Facial Recognition Banned in Third U.S. City
Oakland, Calif. Officially Votes Down Use of the Technology
Oakland, California, has become third city to ban the municipal use of
facial recognition technology. Late Tuesday night, the Oakland City Council
approved the ordinance, which requires a second and final vote that's scheduled
for Sept. 17.
Oakland neighbor San Francisco in May became the first city to ban its police
officers from using facial recognition technology, citing a breach of citizens'
civil liberties. The Somerville City Council in Massachusetts followed suit last
month.
Oakland City Council President Rebecca Kaplan, who prepared a report on the
proposed ban, cited limitations of the technology, the lack of standards around
its implementation, and its potential use in the persecution of minorities,
according to KPIX.

CFOs Remain Cautious With Corporate Cash
U.S. companies have not relinquished their liquidity buffers or their habit
of keeping cash in ultra-safe investment vehicles.
Credit may be bountiful and cheap, but finance chiefs refuse to play fast and
loose with the cash on their balance sheets or spend big on capital investments
that will deplete liquidity.
Restraint characterized the strategies for cash deployments and
short-term investments for the bulk of 2018 and the beginning of 2019, according
to the latest Association
For Financial Professionals annual liquidity survey.
In the 12 months to March 2019, about half of the 496 finance and treasury
professionals surveyed by the AFP said the size of their cash hoards had not
changed much, either domestically or outside the United States. Of those
whose overall cash balances had changed, 20% said their cash levels were smaller
and 30% said they were larger.
Increased operating cash flows, higher debt levels, and a pullback in
capital expenditures were most often cited as the reason for more cash on
hand.
In the months ahead, 61% of treasury and finance professionals reported that
their organizations will follow the same script — retain the size of their cash
balances. About one in five respondents anticipated their company’s cash balance
would rise (20%), but about the same number said their balance would fall (19%).

RILA Panel Discusses Product Recall Effectiveness
Retailers Play Unique Role in Recall Process
Last
week, Autumn Moore, RILA’s director of regulatory affairs and compliance, spoke
to over 150 product safety professionals on a panel at the International
Consumer Product Health and Safety Organization (ICPHSO). The panel, titled “Why
are Effective Recalls so Hard?”, focused on retailers’ role in implementing
consumer product recalls and also featured U.S. Consumer Product Safety
Commission (CPSC) Compliance Field Director Beverly Kohen and Carma Project’s
Founding Partner and President Tony Lim, and was moderated by Consumer
Federation of America’s Legislative Director and General Counsel Rachel
Weintraub.
RILA highlighted the unique role retailers play in the recall process, as both
the face of a recall for customers returning a product and seeking remedy, and
the facilitator of recalls on behalf of the manufacturer or supplier. Both roles
are key in ensuring that consumer product recalls happen efficiently and

New York Legislators Upend the Workplace Legal Landscape
New York employers should be aware of sweeping changes to the state's employment
laws impacting settlement and separation agreements, employment-related
litigation, and hiring and pay practices.
State lawmakers' 2019 changes come on the heels of landmark legislation enacted
in 2018 aimed at curbing workplace sexual harassment.
Nondisclosure Provisions Get the Kibosh
In July 2018, New York became the first jurisdiction to curtail the use of
nondisclosure provisions in sexual-harassment settlement agreements. The law
prohibits employers from including nondisclosure provisions unless the employee
wants to include the provisions and the employer complies with certain nuanced
procedural requirements.
In 2019, lawmakers expanded this limitation to cover agreements resolving all
forms of unlawful discrimination, harassment and retaliation
Lowering the Bar for Proving Workplace Harassment
Following California's lead, New York's new laws make it easier for employees to
prove workplace harassment claims. Under the new laws, however, harassment, at
least for purposes of New York's anti-discrimination law, will be deemed illegal
"regardless of whether such harassment would be considered severe or pervasive
under precedent applied to harassment claims."

Surge in Brazen Phone Thefts Leads to 'Major Police Crackdown' in Australia
Shoppers & Workers Terrorized by Gangs, Stores Hiring Security Guards
Police
arrested the seven teenagers − all aged between 14 and 16 − and seized
electronic devices in raids at three addresses in Melbourne's west on Tuesday
and Wednesday. It follows the arrests of four other boys over similar alleged
thefts last week.
The wave of recent arrests signals a major police crackdown on gangs that
terrorise shoppers and workers by swarming phone and computer displays to
rip away valuable goods.
Smash-and-grabs have become so common in Melbourne shopping malls that the big
three telcos have resorted to hiring security guards, equipping staff with
personal distress beacons and removing expensive models from display. Some
stores are now putting 'dummy items' on display. Others hide their stock
in the back rooms and bring them out only when a customer is interested.
The trend is so new neither police nor AMTA collect specific data about their
frequency, but Mr Althaus estimated there had been more than 100 robberies
combined across Melbourne, Sydney and Brisbane stores in the three months to
May alone. The thieves are brazen enough to work in busy shopping malls and
often in clear view of CCTV.

Luxury Goods-Maker LVMH - Oversees 70 Brands, Including Louis Vuitton & Sephora
Bill Gates is no longer the world's second-richest person. That title now
belongs to French billionaire Bernard Arnault.
Arnault, the CEO of luxury goods maker LVMH (LVMHF), overtook Gates
Tuesday on the Bloomberg Billionaires Index. It's the first time since the index
was created seven years ago that Gates has dropped out of the top two.
Arnault has built LVMH into a global luxury powerhouse that controls
brands such as Louis Vuitton, Christian Dior and Givenchy. It's also the
home of Champagne brand Dom Pérignon and beauty retailer Sephora.

companies said they planned to open more locations in "prime, high-traffic
retail markets" in 2020 but did not specify how many.

JetBlue flight evacuated after photo of suicide vest sent to crew, passengers
via AirDrop
A Tampa-bound JetBlue flight waiting for takeoff at Newark Airport was evacuated
after members of the crew and some passengers received a photo of a suicide vest
via Apple’s AirDrop. Although the source of the photo is unknown, someone nearby
– potentially a passenger, according to a report in the New York Daily News –
would have had to share the disturbing picture through the Bluetooth technology.

Security Snapshot: OS, Authentication, Browser & Cloud Trends
New research shows cloud apps are climbing, SMS authentication is falling,
Chrome is the enterprise browser favorite, and Android leads outdated devices.
As cloud and mobile adoption skyrocket, businesses seek new and stronger
ways to protect applications and data. In some ways, many have grown smarter
about data access and security. In others, research shows they still have some
work to do.
The
2019 Duo Trusted Access Report amasses data from 24 million devices, 1
million applications and services, and 500 million authentications across North
America and Western Europe to unearth trends in technology and cybersecurity.
Its findings show a rise in Windows 10, greater biometric adoption, and
an increasingly mobile workforce reliant on cloud. But researchers also
found businesses running outdated operating systems and popular browsers.
Application integration is up across most key categories. The number of
customers per cloud app is up 189% year-over-year, and the number of
authentications per customer per app is up 56%. Remote access rose 89% as more
people work outside the office but still need application access: Nearly half
(45%) of requests for protected apps came from outside the organization.

US businesses wired $301M a month to business email compromise (BEC) scammers in
2018
The US Department of Treasury's
Financial Crimes Enforcement Network (FinCEN) has run an analysis on suspect
transactions in the past year and found that US businesses in 2018 wired around
$301 million per month to business email compromise (BEC) scammers.
FinCEN
says the number of SARs (suspicious activity reports) describing BEC fraud
has climbed from 500 per month in 2016, when total monthly losses averaged $110
million, to 1,100 BEC-related SARs per month in 2018.
FinCEN found the number of victims from commercial services including
landscaping, retail, restaurants and hotel lodgings rose from 6% of reported
incidents in 2017 to 18% in 2019.
The dominant technique today is using fraudulent vendor and client invoices,
which grew from 30 percent in 2017 to 39 percent in 2018. FinCEN references the
case of a Lithuanian man who conned "multinational firms" into wiring at least
$100 million to overseas accounts he controlled. Those companies were Google and
Facebook
There is some good news despite the seemingly unstoppable growth of BEC fraud:
FinCEN claims its rapid response program, backed by law enforcement, recently
topped $500 million in recovered funds. Still, that's less than 20 percent of
the $2.9
billion the FBI estimates US business have lost since 2013.

Cyber NYC initiative strives to make New York a cybersecurity hub
The Cyber NYC plan is bringing together academic institutions, government
leaders and corporate partners to work on six distinct but interconnected
projects to
build cybersecurity competencies and create a cybersecurity ecosystem.
The New York City Economic Development Corp. (NYCEDC) announced the
Cyber NYC program last
fall, with $30 million in city funds and $70 million in private funding fueling
the initiative.
Meeting a global need
Government and business leaders believe Cyber NYC could have ripple effects far
beyond the city's boundaries.
The cybersecurity initiative focuses on driving innovation in the cyber
protection space, promoting thought leadership around the topic and training
cybersecurity experts -- all of which will help organizations throughout the
world better defend themselves against hackers and other cyberthreats.
Programs designed to address lacking cybersecurity
Two of the six distinct programs within Cyber NYC address the need for more
cybersecurity workers.
One is the Applied Learning Initiative, with the City University of New York
(CUNY), Columbia University, Cornell Tech, iQ4 and New York University
developing courses to train cyber specialists through new certifications and
degree programs. The other is the Cyber Boot Camp, for which Fullstack Academy
and CUNY's LaGuardia Community College have created additional cybersecurity
training programs.

Sprint Reveals Account Breach via Samsung Website
Sprint has been informing customers of a data breach discovered on June 22
that came by way of their account credentials via Samsung's "add a line"
website. The number of customers impacted has not been disclosed.
Information exposed in the breach includes phone number, device type, device
ID, monthly recurring charges, subscriber ID, account number, account creation
date, upgrade eligibility, first and last name, billing address, and add-on
services, according to Sprint's notification. The notification also stresses
information that might be used in financial fraud was not affected.
The most important information about this breach, according to Bob Maley, chief
security officer at NormShield, is it's not the first Sprint has seen this year.
"It sounds like [Sprint's] process for risk assessment for third parties might
be lacking," Maley says.

Beware of unsolicited packages after Amazon Prime
Day
They could be part of a scam
Earlier this month, Alice Mitchell, a writer and podcast producer who lives in
Los Angeles, opened an Amazon package filled with unusual items. At first, she
figured there must have been a mix-up and that her roommate had ordered
something in her name by mistake. But then the packages continued to arrive.
Mitchell wasn’t just inconvenienced; it’s likely she fell victim to an
online-shopping scam called “brushing.”
Other consumers across the country have similarly reported receiving dozens of
packages or more from Amazon that they never ordered in brushing scams. A New
York woman
received roughly a dozen packages containing a random assortment of items.
And a Massachusetts couple received unwanted packages from Amazon
once or twice a week for five months.
So-called “brushing” scams tied to Amazon began in the past three years, said
Brian Kilcourse, managing partner at consulting firm RSR Research. Retail and
security experts believe these scams are a ploy on the part of third-party
sellers to improve the number of reviews they have on Amazon for their products.
Here’s how they work: A third-party seller on Amazon will get the name and
address of a consumer. They will purchase an item that they will then send to
that person, claiming it’s a gift. Amazon’s policy allows the individual who
purchases a gift to leave a review for that item, so the third-party seller will
leave a fake review after the item ships. The review is listed as a “verified
buyer” review, meaning that it’s supposed to have more authority because it’s
from someone who actually bought and theoretically used the product.
In some cases, a consumer may have actually purchased an item in the past from
that seller, providing them with access to their name and address. And to some
extent, people’s addresses are easily found through basic web searches. Being a
victim of a “brushing” scam could also indicate something more nefarious. “It
can be indicative of some kind of breach of confidentiality or data security,”
Kilcourse said. “It’s a low-grade scam, with some pretty potentially serious
data privacy considerations.”

Facing a Big Jump in U.S. CNP Fraud, Retailers
Turn to Automated Tools
With merchants facing a projected 16.4% increase in U.S. card-not-present fraud
by 2021, many are relying more and more on automated screening tools to cull bad
transactions from the pile of good ones. That’s the assessment from Aite Group
Inc. in its report, “The E-Commerce Conundrum: Balancing False Declines and
Fraud Prevention,” released this week.
This fraud will increase from an estimated $5.5 billion this year to $6.4
billion in 2021. “CNP fraud losses continue to increase globally due to the
wealth of data available from data breaches and other sources,” Shirley W.
Inscoe, a senior analyst at Boston-based Aite, says in an email. “Some countries
that saw a decline last year are seeing these losses on the rise again. CNP
fraud is a low risk/high reward crime, and will continue to grow until major

Waco, TX: Ulta shoplifting case part of DHS
investigation into $2.1 million multi-state theft ring
A shoplifting case at an Ulta Beauty in Waco is connected to a federal
investigation into a multi-state theft ring at the cosmetics stores, Waco Police
Department Sgt. Patrick Swanton said. At about 9 p.m. on April 2, two women
carrying blue bags walked into an Ulta store in Waco, Swanton said. According to
Swanton, they loaded the bags with $1,349.95 worth of products and left the
store.
The case matches the description of a theft at a Temple Ulta store that same
night about an hour earlier. Cell phone video take from the Temple store shows
two women leave the store with blue bags loaded with merchandise. Temple police
said they stole $11,000 worth of perfume and cologne. A Temple police spokesman
could not confirm if the shoplifting there was part of the larger federal
investigation.
He said the case included multiple jurisdictions across central and northern
Texas and that charges were at the state level.
As Waco police officers started investigating the shoplifting, Swanton said Ulta
loss prevention contacted them, saying the Department of Homeland Security was
investigating the case as part of a multi-state theft ring at Ulta stores. The
department was asked to hold onto its case for documentation as part of the
larger federal investigation, Swanton said. Swanton said warrants have been
served in the case but could not say if they were search warrants or arrest
warrants. In total, DHS estimates the theft ring has led to $2.1 million in
loses for Ulta, Swanton said. A spokesperson for DHS said they don't comment on
active investigations.

Watertown, SD: Man arrested for burglary of
$100,000 in Jewelry
Drove 1400 miles with a Road Atlas to Makepeace Jewelry store
Watertown Police Detective Chad Stahl says 67-year-old Taksim Neriroski was
arrested for the crime. Stahl says Neriroski has a Las Vegas address. Stahl says
Neriroski disabled a lock on the front door of Makepeace Jewelry, which allowed
him to get inside the store. Neriroski has a criminal history dating back to the
1970’s that includes convictions for burglary, armed robbery, assaults with
weapons and drug crimes. Neriroski was not armed when he was arrested by police
Wednesday. Stahl says investigators are trying to determine how long the suspect
had been in Watertown before the arrest. Stahl says in the suspect’s vehicle had
a road atlas opened to the state of South Dakota.

West Sacramento, CA: Theft of over $1,000 in
cosmetics leads to 4 arrests, police chase
Four people were arrested accused of stealing $1,000 worth of cosmetics from a
Target store in West Sacramento, Wednesday evening. One of the four arrested,
however, is facing more serious crimes after police said she tried to drive a
car into police officers before leading them on a short chase. West Sac Police
said the three people who surrendered outside of Target are facing complaints of
conspiracy and burglary. The woman who fled is looking at charges of assault
with a deadly weapon and evading police.

Run: Seven more teens arrested for theft offences in Operation Burns
North West Metro Regional Crime Squad, ‘Operation Burns’ has arrested another
seven teenagers in relation to thefts from electronic and telecommunication
stores across Melbourne. Detectives executed warrants in the western suburbs on
Tuesday and Wednesday. The teenagers have been charged with more than 16
offences of theft occurring between 21 June and 9 July, 2019. This week’s
arrests come after detectives arrested and charged four teenagers on Friday (12
July). North West Metro Region Commander Tim Hansen said, “We are also working
closely with retailers to address security issues and implement crime prevention
measures, including through the National Retail Association’s Loss Prevention
Committee.”

Boynton Beach, FL: Woman sought in $1,000 Macy's
theft and assault on LP
Police said a loss prevention officer tried to stop the woman from stealing more
than $1,000 worth of Michael Kors and Tommy Hilfiger products from Macy's on
Tuesday. Investigators said the woman sprayed some sort of substance in the
officer's face and took off.

Phoenix, AZ: Armed Robbery victim shoots, kills
suspect outside Circle K
Phoenix police said around 1:30 a.m. on Wednesday a 19-year-old man called
police to report he was the victim of an attempted armed robbery at knifepoint.
The victim told police he was sitting in his vehicle at the fuel pump when his
door opened. An unknown woman approached in an attempt to divert his attention
when a man, 25 to 35 years old moved towards him. The suspect displayed a knife
and demanded the victim's vehicle. The victim had a gun and fired several shots
at the suspect. The suspect was pronounced dead on the scene. The female suspect
fled the scene on foot.

shot dead following Armed Robbery
Birmingham police officer was shot and the suspect is dead after an armed
robbery Wednesday evening at a convenience store downtown. The officer has been
identified as Cullen Stafford. He underwent surgery at UAB Hospital and is in
stable condition. The incident happened after police were called to a robbery in
progress at a convenience store. When police were trying to apprehend the
suspect, officers say he pulled out a handgun and fired at them. After the first
officer was hit, the suspect continued to fire a weapon and police officers
began to return the fire. Gunfire was exchanged over multiple locations before
the suspect was pronounced dead at a scene near a parking structure.

Armed Robbery at Verizon store (bodycam and surveillance video)
Four suspects burst into a Verizon store on Wednesday, put a gun to a clerk’s
head, tied him up and demanded that he open a safe in the back room. As police
converged on the scene, the bound clerk escaped from the suspects and made his
way into the arms of officers. The thieves may have pulled off the heist, but
the armed robbery was disrupted after an observant 911 caller noticed four
people run into the store. As soon as two of the suspects were walking out of
the back room, police were right there at the front door telling them, “Put your
hands up.” They cooperated, but the two others were hiding in the back room
where police easily found them. One firearm was found on scene as police
investigated. They’re being charged with aggravated robbery with a gun and
kidnapping.

Two suspects are under arrest, accused of running a burglary ring that’s plagued
businesses in Louisiana. Detectives say these suspects committed more than 60

stores, gas stations, Dollar Generals, and similar shops. Detectives say the duo
may be involved in crimes in Mississippi and Texas, those investigations are

Fingerprints on peanut butter container ID'd him. A sticky-fingered thief ran
off with a woman's wallet, but investigators think they know whom to look for.
That's because they found fingerprints on the container of peanut butter that
played a major role in the 2018 theft at Whole Foods in Palm Desert. Grand theft
charges were filed last week against Ramon Ayala, 31, of Van Nuys, who is
suspected of using a peanut butter dispenser as a distraction to steal a $300
wallet on May 6, 2018.

Canal Street’s notorious knock-off vendors are up to their old tricks. At least
four people were busted and approximately half a million dollars in fake
merchandise seized Wednesday afternoon by NYC Sheriff’s Officers during a series
of raids on Chinatown counterfeiters. Videos and photos show about 20 Big Apple
sheriff’s officers scouring shops and standing among overflowing bags of
imitation Gucci hats, fake Louis Vuitton bags and belts and other faux luxury
goods.

Hampton, VA: Man sentenced to life in prison,
plus 163 years in prison for GameStop robbery, murder of police officer
Leonard Allen Morrison III, 31, of District Heights, Md., was convicted of two
counts of attempted capital murder of a police officer as well as several
robbery, robbery conspiracy, abduction and gun charges in the June 12, 2017,
shooting outside the theater on Hampton Roads Center Parkway. According to
witness statements, the men locked customers and staff inside the store before a
foot pursuit with police that ended with one officer being shot. Luckily the
officer survived but tore his ACL during the encounter. James Gregory, one of
the men accused of robbing a GameStop, was sentenced to 80 years in prison.

Sumter, SC: Teen found guilty of murder in
Save-Mart Grocery shooting
A Sumter teenager was found guilty Wednesday of murdering a Manning Avenue
convenience store owner in 2017. Sincere Dinkins was 17 years old on Nov. 24,
2017, when he and Larenzo Hagood entered the Save-Mart Grocery, ordered two
female customers to the ground and attempted to rob Vijaykumar Patel at
gunpoint. By the time they fled, Patel had fallen fatally wounded on the ground,
multiple bullets shot into his chest.

Going beyond your job description and taking responsibility for things outside
