Shoplifting & Employee Theft Case Values Soared in 2018
According to Jack L. Hayes International's 31st Annual Retail Theft Survey
Over 279,000 shoplifters and dishonest employees were apprehended in 2018
by just 20 large retailers who recovered over $114 million from these thieves,
according to the 31st Annual Retail Theft Survey conducted by Jack L. Hayes
International, a loss prevention and inventory shrinkage control
consulting firm.
“Theft case values soared in 2018 with the average shoplifting case value
($301.97) increasing 11.8%; the average dishonest employee case value
($1,361.37) increasing an amazing 30.1%; and the total average theft case
value ($408.77) up 17.0%! While the retailers participating in this survey
did not apprehend as many thieves as they did the previous year, they were
recovering more dollars from the thieves they did apprehend,” said Mark R.
Doyle, President of Jack L. Hayes International, Inc. “With the
increase in dollar recoveries, retail theft overall continues to be a serious
problem for retailers negatively impacting their bottom-line, which results in
higher prices to consumers.”
Highlights from the annual theft survey include:
• Participants: 20 large retail companies with 13,674 stores and over
$330 billion in retail sales (2018).
• Apprehensions: 279,196 shoplifters and dishonest employees were
apprehended in 2018, down 11.8% from 2017.
• Recovery Dollars: Over $114 million was recovered from apprehended
shoplifters and dishonest employees in 2018, up 3.2% from 2017.
• Shoplifter Apprehensions: 251,051 shoplifters were apprehended in 2018,
down 11.7% from 2017.
• Shoplifter Recovery Dollars: Over $75 million was recovered from
apprehended shoplifters in 2018, a decrease of 1.4% from 2017.
• Employee Apprehensions: 28,145 dishonest employees were apprehended in
2018, down 12.7% from 2017.
• Employee Recovery Dollars: Over $38 million was recovered from employee
apprehensions in 2018, up 13.5% from 2017.
• Average Case Values: Total Theft: up 17.0%; Shoplifters: up 11.8%;
Dishonest Employees: up 30.1%
• Shrink: 55.0% of survey participants reported an increase in shrink in
2018, with 35.0% reporting a decrease in shrink, and another 10.0% reported
shrink stayed about the same.

Manhattan U.S. Attorney Announces
Criminal & Civil Charges Against
CEO Of Stargate Apparel Group For Million-Dollar Customs Fraud
JOSEPH BAILEY, the CEO of a children’s apparel company headquartered in
Manhattan. BAILEY was charged, in an indictment unsealed today, with
participating in a years-long scheme to defraud U.S. Customs and Border
Protection (“CBP”) by submitting invoices to CBP that falsely understated the
true value of the goods his company imported into the United States.
BAILEY’s scheme resulted in the loss of over $1 million in duty revenue to the
United States.
Around 2007 to i2015, BAILEY and other employees of STARGATE engaged in a
scheme fraudulently to understate the value of goods imported into the
United States. STARGATE purchased much of its merchandise from a manufacturer
located in China. Starting shortly after STARGATE began doing business with
Manufacturer-1 in 2007, BAILEY and others at STARGATE engaged in a
double-invoicing scheme by which STARGATE would receive two sets of invoices
from Manufacturer-1 for the same shipment of goods. One invoice, referred to as
the “pay by” invoice, was significantly higher and reflected the actual price
paid by STARGATE for the goods. The second invoice reflected a significantly
lower price for the goods and was presented to CBP. This allowed STARGATE to pay
a fraudulently lower amount of customs duties.

Vermont: Dollar General to pay $1.7M for over-pricing errors
Dollar General is paying Vermont $1.7 million dollars as part of a settlement
under the state's Consumer Protection Act. Attorney General T.J. Donovan says
the company repeatedly violated consumer protection laws by advertising prices
on store shelves and then charging more at the register. Donovan says there were
at least 362 violations at 22 different stores. There are a total of 36
stores in Vermont.
The price differences ranged from two cents to $6. Donovan says the Vermont Food
Bank will receive $100,000 of the settlement money. Donovan says Dollar General
paid nearly a quarter-million dollars in administrative penalties in recent
years but did not correct problems, so his office enforced the law under the
Consumer Protection Act.

Snoop Dogg-Backed Pot Co. Accused of Conning Credit Cards
Eaze, a Snoop Dogg-backed cannabis delivery company, has been accused of conning
unwitting banks and credit card companies into processing payments for pot
products in a lawsuit filed in California state court by a competing delivery
company.
Herban Industries claims Eaze's credit card payments are illegal. The card
payments are filtered through shell companies that Eaze controls and are
designed to look like a payment for a more innocuous product - like dog toys or
face cream - a violation of both federal and California state fraud laws, Herban
says.

Imports at the nation’s major retail container ports are expected to continue to
grow this summer as retailers stock up inventory to get ahead of higher tariffs,
according to the monthly Global Port Tracker report released today by the
National Retail Federation and Hackett Associates.
“With a major tariff increase already announced and the possibility that tariffs
could be imposed on nearly all goods and inputs from China, retailers are
continuing to stock up while they can to protect their customers as much as
possible against the price increases that will follow,” NRF Vice President for
Supply Chain and Customs Policy Jonathan Gold said.

Mexico tariffs to hit small biz most
Main street groups are sounding off on President Donald Trump’s latest round of
tariff proposals, worried about ongoing trade tensions and the impact frayed
relationships may have on the companies’ bottom lines. Last week Trump
threatened to put 5% tariffs on Mexican goods beginning on June 10, with gradual
increases as high as 25% this year. Several small business groups have issued
statements since the tariffs were proposed last week.

US airlines are bumping more travelers as Boeing 737 Max planes grounded
Here’s some unwelcome news to start the summer travel season: Your chances of
getting bumped off your flight are on the rise. After boasting record low
bumping rates, U.S. airlines in the first three months of this year denied
boarding to travelers at the highest rate since 2017, according to Department of
Transportation data released Wednesday. The increase was partially driven by the
grounding of the Boeing 737 Max, which took more than 70 of the high-capacity

author, speaker and the CEO of LMG Security and BrightWise Inc. Over the years
she has worked closely with numerous retail companies, evaluating security
systems and data breach responses.
In June, Davidoff will speak at
NRF PROTECT about emerging threats and potential

hacking, retail cyber threats and tips for avoiding potential data compromises.
What is an “ethical hacker”?
To me, hacking means you are thinking outside of the box and you’re really
pushing the envelope and being creative. Unfortunately, hacking has had a
negative connotation over the past 20 years because many hackers have turned to
crime and we now have organized cybercriminal groups.
The term ethical hacking is a way of taking back the word “hacking” and bringing
it to the side of the good and light where we remind ourselves that it is
possible to hack for ethical purposes. [We] break into companies in order to
show weaknesses — and we do it under contract, so it’s with permission and for
good and beneficial purposes.
Is the retail industry more susceptible or on a par with other industries?
It seems that way due to negative publicity. It’s easier to detect payment card
breaches than it is other types of breaches. When payment card numbers are
stolen, third parties typically find out about that.
As a forensic analyst, I see a huge number of cases come through. Cases where
business email is compromised are a good example. Organizations have their email
hacked, intellectual property gets stolen, social security numbers get stolen,
but they can handle those quietly, investigate them and notify a small number of
people. When payment card breaches happen, it tends to be very public —
merchants get outed, it’s in the news.

Security Chiefs Challenged to Gain Corporate Directors' Trust
Company boards know they need to understand cybersecurity better, but many
haven’t developed deep knowledge of the field so critical to corporate health,
experts said Thursday at the WSJ Pro Cybersecurity Executive Forum. That’s where
security chiefs come in.
Helen Rabe, former CISO of real-estate firm CBRE Group Inc., says a CISO must
educate directors about security in a way that doesn’t belittle their surface
understanding and avoid jargon that makes their eyes glaze over. “There’s a lot
of work involved. It’s political,” she said. “They’re human beings. You need to
coach. All have different needs, requirements and personalities.”
One method she has used is to cultivate an ally in the chief executive, who can
smooth introductions and promote conversation.

How do Amazon Go stores work?
Customers like to shop. They do not, however, like to wait.
This unsurprising discovery, Amazon vice president Dilip Kumar said, is at the
heart of Amazon Go’s in-person retail stores, in which customers simply select
their goods of choice, place them in their bag, and go. No lines, no check-outs,
no problems. (There are currently 12 stores across the US.)
But such a “magical” shopping experience doesn’t come easy. Speaking at Amazon’s
inaugural public Re:MARS conference on robotics, machine learning, automation,
and space today, Kumar laid out the three problems Amazon Go engineers faced in
producing staggeringly twiddly technology to solve these comparably complex
problems. (The sensor- and AI-powered technology is similar to what makes
self-driving cars work: computer vision, merging data from multiple sensors, and
deep learning.)

Some Walmart associates say robots aren’t what they’re cracked up to be
Employees at a Walmart Supercenter in Marietta, GA say that robots brought on to
relieve workers of boring, repetitive tasks may actually be making their jobs
worse. By focusing on tech-led efficiencies, workers complain that much of

Study Preview Finds Cost of Fraud for E-Commerce
Merchants Highest Ever
On its first day, CNP Expo attendees got an advance look at one of the most
eagerly anticipated fraud benchmarking reports released each year. For U.S.
merchants in 2019, the True Cost of Fraud Study from LexisNexis Risk Solutions
found that every $1 of fraud loss actually cost companies $3.13. That’s 6.5
percent higher than last year and the highest figure measured by LexisNexis in
the 10 years the company has been producing the report. To account for all the
costs a business incurs from a fraudulent transaction in addition to the direct
loss of the stolen goods, the company uses a proprietary multiplier.
While the report will be released widely later this year, LexisNexis shared
preliminary results with attendees of a pre-conference session at the CNP Expo
at the Marriott Marquis in San Francisco.
The study also noted a huge surge in fraud attempts and successful attacks.
After posting moderate annual growth since 2013, the number of overall fraud
attempts rose by 123 percent from 2018 to 2019. And, the number of those
attempts that succeed grew by 84 percent. The average value of successful
fraudulent transactions rose 34 percent from $184 to $248, according to
LexisNexis.

The rise of authentication has curbed the flow of
counterfeits to fashion resellers
As the resale market has continued to boom, stricter measures of authentication
have lessened the strength of fashion counterfeiters.
Counterfeits are one of the biggest pains in the neck of fashion and beauty
brands, particularly in luxury and streetwear where authenticity and
exclusivity are paramount, but the number of fakes coming through resellers is
on the decline. According to a report from Entrupy, an authentication platform
used by resellers to authenticate luxury goods, the rate of counterfeit goods
being sold at resellers has diminished from 15% of products in 2017 to 10% this
year.
“Fakes are huge,” said Eddy Lu, co-founder of sneaker reseller GOAT. “Nike is
the most-counterfeited brand in the world. That’s why GOAT exists in the first
place. We used to see a much higher volume of fakes, but now people know we
authenticate heavily, and our fake rate has gone down.”
As resellers like The RealReal or StockX
strengthen their authentication teams, counterfeiters are dissuaded from
trying to sneak fakes through. But this actually has two unintended side
effects. According to Entrupy, stricter authentication means fewer fakes, but
the fakes that are still being sold are a much higher quality (the
so-called “superfakes”) and they are being pushed to other markets and
worming their way into the supply chain there.

IL internet sales tax overhaul takes aim at
e-commerce giants
Beginning Jan. 1, 2020, online sellers like eBay, Amazon and Walmart must
collect and remit the Illinois sales tax at 6.25 percent. Additionally, sellers
in other states must also comply with the new collection laws that apply in the
location where the products are being shipped. The Illinois Retail Merchants
Association projects the two changes will generate an additional $460 million
in annual revenue and lead to an increase in compliance.

Winter Haven, FL: Retail theft suspects stole
over $2 million in products across Florida
Five people have been arrested and one is on the run accused of orchestrating a
retail theft scheme across 14 Florida counties, stealing over $2 million worth
of goods. The suspects, all from Tampa, were arrested following an undercover
investigation among state and local agencies in Florida. Detectives said the
individuals targeted the following stores: Burlington Coat Factory, CVS,
JCPenney, Publix, Walgreens and Winn-Dixie, stealing items like razor blades,
white strips, shoes, and cologne, among other items.
Officials said the six suspects hit up to 10 businesses per day, between four
and five nights a week, stealing between 10-and-$15,000 worth of merchandise a
night, storing the stolen goods inside a cooler and making several trips in and
out of the store. "This is unbelievable to me that they can go out like a swarm
of locusts and steal so much in one night," said Polk County Sheriff Grady Judd
at a news conference Wednesday.

Las Vegas, NV: Crooks use stolen credit cards to
buy gas; fuel sold in neighborhoods
A warning from Metro Police: Beware of people who are using stolen credit cards
to buy gasoline. Metro said after they purchase it, they store and sell the gas
in valley neighborhoods. According to Metro, it's the most organized crime
detectives have investigated involving fuel. The scheme spans multiple
jurisdictions and required the assistance of other law enforcement agencies in
Clark County, along with the Secret Service. Police say people are using stolen
credit cards to make purchases of 100, 200 and even 300 gallons of gas at a
time. Metro released a PSA Thursday that shows modified cars and vans with
hidden containers to hold the fuel for transport. The criminals then sell the
gas in neighborhoods or store it in large tanks at homes. There's no law against
the number of fuel people can buy or have on their property, but firefighters
concerns include the unsafe transfer of gas to other cars and improper storage
which may cause an explosion.

Oxnard, CA: Police arrest four during shoplifting
sting at Home Depot
Two adults and two teenagers were arrested during a shoplifting sting operation
in Oxnard on Wednesday, authorities said Thursday. The sting took place from 2
p.m. to 6 p.m. at Home Depot, 401 W. Esplanade Drive. During the operation,
police detained and arrested four suspects on suspicion of shoplifting: a
30-year-old male adult, a 26-year-old male adult and two 16-year-old male
juveniles. The sting operation was conducted in conjunction with loss prevention
officers at Home Depot, authorities said.

Houston, TX: Food truck owner killed in robbery outside
store in SW Houston, gunmen on the run
Martin Ayala, 49, was leaving the Post Oak Corner Store on South Post Oak near
Willowmine Way when he was ambushed by four men. They robbed Ayala and shot him
multiple times outside the store before taking off in a vehicle, police say.
Police believe Ayala may have been targeted because he was a local business
owner known to carry money. It's also possible he parked his taco truck there
and the gunmen may have known his routine.

said. The officer who shot the suspect was a member of a task force created by
police in Bucks County along with the F.B.I. to investigate the 7-Eleven

Asheboro, NC: Shooting reported outside Grocery Store
A reported shooting outside of Compare Foods, across the street from Randolph
Health on North Fayetteville Street in Asheboro, was being investigated by
Asheboro Police in the early evening hours Thursday. The area outside the left
side of Compare Foods was cordoned off with police tape. The shooting reportedly
happened near the last pillar outside the store. Several Asheboro officers and a
K-9 officer were on scene at 7:30 p.m.

Portland, OR: Kohl’s Robbery suspect in custody after
barricading inside Fred Meyer
Police said an armed man robbed a nearby Kohl's around 1 p.m. and then ran into
the Gateway Fred Meyer and barricaded himself, spurring a massive police
response. Portland police officers seized a gun from an armed robbery suspect in
Northeast Portland, June 6, 2019.
Officers found the man outside near Fred Meyer but he ran into the store. Fred
Meyer was evacuated and a Special Emergency Reaction Team and a Crisis
Negotiation Team responded to help. The man was taken into custody around 4 p.m.
Authorities identified him as 34-year-old Tommy Lee Brown Jr. and said he was
found hiding in a storage area with a firearm. No force was used to take him
into custody.

Lamar County, MS: Dollar General robber had help
from store employee
Investigators with the Lamar County Sheriff’s Office said they believe the man
who robbed the Dollar General store on State Route 589 on May 30 had inside help
from a store employee. Sheriff Danny Rigel said deputies have arrested Andrea
Cooley, 19, and Daylen Jones, 19, in the case.

The Delaware State Police said in a news release Friday that 28-year-old Irvin
Parker, of Bear, falsely reported that a suspect had entered a Dollar Tree store
in New Castle late Thursday and demanded cash at gunpoint. Police say
investigators arrested Parker after finding inconsistencies in his report.

Wilkes-Barre, PA: Police letter to hit-and-run
suspect who picked up a shoplifter goes viral
A kindly worded open letter from police to a hit-and-run suspect went viral
Thursday morning. The letter, addressed to a woman identified only as “Katie
Y.,” says she struck two vehicles while picking up a male shoplifter fleeing a
loss-prevention officer at Gabe’s at 815 Kidder St. Police inform the suspect
that one victim had only liability insurance and cannot afford to fix the damage
herself.
“While you were kind enough to stop to pick up the fleeing male; allowing the
victim (whose) vehicle you struck to take photos of you and the vehicle’s
registration number, unfortunately state law also requires to provide your name,
address, drivers license and insurance information,” Wilkes-Barre Twp. police
wrote in the letter, which was posted on Facebook.
Police say they were able to identify the driver in the photos because she was
previously on the A&E program “Intervention.” In an episode titled “Katie is
Addicted to Heroin” that aired on March 22, 2015, Katie describes how her plans
to become an Irish dancer were dashed by her addiction.
Police say they provided the victim with Katie’s information, but they were
still asking her to come to headquarters and to provide the name of the
shoplifter she picked up. “Please kindly stop by our station with your insurance
information and the name of the fine gentleman you were the gateway vehicle for
so we can help the victims get their vehicle’s repaired,” police wrote, offering
to give her a ride if her vehicle is no longer operational. As of Thursday, the
post had more than 1,000 likes on Facebook.

Richland, WA: Arsonist sets three fires inside
Walmart
Fire crews were called out to the Richland Walmart at around 11:00 p.m. Thursday
on a report of a fire set in the gardening section of the building. Upon
arrival, Richland Fire Battalion Chief Duncan said there were two more fires set
in the building. One was in the houseware section and the other was near the
center of the store. According to Duncan, all three fires were small and fire
crews were able to extinguish the flames quickly. He said their biggest concern
was the potential smoke damage on the merchandise in the store. The Walmart was
evacuated and closed down as fire crews used fans to clear the store of smoke
and multiple agencies worked to investigate the arson. Duncan said they do have
surveillance footage, as well as witnesses and evidence they will review as part
of the ongoing investigation.

With everything that goes on in one's personal and professional life, it's
oftentimes difficult to be able to really focus on the day's objectives. It's
easy to get lost in everything going on around you and, while no one can bat
1,000 everyday, you've got to be able to separate -- to use your work as a form
of escape from everything and to get lost in your work. Your work can give your
mind the chance to separate from virtually anything going on in your life which
allows your subconscious time to rethink-refresh- and hopefully see things more
clearly. It's like using work as therapy. The trick is forcing yourself to do
it. Much easier said then done.
