"No
Touch" Shoplifting Policies on the Rise
News Team Visits Dr. Read Hayes and the LPRC Lab
The recent firing and subsequent re-hiring of a manager at Academy Sports gained
national attention as he chased a suspected gun thief and tackled him outside.
That incident fueling a fiery conversation about the nexus between following the
rules and doing the right thing.
Academy Sports manager Dean Crouch tackled a man accused of fleeing the store
with a stolen gun in his hand.
Academy sports initially benched Crouch for violating a "no touch" shoplifting
policy.
"What a powerful dilemma," said Dr. Read Hayes as he discussed the case with us
this week. "This just happened. I know the policy. I know why we have this
policy, but I just can't let this happen."

in Gainesville, Florida tuned into the story. Hayes launched the research institute after years as a store detective.
"I still have scars," Hayes said, "From shoplifters resisting, grabbing you or
cutting you."
Hayes says retailers are increasingly counting on technology - not people - to
stop retail theft.
A recent survey by Loss Prevention magazine shows 78 percent of retailers have a
no chase policy, 45 percent have a no touch policy, and 18 percent don't allow
apprehension at all.
"There's a huge mandate for that retail chain to say 'I want to protect my
people more than I want to protect my merchandise," Hayes said. "So you're
seeing a decrease overall of those wanting to - or allowing - touching or
detaining shoplifters."

Papa John's employees allege the pizza chain's controversial founder created a
toxic culture and made inappropriate advances toward employees
Papa John's is trying to distance itself from its controversial founder and
former CEO, John Schnatter, after it was reported he had used the N-word during
a conference call and resigned from his position as chairman.
Now, in a
wide-ranging investigation published by Forbes on Thursday, Schnatter is
being accused of inappropriate sexual behavior with employees.
"His behavior ranges from spying on his workers to sexually inappropriate
conduct, which has resulted in at least two confidential settlements," Forbes
writer Noah Kirsch wrote in the article, which is based on interviews with 37
current and former Papa John's employees.
One female employee said that Schnatter had asked about her bra size and whether
she'd slept with her previous boss, and that he never let her pass in a hall
without giving her a hug. Schnatter later denied this to Forbes.
The employees allege that Schnatter and two leading executives — Tim O'Hern,
president of international operations — and Steve Ritchie, the company's current
CEO, allowed a toxic work environment to thrive at the fast-food chain.

MGM Resorts denies liability for Las Vegas shooting,
asks courts for protection from lawsuits
The owner of the Mandalay Bay hotel says it bears no liability in last year's
Las Vegas concert massacre and is asking the courts to grant federal protections
that shield companies who provide anti-terrorism products and services to
civilians.
MGM Resorts International, which is facing a barrage of lawsuits over the
shooting, responded Friday by naming more than 1,000 of the shooting victims as
defendants in two lawsuits of its own. The entertainment giant is not seeking
monetary damages but, citing a federal law, asks the courts to protect it from
legal actions filed by the victims.

Nike Gets Default Win In TM Suit Over Counterfeit Shoes
A New Jersey federal judge handed a win Wednesday to Nike Inc. in a lawsuit
against several shipping companies who helped transport thousands of counterfeit
shoes from China to the United States.
U.S. District Judge Claire C. Cecchi granted Nike’s motions for summary judgment
on its claims against two affiliate companies called City Ocean International
Inc. and City Ocean Logistics Ltd., finding that whether they knew the
shipments were counterfeit is not relevant to whether they can be held liable
under the Lanham Act.
“For purposes of liability, Nike need not show that defendants intended to
transport counterfeit goods, or that they had knowledge of the counterfeit goods
in the seized shipments,” the judgment says.
The court also ordered Eastern Ports Customs Brokers Inc. to pay $240,000 in
damages to Nike in a default judgment, after the New York-based shipping company
failed to obtain new counsel, as ordered by the court, after their attorneys
withdrew from the case five years ago.

Internal documents show how Amazon scrambled to fix Prime Day glitches
One hour of downtime may have cost Amazon up to $100M in lost sales
Amazon failed to secure enough servers to handle the traffic surge on
Prime Day, causing it to launch a scaled-down backup front page and temporarily
kill off all international traffic, according to internal Amazon documents
obtained by CNBC.
And that took place within 15 minutes of the start of Prime Day — one of
Amazon's biggest sales days every year.
The e-commerce giant also had to add servers manually to meet the traffic
demand, indicating its auto-scaling feature may have failed to work properly
leading up to the crash, according to external experts who reviewed the
documents. “Currently out of capacity for scaling,” one of the updates said
about the status of Amazon’s servers, roughly an hour after Prime Day’s launch.
“Looking at scavenging hardware.”
A breakdown in an internal system called Sable, which Amazon uses to provide
computation and storage services to its retail and digital businesses, caused a
series of glitches across other services that depend on it, including Prime,
authentication and video playback, the documents show.
Other teams, including Alexa, Prime Now and Twitch, also reported problems,
while some warehouses said they weren’t even able to scan products or pack
orders for a period of time.

lost sales, depending on whom you ask, according to the news website Axios.

Survey Finds Technical Problems on Amazon Prime Day Hurt E-Commerce Giant
A new JDA Software, Inc. survey of over 1,000 U.S. consumers found that 27
percent of respondents who experienced technical issues on Amazon Prime Day
either gave up without making purchases or purchased less than they had planned.
A total of 52 percent of respondents experienced technical difficulties overall
during the two-day flash sale earlier this week.

Amazon Prime Day = Porch Pirate Week
Prime Day deliveries provide big opportunity for package theft
More than 100 million Amazon packages were delivered around the country on
Thursday after Prime Day earlier this week. And that means a prime
opportunity for porch pirates to poach packages.
Amazon said Prime Day was the company's biggest shopping event in its history so
millions of packages will be delivered.
Police nationwide are warning people that porch pirates will be waiting and
watching too. The Denver Police Department released surveillance video of
several porch pirates being caught on camera.
"If you see anyone suspicious driving by slowly looking at the porches or even
just walking by and looking, walking up to the porches, checking doors -- give
us a call or 911 or if you don’t feel it’s a big emergency, please give us a
call at the non-emergency line," Denver police spokesman Jay Casillas said.

Beware of Amazon Prime Day phishing scams that are spreading now
Amazon Prime Day phishing email scams are spreading like wildfire. There are
some different versions of the scam, though they all have the same goal in mind.
It starts with an email, one of which thanks the recipient for a Prime Day
purchase and goes on to say they are invited to write up a quick review on the
product. Another says the recipient will receive a $50 bonus or maybe a gift
card if you click on the link.
The link will send you to a lookalike site, one that will appear to be from
Amazon but instead will give any information you provide to the scammer.

NRF, White House make a ‘pledge’ to bolster retail career opportunities
The National Retail Federation is joining forces with the Trump administration
to increase the skills of current and future retail workers.
On Thursday, the
NRF signed the White House’s “Pledge to America’s Workers.” The move
positions both the NRF Foundation’s Rise Up job training program, and student
program that exposes college students to career opportunities in the retail
industry to help create enhanced career opportunities for 250,000 individuals
over the next five years.
The new White House initiative is aimed at increasing the skills of current and
future workers by expanding apprenticeships, educational opportunities and job
training programs. NRF was among more than 20 companies and associations that
signed the pledge. As part of the White House initiative, President Donald Trump
also signed an executive order establishing the National Council for the
American Worker, along with an external advisory board.

Missing bunny returned after Publix employees comb through landfill to
find stuffed animal
Madison, 3, forgot her stuffed bunny in a Publix shopping cart last
week. Thanks to security cameras, store manager Mike Gayhart
tracked Madison and her bunny’s movements from the store, the parking
lot, the cart and eventually a trash can and a dumpster.
It then went to
a trash compactor before being dumped into a garbage truck and driven to
a landfill, WPMI reported.
But Gayhart and three other employees went to the landfill and started
digging, WPMI reported. Against all odds, they found him. The bunny
still has a smell, but Madison doesn’t care. She hasn’t let go of him
and says he smells fine.

Study: Retailers are among cyber criminals’ top targets
75% of retailers have now experienced a data breach
More sensitive data being stored in the cloud - with few encrypting it
Despite an encouraging decrease in data breaches last year, cyberattacks are not
only on the rise in retail, they are gaining momentum.
Seventy-five percent of retailers have experienced a data breach in the past
compared to 52% last year, exceeding the global average, according to the “2018
Thales Data Threat Report, Retail Edition,” from critical information systems
provider Thales.
Retail data breaches in the United States more than doubled to 50% from 19%
in the 2017 survey. This massive increase drove U.S. retail to be the second
highest vertical polled to experience a data breach in the last year, ahead of
healthcare and financial services, and only slightly behind the U.S. federal
government, according to the study.
Despite these intrusions, U.S. retail is increasingly inclined to store
sensitive data in the cloud as widespread digital transformation is
underway. Yet, only 26% of companies reported implementing encryption —
which trails the global average.
Meanwhile, 95% of U.S. retail organizations plan to use sensitive data in an
advanced technology environment (such as cloud, big data, IoT and containers)
this year. More than half believe that sensitive data use is happening now in
these environments without proper security in place.

Online shopping sites see hacking increase despite security efforts
It's
estimated eight out of 10 Americans have shopped online, entering sensitive
personal data. Credit card numbers, passwords and addresses, for example. And
that's a gold mine for cyber-criminals that hack into online sites.
San Jose's Thales eSecurity's latest research says half -- 50 percent -- of all
medium and large online retailers it surveyed acknowledge they've been hacked.
That's two a half times higher than a year ago. Changes in payment systems are
making security more challenging.
"Now we have mobile devices, we have digital payments, we have mobile payments,
we have person-to-person payments," said Thales chief strategy officer Peter
Galvin. "Because of the way those changes have occurred, there really isn't a
perimeter. There's no four walls to protect."
This year alone, hackers broke into the retail sites of Adidas, the Dollar
Shave Club, Saks Fifth Avenue, and Under Amour, according to the nonprofit
group Privacy Rights Clearinghouse.
The servers of those and all other retailers store sensitive data. That is
leading to increased spending to encrypt that data. Or to add two-factor
authentication, where a retailer will send a text message with a code to verify
it's you. A single breach can cost retailers hundreds of millions of dollars and
can impact customer confidence.

'Credential Stuffing' Attack
Here's What Hackers Do With All Your Stolen Passwords
Over the years, hackers have broken in to some pretty massive databases.
Sometimes they make off with millions of records at a time. So what does a
hacker do with millions of users' passwords? Shape Security's latest report
highlights a kind of cyberattack known as credential stuffing.
In a credential stuffing attack, a hacker loads up a database with as many
usernames passwords as he or she can get their hands on. Those login credentials
are fed into an automated hacking tool that hammers away at a website.
You can think of a hacker's password database as a key ring. The more keys there
are, the more likely it is that the attacker will find one that unlocks your
account.
These attacks are much more common than you might think. According to Shape
Security, around 90% of all login attempts on retail websites aren't shoppers
logging in with their own accounts. They're the result of a credential stuffing
attack.

Human Resources Firm ComplyRight Breached
Cloud-based human resources company ComplyRight said this week that a
security breach of its Web site may have jeopardized sensitive consumer
information — including names, addresses, phone numbers, email addresses and
Social Security numbers — from tax forms submitted by the company’s thousands of
clients on behalf of employees.
Neither ComplyRight nor its parent company Taylor Corp. responded to multiple
requests for comment this past week. But on Wednesday evening, ComplyRight
posted additional facts about the incident on its site, saying a recently
completed investigation suggests that fewer than 10 percent of individuals
with tax forms prepared on the ComplyRight platform were impacted.
According to ComplyRight’s Web site, some 76,000 organizations — many of them
small businesses — use its services to prepare tax forms such as 1099s and W2s
on behalf of their employees and/or contractors. While the company didn’t
explicitly say which of its cloud services was impacted by the breach, the Web
site which handles its tax preparation business is efile4biz.com.

Walmart employees using app to get pay advanced
More than 200,000 Walmart employees in the U.S. have used the Even app to gain
access to their checks ahead of schedule. The retailer has partnered with Even
and another startup PayActiv to help employees better manage their finances.

How Online Retailers can Combat Fraud at

It’s imperative for online merchants to have a clear understanding of the
trends within the world of online fraud. They need to understand how

of transaction and beyond). Online retailers should fine-tune their fraud
prevention to ensure they can differentiate real account owners from

Identity Manipulation
After gaining access to an individual’s account, fraudsters find identity
manipulation an appealing fraud method, as it is particularly difficult to
detect. Identity manipulation occurs when a fraudster alters account
details, such as phone number and shipping address, without ever being
flagged as suspicious.
Coupon & Promo Abuse
Customers are savvy. By creating a new account, they can take advantage of
promos that would be otherwise unavailable to them as a return customer. But
when individuals continuously abuse promotions, businesses suffer a direct
financial loss. In some cases, the perpetrator may not even be aware that
they’re committing fraud.
Return Abuse
Customer expectations have shifted. Flexible return policies are no longer
the exception, they are the rule. But return abuse is a growing problem for
online merchants. Repeat abusers will frequently return goods for a full
refund after already using the merchandise. Sophisticated abusers set up
multiple accounts and leverage alternative payment methods to hide their
identities. As this abuse continues to grow, merchants often struggle with
the operational costs of fulfilling fraudulent orders, processing returns,
restocking merchandise and reassessing the worth of the returned items.

Anderson County, SC: 3 arrested in connection
with Organized Retail Thefts, ‘Operation Turning Tables’
Investigators worked since June to identify shoplifters who stole large amounts
of merchandise from retail stores in Anderson. The shoplifters would sell stolen
merchandise for a fraction of its retail value to others, referred to as fences.
These people would then resell the stolen merchandise at flea markets for a
profit, according to a press release form the Sheriff's Office. Troy Fowler, 75,
of Piedmont; William "Billy" O'Leary, 44, of Anderson; and Peggy O'Leary, 41, of
Anderson were identified by deputies as suspected fences, arrested and charged
with organized retail theft. Search warrants were executed at the suspects'
properties where an estimated $121,997 of stolen merchandise was recovered.
The arrests were made as a part of "Operation Turning Tables" that included
investigators from the Anderson County Sheriff's Office, Home Depot, CVS, T.J.
Maxx, Belk and Publix.

Palo Alto, CA: Police arrest 4 in Stanford
Shopping Center heists at Urban Outfitter and Victoria’s Secret
Palo Alto police announced yesterday they have arrested four suspects
in connection with two separate thefts in the last 10 days at Stanford Shopping
Center. On July 10 at 2:45 p.m., got a call about a theft that had just occurred
at Urban Outfitters. An employee saw two women loading numerous articles of
clothing into bags and running away from the store. Through follow up
investigation, detectives were able to identify one of the suspects as Tonisha
Harris, 26, of Fremont. Detectives arrested Harris in Hayward on Monday (July
16) and booked her into the Santa Clara County Main Jail on charges of felony
commercial burglary and a violation of probation. The other suspect has not yet

Trumbull, CT: Forever 21 Associate busted; scheme
to steal around $7,000 worth of merchandise
Officers arrested a Bridgeport woman who was involved in a conspiracy to commit
around $7,000 in internal theft from Forever 21. Corporate Loss Prevention
reported in November 2017 that merchandise was stolen and that several employees
were involved. Employees took sensors off of merchandise and a manager pretended
to ring up items for sale. The items were put in a bag and left near the back
door. Shameen Thomas, 33, of Bridgeport was charged with criminal attempt at
third-degree larceny and conspiracy. She was arrested July 16. More arrests are
expected.

Peachtree City, GA: 5 Shoplifters grab $6K in
merchandise from Victoria’s Secret
A group of five people on July 17 targeted Victoria’s Secret at The Avenue in
Peachtree City, and walked away with approximately $6,000 in merchandise.
Peachtree City Police Department spokesperson Odilia Bergh said the five
individuals entered the store carrying reusable shopping bags, later leaving the
store with a reported $6,000 in store merchandise. Bergh said one of the
suspects left the store and came back a second time.

TX: Police hunting 12 suspects who smashed Walgreen's with van, stole ATM
Police received a burglary-in-progress call at about 3:50 a.m. and a witness
told them multiple suspects in a van backed through the front of the store at
East Lucas Drive. The witness told police that the suspects fled in another van
and a dark colored sedan. When police reviewed surveillance video at the store
they noted at least 12 masked suspects wearing dark clothing were involved in
the burglary.

Boynton Beach, FL: PBSO says Delray, Boynton men
trafficked in painkillers; Armed Robbery and 3 Burglaries at Walgreens
Two men are now facing charges of trafficking in painkillers and stimulants
following their arrests with a bag filled with pills and liquids in a Boynton
Beach apartment complex parking lot. The Palm Beach County Sheriff’s Office
first arrested Douglas Johnson, 26, and Kennard Banks, 28, on May 8 for
trafficking more than 7 grams of oxycodone. An informant led investigators to
the two men. The informant spoke of one robbery and three attempted burglaries
at Walgreens pharmacies in Palm Beach and St. Lucie counties between March and
May. Johnson told the informant that “a new locking mechanism” kept him from
getting access to pharmacy pill vaults, the report said. He has not been charged
in any of these burglaries.

A surveillance camera captured a shot of a man who allegedly burglarized a North
Fort Myers convenience story Wednesday, making off with lottery tickets. No idea
if he won anything, but was later arrested.

Police are still looking for 3 women who pulled a Taser on a Victoria’s Secret
staff member as they fled with arms full of merchandise. As seen in the Robbery
video, a large front window of the store was covered by plywood resulting from a
Burglary reported on Sunday, $5,000 of merchandise was stolen.

UK: East London, England: Armed Robbery Gang hits
two Malls in one day;
targeting cellphone stores
Two
of East London’s biggest malls – Vincent Park and Hemingways – were hit by a
gang of armed men yesterday. There was speculation that the same gang said to be
seven strong, hit both malls. Customers and staff were locked in a store in one
of the heists, while at the other a person was seen through the shop window
being treated by paramedics. In the morning the Telkom Mobile store at Vincent
Park mall was the first target of the armed robbers yesterday morning when the
gang forced their way into the store and made off with an undisclosed number of
the latest mobile devices. In the afternoon, the Incredible Connection Store in
Hemingways mall was also robbed by a gang believed to number around seven.

found at Florida gas stations triple;
South Florida is ‘ground zero'
Across the state of Florida, skimming devices uncovered by state
inspectors nearly tripled in just one year. According to the Florida
Department of Agriculture and Consumer Services, inspectors found 169
skimmers in 2015, 219 skimmers in 2016 and tripled to 655 skimmers in
2017. Inspectors have recovered 539 skimmers in just the first six
months of 2018, putting Florida on track for over 1,000 skimmers this
year alone. More than half of those skimmers were found in Broward
and Palm Beach counties.

Green Bay, WI: Cuban citizen sentenced to prison for Green Bay area skimming
scheme
Alain Ceballos-Rodriguez, 37, committed credit card fraud and aggravated
identity theft, according to federal prosecutors. The devices used Bluetooth
technology to transfer customer credit card information to a laptop. The
scammers would then create "clone" cards. Ceballos-Rodriguez took cloned cards
and used them to purchase Wal-Mart gift cards. Ceballos-Rodriguez and
co-conspirators used the self-checkouts at the retailer to buy hundreds of gift
cards in the Eastern District of Wisconsin. The gift cards were taken to Florida
where they were used or sold online. Ceballos-Rodriguez was sentenced in federal
court on July 17. Chief Judge William C. Griesbach called him a "lower-level
participant" who was part of a well-organized fraud ring. The ring, based in
Florida, is comprised mostly of Cuban Nationals, prosecutors say.

Beach, SC: Delaware man sentenced to 12 years for Armed Robbery, Kidnapping of
C-Store Clerk
Nazjier Ferrell, (19 years old), of Castle, Delaware, pleaded guilty to armed
robbery and kidnapping in court on Thursday. A judge sentenced him to 12 years
in prison on each charge, but his sentence will run concurrently. Police were
called to the Scotchman in the Surfside Beach area for a robbery on May 7, 2017.
The clerk was forced into a vehicle with the suspects and held at gunpoint
before she was able to escape in Columbus County, North Carolina.
