STATE ISSUES: Criminal Justice Initiative - Increasing
Penalties for Shoplifting
Signature petitions are now being turned in to counties around the state in
order to qualify the Keep
California Safe Campaign ballot initiative for the ballot. The campaign has
collected over 560,000 signatures for the purpose of qualifying the
initiative that would, among other things, increase penalties for shoplifting.
Although the campaign has collected more than the 365,880 signatures required by
law, it is general practice to collect significantly more to account for invalid
signatures. County officials must report to the State Secretary of State by
June 28 for the purposes of certification.

accused of Edmonton jewelry store heist to fund ISIS fighters
An Alberta man facing extradition to the U.S. is accused of robbing a
jewelry store in Edmonton to finance the terrorist activities of
relatives and a friend who fought overseas with ISIS. Abdullahi
Ahmed Abdullahi, 33, is charged with providing material support to
terrorists, according to a U.S. indictment.
Between August 2013 and November 2014, Abdullahi, who was living in
Alberta at the time, allegedly conspired with Douglas and others to
provide personnel and money for terrorist activities.
On Jan. 9, 2014, Abdullahi and two accomplices robbed a jewelry store
in Edmonton, but struggled to pawn the loot, the indictment says.
Abdullahi is scheduled to appear in Edmonton provincial court Aug. 9 on
a charge of armed robbery.

Former Pilot Flying J president wants last-minute change at defense table in
fraud case
The Old Hiring a Local Good Old Boy Trick
With the clock ticking on his fate in a scheme to rip off trucking companies,
former Pilot Flying J President Mark Hazelwood wants to ditch a Texas law
firm with a roster of celebrity clients and tap a Knoxville attorney instead,
court records show. Attorney Brad Henry on Monday filed a motion in U.S.
District Court on behalf of Hazelwood, seeking permission to take over the
ex-president’s defense.
Hazelwood faces sentencing before U.S. District Judge Curtis Collier in August
for both heading up a band of thieving sales executives at the nation’s
largest diesel fuel retailer and pushing them to think bigger in their
defrauding of Pilot Flying J’s trucking customers.
A jury in Collier’s Chattanooga courtroom convicted Hazelwood in February of
conspiring to commit wire fraud and related charges in a scheme to lure trucking
companies to do business with Pilot Flying J with promises of discounts on
diesel fuel and then shortchanging them to the tune of at least $56.5 million
in five years.
Pilot Flying J has been paying Hazelwood’s legal bills. He used that
money to tap the law firm of Texas attorney Rusty Hardin, revered as a legal
powerhouse, for his defense.
A section in Pilot Flying J’s contract with Hazelwood that states the board
will only stop paying his defense once he “is ultimately found guilty, including
the conclusion of any appeals.”
Seventeen former Pilot Flying J staffers struck plea deals in the fraud plot
after the truck stop giant’s Knoxville headquarters were raided in April 2013.
Pilot Flying J’s board struck its own plea deal, agreeing to pay $92 million
in restitution and penalties as part of a criminal enforcement agreement.
The board also paid $85 million to settle lawsuits.

Is excess space behind retail’s shrink and
customer experience problems?
Large, under-staffed stores create an environment that is rife for retail theft.
The National Retail Federation (NRF) reports that shoplifting causes more shrink
losses than any other factor, accounting for 36.5 percent of retail’s total in
2017. However, NRF reports that when it comes to staffing loss prevention
officials, “There is a sizeable gap between what is expected and what is
needed.”
It’s not just a lack of LP officials that are cutting into retailers’ profits.
Understaffing is another big problem that is particularly evident in big box and
department stores. RetailDive reports that, “A third of customers who
experienced a problem at apparel stores were not able to locate sales help, and
six percent of all possible sales are lost because of lack of service.”
Yet, when retailers make budget cuts to increase margins, they often fail to
look for ways to shed unnecessary rent costs. Instead, they look for
budgetary wiggle room by cutting billable hours for loss prevention officials
and hourly employees.
Smaller stores would mean less space to staff and less space for LP officials to
watch over. Would reducing unnecessary floor space make it easier for customers
to locate employees, as well as enabling LP officials to better identify and
deter potential shoplifters?

Starbucks racial bias training will include
rapper Common, lots of dialogue
A big-name rapper, messages from corporate bigwigs and a chance for Starbucks
employees to relate their own stories will all be part of the
racial-bias training that the coffee giant plans for workers Tuesday.
Besides the video messages from executives and from hip-hop artist Common,
employees will hear what they can do
to make the stores more welcoming, Starbucks just revealed to reporters in
its first preview of the session next week.
Starbucks is shutting down all its U.S. stores for the session, the result of
the outcry over a manager who called police to complain about two
African-American men who came to a Philadelphia store and didn't buy anything.
They arrested, but charges were later dropped.

Bloomingdale's Ties Training To $3 Million In
Savings
Bloomingdale's has been using the Axonify Microlearning Platform for associate
training since 2013, but the retailer could not quantify the financial impact of
the program until the recent addition of a new product, called Axonify Impact.
With this functionality, Bloomingdale's was able to tie its safety and asset
protection training program directly to $3 million in savings in one year. The
savings were attributed to a reduction in safety claims among store associates.
The business objective for Bloomingdale's was to reduce General Liability and
Worker's Compensation claims. Employees could access the training via POS
terminals within the stores as well as tablets and desktop computers, and 90% of
eligible associates opted into the voluntary program.

Owners of Mugshots.com accused of extortion:
They attempted 'to profit off of someone else's humiliation'
Mugshots.com is one of several websites nationwide that make money by
publicizing arrest information and demanding fees through intermediary
sites to swipe records clean.
Mugshots.com and similar websites say they are simply republishing
arrest information that is already publicly available through government
records. Mugshots.com shows a disclaimer in capitalized letters at the
top of its Web page saying the information on its website is in no way
an indication of guilt or evidence that an actual crime has been
committed.
But to many people whose photos have cropped up on the site, such
disclaimers are not enough to make up for the damage to their
reputation. Mugshots.com refuses to take down criminal record
information unless that person pays a fee, usually $399, through the
secondary website, Unpublisharrest.com. They make no exceptions - even
if the person's charges were dismissed or if the arrest was due to a
mistaken identity or law enforcement error, according to a law
enforcement affidavit, which included interviews with 18 people.
Websites like Mugshots.com have been operating for years, particularly
in Florida. In 2012, the Miami Herald called mug shot websites the "hot
new internet business." One of the first such websites appears to have
been Arrrests.org, operated by Rob Wiggen, a 33-year-old Floridian
skilled in computer programming. He would post hundreds of new mug shots
on a daily basis, mining law enforcement websites in Florida and four
other states, the Herald reported.
An intermediary website would, in turn, charge people hundreds of
dollars to remove mug shots.

and visibility of your group
You know that your team does great work. You're invested in what they do, day in
and day out, and you know the value they bring. You know the benefit their
successes have delivered to the organization.
The question is, does everyone else know?
If you haven't made the effort to promote your team's work, it may well be that
they don't. Even if they benefit from the work you do, if they don't know about
the part you play, it will be hard for you or your group to get ahead at work.
It can also make it hard to ensure you're consulted on key decisions or get the
resources you need to function well. While it may seem like quietly doing your
job should lead to appreciation, it's not always the case.
Want to make sure everyone knows the critical role your team or group plays?
Step 1: What does your team do?
Imagine that you are presenting to everyone you talk to. Can you distill what
your team does in one or two short sentences? Practice articulating what your
team does in terms of these critical soundbites and leave the smaller details
out.
Step 2: What do you deliver?
Once you're able to deliver what you do, practice sharing the message about your
objectives and outcomes. Try to think big picture and the business value.
Step 3: What is your team's value?
Now add to your message with the key statement -- your value. Once you have
clearly articulated your activities and output, you need to be able to share
their value.
Step 4: Share your victories and achievements
For some of us, it can be uncomfortable to "toot our own horn" and talk about
our achievements. For the sake of your team, put that aside and plan to market
your successes.
By following these four steps, you can create a mental template to help you
raise your visibility and share your team's value and success.

LP Director Who Passed Away on May 16
Rob
Shields, a veteran of the loss prevention industry, passed away on May
16, 2018. Rob spent more than two decades with Staples as the company's
Director of Global Loss Prevention - Field Operations. Prior to that, he
spent ten years as a Senior Regional LP Manager with CVS Pharmacy.
Over the span of his LP career, he became a mentor and friend to many
across the industry. Read below to see some of the memories his
colleagues shared with the D&D Daily.

I’m just at a loss for words right now as this has hit me pretty hard.
All I can say about Rob is that he was a great friend, mentor,
colleague, and supervisor. I’ve worked alongside or for him the last 19
years at Staples and you will not find a more quality individual. He was
a man of great integrity and a shining example for our industry. He will
truly be missed.

I've worked with Rob for about 12 years. I had the opportunity to sit
down with Rob last week. The first thing he asked was about my family.
And that's the way he was. It was always family first. Rob had the
ability to create a relationship with anybody he encountered. Rob always
made you feel like you were the only one on the room. This tremendous
skill was instrumental in gaining support for the LP mission. I Googled
Rob's name the other day and the first thing I came across was a listing
of everyone involved with the LP fund. He was listed as Treasurer. This
in itself describes who Rob was.

leading results. I could always confide in Rob and he could always
confide in me. We were more like brothers than friends and I will

soon.

U.S. and EU Retailers Release Industry Approach to New Data Protection
Regulations to Meet Customer Expectations
The National Retail Federation and EuroCommerce today released a
paper that addresses operational challenges retailers in both the United
States and the European Union face as they implement programs to comply with new
EU data protection regulations while continuing to meet consumers’ expectations
for customer service.
“There
are still many questions about how the GDPR applies to critical areas of retail
operations,” the paper said. “Retailers must find appropriate methods for GDPR
compliance that further their customer relationships and do not frustrate them.”
The 14-page “Retail
Approach to Implementing Critical Elements of the GDPR” said retailers want
to find “approaches to compliance that will meet the requirements of the GDPR
while ensuring that retailers can continue to provide customers with the
personalization, omnichannel experiences and seamless retail operations that
they expect.”
The General Data Protection Regulation, which takes effect on Friday,
sets out changes to almost every area of customer data processing. Retailers
with stores, websites, mobile apps and other digital platforms serving consumers
will face new compliance standards, increased liability for violations and more
stringent enforcement.
While the GDPR is European legislation that affects retailers headquartered
in any EU country, it also covers companies from countries around the world that
have stores in Europe, target sales to Europeans over the internet or through
mobile apps and other remote commerce channels, or simply track European
consumers online.

As U.S. companies scramble to meet the European Union's General Data Protection
Regulation, security professionals question whether they can implement changes
in time for the May 25, 2018, deadline. It's not clear whether they have the
tools and processes in place to properly respond to the 72-hour GDPR breach
notification requirement.
The mandatory 72-hour GDPR breach notification period has security professionals
concerned because the U.S. has no national data breach notification
requirement, and the hodgepodge of 48 state laws that exist typically require
notification within 30 to 45 days. With potential sanctions and fines of up
to $20 million or 4% of global revenue, companies are on alert.

GDPR Says Companies Must Have a Data Privacy
Officer. Who Should That Be?
Employers in the U.S. that must comply with the European Union (EU) General Data
Protection Regulation (GDPR), which takes effect May 25, are struggling with the
requirement to appoint a data protection officer. They also face grappling with
the GDPR's 72-hour notification requirement upon discovery of a qualifying
breach.
The requirement to hire or appoint a data protection officer applies if a
business is engaged in large-scale data processing, but there is no real

45% Of Retailers Still Lag In GDPR Compliance Ahead Of May 25 Deadline
Retailers targeting consumers in the European Union (EU) are counting down the
days until they must comply with the General Data Protection Regulation (GDPR)
deadline of May 25. The regulations will introduce more stringent provisions for
organizations processing consumer data. But while 55% of retailers say they were
largely or completely GDPR-compliant as of April 2018, that leaves 45% that say
they are lagging behind or only partially compliant, according to Capgemini.

GDPR Goes Into Effect This Week, Online
Retailers Beware
This Friday, the General Data Protection Regulation (GDPR) will go into
effect in the European Union and businesses all over the world will need
to be ready. The new requirements will hit online retailers especially
hard, according to recent research by software giant Sage. One out of
every three adults in the EU plans to exercise the right granted by the
GDPR to remove personal data from the databases of online retailers and
to request that their data stop being used for marketing purposes.
Nearly half will make the same request of social media companies.
Consumers must now give companies explicit “opt-in” consent to have
their information stored and used for marketing as well as the legal
right to ask any business anywhere in the world how, why and where their
data is being used. Non-compliance can result in fines up to €20 million
($24.6 million) or 4 percent of global turnover. Sage found that more
than half of organizations (56 percent) are not clear on these
consequences. Only 45 percent of businesses have a plan in place to
ensure GDPR compliance, but only two-thirds of those companies are
confident in their plan.

Retailers Say Visa, Mastercard Pressing
the Wrong Button
A new fight is brewing between merchants and card companies.
Representatives of large retailers including Walmart Inc. and Home Depot
Inc. met with federal regulators this week to raise concerns about a new
online payment initiative that Visa Inc. and Mastercard Inc. are
preparing to roll out, according to people familiar with the matter.
The retailers, working through merchant trade groups, have flagged
issues around the networks’ recently announced plan to combine their
individual payment buttons on merchants’ online checkout pages.
The networks say the move is largely aimed at simplifying the checkout
process and making it more secure. But merchants, who have long tussled
with the card networks and issuers over fees they pay in exchange for
accepting cards, are picking up the new fight as one that may help shape
the future of how consumers pay for goods online.
Retailers’ main concern with combining the buttons is that merchants
won’t be able to route their debit-card transactions to lower-cost
networks.

Deputies take on Racketeering Operation; hundreds of thousand of dollars in
Retail Theft
Sheriff
Mike Chitwood will hold a media conference today to discuss a break in a
racketeering investigation involving “hundreds of thousands of dollars worth of
retail theft,” agency spokeswoman Laura Williams said. Two organized groups are
suspected of carrying out the operation, according to the Sheriff’s Office. The
owner of a South Nova Road pawn shop is behind bars on racketeering charges and
Volusia County Sheriff Mike Chitwood will discuss details of the investigation
Thursday afternoon. Jail records show deputies arrested Richard Hill, 51, on
four counts of dealing with stolen property, as well as one count each of
racketeering and conspiracy to commit racketeering. Hill owns Richard Hill’s
Music & Pawn, 2550 S. Nova. At least four other people also were arrested today
on racketeering-related charges, according to jail records. Their bail amounts
range from $260,000 to $1.8 million. The news conference will be held at 1:30
p.m. at Richard Hills Music & Pawn, 2550 S. Nova Road.

A federal jury has convicted two Connecticut men of running a large-scale
operation that swapped cash for retail goods swiped by shoplifters to support
their opioid addictions, prosecutors say. George J. Connelly Jr., 48, and
William Reidell, 41, were convicted Thursday for their role in the "fencing''

Connecticut U.S. Attorney's Office said. Connelly and Paul Muzyka, owned a
second-hand store, Ace Amusements in New Haven. There, the pair bought
merchandise they knew to be stolen from "boosters," who typically were
shoplifters with opioid addictions, authorities said. The stolen items were sold
to Ace for about a third of their retail value, which in turn resold them
online.

MS
Charges have been filed against two suspects accused of grabbing thousands of
dollars worth of electronics from the Apple Store on The Plaza. Court records
show Timothy O'Neal and DeVarrio O'Neal are suspected of stealing from Apple
stores in six Texas cities and Apple stores in Mississippi and Arkansas, taking
more than $300,000 worth of merchandise. They have been charged with robbery.

stealing $9,000 in toys
East Aurora Police say they have charged a Buffalo woman with third-degree
larceny in connection with the theft of toys and merchandise from the Fisher
Price toy factory. Detectives say they found more than $2,500 worth of toys in
the home of Heather Wilson, 21, and that they believe she is responsible for
stealing more than $9,000 worth of merchandise. As a seasonal employee of Fisher
Price, Wilson is accused of falsifying business records and having the toys
shipped to her home.

Fort Morgan, CO: Officer Involved Shooting
outside Walmart, Suspect shot and wounded
One person was shot at the Walmart store in Fort Morgan around 8 a.m. Thursday
morning. The only person injured was the suspect. That person's condition is not
known. Law enforcement in Northeast Colorado was given a heads-up by law
enforcement in New Mexico that there was a potentially armed-and-dangerous
suspect headed to their area.

West Hollywood, CA: Suspect sought in violent
robbery inside Best Buy
Sheriff's deputies are hoping the public can help catch the suspect in a violent
robbery that took place inside a Best Buy store in West Hollywood. The assault
inside the store was caught on surveillance camera. One minute a customer was
browsing through the electronics store. The next he was on the ground, decked by
a man who swiped his iPhone and headed out the emergency exit.

serial robber ‘getting more aggressive’
A man allegedly began a robbery spree at a Dollar General in Henry County in
March, police said. Since then, he has struck 11 more times in three metro
Atlanta counties, Channel 2 Action News reported. Targeted locations include
dollar stores, an AutoZone and a CVS in Henry, DeKalb and Gwinnett counties.

Huber Heights, OH: 2 teens arrested after Target
break-in, short Police pursuit
Ankeese Brown and Cy’Ran Campbell, are currently in Montgomery County Jail. The
teens are suspected of breaking into the Target on Executive Blvd., where one to
three Xbox gaming systems were stolen. They then led police on a pursuit that
ended after an officer made contact with the left rear tire of their vehicle,
causing it to spin. Their charges are pending at this time.

OH: Burglars use Cinder blocks to gain access to Gun Store
Several guns were stolen during a break-in at a Mason firearm store early
Wednesday morning. Surveillance images show the thieves carrying large stones or
cinder blocks to smash out the front window. Another image from inside the store
appears to show one man reaching into a glass display case. This was the second
firearm theft from a store in the northern suburbs this spring.

Portsmouth, VA: Shoplifting/ Robbery at Food Lion
leads to pedestrian hit during car chase
A woman was hit by a robbery suspect who was fleeing the scene of a robbery at a
Food Lion on Wednesday around 12 p.m. Portsmouth Police said, a woman shoplifter
robbed the Food Lion and started to be chased by police after fleeing the scene.
The woman also almost hit a responding police officer in the process. While the
suspect was being chased, she hit a white pick-up truck with a woman passenger
inside. When the woman inside the pickup got out to asses the damage, the
suspect hit her with the vehicle she was driving. The woman passenger from the
white -pickup received serious but non-life threatening injuries during the
incident. While the suspect fled the scene of the hit and run, she would later
crash her vehicle while trying to evade officers. The suspect was not injured
and was taken into custody.

McDonald’s
The St. Johns County Sheriff's Office arrested John Jay Smith, 60, Wednesday
after he went on a racist rant against two men he believed to be Muslim or of
Middle Eastern descent outside a McDonald's. Smith faces felony charges of
aggravated assault with a deadly weapon, felony charge of burglary with assault
or battery and a third-degree felony charge of trespassing. While being
arrested, the report says Smith said "they killed my son," a U.S. Marine who
died while in combat in Afghanistan.

On Sunday around 2:17 a.m., several departments responded to a structure fire at
the Morganfield Walmart. A fire was set in the back part of the store in the
fabric section. Officials have video footage where two men are seen entering the
parking lot in a small black passenger car. They enter the store around 1:17
a.m.
The men go through the store filling a shopping cart. Somewhere around 2 a.m., a
fire was set in the back part of the store in the fabric section. One of the men
is seen carrying a large ax through the store after he reportedly set the fire.
He made his way back to the front of the store where he and another man take
their cart of unpaid merchandise out the front door of the store.
