Mark Zuckerberg's personal security chief accused
of sexual harassment
And making racist remarks about Priscilla Chan by 2 former staffers
Mark Zuckerberg's personal head of security has been accused of misconduct
by two former members of the Facebook CEO's private staff.
Liam Booth, a former Secret Service agent, has been accused of sexual harassment
and making racist, homophobic, and transphobic comments.
The two former staffers have hired the high-profile law firm the Bloom Firm to
represent them.
They
allege, among other things, that the security chief repeatedly made racist
remarks about Zuckerberg's Asian American wife, Priscilla Chan.
One of the accusers is a former employee of the 34-year-old billionaire's
household staff, the other is a former executive assistant to Liam Booth,
Zuckerberg's security chief.
They describe "pervasive discriminatory conduct," "horrific levels of sexual
harassment and battery," and an environment in which support staff were
repeatedly subjected to racist, homophobic, and transphobic diatribes.
The letters also accuse Brian Mosteller, the managing director of Zuckerberg's
private office and a former special assistant to former President Barack Obama,
of failing to take action after the two staffers raised complaints.
Facebook spends
$20 million annually on Zuckerberg's personal protection and travel.
As soon as The Bloom Firm presented these allegations, the family office engaged
Munger, Tolles & Olson, an outside law firm, to conduct an investigation of all
allegations made by The Bloom Firm to determine whether the claims have merit.
The investigation is ongoing. Mr. Booth is on administrative leave pending the
completion of this investigation."
Booth heads up the security operations for Zuckerberg's personal infrastructure
while also working as the chief security officer for the Chan Zuckerberg
Initiative.

In Case You Missed It:
Canada's Not Prosecuting
Decriminalization Trend in North America
"Shoplifting and other petty-crime cases are being dropped by courts"
'Our justice system is crumbling both on a federal level and provincial
level'
Across Canada, people accused of petty crimes like shoplifting, minor
assault and fraud are walking free - because the justice system doesn't have
time to deal with their cases, as it struggles to move more serious crimes
through the courts.
"At some point, we have to make a decision: what crimes do you want us not to
prosecute?" said Rick Woodburn, president of Canadian Association of Crown
Counsel, whose organization represents 7,500 Crowns across the country.
"And as you can see, it starts falling off the bottom. And sooner or later,
we're going to decriminalize, because we're not prosecuting certain types of
offences."

Retailers' Online Reputation Impacts Sales
Online reputation matters. At the Transform '19 conference in San Diego earlier
this month, one point driven home was that, while brands and retailers have
expanded their conversational touchpoints as a result of social media efforts,
the vast majority of conversations about a particular company's products and/or
services takes place outside of those they control.
"We live in a 'Feedback Economy' with millions of points of presence to
manage,” said Joe Fuca, CEO of reputation.com, the firm behind the conference.
Reputation score and revenue performance correlate directly - retailers with
high scores generate 3.9 percent higher sales.
Effectively managing online perception requires a systematic approach (beyond
social listening and crisis management) that supports brand strategy. New
technologies, processes, data sources and machine learning provide the ability
to dynamically develop, analyze, act on and measure online presence.

Sustainability is Driving Consumers' Purchase Decisions
It's All About Your Actions & Reputation
The meteoric rise of fast-fashion has brought with it a serious
philosophical for consumers: should they consider mass produced goods' impact
on labor practices and the environment?
Shoppers are increasingly considering sustainability when making purchases,
according to research conducted by CGS in November 2018, which found that 68% of
US internet users deemed product sustainability an important factor in making a
purchase.
Some retailers are paying attention to consumer demands for a better
understanding of issues that once were likely ignored, such as ethical supply
chains. For example, the fashion retailer Everlane has incorporated a policy of
"radical transparency" into its brand identity by sharing the details of
product markups, sourcing practices and manufacturing facilities with
shoppers.
GS's survey revealed that younger shoppers seemed more attuned to the ecological
impact of their purchases. The poll found that 68% of those ages 18 to 24
had made an eco-friendly purchase sometime during the preceding year and were
willing to pay higher prices for sustainable products when compared with the
general public.
CGS claims that transparency around the materials and development of products
can increase consumer loyalty. "Today's buyers are driven by more than
price-they're looking for brands that align with their own values and needs,"
said Paul Magel, president of CGS' business applications division.

Sexual-Harassment Settlements: How to Comply with California's New Rules
A new law, effective Jan. 1 of this year, has changed the way businesses must
handle settlements, so employers will need to review their policies and
procedures to ensure they meet the new requirements.
Specifically, California Code of Civil Procedure Section 1001 prohibits public
and private employers of any size from settling lawsuits and administrative
claims using agreements that prevent the disclosure of factual information
regarding:
● Sexual assault.
● Sexual harassment.
● Workplace harassment or discrimination based on sex.
● The failure to prevent acts of workplace harassment or sex discrimination.
● Retaliation against workers who report sexual harassment or sex
discrimination.
Any settlement agreement that provides otherwise is void on grounds of public
policy. This means that settlement agreements for lawsuits or administrative
claims alleging sexual harassment, assault, or discrimination or retaliation
based on sex cannot be confidential.

FMI Delivers Comments at FDA Public Hearing to Address Products Containing
Cannabis, Hemp, CBD
Food Marketing Institute (FMI) today participated in the Food and Drug
Administration's (FDA) public hearing regarding products containing cannabis or
cannabis-derived compounds, including hemp and cannabidiol (CBD), as the agency
considers whether and how to create a legal pathway for such products. FMI both
conveyed the seriousness of the regulatory ambiguity facing its member companies
and their shoppers amidst the momentum of these products in the marketplace, and
also appealed to FDA for additional clarity.
"A challenge for us is that the Agricultural Improvement Act of
2018, or Farm Bill, contains several provisions that allow for the cultivation,
production, and commercialization of industrial hemp and hemp-derivatives like CBD," FMI
President and CEO Leslie G. Sarasin said. "However, the new law did not alter FDA's authority over the use of such
ingredients in FDA-regulated products; not to mention the role of other
regulatory agencies and the states. Food retailers recognize the confusion among
the public, suppliers and retailers, and state regulators as a result of the
Farm Bill language."

The Gap Makes Headline News:
'The Gap may not be around 10 years from now'
After years of product miscues, weak sales and pressured margins at the hands of
rising online apparel competition and mall rents, Gap management has settled on
a strategy to "fix” what ills the once iconic brand. Spin off Old Navy and keep
on closing underperforming Gap stores.
But simply closing stores of an apparel brand that probably can no longer
consistently grow sales (if at all) isn't a long-term savior. Rather, it's a
short-term elixir designed to hopefully pump up the brand's profit metrics and
grab some investors ahead of a spin-off.
An apparel company - which Gap is unless told otherwise - has to grow sales to
stick around. Straightforward equation. But one that Gap has not proven adept at
for eons, which calls into question if the brand will even be around 10 years
from now.

RILA: Retailers Warn the Tariff Bill is Adding Up for American Consumers
New tariffs could imperil Best Buy, Dick's and Bed Bath & Beyond
The proposed new tariffs, known as "tranche four," could eat 20% to 40% of
the operating margin of a wide swath of retailers, including BJ's Wholesale,
Michael's, Walmart, Target and Costco, according to the analysts. The hits to
margins could send prices up 6% to 13% for the goods covered by the newly
announced hikes ("tranche three") and 10% to 21% for tranche four goods, the
analysts estimated.

Cybercrime: Looking Beyond the Dark Web
Fighting cybercrime requires visibility into much more than just the Dark
Web.
Here's where to look and a glimpse of what you'll find.
The
now-shuttered DeepDotWeb, which was a uniquely centralized and trusted
repository of Dark Web links and information, had long made it easier for threat
actors - and consequently, law enforcement and other defenders - to keep track
of which Dark Web sites are active, and where. The repository's takedown left a
void that no comparable alternative seems to be able to fill, at least for the
near future.
There are other sites, known as hidden wikis, that can appear to be
comprehensive directories and are often referred to as such by defenders. In
reality, they tend to be little more than human-assembled catalogs that harken
back to the early days of the Internet. All this volatility is largely why
threat actors who operate on the Dark Web also typically frequent a number of
other channels.
It's also why fighting cybercrime requires visibility into much more than just
the Dark Web. Contrary to popular belief, the Dark Web accounts for just a minor
subset of the many online venues that facilitate cybercrime. Even if the Dark
Web were somehow to be eliminated, its absence would simply cause threat actors
to rely more heavily on the various other online venues in which many, if not
most, already operate.
Encrypted chat platforms are one such venue - and in fact, they support
far more illicit activity than any other, including the Dark Web. Threat actors
are increasingly using platforms such as Telegram and Discord, among many
others, to communicate more securely and to share mirrors, which are sites that
contain nearly identical information but are hosted on different URLs. If one
URL faces downtime for any reason, the secondary URL acts as a backup to help
minimize operational disruption and consequential profit losses.

How To Mitigate Account Takeover In Retail
Online shopping is pervasive, especially as more and more retailers expand their
digital commerce. While online shopping provides a multitude of benefits for
both retailers and consumers, it also has created a new threat in the industry
called account takeover (ATO) fraud.
ATO is the unauthorized access and control of a legitimate user account.
By getting hold of a customers' usernames and passwords, cybercriminals can use
the hacked accounts to glean a lot of information. This information can be used
to create new accounts, impersonate real customers and steal goods and services.
Like so many other types of fraud, ATO is increasingly committed at scale by
bots. In fact, according to Akamai's "State
of the Internet Security” report, more than 40 percent of online login
attempts are attackers trying to invade accounts. Hackers write scripts that
test various combinations of stolen usernames plus potential passwords across
multiple websites and apps, until they find a way in. This is called credential
stuffing. These brute-force attacks are helping fraudsters move as quickly as
possible and focus on maximizing the value of each successful ATO.

Why it's so hard to root out fake goods in China
ecommerce
There are millions of sellers on big Chinese online marketplaces like
Taobao and Pinduoduo, and they resell merchandise obtained from a wide variety
of sources. A new Chinese law could help cut down on the sale of counterfeit
products on Chinese ecommerce sites.
On April 25th, the U.S. Trade Representative’s Office placed Pinduoduo, China’s
third-largest ecommerce platform, on its
blacklist of notorious marketplaces that fail to curb the sale of
counterfeit products. Alibaba Group’s Taobao platform, which dominates China’s
online retail market, has also been on the list for years, having been found to
sell counterfeit products such as watches, handbags, and other goods.
The Chinese government is taking the issue of counterfeit goods seriously,
enacting new legislation this year.
China’s new ecommerce law, effective at the beginning of 2019, cracks down on
the sales of fake products by holding internet platforms and sellers more
accountable for their actions (or lack thereof). Its provisions include:
● Ecommerce platforms, individual and merchant sellers, as well as social media
platforms such as WeChat and Douyin, are held legally responsible if fake goods
are sold and no measures were taken to prevent transactions.
● All individual sellers also must register their businesses, obtain a business
license, and file and pay taxes.
● Platform operators also will have to keep at least three years of product and
service information records for each merchant.
● Lastly, the new law also outlines a mechanism structure for notifying parties
about fake listings and the process of removing the sales.

Fraudsters Spend Twice as Much as Legitimate
Customers: Report
The
Q1 Fraud Report, published by RSA, found that card-not-present (CNP) fraud
transactions increased 17 percent in the first quarter of 2019, with more than
half of those transactions (56 percent) originating from the mobile channel.
The report reflected the array of fraud patterns that have increased since the
end of 2018. Even though less than 1 percent of logins were attempted from a
combination of a new account and new device, “this scenario accounted for 32
percent of total fraud volume observed in Q1,” according to the report.
The research indicated a similar pattern with the same percentage of legitimate
payment transactions attempted from an existing account and a new device, which
constituted 48 percent of total fraud value, reflecting a slight increase from
43 percent in Q4. “This is indicative of an increase in account takeover where
fraudsters are attempting to use compromised financial information to initiate
payments from victims’ accounts,” the report said.

Returnly Raises $19M to Tackle Online Returns
Just Don't Return It
Returnly offers store credit, rather than cash, in the hope that shoppers will
spend the amount they are credited and then some. It seems that the company’s
customers have done just that. Nine in ten have ordered a second item before
they even shipped the first unwanted item back, the company says. They’re likely
to outspend the original size of their order, too, by 23%.
Returnly is poised to profit from all these returns. It has processed close to
$200 million in returns in the last three years, taking a cut on each
transaction. It also charges merchants an annual subscription fee.
In order to extend store credit the way that it does, it depends on data from
its merchant network to assess a shopper’s risk. This essentially means it
analyzes a consumer’s past shopping activity at the retailers that it works with
to make a decision. “Our whole business model is predicated on the network
effect,” says Vilar.
Returnly then assumes the risk that a product is never returned, whether that’s
because a customer fails to ship it back in the first place, it arrives damaged
or it gets lost in the mail. The company declined to disclose any figures
surrounding how many items are never returned. Its avenues for recourse appear
limited. In such an event, says Vilar, it can nudge a customer over email or try
to make a return easier by sending a printed return label in the mail, for
example, or scheduling the pickup of an item.

Chandler, AZ: Couple arrested for $55,000 baby
formula theft ring
An estimated $55,000 worth of baby formula has been swiped from several Valley
stores, and police say it all links back to one Chandler couple. Chandler police
arrested Rafid Khoshi and Manal Sulaiman last Friday; the couple facing more
than 20 charges combined including theft, trafficking of stolen goods, fraud,
and illegal control of an enterprise.
Police say their investigation started in September of last year when they
caught two people trying to steal the formula. Those suspects told police they
were planning to sell them to a 'third party" who was "requesting to buy upwards
of 1000 cans at a time if they could obtain it." Police say after months of
surveillance into more than 100 thefts in Maricopa County undercover work led
them to Khoshi and Sulaiman. Both purchased formula from their undercover
officer, posing as a thief. Court documents say the two knowingly ran an
"organized theft ring," purchasing the stolen goods, then reselling it.

Harris County, TX: Shoplifting suspects caught
thanks to quick actions of Harris County deputy
A pair of frantic store employees caught on a deputy’s dashcam alerted him to a
crime that had just been committed. "Patrolling our business districts, and the
deputy was flagged down in a Home Depot parking lot that a robbery just
occurred," Capt. Jonathan Zitzmann, with the Harris County Precinct 4
Constable's Office, said. After learning the details of the robbery, the deputy
also got the specifics of the suspects and their car.
It wasn’t long before the deputy spotted the sedan and pulled it over in a
convenience store parking lot. Dashcam video showed it would hardly end in a
routine stop when one of the passengers made a run for it. "Located that
vehicle, eventually made a traffic stop on the vehicle and tried to detain three
individuals ... A female passenger bailed from the car," Zitzmann said.
Backup deputies arrived and later found the woman, who bolted to nearby a
restaurant. She was later arrested. The other two suspects in the car were also
arrested. Investigators said the trio is accused of stealing over $2,000 in
power tools from the Home Depot and assaulting an employee when they left the
store.

Lynnwood, WA: Everett man steals $6,700 in
laptops, then pepper-sprays cops
An Everett man said he stole computers from a mall and sold them online to
support his drug use, according to a Lynnwood police report. The man, 27, with
spiked, blond hair and wearing a black jacket, allegedly hit the same Microsoft
kiosk at the Alderwood mall on three days in April and May. He would grab a
laptop or two and then run off, according to court papers filed in Snohomish
County Superior Court. By the time officers arrived, he was gone. In total, he
allegedly took four computers, with a combined value of $6,700. He then sold
them online at a steep discount, for $2,180 all together, he later told police,
according to documents.
On Sunday, he was spotted at the mall again, near the Macy’s. A Lynnwood police
officer arrived around 6 p.m. and found him in the parking lot. The man took off
running. Then, he turned his right hand back toward the officer, who had almost
caught up, and blasted him in the face with pepper spray.

No matter how smart a person is or how good a product or service is, your
success always boils down to your attitude - your demeanor - how well you
connect with those you're working with. Making that connection - working on that
relationship - and approaching your internal and external customers as just that
- customers - is critical if you expect to be successful. Remembering one key
point all the time may help - they don't have to buy anything you're saying or
selling regardless if you're a vendor or an LP executive. Because at the end of
the day, there's always someone else close by that can offer the same thing
you're offering.
Just a Thought, Gus
