Apple claims it isn’t scanning customers’ faces, after teen sues for $1 billion
A detective claims that Apple - or its security firm - used facial recognition software to have the wrong person arrested

Apple is being accused of using facial recognition software in its Apple Stores to arrest the wrong person for theft — a New York student who’s now suing Apple for $1 billion. And while Apple tells The Verge it doesn’t use facial recognition technology in its stores, the case is weird enough, and there’s enough wiggle room, that it’s not clear if that’s the whole truth.

Ousmane Bah, 18, claims in a lawsuit that he was incorrectly identified as the robber in several Apple Store thefts across multiple states, but denies that he’s the person in the photo that accompanied the warrant for his arrest. Backed by surveillance footage and the testimony of a detective, district attorneys in New York and Boston have already dropped the charges against Bah, the lawsuit states. (He is still being accused of larceny in New Jersey in a pending case, according to the document.)

According to the lawsuit, NYPD detective John Reinhold first noticed that Bah “looked nothing like” the suspect in the surveillance video of a Manhattan Apple Store that was robbed. According to the lawsuit, the detective then explained that Apple’s security technology identifies suspects of theft using facial recognition technology.

When we reached Reinhold on the phone for comment, he agreed that Apple doesn’t technically have facial recognition in its stores, but also that his statements as described in the lawsuit were correct. He declined to answer further questions, but it’s worth noting that the second defendant on the lawsuit, Security Industry Specialists, might explain the contradiction — it could have been that company which used facial recognition to analyze security footage after the fact, and possibly outside of Apple’s facilities.

SIS Security doesn’t explicitly mention Apple as a client on its public website, but the third-party firm seems to have a long working relationship with Apple, and a 2016 employee handbook hosted at its website specifies Apple as a client. theverge.com

Supreme Court Backs Businesses, Curbs Class Arbitration
5-4 Decision Sides with Retailer in Blocking Class-Action Lawsuits

An ideologically divided U.S. Supreme Court gave businesses more power to channel disputes into individual arbitration proceedings, siding with lighting retailer Lamps Plus Inc. who was trying to prevent its employees from pressing group claims stemming from a phishing attack.

The 5-4 ruling said courts shouldn’t allow class arbitration unless an agreement clearly authorizes that type of proceeding. It’s the latest in a line of Supreme Court decisions that have backed arbitration and helped companies avoid the prospect of costly class actions filed by workers and consumers.

The ruling is a victory for Lamps Plus Inc., reversing an appeals court ruling that interpreted its accord with its workers as allowing class arbitration. The phishing attack took place in 2016, when a Lamps Plus employee received what appeared to be an email from a colleague requesting copies of worker W-2 tax withholding forms. The duped employee responded by sending the forms of 1,300 workers.

The company told the workers about the attack and offered a year of credit-monitoring services and identity counseling. But one of the workers, Frank Varela, said a fraudulent 2015 federal income tax return was filed in his name. Varela sued in federal court in California and sought class action status on behalf of his fellow workers. bloomberg.com

LVMH Told VP, Litigator to “Simply Tolerate” Years of Sexual Harassment
LVMH Moet Hennessey Louis Vuitton is being sued for “doing everything it could to bury” years of sexual harassment experienced by a female executive at its New York headquarters. According to the complaint that LVMH’s Litigation Counsel and Vice President of Legal Affairs Andowah Newton filed in a New York state court on Tuesday, she has been exposed to “sexual harassment at the hands of a senior level management employee ... that continued for years” and the parent company for Louis Vuitton, Dior, Celine, and Givenchy, among 70+ other brands, did very little to remedy it.

On various occasions “between late 2015 and 2018,” Newton alerted LVMH’s in-house counsel of the harassment, initially making informal reports because she is “familiar with the image-obsessed culture at LVMH [and was] worried that any sort of formal reporting would result in backlash against her, not the harasser.” Newton claims that she hoped that “by informally reporting the sexual harassment, LVMH would resolve the problem without the potential negative effects that could follow from a formal report.”

However, instead of remedying the problem, LVMH tried to “intimidate Ms. Newton into not pursuing her claims and [attempted to] convince Ms. Newton that the harassment was just a byproduct of being an attractive woman who works at a company with a French culture, and thus, should simply be tolerated.” thefashionlaw.com

Owners of Fas Mart stores agree to settlement in complaint over service animal
A Richmond-based company that owns convenience stores in 22 states, including Fas Mart stores in Virginia, has agreed to settle a complaint under the Americans with Disabilities Act over the alleged refusal to serve an individual with disabilities who was accompanied by a service animal.

Under the settlement, according to the U.S. attorney’s office, GPM Investments LLC has agreed to adopt a service animal nondiscrimination policy for the 1,400 stores it operates. The company also agreed to train its employees about the policy, display signs in stores indicating that service animals are welcome and pay $1,000 in damages to the complainant, authorities said. richmond.com

Birmingham, AL: Crime Stoppers sergeant optimistic about time-delay safes at CVS stores aimed at preventing robberies
We spoke with Crime Stoppers to find out whether they think the new time-delay safes, now installed at all 186 CVS pharmacies in Alabama, will help cut down on robberies. The goal is to prevent robberies and combat opioid abuse because of the delayed time it would take for employees to be able to open the safes.

Sgt. John Pennington with Crime Stoppers said for several months, these robberies at pharmacies weren’t showing any signs of slowing down.  “For a period of time, it was happening every week,” he said. “Something had to be done."

Crooks came in, demanded pills, and got out quickly with potentially thousands of dollars worth of pills that would then end up on the streets.

America’s Biggest Supermarket Company Struggles With Online Grocery Upheaval
Kroger adjusts operations and invests in technology to hang on to customers who avoid stores; CEO says ‘We’ve got to get our butts in gear’

Not since Walmart Inc. first pushed into groceries in the late 1980s have traditional chains faced so many challenges. E-commerce is transforming the business, forcing cash-strapped companies to overhaul their operations and invest heavily in technology and talent to keep customers from straying to Amazon.com Inc. At the same time, they have to keep food prices as low as consumers have come to expect.

The transition has proven rough for Kroger, which stayed focused on store sales long after mass-merchant competitors were investing in online-ordering technology and delivery services. The Chipotle Hack And The Troubling Trend Of Credential Stuffing
Reports have appeared all over social media, particularly via Reddit and Twitter, about Chipotle user accounts being pirated, with hundreds of dollars’ worth of food ordered to customer cards that those customers never saw. In many cases, according to reports, the delivery addresses on the fraudulent orders were to states different from the home addresses on the accounts.

There is a bit of a twist in this often-told tale of breached consumer data: Chipotle maintains that the company itself has not been breached. Consumers often repeat passwords across sites, the firm noted, and fraudsters use a technique known as credential stuffing — wherein they’ve taken email addresses and passwords gleaned in other attacks, and used them to brute force their way into customers’ Chipotle accounts.

Chipotle customers, incidentally, beg to differ, with many swearing that their Chipotle passwords were used solely on that site, and that there was no way they were snatched in an unrelated hack. When asked directly, Chipotle Chief Communications Officer Laurie Schalow said the firm is “monitoring any possible account security issues, of which we’re made aware, and continue to have no indication of a breach of private data of our customers.” She further noted that the firm is pretty sure credential stuffing is the root cause in this case. pymnts.com

Online Retailer Accused Of Secretly Recording Customer Info
Online retailer Harriet Carter Gifts used NaviStone Inc.’s software to secretly record and use identifying information customers typed into forms on the retailer’s website, even if that information was never officially submitted with an order, according to a Pennsylvania woman’s $5 million proposed class action lawsuit moved to federal court Friday.

Originally filed in the Lawrence County Court of Common Pleas, Ashley Popa’s lawsuit claimed that Harriet Carter used marketing company NaviStone’s software to match online customers’ otherwise-anonymous shopping to personal identifying information captured from the user’s browsing and information they typed into online forms, even when those forms were never officially submitted with an order. NaviStone denied the allegations in a statement to Law360 early Tuesday. law360.com

WannaCry Stopper Pleads Guilty to Writing Banking Malware
Marcus Hutchins, the British computer security expert who helped halt the massive WannaCry ransomware outbreak in mid-2017, has pleaded guilty to developing banking malware.

Hutchins, 24, of Devon, England, had previously maintained he would fight U.S. charges that he developed the Kronos malware, also known as UPAS Kit. But on Friday, in a statement posted to his website, Hutchins says he has decided to plead guilty. bankinfosecurity.com

Google's Drone Delivery Business Becomes First to Get FAA Approval
Routine customer deliveries to begin in Virginia 'within months'

An offshoot of Alphabet Inc.’s Google has become the first drone operator to receive government approval as an airline, an important step that gives it the legal authority to begin dropping products to actual customers.

The subsidiary, Wing Aviation LLC, now has the same certifications that smaller airlines receive from the U.S. Federal Aviation Administration and the Department of Transportation. It plans to begin routine deliveries of small consumer items in two rural communities in Virginia within months, the company said.

Drone regulations still don’t permit most flights over crowds and urban areas, limiting where Wing can operate. But the approvals signed by the FAA on Friday and Monday give the company the ability to charge for deliveries of clients’ goods in Virginia and apply for permission to expand to other regions. bloomberg.com

Infamous Ottawa McDonald's cuts hours, hires guards as security concerns rise
Fast food location is one of the top spots in the city for 911 calls

The infamous McDonald's at 99 Rideau St. will no longer serve overnight customers due to security issues, according to the franchise owner. The fast-food restaurant used to be open 24 hours, but will now be open from 6 a.m. to 10 p.m. seven nights a week.

Adeel Hashmi, the owner of the franchise, said in a statement provided through McDonald's Canada that he's concerned about safety in the neighbourhood.

"I take the situation in the area very seriously and recognize the impact these changes will have on my business. Affected crew will be offered the chance to relocate to other restaurants in the area," he said.

The decision follows years of issues and a letter to McDonald's Canada from Ottawa's police chief, according to Coun. Mathieu Fleury.

"It's a great first step that they're closing earlier, that they're [hiring] security guards for the entire operation, but I'm cautious about being over-optimistic," Fleury said.

Bordeleau said the number of calls for help had steadily risen at the location, jumping from 647 calls in 2014 to more than 900 in 2017.

Retail apocalypse sweeping across Canada and U.S.
Canada isn’t feeling the pinch quite as badly

The retail apocalypse is less terrible here in the True North than it is for our American cousins. Malls, for example, which sit empty and even abandoned in some U.S. cities, still have a vibrant life here. And international retailers hoping to conquer the world often start out in Canada on a trial run.

According to retail-insider.com, luxury brands and other international retailers continue to come here. So what’s the big difference between U.S. and Canadian retail?

“The main difference I see is that the pure scale of the population of the USA and the relative wealth of the population drove the country to get over-saturated in retail,” the Canadian-born, Washington D.C.-based Jardine said in a recent interview. “Favourable import tariffs with China and India, Vietnam etc. allowed for the vast availability of cheap goods and the eventual commoditization of the apparel category, fed by the ‘more is more’ cultural orientation.”

“The aggressive competition for foot traffic to support the bricks and mortar overhead as online became more important created a promotional frenzy and dependency,” she said. “That addiction got built into the prior year results and had to be ‘anniversaried’ into the sales results every year. I think that makes the USA unique from any other country in the world.”

Canada, on the other hand, “has not had the population to support being oversaturated in retail space and has a very different import tariff system which has regulated inexpensive imports from China. And Canadians have traditionally leaned towards a ‘less and better’ orientation,” Jardine explained.

The stores that do survive — south of the border — tend to be either high-end or low-end, with the middle market getting decimated.

The Cost Of Counterfeit Merchandise: $323B A Year
Counterfeits caused the loss of $323 billion from the global economy in 2018 alone, and an estimated 2 out of every 5 ‘brand name’ products consumers think they are purchasing online are counterfeits. It’s almost impossible to know the difference sometimes unless you know what you are looking for – often times counterfeiters have obtained information about the products through manufacturers, a key component of our current trade war with China. How can you protect yourself from counterfeit merchandise?

More than one in four consumers has reported discovering a purchase they made online turned out to be a counterfeit. A terrifying 16% of medications purchased online turned out to be counterfeit, as well as 22% of supplements. Makeup and skincare products are also highly likely to be fakes, with 25% of skincare products and 32% of makeup bought online being fake.

Items purchased online can often go missing between the warehouse and the customer’s doorstep. Unfortunately, the result for e-commerce merchants is all too often an item-not-received (INR) chargeback.

Police said FOX 5 viewers calling in tips helped Chamblee detectives solve a jewelry heist worth $100,000. "After FOX 5 news released the video, we were able to get multiple calls," said Chief Kerry Thomas. "We're very pleased with the recovery of such high dollar items...[which] is sometimes unheard of," he said, noting the swift recovery after people called in the information that led to an arrest. Medford, OR: $5,000 Best Buy crime spree ends with 2 arrested
Bradford Lawrence Andrews, 53, and Cambria Shae Reis, 40, face felony counts of organized retail theft alleging they stole or attempted to steal more than $5,000 worth of merchandise in the span of 90 days, according to documents filed last week in Jackson County Circuit Court. Andrews and Reis were arrested April 11 in Medford on accusations they attempted return fraud on a $1,999 computer in the Medford store and shoplifted an iRobot Roomba i7 vacuum valued at $799. Prior to the Medford incident, the couple allegedly stole two high-performance Alienware gaming laptops valued at $3,298 from the electronics store in Gresham. A store in Springfield told Medford police that Andrews and Reis made a theft attempt in Lane County. mailtribune.com

Everett, WA: Suspect arrested in the Stabbing Death of a Grocery Clerk during an Armed Robbery; Customer wounded
A 25-year-old Everett man is behind bars accused of robbing then murdering a convenience store clerk late Monday night. It all happened at the Broadway Grocery store in the Pinehurst neighborhood of Everett. Police say the suspect also attacked a customer who interrupted the crime, and the suspect was arrested only a few blocks away from the store. Investigators from the Everett Police Department and the Washington State Patrol spent hours Tuesday scouring the crime scene after a clerk and customer were robbed and attacked by a man with a knife. Police say the clerk died from his stab wounds and a female customer who interrupted the crime was able to escape the assault.

“The suspect also attacked her and tried to stab her,” said officer Aaron Snell. “Fortunately, she was able to fight him off and sustained very minor injuries.” Police dogs were trailing the suspect while officers eventually caught up to him at only blocks away where he allegedly admitted to his roommate his role in the crime. q13fox.com

Ladue, MO: Police investigating officer-involved shooting at Schnucks in the Ladue Crossing Shopping Center
According to Benjamin Granda, St. Louis County Police said, the call to Schnuck’s Grocery store was for a disturbance following a shoplifting incident, that may be tied to a possible strong-armed robbery involving 2 suspects. The suspect in question, a 33-year-old female encountered a female officer from the Ladue Police Department and told the officer she was injured. What happened next according to police that the officer attempted to arrest the female suspect who resisted and struggle ensued resulting in the officer shooting the suspect. She was transported to the hospital in critical condition with a gunshot wound to the torso. The second suspect, a male fled the scene. fox2now.com

The Daytona Beach Police Department has released footage of the arrest of an armed robbery suspect at the Walgreens near West International Speedway Boulevard. Police said officers shot the suspect Tuesday afternoon after he walked into the store and demanded drugs and money. The footage shows the suspect jump over the counter with a rifle in hand. Fugitive Wanted Since 2015 On Multi-State Jewelry Store Robbery Charges Apprehended
Arthur Berry Jr. was arrested by the FBI’s Phoenix Division on March 18, 2019 and was returned to Michigan earlier this week to face charges for conspiring to interfere with commerce by robbery. Berry, 32, from Detroit, Michigan, was found in Phoenix, Arizona, where he allegedly fled in 2015 after being indicted by a federal grand jury earlier that year. Berry was a leader of a group that conducted the following robberies: September 2014: Jared the Galleria of Jewelry in Toledo, OH; October 2014: Lux Bond & Green Jewelers in West Hartford, CT; November 2014: Fink’s Jewelers in Sterling, VI; November 2014: RF Moeller Jewelry in St. Paul, MN; February 2015: Jared the Galleria of Jewelry in Erie, PA; September 2015: Jared the Galleria of Jewelry in Portage, MI.

Berry was the only remaining fugitive out of nearly two dozen subjects that have been prosecuted since 2014. Berry’s co-defendants all pled guilty and received various sentences, including a fourteen year prison term for one of the group’s leaders, Cedarrius Frost. justice.gov

Authorities Seize Over $11 Million Worth of Fake Championship and Team Rings
Over $11 million in counterfeit championship and team rings are now in the hands of authorities as reports claim the United States Customs and Border Protection seized 177 fake pieces. On Tuesday, the Customs and Border Protection announced that they were able to track and intercept a shipment carrying $11.7 million worth of fake team jewelry from China into the United States. Per reports, the bust took place on March 11 and the inventory included merchandise posing to be from official MLB, NBA, and NFL teams. Along with replicas of the standard team rings, it is said officials also confiscated imitations of the Philadelphia Eagles' and New England Patriots' Super Bowl rings as well as the New York Yankees' World Series rings. tmz.com
