honda Odyssey. Deputies say the same group did the same
crime at the Spirit Halloween store on Eisenhower Parkway about an hour later.
Deputies located the uninsured Honda just before noon on Ell Street. They were
all taken to the Bibb County Law Enforcement Center where they all face charges
of felony theft by shoplifting. Worthy was currently wanted in Henry County.

Gadsen, AL: Suspect arrested after man found dead in grocery store parking lot
A man has been arrested following a homicide investigation over the weekend, the
Gadsden Police Department announced. At around 9:29 p.m. on Friday, GPD officers
were dispatched to the Fresh Value grocery store at 2519 West Meighan Boulevard
on reports of a man who was shot. They arrived and found Briantez Vinson, 24, of
Gadsden, lying in the parking lot with a fatal gunshot wound. Within 36 hours,
detectives identified the suspect as D’amon Johnson, 21, of Gadsden. He has been
charged with murder and is being held at the Etowah County Jail on no bond.

Wilmington, DE: Update: Jurors picked for trial of suspected serial killer who
struck in Delaware and Pennsylvania
The trial of a suspected serial killer who calls himself "the Beast" and is
accused in the deaths of several people in Delaware and Pennsylvania during a
violent crime spree in 2021 began Monday with jury selection. A jury panel of 12
was selected for the trial of Keith Gibson, 41, who is being tried for the
killings of an Elsmere cellphone store manager and a Wilmington man in separate
robberies. The fatal shootings are among a host of charges against Gibson
outlined in a 41-count indictment, including assault and attempted murder in two
other shootings in Wilmington. The Philadelphia district attorney has
approved murder charges against Gibson for the killings of his mother and a
Philadelphia doughnut shop manager, as well as the deaths of two men found shot
in the head inside a store in Philadelphia's Germantown neighborhood in January
2021.

Chicago shooting: 16-year-old boy shot, critically injured at Grand Crossing gas
station
A teen boy was critically injured in a shooting at a South Side gas station on
Monday afternoon, Chicago police said. Police said the shooting happened in the
Grand Crossing neighborhood's 7600 block of S. South Chicago Avenue just before
5 p.m. Chopper 7 was over the scene near East 76th Street. Police said an
unknown offender approached the 14-year-old victim, took out a gun and shot him
in the thigh. The victim was transported to Comer Children's Hospital in good
condition. There is no one in custody and area detectives are investigating.

Bakersfield, CA: BPD arrests man accused of pointing firearm at Macy’s Security
Officer
Police officers arrested a man for allegedly pointing a gun at a security guard
at the Valley Plaza Mall, according to the Bakersfield Police Department.
According to BPD, officers arrested 19-year-old Andrew Garcia of Bakersfield for
assault with a firearm on Friday, Oct. 27. BPD said officers responded to a
report of a robbery at a Macy’s store at the Valley Plaza Mall on Thursday, Oct.
26 at approximately 6:13 p.m. Upon arrival, officers determined a subject was
inside Macy’s gathering merchandise and appeared to notice store security
watching him. BPD said the subject then set the merchandise down and left the
store without committing a theft or robbery, however, security followed the
subject outside and observed him get into a vehicle. As the subject drove away,
he allegedly pointed a firearm at the security officer. Garcia was later
identified by detectives assigned to the Organized Retail Theft unit as the man
who pointed the firearm, according to BPD. He was arrested in the 3300 block of
Center Street for assault with a firearm. The firearm used in the offense was
located and seized, officers said.

Channahon, IL: Investigation After Armed Robbery at Love’s Truck Stop
An
investigation is underway after an armed robbery at a Channahon truck stop. It
was at 2:37 a.m., that Channahon Police Officers responded to the Love’s Travel
Stop located at 23801 W Bluff Rd. for a report of a robbery. Officers learned
man, wearing a black ski mask and gloves, dressed in camouflage clothing,
entered the store and demanded money from the clerk working at the counter. A
weapon was implied, but not displayed. The Love’s employee working the at the
time complied with the suspect’s instructions, providing the suspect with the
money from the register. The suspect fled the area in a dark colored SUV prior
to officers arriving. No one was injured during the robbery.

Sacramento, CA: Dollar Thrift owners attacked by two armed homeless people
A Sacramento couple is recovering after investigators said they were attacked by
two homeless people outside their store. The Sacramento County Sheriff's Office
said the man and woman who attacked them are in custody and will face charges of
assault with a deadly weapon. Melissa and Thomas Jones, the owners of Dollar
Thrift on Auburn Boulevard in Sacramento, said it's become a constant battle to
keep their business open because of the homeless problem in the area.
