FDA Commissioner to Resign Amid Crackdown on Retailers
for Underage Tobacco Sales
In a surprise turn of events, Food and Drug Administration Commissioner Dr.
Scott Gottlieb will resign in about a month, the Trump administration confirmed Tuesday.
His two-year tenure since he was appointed as head of the FDA by President Trump
has included efforts to push tougher regulation of e-cigarettes and the tobacco
industry generally.
Gottlieb's work in recent months was hardly popular among retailers. Last month,
he
put
Walgreens on notice initiating “enforcement action against certain retail
locations of Walgreens and Circle K Stores for repeated violations of
restrictions on the sale and distribution of tobacco products, including sales
of cigars and menthol cigarettes to minors.”
On Monday, Gottlieb
broadened the crackdown on retailers, announcing what he
called "forceful actions" focused on retailers and manufacturers "to combat
youth access to e-cigarettes as part of FDA's Youth Tobacco Prevention Plan."
"We know that Walgreens isn’t alone," the FDA said. "There are a number of other
national, corporate-owned chains and franchise stores with disturbingly high
rates of violations for illegal sales of tobacco products to minors. In total,
we’ve identified 15 national retail chains, either corporate-owned or
franchised, whose rates of violative inspections exceed 15 percent of their
total inspected stores since the inception of the FDA’s retailer compliance
check inspection program in 2010."

Walgreens responds to FDA letter on tobacco sales to minors
Walgreens on Tuesday said it welcomed a meeting with Food and Drug
Administration commissioner Scott Gottlieb to discuss its approach to preventing
the sale of tobacco to minors. The statement followed a letter that Gottlieb
sent to the chain Monday requesting a meeting with its leadership to discuss
what he called “this corporate-wide issue related to your stores’ noncompliance”
when it came to selling tobacco to minors.

FDA puts 15 retailers on notice for allegedly selling tobacco products to minors
The Food and Drug Administration called out 15 retailers on Monday for allegedly
selling tobacco products to minors and requested information from more than 40
e-cigarette companies the agency thinks may have illegally introduced new
products onto the market.
The agency named corporate-owned and franchise retailers who were allegedly
found selling tobacco products to minors more than 15 percent of the time since
the FDA started conducting inspections 2010. These retailers include
Walgreens, Walmart, Kroger, 7-Eleven, Family Dollar, BP and Citgo. FDA
Commissioner Scott Gottlieb said in a
statement that he plans to ask these companies about what policies they
have in place and what more they plan to do.

Republicans Propose Mandatory E-Verify
Sen. Charles Grassley, R-Iowa, has reintroduced legislation which would require
employers to use the federal government's
E-Verify program to
determine if workers are authorized to work in the United States.
Grassley's Accountability Through Electronic Verification Act would permanently
authorize E-Verify, first established in 1996 as a pilot program and
reauthorized several times since then.
Within three years of enactment, the bill also would require employers to
check the status of all current employees and terminate the employment of any
unauthorized employees found due to the electronic checks. The bill has
several Republican co-sponsors. Rep. Mo Brooks, R-Ala., introduced companion

FDA confirms asbestos in Claire’s and Justice makeup products
The Food and Drug Administration confirmed Tuesday that Claire’s and Justice,
two retailers aimed at tweens and teenagers, carried makeup products that
contained asbestos. The FDA
released test results that revealed that three powdered makeup products from
Claire’s and one from Justice contained asbestos, a mineral fiber that once was
commonly used in building construction materials. Exposure to asbestos fibers
and particles may cause lung disease.

Target Chief Puts Stores at Center of Retailer’s Universe
The mass retailer is using stores as delivery hubs to lower costs
At a time when the industry continues to feel the pain of store closures and
bankruptcies — and even as its digital sales grew 31 percent in the fourth
quarter — Target Corp. chairman and chief executive officer Brian Cornell
sounded as bullish as ever about physical retail.
“The digital component is important, but at the end of the day the majority
of guests go to stores,” Cornell told a room of retail analysts at Target’s
annual meeting for the financial community.
Stores are key to reducing shipping and delivery costs, Cornell said, with
shipping from stores resulting in cost savings of 40 percent. A 90 percent
savings with a lower average unit cost is realized through drive-up pickup,
where a customer alerts the local store that she’s on the way, and a sales
associate puts the order in the trunk.

Dillard's Lead of Threat Hunting & Intelligence, Angeline Button
2018 Breakthrough Female in Cybersecurity Award Winner
Managing
time to complete intelligence sharing is a huge priority for
Peer Choice Winner Angeline Button. She manages to be a rock-solid resource
for not only the intel sharing community, but as a strong female influence in
cyber security. Angeline is the practice lead of Threat Hunting & Intelligence
at Dillard’s. In her role, she manages Dillard’s MSSP, continues the process of
maturing Dillard’s Threat Intelligence, and is involved in email security and
PKI.
Here’s what Angeline has to say about sharing and the benefits of being an RH-ISAC
member:
1. How has information shared via the RH-ISAC
benefited your organization?
Threat Intelligence Sharing: There have been two occasions that come to mind
where RH-ISAC members sharing IOCs have notified us of an issue on our site as
well as malicious emails that bypassed our security controls. We have used
Information in the portal on how to monitor for threats to create new credential
stuffing and fraud monitoring, and, because of RH-ISAC, we have begun monitoring
our email threats daily (to share “interesting” threats) instead of weekly (for
reporting). We have also added additional logging/monitoring due to suspicious
activity that was noted in the “Strange Gift Card Related Activity” email.
Originally, we didn’t have the logging in place to assist with the question from
Target, but as a result we do now and will be able to share/alert on spikes in
activity to email domains, etc.
2. Many companies say it’s difficult to find time
to share. How do you find time?
I’ll admit starting out that it took a lot of time to compile the information
and review before sharing, and I’d only be able to do it a few times a week. We
have been working to streamline the process so I can carve out time to share on
a daily basis with the goal of automating some of the reporting/IOCs.

You received the Breakthrough Female in Cybersecurity award last year. What did
it mean to receive this award?
I honestly wasn’t expecting to receive a Peer Choice Award last year along with
Vanessa Aranda at Gap. I’m honored, especially because I felt like a relative
newcomer to threat intelligence. I’ve also been incredibly lucky to have a
manager, director and CIO who firmly believe in sharing intelligence within this
community.
4. What can leaders do to increase the number of
women in security?
I believe we need to have a welcoming atmosphere for women coming into this
field, and an even bigger impact is seeing the growing number of women already
flourishing in security. For example, women hold both our Information Security
Officer and Manager of Information Security positions at Dillard’s.

Retail industry endures new point-of-sale cybercrime spree
Researchers have uncovered an ongoing campaign against retail VMWare Horizon
Point-of-Sale (PoS) thin clients. The new attack wave, which has taken place
over the past eight to ten weeks, is attempting to spread Cobalt Strike, a
legitimate penetration testing tool which has also, unfortunately, been adopted
in recent years by threat actors.

researchers from Morphisec, Cobalt Strike -- in tandem with malicious
payloads -- can be used to hijack systems, execute code, harvest credentials,
and is also able to circumvent EDR scanning.

Fraud Protection for Brick-and-Mortar Retailers Navigating Digital
Transformation
Brick and mortar businesses navigating towards a digital transformation need to
deploy a fraud strategy that is multi-layered and specifically accounts for
card-not-present fraud.
An underpinning technology for stopping CNP fraud is machine learning. Machine
learning combines data, context, and feature engineering to allow organisations
to evaluate the risk of a particular digital interaction or purchase.
Machine Learning, a form of artificial
intelligence, allows fraud prevention solutions to “learn” on their own and
continually improve results. In order to
stop a card-not-present payment, there are two critical types of machine
learning that, when combined, provide the best fraud prevention foundation.
Unsupervised Machine Learning
Unsupervised learning does not require outcomes, so it can learn without waiting
for the completion of a three-month chargeback reporting cycle. This type of
learning often relies on clustering, peer group analysis, breakpoint analysis,
or a combination of these. This enables fraud prevention solutions to detect
patterns and anomalies rapidly within extremely large sets of data.
Supervised Machine Learning
Supervised learning uses outcome-labelled training data sets to learn. Models
include neural networks, Bayesian classifiers, regression, decision trees, or an
ensemble combination. Massive amounts of data run through defined models to
assess risk outcomes.
Brick and mortar merchants that deploy a mobile app need to account for a new
world of risk through digital fraud attacks. There are great benefits to
investing in digital engagement channels, however, with those opportunities
comes risk. By addressing fraud with a holistic strategy, merchants can
authenticate a user, identify fraudulent behaviour, and stop fraud before it
influences the bottom line and diminishes the merchant’s brand. By building a
level of fraud prevention in their mobile apps, brick and mortar merchants are
empowering decision makers with data to make informed decisions and to mitigate
fraud before it impacts the businesses’ bottom line.

How Hudson's Bay CEO Helena Foulkes Is Getting
the Retailer to Focus
Since
taking the helm at Hudson’s Bay Co just over a year ago, Helena Foulkes has been
busy streamlining the department store operator’s business. On her watch, HBC
has made big moves like shedding online flash site Gilt Groupe, selling a large
stake in the company’s struggling European business to a rival,
shelving plans for further Saks expansion in Canada,
closing the Lord & Taylor flagship in Manhattan and selling it to WeWork and
most recently, announcing it would close up to 20 Saks Off Fifth stores.
Instead, HBC is putting its energies into its best performing businesses—and
those with most potential. “I’ve trying to get the organization to focus more,”
Foulkes tells in a recent interview at HBC headquarters in New York City.
Before Foulkes became CEO in February 2018, the retailer had grown bloated with
high debt and was chasing too many markets, all the while much of the business
was stagnant or declining, notably Lord & Taylor and Saks Off Fifth. The bright
spot has been Saks Fifth Avenue and to a lesser extent, the Hudson’s Bay chain
in Canada. So Foulkes wants to apply the lessons learned at Saks, where
comparable sales have been on a tear for two years now, to the other parts of
the HBC business.

Huawei CFO Sues Canada, Argues December Arrest Violated Constitution
Canada violated the constitutional rights of Huawei executive Meng Wanzhou when
border officials detained and interrogated her for hours, lawyers for Meng are
alleging in a lawsuit against the Canadian government.
Meng, the chief financial officer of the Chinese telecom firm Huawei, was
arrested by Canadian officials in December at the request of the United States.
The U.S. had sought Meng's arrest on charges of fraud, arguing Huawei had
violated U.S. sanctions on Iran.
In detaining Meng, Canada became entangled in the ongoing legal battle between
the U.S. and China, which have been sparring over alleged spying by the Chinese
telecom company. China has detained more than a dozen Canadian citizens,
possibly in retaliation for its arrest of Meng.

Gap announces plan to close 230 stores, some in Canada
The parent company of retailer Gap says it will close some stores in Canada as
part of a global plan to shutter almost half of the brand’s locations over the
next two years.
Gap Inc. is refusing to tell The Canadian Press exactly how many of the 230
stores it is closing will be in Canada, but says the majority of international
network closures will be in North America.

Victoria's Secret To Shut 3 Canadian Stores As
Chain Reorganizes
Three Victoria's Secret stores in Canada are expected to close this year as
parent company L Brands looks to improve on its financial performance.
A spokesperson for the U.S.-based lingerie brand's parent company declined to
tell The Canadian Press which locations will be shuttered in Canada, but says
they are part of a plan to slash 53 stores worldwide.

The Food and Drug Administration on Thursday said a major Canadian drug
distributor was selling unapproved and mislabeled medicines to unsuspecting

Edmonton, AB: “Project Timber” Bust of $3.5M
Lumber Theft Ring results in 80 charges against 4 people
A year-long investigation into a commercial vehicle theft ring in Edmonton has
resulted in police seizing $3.5 million in stolen property and laying dozens of
charges. On Feb. 8, 2018, the Edmonton Police Service‘s commercial vehicle
investigation detail launched Project Timber, an investigation into several
suspects who were alleged to be stealing semi-tractor trailer units loaded with
lumber. “It actually started with the recovery of a stolen semi with its load
just west of Edmonton,” said Sgt. Kerry Bates.
“Surveillance
was conducted by a supporting unit for us and identified the driver and another
person at that time. Our investigation that took a year grew from that event. We
were aware there was loads of lumber and tractor trailers going missing and
being recovered. But that was the one incident that led to the whole incident
being uncovered.” Bates said there were, in total, 10 incidents of tractor
trailers and their loads of lumber going missing. Police say the suspects were
targeting the big rigs, which were parked overnight in various industrial areas
around the city. Many of the vehicles targeted were parked on the side of the
street outside a lumber distribution centre north of the Yellowhead. The
suspects would sell the stolen lumber to unsuspecting clients outside of
Edmonton, according to police. The tractor trailers would then be left in
trucking yards or other locations, according to Bates, but have since been
recovered.

theft from Shoppers Drug Mart
According to police, on Feb. 17, 2019, a female suspect went to the Shoppers
Drug Mart located at 2501 Third Line in Oakville. It is alleged that the suspect
stole razors and replacement toothbrush heads. The total value of the
merchandise was $1,167.31.

Police have arrested three people for shoplifting at the Alliston Walmart, but a
fourth person remains at large. The Nottawasaga OPP received a call from the
store on Tuesday, Feb. 12 around 6:30 p.m. after the store's loss prevention
officer apprehended four people outside the building. When police arrived one of
them fled on foot while the other three tried to escape in a vehicle. The
quartet is accused of stealing several electronics and sporting items worth
about $400.

Police say around 1am on Friday, March 1, the store, located on Elizabeth
Street, had its front windows smashed in, with two suspects gaining access.
Video surveillance shows the pair entering the store and stealing multiple NHL
sweaters, hoodies, hats along with other clothing and cash. Police say on
Sunday, March 3, Redcliff RCMP arrested and charged one of the two men who they
say was involved in the crime.

Brands Lose Up To An Estimated $50 Billion
Annually From Ad Fraud
About three-quarters of U.S. fraudulent advertising traffic is “sophisticated”
invalid traffic, according to data released Tuesday. Looking at IP and
blacklists no longer works, said Guy Tytunovich, CHEQ founder-CEO, and a former
Israeli military intelligence officer. Tytunovich called ad fraud the
second-largest organized-crime scheme globally, in terms of revenue generated,
including narcotics.
“The industry needs to understand that for the last 10 years, vendors have been
talking about different methods for detecting fraud through probabilistic and
simplistic approaches,” he said. “At the end of the day, which I learned working
for the defense intelligence in Israel, it’s a cat-and-mouse game. These methods
no longer work.”
CHEQ, whose scientists continue to build out a military-grade ad-verification
service, analyzed 4.1 billion ad requests made in the United States across 1.2
million websites between October 2018 and February 2019 -- up about 20% from the
prior year. About 18% of the online ad traffic was fraudulent.
Ad fraud is just one element; brands are losing between $20 billion and $50
billion per year, he said.

Savvy crooks make card not present fraud a risk
without end
Fraud against e-commerce merchants is growing faster than the rate of e-commerce
sales, and Juniper Research projects that
retailers will lose $130 billion to CNP fraud between now and 2023.
Why is CNP fraud growing so fast? It’s no longer a matter of post-EMV migration
from POS to online fraud. What we’re seeing now is brazen, organized
cybercriminals leveraging technology and traditional business strategies to
commit more fraud faster.
Today’s CNP criminals network online, and not only in the far recesses of the
dark web. RSA recently reported that
fraudsters are using the popular global messaging app Telegram in new ways
to grow their criminal enterprises. Although they used to use the app for group
chats to share knowledge and stolen data, RSA has found they’re also now using
Telegram channels to sell their services to other would-be criminals. The new
bot feature in Telegram is also being used by fraudsters to automate sales of
stolen data, provide fully outsourced fraud-as-a-service and sell subscriptions
to compromised card numbers and card-testing services.
As fraudsters take more technologically complex approaches to fraud, they’re
also, ironically, making it easier for just about anyone to become a CNP
fraudster. Card brands are keeping an eye on the growing trend of
fraud-as-a-service that is growing on the dark web and beyond. Visa Chief Risk
Officer Ellen Richey recently wrote that “the black market for cybercrime has
also evolved to enable individuals of all skillsets to participate as long as
they have the desire.”

McDonough, GA: Home Depot Loss Prevention
attacked with Pepper Spray
Couple has hit HD stores 6 other locations
The pepper spray attack on the loss prevention officer at the McDonough store
was recorded on surveillance video as it happened just outside the store on
Jonesboro Road. On surveillance video a fast-moving suspected thief is seen
turning around to pepper spray the loss prevention agent at the rear door of the
store. Henry County Police said the security officer was taken to the hospital
where he was treated and released after the pepper spray attack.
Investigators tell FOX 5 News he spotted the man and the woman with him in the
store trying to steal power tools and batteries. “These individuals are probably
expecting to be confronted. They used violence to get away so its very
concerning for us as well, said Captain Joey Smith with the Henry County Police
Department. Smith said the couple apparently left empty-handed after they pepper
sprayed the security officer. He said this wasn’t the first time the couple has
been seen at the McDonough store and other Metro Atlanta Home Depot’s “McDonough
three times, Fayetteville, Riverdale, Griffin, LaGrange, Newman, Locejoy, just
several locations that these individuals are involved in,” said Smith. Stephen
Holmes, a Home Depot spokesman, couldn’t discuss specifics of the pepper spray
attack. He said shoplifters have become more and more aggressive, adding it’s
often tied into what’s called organized retail crime.

$183,000 worth of stolen rings from an Issaquah house six hours after jewelry
heist at mall
The discovery happened six hours after the jewelry heist at Factoria Mall.
According to investigators, Drew Creighton, 30, walked into Olsen and Son's Fine
Jewelry and asked to see engagement rings last Wednesday night. After looking at
rings for about 45 minutes, police say Creighton grabbed the trays of rings and
ran. The employee chased him. As Creighton got in his car to get away, he
dropped his health insurance card with his name and birthdate, according to
police.

$3K in electrical supplies from The Home Depot in West Springfield, Police chase
into Chicopee
Police say a trio from Connecticut stole thousands in electrical supplies from
the Home Depot on Route 5 Sunday, and then led officers on a chase on the
highway into Chicopee before finally surrendering, police said. When officers
looked inside the minivan at the end of the chase, they found enough stolen
electrical supplies “to wire a home or small office," police said. The total
value of the stolen items was $2,944.

Mecosta County, MI: Man stole $4,500 in Apple
products, other devices in Walmart theft
Police
are looking for a man who stole about $4,500 in electronics, including Apple
iPads and Apple watches, during an early morning theft at a Walmart store in Big
Rapids. Mecosta County sheriff’s deputies said a man entered the store at about
3:20 a.m. Tuesday, March 5 and went behind an employee counter. He pried open a
locked case and cut a security cable to access electronics.

Sports Card Storage Unit Theft Case
A Maryland man has been convicted of stealing thousands of dollars worth of
sports cards and other collectibles from a storage unit owned by a former New
Jersey card shop owner. David E. Stone, 46, was found guilty of theft of more
than $25,000 and less than $100,000, a felony that carries a maximum 10-year
sentence and a fine of up to $15,000. About $65,000 of stolen sports
collectibles and comic books were recovered by Elkton Police Detectives.

electronics with stolen identification
Rafael Sosa admitted to using someone else's identification to buy over $2,000
worth of cell phones. Sosa, who's from New York, told police he came to
Morgantown to buy cell phones. He was then told to return to New York where he'd
get paid for them. "There are organized groups that will travel around the
country and up and down the interstate. They will stop at large box retail
stores and go through this process over and over and over again. In a day's time
they can hit dozens of stores," said Chief Ed Preston.

County, GA: Armed Robbery suspect dies in Police shooting at Family Dollar
A suspect has died after a police shooting at a local Family Dollar, the Georgia
Bureau of Investigation announced Wednesday. The GBI identifed the man as
22-year-old Steven Goins. No officers were hurt. The DeKalb County Police Chief
said this started with an armed robbery at the store on Glenwood Avenue. Police
say the suspect ran away to the back of the shopping center, where he shot at a
Police Officer who returned fire.

St Charles, MO: Amazon Driver shot in dispute
over handicapped parking spot outside Target
One man is in custody and another hospitalized after a dispute over a
handicapped parking spot at a Missouri Target store turned violent. The shooting
happened around noon Tuesday in St. Charles. Police say a 65-year-old man shot a
21-year-old Amazon delivery driver who had parked in the handicapped spot,
following an argument between the two men. The driver was shot once in the back.
Amazon described what happened as “terrible” and said in a written statement
that it would “work with law enforcement and the delivery service partner as
they investigate.” Police say the weapon used in the shooting has been
recovered.

Loss Prevention Manager at Fred Meyer Convicted
of Stealing $230,000 From Self-Checkout Machines
The
loss prevention manager at the Gateway Shopping Center Fred Meyer was convicted
of stealing almost $230,000 from self-checkout machines. As the store's loss
prevention manager, 37-year-old Emily Tallman was the person tasked with
investigation thefts.
But prosecutors presented evidence that Tallman used her employee badge to enter
the store outside of normal business hours, pull up to the machines with cart
and use a clipboard to obscure security camera views with she took out money.
Multnomah County Deputy District Attorney Sean Hughey, who prosecuted this case,
said in court today that Tallman "was the person that [Fred Meyer] had tasked
with looking into these thefts," and that regional loss prevention managers
started looking into the issue after Tallman reported she didn't know why the
machines were coming up short.
Hughey said the company soon realized: "Our store's loss prevention manager
is the one stealing the money." A jury found Tallman guilty of 14 counts of
theft in the first degree and seven counts of aggravated theft in the first
degree. Sentencing is tentatively scheduled for April 12, 2019.

MD: Arrests Made In String Of 76 Commercial Armed Robberies Across Maryland
Baltimore County Police arrested three suspects in a robbery spree that targeted
several businesses across Maryland. The spree ended at a McDonalds on Falls
Road, and now they are connected with dozens of armed robberies across the area.
Multiple agencies, including Baltimore Police, Anne Arundel County Police and
the FBI, investigated a string of 76 robberies that started at a Game Stop on
York Road on Nov. 28. Of the 76 robberies, 18 were in Baltimore County, four
were in Anne Arundel County and 54 were in Baltimore City.

Armed Robberies
Six
people -- including four males age 18 and younger -- were indicted Tuesday for a
string of alleged gang-influenced armed robberies in Macon. Tiquan Jamir Spivey,
20, Anthony Rashad Love, 19, Juan Malik Parker, 18, a 16-year-old and two
15-year-old's are each charged with three counts of violating the Georgia
Racketter Influenced and Corrupt Organizations (RICO) Act. Between Sept. 23,
2018, and Nov. 17, 2018, five armed robberies occurred at Dollar General and
Family Dollar stores in Macon. An Oct. 5, 2018, armed robbery at Waffle House,
4731 Chambers Road, also has been linked to the robbery spree. An investigation
by the Bibb County Sheriff’s Office and Federal Bureau of Investigation led to
the arrest of the six suspects.

The last of three New Mexico men charged for their roles in a carjacking and
pharmacy robbery in Wyoming has been sentenced. Antoine Mitchell was sentenced
on Monday to 35 years in prison. Mitchell and his co-defendants, Moses D.
Dickens III and Christopher Dominguez, were indicted in Wyoming in May 2017. The
men were arrested on Dec. 3, 2016, in Raton, New Mexico, after robbing another
pharmacy and leading police on a high-speed chase. Dickens was sentenced to 35
years in prison and Dominguez to 28 years as part of plea agreements.

Allentown, PA: Man Pleads Guilty to Assault in
Shooting Outside Macy’s
at Lehigh Valley Mall
Twenty-year-old Miles Harper pleaded guilty Tuesday to aggravated assault in a
deal in which Lehigh county prosecutors dropped attempted homicide counts.
Prosecutors said a June 1 fight near the cosmetics section of Macy's at the
Lehigh Valley Mall continued outside the store and involved about 10 men.
Prosecutors said Harper was a member of a Bethlehem-based gang, and one of the
two people wounded was a member of a rival gang.

The Utah Attorney General’s Office announced that the principal owners of Big
Dog Pawn & Jewelry of Murray, Inc., have entered plea agreements to felony
charges after investigations into the pawn shop revealed unlawful activity,
including money laundering and receiving stolen property. On June 19, 2018,
Special Agents from the Utah Attorney General’s Office served search warrants on
seven different pawn shops, one being Big Dog Pawn & Jewelry, and seized several
hundred thousand dollars’ worth of new-in-the-box merchandise alleged to be
stolen from various local retailers.
Monte McKee, 68, and Kelli Carpenter, 43, were charged with felony Pattern of
Unlawful Activity, Money Laundering, and several Misdemeanor counts of Receiving
Stolen Property. On February 8th, both defendants entered a Plea in Abeyance to
the felony Pattern of Unlawful Activity charge and the remaining counts were
dismissed.
