NRF: Setting the record straight on the state of
retail and store closures
UBS report findings ignore key industry trends
Retail contributes $2.6 trillion to annual GDP and drives the nation’s economy,
but for years, we’ve seen sensationalist headlines about a so-called “retail
apocalypse.” The latest wave of coverage was sparked by a UBS report projecting
that retailers must close 75,000 stores by 2026 due to ecommerce.
But as Greg Buzek, a retail analyst for more than two decades and founder and
president of IHL Group, said, “not so fast, my friends.” IHL Group took a hard
look at the math and research behind the report and found it painted a
misleading picture of the industry.
“When one relies almost exclusively on the US Retail Census data, one assumes
that the government has kept up in their measurement criteria to handle all
aspects of retail trade (online and stores),” Buzek said. “They are really
struggling with how to deal with bricks and mortar retailers and the growth of
the online business. Their systems have not kept up with the rapid pace of
change in retail in all facets.”

Facial-recognition technology is being marketed to retailers as a
way to flag people who have previously shoplifted or sought refunds for stolen
merchandise. For now, many retailers are apprehensive but use of the technology
is
starting to make its way into real-world commerce, including retail. Walmart
Stores Inc., Lowe’s Cos. and Target Stores Inc. say they have tested
facial-recognition systems but currently don’t use the technology.
In-store beacons haven’t been as impactful as hoped, often sending promo
messages only to customers who have the store app open, for example. So while
there is trepidation, there’s also strong interest among retailers in moving
to the next stages of technology, particularly facial recognition.
Privacy advocates, however, say the risks of abuse from in-store tracking of
customers are as high as online.
Facial-recognition systems are being marketed as a means to monitor
customers or employees, said Joseph Jerome, policy counsel at the Center for
Democracy and Technology. That raises the likelihood that unregulated
data-sharing cooperatives would emerge among retailers, he said -- as well
as accuracy concerns and the risk of unfair blacklisting.

Mainstream retailers embrace marijuana’s less taboo cousin
It’s showing up in everything from skin creams to bath balms to dog treats — an
elixir that can supposedly reduce anxiety and help you sleep.
Mainstream retailers are taking advantage of a sudden boom in the industry even
as CBD’s health benefits remain murky amid a patchwork of state and local laws.
And the flood of products is only testing how federal regulators can police it.
Retail sales of CBD consumer products in 2018 were estimated to reach as much as
$2 billion, according to Cowen & Co. By 2025, that figure could hit $16 billion
in retail sales, the investment firm predicts.
Domestic diva Martha Stewart is working with Canada’s Canopy Growth Corp. to
develop new CBD products. And the nation’s largest mall owner Simon Property
Group has hooked up with a cannabis goods maker to open roughly 100 kiosks at
its U.S. malls by mid-summer.
CBD is operating within a patchwork of regulations that vary by cities and
states. Legal hurdles are still hard to navigate and companies should take it
slow.
Now that hemp is legal, I think the USDA and state departments of agriculture
are interested in seeing what type of crop it will be and what its applications
are,” he said. “They’ll move with the speed governments often move with ...
(but) by the 2020 growing season, people will have a better understanding how to
operate within the law.”

New strategy for credit card fraud detection
Team creates system of consumer incentives that encourages credit card safety
A team of researchers has developed a new strategy for detecting credit card
fraud using incentives that encourage individuals and merchants to think safety
first.
According to the team’s analytical models, this incentive strategy would pay off
if put into action. Their results, published in Omega, The International Journal
of Management Science, found that the strategy could increase profits and
consumer surplus by about 10 percent, outperforming current fraud detection
systems.
The team said that one key to making their system so effective was apply 2V only
to transactions with higher values. Their models found that in order to maximize
financial benefits, 2V should only be required for transactions over about
$2,000. Since transactions of this size make up less than one percent of all
transactions, the strategy is easy to implement and not inconvenient
The size of these transactions also means that merchants can afford to give
incentives of up to $20 without losing money. This is an amount high enough that
many consumers wouldn’t mind spending an extra minute or so on 2V in exchange.
The best part of this strategy? It could lead to what the team calls a
“win-win-win” for consumers, merchants and banks.

Mobile games better for brand safety/reputation
than social media
Gaming apps rank higher than social media platforms in providing a brand-safe
environment for advertisers, a survey of global consumers by AdColony found.
More than half (60%) of respondents said they see offensive content on Facebook,
compared with 31% on YouTube and 18% on mobile games.
Nearly half (49%) of those surveyed said offensive content negatively affects
their perceptions of brands whose ads appear nearby. Mobile games have the
lowest incidence of "fake news" at only 8%, compared with 49% on Facebook, 25%
on YouTube and 20% on Google, per AdColony.
Brand safety has been a major concern for advertisers in the past few years amid
repeated reports of ad inserts appearing next to objectionable content on social

So-Called Experiental Tenants Not Drawing Extra
Traffic to Malls
But Onliners Are Opening Hundreds
Foot traffic at some of the best shopping centers across the country peaked
around August 2018 and has since started to fall, after rebounding for much of
last year, according to a new report from data analytics firm Thasos, which uses
more than 100 million mobile phones to track when consumers enter and leave
certain trade areas.
As retailers are now starting to talk about pulling back on discounting, this
could be one reason why traffic is dropping at malls, he said, in addition to
the fact that some purchases are moving online. Another issue is landlords have
been hoping that offering shoppers new experiences would make it more exciting
to go to the mall, but the early evidence isn't showing a boost in activity.
Landlords are turning to up-and-coming digitally native brands like shirt
company Untuckit, glasses maker Warby Parker and mattress retailer Casper,
which are opening hundreds of stores as a group across the country after
finding success on the internet, to move into their properties. They're hoping
adding tenants that provide unique experiences, like Legoland, Crayola
Experience and Dave & Busters, will lure shoppers from their homes and out to
the mall.
With more store closures likely on the horizon, consumers can expect to start
seeing hotels, gyms, apartment complexes, more food halls and grocery stores at
traditional malls, turning them into more like city centers.

Ohio Man Sentenced to Prison
for eBay Scam
An Ohio resident has been sentenced in federal court to three years and six
months in prison, followed by three years’ supervised release, and was ordered
to pay $379,591.95 in restitution on his conviction of mail fraud, United States
Attorney Scott W. Brady announced today.
According to information presented during trial and at sentencing, around 2014
to on or about July 5, 2016, Sliter-Matias advertised electronic devices for
sale on 498 eBay accounts. However, Sliter-Matias mailed empty packages through
the United States Postal Service to the purchasers instead of the purchased
merchandise. Sliter-Matias often used the proceeds from these fraudulent sales
to purchase gold or silver bars and coins, which were delivered to his UPS
mailbox. As a result of this scheme, the victims suffered a loss of $379,591.95.

The 10th annual Online Trust Audit & Honor Roll
The Online Trust Alliancerecognizes excellence in consumer protection, data
security and responsible privacy practices. Today, we released the 10th annual
Online Trust
Audit & Honor Roll, covering more than 1,200 predominantly
consumer-facing websites, and found that 70% of the websites we analyzed
qualified for the Honor Roll. That’s the highest proportion ever, driven
primarily by improvements in email authentication and session encryption.
Overall, we found a strong move toward encryption, with 93% of sites encrypting
all web sessions. Email authentication is also at record highs; 76% use both SPF
and DKIM (which prevent spoofed/forged emails) and 50% have a DMARC record
(which provides instruction on how to handle messages that fail authentication).
Internet Retailers ranked fifth: (2017: 2nd) While 65 percent of internet
retailers made the honor roll, better than last year’s 51 percent, this sector

Data on 23,000 Law Enforcement Personnel Exposed
in Breach
FBI Non-Profit Hacked - Selling Data to Criminals
Unknown hackers broke into databases of nonprofit and have posted online
personal info on FBI, Secret Service, Capitol Police, US Park Police, others.
A data breach of systems operated by chapters of an FBI-affiliated nonprofit
organization has exposed personal information of thousands of law enforcement
personnel and affiliated individuals.
According to the Associated Press, home addresses and phone numbers, emails, and
employers' names were published online on at least 1,400 employees of the FBI,
Secret Service, Capitol Police, US Park Police, and other federal agencies as
well as police and sheriffs' deputies in North Carolina and Florida. This was
part of a data release exposing information on more than 23,000 people overall.
Data indicates the hackers were able to capture significantly more data than
they posted online; the stolen information is believed to be available for
purchase by criminals.
The hacked databases were operated by three chapters of the FBI National
Academy Associates Inc, a 501(c)(3) organizations. darkreading.com
Google's Sensorvault - Geofencing Digital Dragnet
Usage Spikes
The tech giant records people’s locations worldwide. Now, investigators are
using it to find suspects and witnesses near crimes, running the risk of snaring
the innocent.
An enormous Google database employees call Sensorvault, turn the business
of tracking cellphone users’ locations into a digital dragnet for law
enforcement. The new investigative technique, whose use has risen sharply in
the past six months, according to Google employees familiar with the
requests. It can help solve crimes. But it can also snare innocent people.
The new warrants go further then just user information, suggesting possible
suspects and witnesses in the absence of other clues. Often, Google employees
said, the company responds to a single warrant with location information on
dozens or hundreds of devices.
Law enforcement officials described the method as exciting, but cautioned that
it was just one tool.
The technique illustrates a phenomenon privacy advocates have long referred to
as the “if you build it, they will come” principle — anytime a technology
company creates a system that could be used in surveillance, law enforcement
inevitably comes knocking. Sensorvault, according to Google employees, includes
detailed location records involving at least hundreds of millions of devices
worldwide and dating back nearly a decade.
The new orders, sometimes called “geofence” warrants, specify an area and a time
period, and Google gathers information from Sensorvault about the devices that
were there. It labels them with anonymous ID numbers, and detectives look at
locations and movement patterns to see if any appear relevant to the crime. Once
they narrow the field to a few devices they think belong to suspects or
witnesses, Google reveals the users’ names and other information.

European Union regulators are demanding companies make changes to how they

Amazon 'flooded by fake five-star reviews'
Amazon (AMZN) is flooded with ‘fake’ five-star reviews of popular products,
a leading UK consumer group has claimed. An investigation by the
consumer group Which? found hundreds of unverified accounts left top
reviews on tech products in a single day. Which? says glowing reviews from
unverified buyers are a “telltale sign of ‘fake’ reviews,” and said its findings
showed they had become a “serious problem” in online shopping.
The research found little-known brands dominated search results for several
popular tech products including cameras, headphones and smart watches, often
thanks to reviews regarded as suspicious by Which?. But Amazon has said it
invests “significant” resources in weeding out fake reviews, and took action
against firms and individuals suspected of using them.
The first page of headphones on Amazon’s site was “by far the worst
offender,” with every single product from a brand not recognised by the
organisation. Which? found more than 10,000 reviews from unverified users on
just 24 pairs of headphones in a couple of hours. It said 71% of products on the
first headphones page had perfect five-star reviews, and 87% of products were
not confirmed as Amazon purchases. In some cases, it found positive reviews for
the wrong products on listings.

We need stronger measures to combat fake reviews
and counterfeit products
Fake reviews and counterfeiters have eroded consumers’ trust in the ability to
make safe and rational decisions while shopping online. Counterfeit goods
account for almost 10% of worldwide trade,
valued at $500 billion in 2016 and
estimated to reach over $1 trillion by 2020. As the counterfeiting industry
continues to experience hypergrowth, ecommerce retailers like Walmart and Amazon
are caught in the war for greed, ultimately victimizing consumers.
Counterfeiters know how to game platforms like Amazon and Walmart with fake
reviews that dupe consumers into buying counterfeit and knockoff products.
Recent research from Fakespot
found that 52% of reviews posted on Walmart.com are inauthentic and
unreliable. The same research from Fakespot also found that
30% of Amazon reviews are inauthentic and unreliable.
As a result of previous failures to address the problem, Amazon
announced Project Zero this year. Project Zero is an invite-only program
that will leverage AI to combat counterfeit products. Currently their pool of
participants is low, counting Vera Bradley, Thunderworks and ChomChom Roller as
a few selected members that have benefited from this program.
Even though Amazon reported 100x improvements in detecting counterfeit
products over its previous reporting system, there isn’t any hard data on
how much it is helping as a whole. With only
limited access for 15 brands, consumers are still at the mercy of
unscrupulous sellers and counterfeiters who use every available trick to
circumvent measures by online retailers.

Somerset County, PA: Caregiver and Son purchases
$50,000 of wire transfers and gift cards on victim’s credit card
Constance “Connie” Slebodnick, 63, and her son, Joseph Drescher, 24, are facing
a slew of felony theft and conspiracy related charges. Authorities say the
investigation began back in October, when police received a tip from the Giant
Eagle purchasing large amounts of gift cards. According to the complaint,
Slebodnick purchased $44,478.55 worth of gift cards with the victim’s credit
card. When police contacted the owner of the card, he told them that Slebodnick
was his caregiver and he had given her the card to make purchases for him, but
never gave her permission to use it to buy gift cards. Police say staffers at
Giant Eagle also told them that Slebodnick had sent wire transfers to her son,
Drescher, who lived with her. After reviewing bank records, police say they
found that Slebodnick had sent numerous wire transfers to her son and had taken
a total of $50,623.37.

Investigators believe that the credit cards may have been stolen from the
victims’ vehicles while they were parked at park and recreation facilities
located in Derwood and Darnestown. Investigators further believe that the same
female suspect used those stolen credit cards to purchase merchandise at stores
in Germantown and Rockville.

Cobb County, GA: Woman stole $2,300 in
merchandise, led police on chase with 8-year-old in backseat
Officers tried to take Danetra Medley, 28, into custody in the parking lot of a
Belk department store in in Marietta, Friday. Surveillance cameras from inside
the store reportedly caught Medley as she took items off the shelves, then tried
to walk past the registers. When an employee noticed her trying to walk past
sensors out the doors, he tried to stop her. Police said Medley responded by
shoving him as she escaped with more than $2,300 worth of merchandise in her
hand. The warrant said an officer tried to stop her in the parking lot, but she
ignored them and drove her Kia Optima past them. Authorities said Medley
continued ignored officers' requests to pull over, leading them on a 2-mile
chase.

Milwaukee, WI: Man accused in thefts at Walmart,
Meijer, Home Depot
may be responsible for 23 others

McKenzie, 36, is facing charges in connection with four retail theft incidents
occurring in Franklin, Milwaukee and Wauwatosa in March — and prosecutors
believe he could have been involved in 23 other incidents in Milwaukee County
from December through April. According to a criminal complaint, on March 26,
police responded to the Walmart store in Franklin for a report of a firearm
being discharged. They took a look at surveillance video, which showed an
individual had placed a hover board worth $198 and motorized scooter worth $249
into a shopping cart and then exited the store without paying for those items.
He got into a vehicle and was confronted by a Walmart employee, who discharged a
firearm. An officer was able to identify the suspect as McKenzie — who had been
arrested days prior for a robbery at 7-Eleven.

Charlotte, NC: Peaceful Protests follow release
of Police Shooting video

The
video shows the moments leading up to the deadly shooting of 27-year-old
Danquirs Franklin by a Charlotte-Mecklenburg Police officer on March 25. The
video is approximately two minutes and 30 seconds long. The first 40 seconds are
silent, which is standard when police release body cam video. In the video,
which was worn by CMPD officer Wende Kerl, multiple officers are seen engaging
with 27-year-old Danquirs Franklin, who was kneeling beside a maroon Honda.
Officers are heard telling Franklin to "drop the weapon" and "put it on the
ground" at least 17 times. A judge ordered police to release the video which
prompted the Mayor and Police Chief to say they were bracing for protests hours
before the video was made public. Both appealed for calm hours before a crowd
gathered for a peaceful rally and vigil in a downtown park.
Charlotte-Mecklenburg Police Chief Kerr Putney told reporters that Kerl shot
Franklin at a Burger King after the 27-year-old refused to drop his weapon.
Witnesses and friends have told local media that the police statement doesn't
add up and offered competing narratives, including that Franklin was trying to
defuse the situation when he was shot. Before the video was released Monday,
Putney told reporters, "We're preparing for the worst, but praying for the
best." Mayor Vi Lyles said she has not seen the video, but she called on "all of
Charlotte to come together respectfully."

CA: Man killed by Security Guard after bizarre stabbing attack at McDonald's
A 29-year old man was shot and killed by a security guard after slamming his car
into a California fast food restaurant, stripping off his clothes, running into
another restaurant and stabbing an elderly man, police said. On Sunday evening,
the Hispanic male, who has not yet been identified by authorities, crashed his
car into a Palmdale Carl's Jr. before disrobing and running into a McDonald's
across the street.

Houston, TX: Trio on the run after deadly C-Store
Armed Robbery near NRG Park
A store clerk in southwest Houston was gunned down while doing his job. Police
said around 11:30 p.m. Monday, three armed men in masks rushed inside the Exxon
station on Main Street near Murworth Drive and announced it was a robbery. The
gunmen opened fire once inside, hitting the employee behind the counter was
critically hit, officers said.

Dekalb County, GA: Man shot and killed at gas
pump outside C-Store
Investigators said he managed to make it into the store where he collapsed. He
was rushed to the hospital where he was pronounced dead. A family friend said
the man who was shot was just 18 years old and had no idea who shot him.

Orlando, FL: Trial begins Today for man accused
of killing Shoplifter at Walmart
Bystander in Walmart parking lot in Pine Hills, FL was charged with manslaughter
in April 2017
The trial for a man accused of killing a suspected shoplifter begins Tuesday in
Orange County. Lonnie Leonard was charged with manslaughter back in April 2017.
Deputies said he shot and killed 19-year-old Arthur Adams outside of a Walmart
in Pine Hills. They said the victim and two others were stealing two cartloads
worth of stuff - including diapers - from the store and when Leonard saw store
employees try to stop them, he jumped in and shot at them. Deputies say Adams
and the others drove off in a stolen car and then crashed. Adams died later at
the hospital. Leonard was charged with manslaughter a couple months later.

Martinsburg, WV: Two Juveniles shot by Off-Duty
Police officer during Armed Robbery at 7-Eleven
Berkeley County Sheriff Curtis Keller has confirmed two juveniles were shot by
an off-duty officer during an attempted robbery. The suspects entered the
7-Eleven store at around 4:37 Monday morning. The juveniles allegedly pointed
firearms at a store employee and a patron. “The patron, who was an off-duty
officer at that time, backed away and drew his gun and identified himself to the
two suspects,” Sheriff Keller said. “At which time they made a turn towards him
and he fired at them, striking both of them.” Once shot, one of the suspects
fled the store and was later apprehended. The remaining suspect was detained by
responding Berkeley County Deputies.

Houston, TX: Two men disarm Off- Duty Officer
during Verizon Armed Robbery
A female officer working security at a Verizon cell phone store in the North
Loop near Garden Oaks was disarmed when two robbery suspects walked in, Houston
police said. According to HPD, two suspects wearing masks stormed into the store
on Yale around 3:45 Monday afternoon. A getaway driver remained in a car waiting
outside. There were at least a half dozen employees and an off-duty police
officer working an extra job inside.

SC: Man, woman try to return stolen goods at GNC, pull gun on clerk who refuses
The incident was reported at the Verdae Marketfair Shopping Center in
Greenville. The GNC employee told police that on Sunday, the man and the woman
tried to return merchandise that he knew to be stolen from a previous incident.
The employee refused to process the return and put the merchandise behind the
counter. He says when he told the couple he would be alerting the police, the
woman went behind the corner to grab the merchandise. The employee said when he
tried to stop the woman, the man pulled out a gun. The couple ran from the scene
before officers arrived.

Portland, OR: Fred Meyer Employee sentenced for
stealing $230K from Self-Checkouts
Emily Tallman was convicted in March of 14 counts of theft and seven counts of
aggravated theft. Prosecutors say she stole nearly $230,000 from the machines.
The Multnomah County District Attorney's Office says Tallman stole the money at
the Fred Meyer Gateway store from January 2017 through June 2017. Tallman was
sentenced to 3 years in prison April 12.

Las Vegas, NV: Man who beat 1st robbery case gets
27 years for 2nd
A Las Vegas man who orchestrated a pair of jewelry store heists just months
after walking away from similar robbery charges because of a legal blunder was
ordered to serve more than 27 years in federal prison Monday. But the
34-year-old Brian Wright, who was convicted late last year of using a firearm
during a crime of violence, interfering with commerce by robbery and conspiracy
to interfere with commerce by robbery, was not in the courtroom as U.S. District
Judge Jennifer Dorsey handed down his sentence. While Wright did not enter the
stores, prosecutors said, he was nearby and communicating with the gunmen during
a holdup at Jared The Galleria of Jewelry on North Rainbow Boulevard and at MJ
Christensen Diamonds on West Charleston Boulevard. More than $800,000 worth of
merchandise was stolen. Authorities later recovered the jewels.

Arlington, TX: 59-year-old gets 7 years in prison
for killing man outside 7-Eleven
The two men had an argument or altercation in the convenience store that started
in the parking lot. The younger man, Michael Alvarado, walked away while the
other man, Gary Kent Lee, reportedly went out to his vehicle and got a firearm.
He then fatally shot Alvarado as he crossed the street.
