14 Security Officers Face Murder Charges in 1 Month
During the month of July, 14 security officers have been charged with
murder and twenty people were fatally shot during an array of
disturbances, confrontations, assaults and interactions with private
security. And these numbers are just the ones that our news desk was
able to confirm. Other similar incidents may have occurred and not been
reported through a news press release or picked up by national media.
During this past week-end alone, five people were killed during
confrontations with security officers in three states.
Of these fatal shootings, all but one was unarmed. But to be clear, it
is not a requirement of the law that a person be armed with a weapon.
Though the language of each state statutes varies slightly, the national
standard is that a person may use lethal force when in imminent fear of
an assault that may cause serious bodily injury or death.
This week-end's fatal shootings occurred at two nightclubs, two at
apartment complexes and one at a hookah lounge. Police are investigating
all fatal shootings and no arrests have been made so far. At this point in the year, fatal shootings have dramatically increased
over shootings in 2017 and 2016 but there's been a decrease of security
officer prosecutions in this year's shooting incidents.

California Prop 47 Aftermath:
One person arrested 83 times since its passing
Prop
47, which classified “non-serious, nonviolent crimes" as misdemeanors instead of
felonies, has some people believing it could be responsible for an increase in
petty crimes.
One of those people is Fresno Police Chief Jerry Dyer who says Prop 47
definitely plays a leading role in what he sees everyday. "There's an individual
we have arrested 83 times since Prop 47 has passed, all on petty thefts, 83
times," Dyer told yourcentralvalley.
The Chief has mostly seen a spike in thefts and says it's happening everyday.
"That's their job, that's their career, there embolden to do it because there's
no consequences."
In the last few weeks 15 Lululemon stores statewide have been robbed with
tens-of-thousands of dollars in merchandise stolen. Apple stores across the
state are also getting hit with thousands of dollars in iPhones and iPads swiped
off the counters.
Dyer says sometimes there hands are tied when it comes to keeping the thieves
off the streets, but that voters can take control at the ballot box.

Update on Biggest Case of Internal Retail Fraud by Entire Sales Team
Former Pilot Flying J's VP of Sales confession filed under seal
Federal prosecutors could reveal – for the first time – what a former executive
of the nation’s largest diesel fuel retailer told authorities about his bosses
and a scheme he helped craft to rip off truckers, court records show.
But whether the public will get to see or hear the statements federal
authorities elicited from former Pilot Flying J Vice President of Sales John
“Stick” Freeman after he took a last-minute plea deal last year remains to be
seen, those same records show.
Freeman was regarded by some as the architect – and chief cheerleader – for a
fraud plot at Pilot Flying J among at least 19 of the firm’s executives,
including its then-president, Mark Hazelwood, and staffers.
The plot involved defrauding small, less sophisticated trucking firms of
promised fuel discounts after luring them with promises of higher rebates to
switch their buying loyalties to the truck stop giant.

MGM Explains Decision to Sue Vegas Shooting Victims
MGM Resorts International, owner of the Mandalay Bay Casino and Resort in Las
Vegas from where a gunman killed 59 people last year, is trying to protect
itself against significant legal liability by filing lawsuits against some of
the shooting victims.
MGM alleges federal law protects it from liability stemming from the massacre,
and claims more than 2,500 people have sued it or its subsidiaries, or have
threatened to do so. It wants all cases to be heard in one court to make it
easier for witnesses, and says having just one trial will help more quickly
bring closure to victims and families.
“The Federal Court is an appropriate venue for these cases and provides those
affected with the opportunity for a timely resolution,“ a spokeswoman said.
”Years of drawn out litigation and hearings are not in the best interest of
victims, the community and those still healing.” The spokeswoman issued a second
response that said, in part, “It is heartbreaking to hear these personal
accounts of an unspeakable tragedy. We grieve with all of the victims..”
MGM Chief Executive Jim Murren said in a July 27 letter to employees “the way
things have been portrayed has left many feeling confused, hurt and
disappointed. I am sorry for that.” It goes on: “MGM Resorts is not suing
victims for damages or attempting to extract monetary payment from the victims
in any way,” and is doing so to consolidate the cases. Such a move “benefits all
victims by providing an opportunity for closure in a swift and fair manner.”

Operation Chill to Rewards Kids’ Positive Behavior
7-Eleven recently kicked off its annual Operation Chill in partnership with the
Irving, Texas Police Department with a coupon presentation to local officers at the
Irving Police Athletic League (PAL) facility.

Walmart
Commits $200,000 For California Wildfire Relief
Walmart and the Walmart Foundation have made a commitment to provide
support through cash and product donations of $200,000 in response to
the severe wildfires that are impacting California. As part of this
commitment, Walmart is working with local officials and governmental
entities to help meet the needs of those affected.
“We are deeply concerned by the devastation impacting our associates,
customers and the communities we serve,” said Dacona Smith, Walmart’s
SVP for operations in California. “In the coming days, we will continue
to help with relief efforts by working with non-profits, first
responders, local officials and governmental organizations to identify
needs and provide additional support.”
Walmart operates 306 retail facilities in California, which includes 140

Democrat Senators Call for Federal Review of Facial Recognition
A group of Democrats in the House and Senate want the Government Accountability
Office (GAO) to probe how law enforcement agencies have begun to use newly
available facial recognition software.
In a
letter, four senators, as well as the top Democrat on the House Judiciary
Committee, wrote that the federal government needs to study whether adequate
oversight is being performed for public and private use of the technology.
“Given the recent advances in commercial facial recognition technology — and its
expanded use by state, local, and federal law enforcement, particularly the FBI
and Immigration and Customs Enforcement — we ask that you investigate and
evaluate the facial recognition industry and its government use,” the lawmakers
wrote.
The letter, signed by Rep. Jerrold Nadler (D-N.Y.) and Sens. Ron Wyden (D-Ore.),
Cory Booker (D-N.J.), Christopher Coons (D-Del.) and Ed Markey (D-Mass.), asks
the GAO to examine “whether commercial entities selling facial recognition
adequately audit use of their technology to ensure that use is not unlawful,
inconsistent with terms of service, or otherwise raise privacy, civil rights,
and civil liberties concerns."
The lawmakers' letter to the GAO comes days after several other Democrats
blasted tech giant Amazon over an American Civil Liberties Union (ACLU) report
that the company's facial recognition software had misidentified dozens of
members of Congress and was significantly less accurate when used with persons
of color.
"Serious concerns have been raised about the dangers facial recognition can pose
to privacy and civil rights, especially when it is used as a tool of government
surveillance, as well as the accuracy of the technology and its disproportionate
impact on communities of color," Markey and three additional House Democrats
wrote in a letter to Amazon CEO Jeff Bezos last week.

Amazon: Cops should set confidence level on facial recognition to 99%
In the wake of the ongoing kerfuffle between the American Civil Liberties Union
and Amazon, the tech giant has now responded more fully to accusations that its
facial recognition system, Rekognition, wrongly
identified 28 members of
Congress as arrestees in an ACLU test last week.
Matt Wood, Amazon’s general manager for deep learning and artificial
intelligence, wrote in a
blog post last Friday that while the ACLU used the
default setting of an 80-percent confidence level, the company recommends a far
higher setting "for use cases where highly accurate face similarity matches are
important."
"We continue to recommend that customers do not use less than 99 percent
confidence levels for law enforcement matches, and then to only use the matches
as one input across others that make sense for each agency," he wrote.
Wood went on to explain that Amazon tried to duplicate the ACLU’s test involving
portraits of the 535 members of Congress. However, Amazon used a far larger
dataset of faces for comparison: 850,000 over the ACLU’s 25,000 mugshots.
"When we set the confidence threshold at 99 percent (as we recommend in our
documentation), our misidentification rate dropped to zero despite the fact
that we are comparing against a larger corpus of faces (30x larger than the ACLU
test)," he wrote.

Consumers still not sold on biometrics payments security
Biometric payments are poised for significant growth, but substantial consumer
security concerns could put its future at risk.
Sixty-one percent of consumers feel that providing companies with their
fingerprint and iris information put their personal identity information at
risk, according to “Vital
Insights into Biometric Payments Adoption,” a report from Transaction
Network Services.
In the last year, 15% of adults have made a biometric payment, including a
quarter of 18 to 24 year olds. However, many consumers remain wary, especially
male consumers in the United States and the U.K. In Australia, women reported
security concerns.
The good news is that trust is building, albeit slowly. Adults in the U.S.
increased biometric payments usage slightly since TNS’ last survey two years
ago. Usage in the last year has been greatest among U.K. adults.

New law could have more security repercussions than GDPR
In late June, 2018, California passed a
consumer privacy act, AB 375, that could have more repercussions on U.S.
companies than the European Union’s
General Data Protection Regulation (GDPR) that went into effect this past
spring. The California law doesn't have some of GDPR's most onerous
requirements, such as the narrow 72-hour window in which a company must report a
breach. In other respects, however, it goes even farther.
The California Consumer Privacy Act takes a broader view than the GDPR of what
constitutes private data. The challenge for security, then, is to locate and
secure that private data.
What is the California Consumer Privacy Act?
AB 375 allows any California consumer to demand to see all the information a
company has saved on them, as well as a full list of all the third parties that
data is shared with. In addition, the California law allows consumers to sue
companies if the privacy guidelines are violated, even if there is no breach.
Which companies does the California Consumer Privacy Act affect?
All companies that serve California residents and have at least $25 million in
annual revenue must comply with the law. In addition, companies of any size that
have personal data on at least 50,000 people or that collect more than half of
their revenues from the sale of personal data, also fall under the law.
Companies don't have to be based in California or have a physical presence there
to fall under the law. They don't even have to be based in the United States.
When does my company need to comply with the California Consumer Privacy Act?
The law goes into effect on January 1, 2020. As a practical matter, companies
need to have their data tracking systems in place by the start of 2019, since it
gives consumers the right to request all the data a company has collected on
them over the previous 12 months. That's a very tight timeframe.
What happens if my company is not in compliance with the California Consumer
Privacy Act?
Companies have 30 days to comply with the law once regulators notify them of a
violation. If the issue isn't resolved, there's a fine of up to $7,500 per
record. "If you think about how many records are affected in a breach, it really
increases very quickly," says Debra Farber, senior director for privacy strategy
at BigID. Since the bill was put together and passed in just a week, it will
probably see some amendments, she adds. "Things like the fine amounts are likely
to change."
There's also another potential financial risk, Farber says. "The bill provides
for an individual's right to sue, for the first time " she says. "And it allows
class action lawsuits for damages."

Police investigating after video shows three security guards

video showing security guards restraining a man at the Uptown
Shopping Centre on Wednesday has prompted outrage after it was
viewed by thousands on social media. The video shows three security
guards restraining a man facedown on the ground. One of
the guards is on his legs, another on the man’s back and a third
holding his arms. In the video the man is heard yelling “I
didn’t do anything” and “why are you doing this?”
One of the security guards tells the man, “you spit in my face.” The
man denies spitting on the security guard’s face. A female witness
can be heard saying “you’ve already hurt him, over some cans.” A
security guard asked someone to call 911 during the incident.
Uptown general manager Kristy Lowes said the man had been legally
banned from the site and has a history of committing crimes at
Uptown over the last four years.

Ottawa woman sues Value Village store, two managers for sexual
harassment, racial and religion discrimination
An
Ottawa woman is suing value village and two Ottawa store managers,
alleging sexual harassment and racial and religious discrimination.
The plaintiff is seeking more than $200-thousand dollars in damages
after what her lawyer says was the worst case of sexual harassment
he has seen, and says he's aware of at least one other woman
pursuing legal action as well.
33-year-old Shimaa Elazzab says she was pursuing her dream in
Canadam climbing the corporate ladder at the Value Village on Bank
Street, promoted to a supervisory role after just 3 months. That
dream, she says, came crashing down after 5 years when a new manager
started at the store
A series of text messages allegedly sent by one of the managers
pointedly offered her money for sex. The lawsuit also alleges
her human rights were violated by those same managers who she says
asked her not to speak Arabic because Canada was an
English-speaking country and asked her to take off her hijab
and show her hair.

New gas-and-dash legislation works to cut down on theft in Calgary
Police in Calgary say that ever since the province brought in a
mandatory rule that all drivers must pre-pay before fueling up,
incidents of gas thefts have virtually disappeared. On June 1, the
Alberta government enacted the Act to Protect Gas and Convenience
Store Workers that included a law requires customers to pay at the
pump or pay the attendant before they pump gas into their vehicle.
The move was to improve safety for workers who often step in to
attempt to stop thieves they witness stealing gas, where the
consequences of such actions often prove fatal. Calgary police say
that in 2017, there were more than 1,000 incidents of gas theft and,
before the law came into effect this year, there were 474 thefts.
However, during the month of June, CPS says they dropped off
completely and in July there was only one.

bike shop using 'power of social media' to catch thieves
Popular Regina bike shop Dutch Cycle has faced late-night break-ins
and broad daylight thefts of cash and merchandise. Now the business
is using Facebook to fight back. A few days ago, one of the owners
posted a photo of a man who stole a pair of shoes and then pulled a
knife on one of his staff members who tried to chase him down. By
Wednesday morning it had been shared 2,000 times. He said it helped
police identify a suspect.

After deadly cafe shooting, Toronto wants to ban handgun sales in
the city
Days after a shooting rampage in Toronto killed two people, its city
council voted overwhelmingly to urge its federal government to ban
the sale of handguns in the city.
The Toronto City Council voted 41-4 on Tuesday to push the Canadian
government to ban the sale of handguns and also for the provincial
government to ban handgun ammunition sales within the city.
In 2017, Toronto Police Service reported 205 shootings. As of Monday
-- with five months left in the year -- the 2018 totals have
exceeded last year's totals, with 228 shootings. Homicides in the
city have also increased this year, so far to 58 -- exceeding last
year's total of 24. Most of the homicides this year, 29 out of 58,
were from shootings, according to police.

International Research funneled more than $125 million into the Pan

ON: Video shows brazen smash-and-grab robbery of jewelry store
New video has surfaced of a brazen weekend robbery at a Malton jewelry store, in
which a group of masked suspects used a minivan to smash through the front of
the building before pointing a firearm at a woman working behind the counter.
The robbery took place at New Rana Jewellers on Airport Road near Derry Road
just before 7 p.m. on Saturday. The video shows a red van repeatedly backing
into the front of the building as terrified customers and employees seek shelter
in the back of the store.

(Update) Toronto, ON: Cafe shooting victims identified as 10-year-old girl,
18-year-old woman
A
child and young woman are dead and 13 others injured after a lone gunman walked
along Toronto’s busy Danforth Avenue on Sunday night, randomly shooting
pedestrians before opening fire on crowded restaurants. The 29-year-old shooter
from Toronto was found dead after an exchange of gunfire with police, though it
remains unclear if he died by suicide.
He said that a total 16 people were shot — a tally that includes the dead
suspect — eight were male and eight were female. The victims ranged in age from
10 to 59, the chief said.

Winnipeg, MB: Police encourage residents to report bike theft after recovering
$6,200 bike
Winnipeg police are encouraging people to report their stolen bikes after
recovering one valued at $6,200 earlier this week. The bike was taken from a

Growing Reality
Biometric Payments Could Soon Become Commonplace
Using irises or veins to buy goods is less futuristic than it might seem
Due to the ubiquity of smartphones, the need for faster and more accurate logins
has arisen and using fingerprints rather than typing passwords is now an
accepted norm. Payments using biometric markers is a logical next step, but
mobile payments in general haven't swept the nation.
We forecast that around one-quarter of US smartphone users will use a mobile
phone to pay for a purchase at a physical point of sale (POS) at least once
every six months in 2018.

Network Services (TNS) and
Kantar TNS survey of
consumers in the UK, the US and Australia in March 2018, just 14% of US
respondents said they had made a biometric payment in the past year. Overall,
more men than women had used this tech (19% vs. 12%), and younger consumers were
more willing to experiment with it. One-quarter of 18- to 24-year-olds thought
biometric payments would be acceptable, compared with just 3% of those 55 to 64.

Online out-of-stocks cost $22B in sales
Worldwide, consumer brands and retailers could gain $22 billion by recapturing
sales lost when customers can't find what they're looking for, according to a
report from the Grocery Manufacturers Association emailed to Retail Dive. At the
same time, the potential losses for manufacturers and retailers are likely to
double over the next few years unless retailers take corrective action,
according to report authors Daniel Corsten and Thomas Gruen.
In the U.S., 15% of consumers encountering an out-of-stock online switched sites
to buy the item, while 60% bought a substitute from the same online merchant. Of
that 60%, half switched brands and half found a substitute from the same brand.
About 10% went to a retail store to find what they wanted, and about 15% said
they delayed or canceled their purchases.

Chevy Chase, MD: 7 Robbers take $30,000 of Gucci
merchandise from Saks Fifth Avenue
The Washington area has its share of both robbers and high-end stores, and on
Tuesday, a group of the former made off with merchandise from one of the latter
in the Chevy Chase area of Montgomery County. Seven robbers took from $20,000 to
$30,000 worth of items from the Gucci store on Wisconsin Avenue, the county
police said. As reported by the police two of the robbers went into the Gucci
area of the Saks Fifth Avenue store about 11:30 a.m. and attacked two employees,
a man and a woman. Then, five other robbers entered the store, and all seven
began taking items from store display cases, the police said.

Stamford, CT: 2nd former AT&T employee accused of
stealing $232,000 worth
of iPhones and iPads extradited from New York
Garfield Lawrence, 38, of Bronx, N.Y., has been charged with first-degree
larceny and conspiracy to commit first-degree larceny. The arrest follows
identical charges filed in April against fellow AT&T store clerk Cody Malcolm.
Sean Coughlin said he and investigator Mike Stempien had been looking for
Lawrence for months. He said they took him into custody last week with the help
of New York Police Department financial crimes detectives. Coughlin said
Lawrence and Malcolm created 68 fraudulent customer accounts at their store
between July and September 2017 and stole 278 Apple iPhones and iPads worth
$231,687. Coughlin says he believes the devices were liquidated in the Bronx,
but none have been recovered.

Cloverdale, IN: Thief steals at least 30 firearms
from Gun store in small Indiana town
Police in Cloverdale are searching for a thief after someone broke into a gun
store and stole nearly 30 guns. The break-in happened sometime over the weekend
in the Putnam County small town. The small gun store called Guy’s Gun Locker
closed for business Saturday night and stayed closed all day Sunday and Monday.
During that time, someone broke into the business and stole at least 30 guns and
maybe more. Those stolen firearms include a number of handguns, as well as some
high powered rifles.

Volusia Sheriff slams Orange Deputies' handling
of gun-shop burglary as 'how people get killed'
Orange
County deputies followed a stolen car driven by a group of teenagers to a
Volusia County gun shop Saturday morning, then watched as the teens cut
electricity to the business, broke a window with a brick and drove away with
nearly $15,000 worth of stolen firearms.
But they did not try to stop the teens until they were back in Orange County,
even telling Volusia County deputies to keep their distance, Volusia Sheriff
Mike Chitwood said Tuesday — a decision he said could have put lives in danger.
“We should have been a part of the team,” Chitwood said. “This is our county.
[For OCSO] to watch a crime occur, and tell us to stay out of it — that’s how
people get killed.”

Milpitas, CA: Two arrested in Kohl’s Armed
Robbery where gun pulled on Loss Prevention jammed, thwarted deadly outcome
A pair of East Bay residents suspected in a Great Mall robbery from mid-July
might be facing far more severe consequences had a gun not jammed while they
were fending off loss-prevention officers, authorities said. Miguel Israel
Tovanche and Carmen Tara Vargas, were arrested last week in connection with the
armed theft at the Kohl’s at the Great Mall, as well as a robbery in Alameda.
According to Milpitas Police, on the afternoon of July 19, two loss-prevention
officers at Kohl’s spotted a woman pushing a shopping cart filled with
merchandise through an emergency exit, where a car was parked right outside. The
security employees intercepted the cart before the woman could load anything
into the car, but soon after, a man carrying a handgun aimed at them and pulled
the trigger, police said. But the gun malfunctioned, and the man and woman drove
off. “If it didn’t (misfire), we could have had a very tragic incident
possibly,” Milpitas Lt. Raj Maharaj said.

for staged Robbery
A man who orchestrated a break-in at the Palm Desert coin dealer business where
he worked, then claimed that two men tied him up and stole merchandise, was
found guilty Tuesday of embezzlement and making a false report to police. Jurors
at the Banning courthouse deliberated for about four hours before convicting
Martin Anthony Sarvey, 49, of Indio, of felony embezzlement and a misdemeanor
for lying to police.

Fort Collins, CO: Loomis Armored truck employee
accused of stealing $220K
A Colorado man working for an armored truck company is accused of stealing about
$220,000 while on the job. The Fort Collins Coloradoan reports 23-year-old
Travis Binder was arrested last week on a felony theft charge after a branch
manager for armored car company Loomis in Fort Collins reported the theft to
authorities. According to arrest documents, Binder told Larimer County deputies
that he made a "spontaneous" decision to take the money. He was in possession of
the bag of money in mid-April while loading a truck before making deliveries.
Authorities say Binder had hidden the money in his backyard and the company
recovered most of it.

Crews responded to a structure fire on Town Center West Road at approximately
10:17 p.m. Tuesday. Fire officials say the fire broke out on the second floor of
the building, and when they arrived the fire was almost extinguished due to the
sprinkler system turning on. The building has suffered water and smoke damage to
the second and first floors.

Houston, TX: Suspect sets fire inside store and
attacks workers
Clerks
at a gas station were shocked when a disgruntled customer returned and started a
fire near the beverage section. They tried to put out the flames, but say the
suspect charged at them when they got close. A clerk said the ordeal started
when the man pulled up to a gas pump and came inside rambling. "He came. He just
yelled like, 'Gas!' and I couldn't understand what he was saying," the clerk
recalled. The employees decided to call the police when they saw the man playing
with the lighter in the parking lot. When he came back inside, he put that
lighter to use, even putting a box in flames. The two workers tried to put out
the fire, but the man had other plans. "We even went out there and, like,
started trying to put out the fire, but he started charging towards us," the
clerk said. Fortunately, an officer arrested the man, later identified as
Richard Baxster. He has been charged with arson.

TN: Charges dropped against man in fatal Opry Mills Mall shooting
Prosecutors in Tennessee have dropped charges against a man who claimed
self-defense in a fatal shooting that set off pandemonium inside a mall in
Nashville. Davidson County Assistant District Attorney Jenny Charles said that
22-year-old Justin Golson’s actions were justified under the law. Golson
originally was charged with criminal homicide. Charles says she dropped the
charges after reviewing video surveillance and social media messages that
corroborated claims Golson was backing away from the confrontation with his
hands raised and that threats were made against him. Police say Golson and
22-year-old Demarco Churchwell were fighting inside the Opry Mills Mall when
Churchwell was shot May 3.
