Elliot Cohen Named Senior VP of Business Development for ADT

Facial-Recognition Compliance Is Anyone’s Guess
Lawmakers Weigh Limits on Facial-Recognition Technology

Federal and state lawmakers have proposed a flurry of regulations to restrict the use of facial recognition, but the bills under consideration, some of them conflicting or unclear, have left technology leaders with questions about how to comply.

The proposals focus on protecting consumer privacy and limiting how organizations can collect, store and use facial biometric data.

Some of the bills under consideration threaten to quash a technology still in its infancy, said Daniel Castro, vice president of the Information Technology and Innovation Foundation, a Washington-based think tank. “It’s a new technology that people aren’t familiar with and the result is that lawmakers are jumping the gun and proposing bad policies,” he said.

Some of the laws aim to extend privacy to public places, a difficult notion to implement, said Anson Fong, chief information security officer at Los Angeles World Airports, which operates Los Angeles International Airport. The airport is in the final testing stages for deploying facial-recognition technology, which is expected to help improve the speed and security of the check-in process, Mr. Fong said.

Lawmakers in Washington state have proposed opposing bills. One calls for a moratorium on government use of facial recognition until acceptable uses are defined and the technology is deemed accurate. A less restrictive proposal, called the Washington Privacy Act, would require companies to obtain consent before deploying facial-recognition services and have a “meaningful human review” process before profiling consumers. Neither bill specifies who would be in charge of the reviews.

The state of Massachusetts and the city of San Francisco are considering proposals to ban or limit the use of the technology. In March, Sens. Brian Schatz (D., Hawaii) and Roy Blunt (R., Mo.) introduced a bill requiring companies to notify individuals when facial recognition is being used, such as in a place of business, and to have third parties test the technology before it is implemented to address accuracy and bias issues.

Illinois, which enacted its Biometric Information Privacy Act in 2008, requires companies to get consent before collecting data such as fingerprints and face scans, and secure the resulting information. Online shopping officially overtakes brick-and-mortar retail for the first time ever
Online shopping led by Amazon hit a new milestone in February. The total market share of “non-store,” or online U.S. retail sales was higher than general sales for the first time in history, according to a report from the Commerce Department this week.

“The days of the internet and online shopping being ‘just a fad’ have come a long way over the years, but February’s Retail Sales report (released Monday) highlighted another of many major milestones that the growth of online shopping has reached over the years,” said Paul Hickey, co-founder or Bespoke Investment Group.

The online sector, referred to as “clicks,” has been slowly eating up market share in the past two decades. Its total rose from below 5 percent in the late 1990s, to about 12 percent in 2019, according to the Commerce Department. In February, online sales narrowly beat brick-and-mortar, or “bricks.” Non-store retail sales last month accounted for 11.813 percent of the total, compared with 11.807 percent for general merchandise. To be sure, brick-and-mortar sales are higher when including other categories such as auto and restaurant sales.

“Amazon Prime has been a big driver because people don’t think about shipping anymore — that’s a big contributer,” Hickey told CNBC in a phone interview. “We’re seeing an overall a continuation of a trend that’s been going on for years now.” cnbc.com

A.T. Kearney: ‘Smaller scale’ retail M&A deals replace megadeals of years past
Mergers and acquisitions activity by retail and CPG companies is undergoing a significant shift as retailers focus on acquiring capabilities that enhance efficiency and agility rather than building economies of scale.

That’s according to a new report, “Fortifying Before the Storm,” from consulting firm A.T. Kearney, which predicts that, in 2019, smaller scale, strategic M&As will replace the megadeals of recent years. The trend will be driven by multiple factors, including cash at hand, divestiture of non-core assets of strategic companies, falling asset prices and an ongoing search for growth through category expansion and investment in adjacencies.

Deloitte CFO Signals Survey: CFOs Anticipating a Slowdown, but not a Recession
CFOs overwhelmingly expect a U.S. downturn by the end of 2020, with a slowdown seen as much more likely than a recession. Their expectations for growth in revenue, earnings, hiring and wages declined (only capital expenditure rose); all metrics sit below their two-year averages. Companies are using a variety of programs to promote diversity and inclusion; flexible work arrangements are the most common. prnewswire.com

McDonald’s reverses positions, won’t actively oppose minimum wage hikes
Every campaign (local, state or federal) to raise the minimum wage of hourly workers at the bottom of the pay scale in the U.S. has historically been met by protests from the business community over the potential side effects such actions might bring such as layoffs, higher prices to consumers and the demise of small businesses.

In today’s tight labor market, however, some of the very same companies and groups that have staunchly opposed raising minimums are now more willing to discuss the matter. McDonald’s, which has been a target of worker groups promoting a $15 an hour minimum, recently said it would stop engaging in a National Restaurant Association campaign to kill such efforts. Managers at Walgreens recently learned the company was cutting bonuses as part of a cost-saving plan. Now, the drugstore giant plans to cut back on information technology and additional spending, which could further complicate the jobs of managers who run the chain’s stores. chicagotribune.com

Cleveland wants to ban new dollar stores from the city
Dollar stores could become a thing of the past in Cleveland. City leaders introduced legislation that would keep new locations of Dollar Tree, Family Dollar, and Dollar General out of the city. The legislation includes several claims: The stores have little selection of fresh foods, but make it difficult for local full-service grocery stores to compete. They pay fewer workers at lower wages than grocery stores. wkyc.com

U.S. Retail Workers Lament Understaffing as their Biggest Frustration
New research reveals that understaffing is retail workers’ biggest frustration of working in the industry. Not only is this the biggest point of frustration, but over 80 percent of retail workers claim that more efficient management of stores and better forecasting would improve their job satisfaction.

By 2025, 66 percent of consumers expect there to be even fewer staff in stores and instead to encounter more automated processes, virtual assistants and virtual reality technology. Additionally, over 70 percent of retail employees agree that a pay-desk will no longer be the area in the store where the greatest value, advertising, or customer retention is provided.

FBI falls short in notifying companies of breaches
The FBI needs to shore up its internal processes for notifying the victims of cyberattacks, according to a U.S. Justice Department inspector general’s report published Monday.

There are issues with the quality and completeness of the data stored in the FBI’s Cyber Guardian system — a tool for disseminating notifications after security breaches — reports Inspector General Michael E. Horowitz.

Many FBI agents tasked with responding to cybercrimes improperly handle the work associated with indexing the victims in the bureau’s system, a problem that could make it more difficult for hacked organizations to recover, according to the report. cyberscoop.com

Private security companies see boom in industry because of shoplifting
Increased security presence at stores is 'the new normal'
More and more retailers across Winnipeg are turning to private security companies to help reduce shoplifting and threats against their staff. Winnipeg police and Manitoba Liquor and Lotteries have started to clamp down on brazen liquor thefts, but the shoplifting isn’t just happening there. Retail stores have seen an increase in shoplifting at both grocery and clothing stores.

“They have to do something to retain some sort of control and mitigate the liability as much as they can, without endangering their own staff,” said Impact Security president Ron D’Errico.

Some retailers believe drugs may have something to do with the increase in thefts and violence towards their staff.

The need for security guards is up 15 per cent compared to last year at Impact Security. The company expects that kind of growth to continue this year, as more private businesses look to reduce theft, and protect staff and customers from people under the influence of alcohol and drugs.

“We actually had to hire another HR person to help us with the growth we’re undergoing and our training classes have actually doubled in size in the past month, ” D’Errico said.

Thieves Cashing In On Communities with Limited Police Resources
Several violent robberies at luxury stores in Vancouver highlight the need for retailers in that space to do a better job protecting themselves. For thieves, luxury products provide a more enticing, and lucrative target than regular stores. They are higher value, and command a higher resale price over the various reseller platforms which is mostly online now (often with a client base of ordinary everyday unsuspecting consumers) but still existing in the bricks and mortar environment, just like the regular shops.

“On the West coast, there have been grab and runs and robberies of that nature at luxury stores,” said Stephen O’Keefe, a Toronto-based veteran of the retail industry and loss prevention industry.

“Electronics are also a major issue. The smart-phone thefts that have been an ongoing problem started with a group out of California. They moved up along the coast to Vancouver, recently making their way across the country, and now known to be in the South Western Ontario region. They are highly organized and very determined, with no fear of causing damage or injury in the course of their activity.”

Major busts are taking place where there is a dedicated approach, with collaboration between police and retailers, but in communities where resources are scarce, retailers are experiencing higher levels of loss associated with crime.

“It really came down to police resources. That’s a common theme right now across the country, that police are being tapped so much that they’re not giving the attention to shoplifting. Combine that piece with the fact that the courts are also overburdened, and reluctant to take on what they view as victimless offenses for fear of having a significant offender walk, and you have a recipe for disaster.”

O’Keefe said that retailers do put in strong retail prevention programs that involve other employees but sales are, and always will be, the first priority.

“They rarely spend their time on loss prevention initiatives unless you have a loss that gives them a nudge towards looking into a specific matter. So that becomes a secondary part of their function and because the resources are so tapped they’re focused on sales. All of that said, it creates the perfect environment for what’s been going on around organized crime,” he said.

Canadian Police Raid ‘Orcus RAT’ Author
Man Behind 'Countless' Malware Attacks Since 2015

Canadian police last week raided the residence of a Toronto software developer behind “Orcus RAT,” a product that’s been marketed on underground forums and used in countless malware attacks since its creation in 2015. Its author maintains Orcus is a legitimate Remote Administration Tool that is merely being abused, but security experts say it includes multiple features more typically seen in malware known as a Remote Access Trojan.

The RCMP said the raid was part of an international coordinated effort with the Federal Bureau of Investigation and the Australian Federal Police, as part of “a series of ongoing, parallel investigations into Remote Access Trojan (RAT) technology. This type of malicious software (malware) enables remote access to Canadian computers, without their users’ consent and can lead to the subsequent installation of other malware and theft of personal information.

Ontario's first legal private cannabis retailers are open
Fewer than half of shops were ready for April 1 launch

Cannabis retail shops began opening in the Canadian province of Ontario on Monday (April 1), although fewer than half of the shops licensed by the government were ready to start operating on the first day of sales. According to the provincial Alcohol and Gaming Commission, 10 retail stores have been given the approval to open on April 1. Until Monday, legal cannabis sales in Ontario were only available online through a government-run e-commerce store.

Three retail cannabis outlets were authorized to open in Ottawa, two in Kingston, and one each in Toronto, Brampton, Burlington, London, and St. Catharines. Government officials had hoped to have 25 stores open on Monday, but many are still navigating the approval process. Regulators set an initial cap of only 25 retail licenses because of a shortage of cannabis from licensed producers that is stifling the growth of the industry legalized in Canada late last year.

"A car came into the parking lot [and] went very close beside me. The passenger reached out — kind of leaned out her window — grabbed my backpack and then they sped off," Synnott told CBC on Friday. "I tried to grab it back, but they were in a car and they had more power than I did," she said. Her initial reaction to the drive-by robbery was disbelief. "You kind of go into shock because you can't believe that people actually do this stuff," she said. It turned out that shortly after the theft occurred, there was activity on Synnott's credit cards. "If I can get them a list of where they tried to charge things … they'll go and look at the store videos to see if they can identify them," she said.

A 46-year-old Hamilton man is facing 14 charges in connection with several alleged thefts in the Halton region. Police say the spree dates back to January with Home Depot locations in Oakville and Burlington the primary targets. Investigators say high-end items were taken, including power tools and barbecues. Trump Takes on Fake Goods
President puts Amazon, Alibaba on notice for sale of counterfeit goods

President Donald Trump put Amazon, eBay and Alibaba and other online marketplaces on notice Wednesday, signing a memorandum that aims to curb the sale of counterfeit items online. "This is a shot across the bow to those companies. If you don't clean it up, then the government will," Trump trade advisor Peter Navarro told reporters. The effort comes as major online marketplaces have struggled to control the sale of fake products from third-party vendors.

The administration will require a report within 210 days from the Departments of Homeland Security, Commerce and Justice, according to the memorandum. It will analyze how widespread the problem is and how effective current responses are, while recommending potential regulatory or legislative changes to better combat the sale of fake goods.

In a Wall Street Journal op-ed Wednesday, Navarro said Trump's measure "instructs the Department of Homeland Security to coordinate with federal law-enforcement agencies working to combat counterfeiting." While Navarro did not give many specific details about how the White House would address the counterfeit problem, the memorandum serves as a warning to e-commerce companies.

In justifying the action, Navarro in part cited a 2018 Government Accountability Office report showing widespread issues with counterfeiting. The agency's investigators purchased brand name products from third-party vendors on sites such as Amazon, Walmart.com, Sears, Newegg.com and eBay and found 40 percent of the goods were fake.

"Our goal is to rightly shift the burden of trafficking to the supply chain and third party online marketplaces and intermediaries that right now are blanketing this country with dangerous products that cheat consumers out of billions of dollars a year," Navarro said. cnbc.com

While retailers are braced to deal with criminal types of fraud, a different response is needed to combat friendly fraud: chargebacks that arise out of legitimate transactions. These costs are a growing concern for the retail industry: 34% of retailers have experienced friendly fraud, which contributed to the $31 billion lost due to chargebacks in 2017, according to a study by Juniper Research.

“Every type of retailer, whether small, medium or large, needs to set realistic expectations about their entire business model, from their product features and benefits to their refund and return policy to whether they’re subscription-based or not,” said Srinivasan. “There are many things that need to be listed on the web site, in the email and anywhere there’s a touch point with the customer.”

Order confirmations are the first line of defense against chargebacks. They should be designed to be as clear as possible, with the total cost clearly broken down in terms of product price, shipping and tax. The form also should include multiple methods of contact, such as phone number, email address and social media accounts. This will help ensure that the shopper can get in touch through whichever channel they prefer, minimizing the chance that they instead contact the payment provider directly.

Conversely, failing to set the right expectations or offering poor customer service can motivate shoppers to file a dispute. Snoqualmie, WA: Suspects charged with organized retail theft; Police recover $10,000 of merchandise
On March 16, at about 6:52 p.m., Snoqualmie Police were dispatched to a report of theft at a Michael Kors outlet in North Bend. The Officer later observed the 4 suspects in another retailer. The officer waited outside the storefront. Two of the three females exited the store and were detained. Back-up officers arrived and the lead officer entered the store, taking the male suspect into custody for theft. The final female suspect was also detained.

The investigation found that the three female victims stole from the first victim business, and they were arrested for organized retail theft. Officers located a large bag of stolen merchandise inside store number two. Scott Carlton, 49, pleaded guilty to conspiracy to defraud the government and making a false statement, according to U.S. Attorney McGregor Scott.
