I first met Gus Downing in the mid-1990s. It was a brief but memorable occasion. At that point, I had no idea that we would eventually be sitting together for holiday meals at the family dining room table.

Many in our industry today know Gus as the creator and President of the D&D Daily. We older folks, however, remember Gus as a second-generation LP professional, a HUGE personality, and the head of a team that essentially built and shaped the Loss Prevention industry in the '80s, '90s, and early '00s.

You see, Downing & Downing was THE Retail Loss Prevention recruiting firm during those years. Everyone knew Gus and his team. At one point, you couldn't find a retail LP team that didn't have at least one member (or leader) placed by D&D.

The entire team was legendary and in high demand—mainly because they were so in tune with what the industry both wanted and needed.

To be "anointed" or endorsed by Gus (or Chris, Gene, or Jacque, for that matter) was almost like receiving a seal of approval for many of us trying to advance our careers. To me, they seemed almost extraordinary, as though they could shape someone's career with a 30-second phone call.

Retail theft is a growing issue that undermines businesses, affects consumer prices, and strains local economies. As shoplifting incidents escalate in frequency and sophistication, many retailers and law enforcement agencies are urging policymakers to enact tougher laws to combat this pervasive problem. Stronger legal measures are not only necessary to protect businesses but also to deter organized crime syndicates that profit from these acts.

Stronger laws are essential to addressing this issue effectively. Many states currently treat retail theft under certain monetary thresholds as misdemeanors, providing little deterrence for repeat offenders or organized groups. By raising penalties and lowering the monetary thresholds for felony charges, lawmakers can ensure that repeat offenders face serious consequences. Moreover, legislation that targets organized retail crime networks by penalizing the sale of stolen goods online can disrupt the broader ecosystem enabling these crimes.

Additionally, raising awareness among consumers about the real costs of retail theft can build public support for stricter measures.

Inaction on retail theft sends the wrong message—to thieves and to law-abiding citizens. By enacting tougher laws, governments can protect businesses, workers, and consumers while safeguarding the health of local economies. Addressing this issue now is essential to restoring trust and stability in communities across the nation.

California city leaders call for 'unified front' enforcing Prop 36
SACRAMENTO, Calif. — Nearly a month after Proposition 36 went into effect in California, leaders from cities across the state are calling for a more unified enforcement of the law. The California Contract Cities Association, which endorsed the proposition, met on the west steps of the California Capitol on Monday.

The organization is calling for law enforcement to take quick action to get Prop 36 fully implemented. "We're actually going to be able to prosecute and hold people accountable," said Jennifer Perez of CCCA. The association said cities are struggling with the rise in retail theft over the past few years.

Across the state, there was a 39% rise in retail theft in 2023, the organization said, the highest level since 2000. In Sacramento alone, businesses have seen a 70% increase.

"We feel that this law will safeguard local economies by imposing tougher penalties on property crimes, combatting the $15 billion annual loss from organized retail theft and protecting small businesses and jobs that are in all of our communities," Perez said.

Prop 36 did not include any new money to help with its implementation. However, supporters said there are already funding opportunities that exist in previously passed state and local legislation. kcra.com

Retailers Ramp Up Efforts to Mitigate Returns
Returns, ‘shrink’ cost U.S. retailers billions of dollars, NRF reports
Total returns in 2024 were projected to reach $890 billion in 2024. Of the $5.13 trillion in in-store and online sales logged in 2023, returns amounted to $743 billion, according to reports compiled by the National Retail Federation and Happy Returns, a UPS company.

Retailers estimated that 16.9% of their annual sales in 2024 would be returned. In comparison, as a percentage of sales the total return rate for 2023 was 14.5%.

According to the NRF, for every $1 billion in sales the average retailer incurs $145 million in merchandise returns. Online sales incur a higher return rate, with 17.6% or $247 billion of merchandise purchased online returned. That compares to 10.02% for pure brick-andmortar returns (excluding online orders that are returned in-store), or $371 billion.

Retailers have been focused on efforts to mitigate returns.

Returns play an important role within the retail ecosystem and offer an additional touchpoint for retailers to provide a positive interaction with their customers,” said NRF Vice President of Industry and Consumer Insights Katherine Cullen. “Retailers recognize the value of returns and their integration with brand loyalty, and many are prioritizing their returns capacity to ensure a seamless customer experience.”

Return policies and expectations impact the consumer throughout their shopping experience. Fully three-fourths of all consumers consider free returns a key factor in deciding where to shop, and 67% say a negative return experience would discourage them from shopping with a retailer again.

In response to consumer demand, retailers continue to enhance the return experience for customers. More than two-thirds of retailers surveyed (68%) say they are prioritizing upgrading their returns capabilities within the next six months. In addition, improving the returns experience and reducing the return rate are viewed as two of the most important elements for businesses in achieving their 2025 goals.

However, retailers must balance meeting consumer demand for seamless returns against rising costs. Fraudulent and abusive returns practices create both logistical and financial challenges for retailers. In a year where consumers still fretted about inflation, Santa Claus delivered a solid holiday shopping season. According to a Mastercard Spending Pulse report, total spending this holiday season increased 3.8% over 2023, surpassing the previously forecasted rise of 3.2% and beating last year's increase of 3.1%. For the shopping period between November 1 to December 24, online grew 6.7% while in-store sales grew 2.9%.

On some levels, 2024 was a challenging year for the USA retail industry. According to Coresight, through November 2024, retailers were projected to close over 7,100 stores, a 69% increase over the same period in 2023. Somewhat surprisingly, the top 5 retail chains with the highest number of physical stores closures were Family Dollar, CVS Health, Big Lots, Conn's, and Rue21.

The mixed results fulfill the prophecy by the Economic Intelligence Unit which in 2024 forecast offline retail as cloudy, online retail as stormy, food as cloudy, and non-food also stormy. NFL Team's Online Store Hacked
Green Bay Packers' online store hacked to steal credit cards
The Green Bay Packers American football team is notifying fans that a threat actor hacked its official online retail store in October and injected a card skimmer script to steal customers' personal and payment information.

The National Football League team says it immediately disabled all checkout and payment capabilities after discovering on October 23 that the packersproshop.com website was breached.

"On October 23, 2024, we were alerted to the presence of malicious code inserted on the Pro Shop website by a third party threat actor," the Packers's Director of Retail Operations Chrysta Jorgensen explains in breach notification letters sent to potentially affected individuals. "Immediately upon learning this, we temporarily disabled all payment and checkout capabilities on the Pro Shop website and began an investigation."

The NFL team also hired outside cybersecurity experts to investigate the incident's impact and find if any customer information had been accessed.

The investigation revealed that the malicious code inserted in the checkout page could steal personal and payment information between late September and early October 2024. However, the Packers say the attacker couldn't intercept information from payments made using a gift card, Pro Shop website account, PayPal, or Amazon Pay.

"We also immediately required the vendor that hosts and manages the Pro Shop website to remove the malicious code from the checkout page, refresh its passwords, and confirm there were no remaining vulnerabilities," Jorgensen added.

"Based on the results of the forensic investigation, on December 20, 2024 we discovered that the malicious code may have allowed an unauthorized third party to view or acquire certain customer information entered at the checkout that used a limited set of payment options on the Pro Shop website between September 23-24, 2024 and October 3-23, 2024." bleepingcomputer.com

Two Largest U.S. Telecom Companies Push Back Against Threat Group

Two of the largest telecom providers in the U.S. said the China-government sponsored threat group is no longer embedded in their networks.

AT&T and Verizon, two of the nine U.S. telecom companies attacked by Salt Typhoon, said they evicted the China-government sponsored threat group from their networks.

We detect no activity by nation-state actors in our networks at this time,” an AT&T spokesperson said in a prepared statement. A Verizon spokesperson made a similar statement, asserting the carrier has “contained the cyber incident brought on by this nation-state threat actor. An independent and highly respected cybersecurity firm has confirmed the Verizon containment.”

Greece, NY: Video captures smash-and-grab robbery at Greece Ridge mall jewelry store
Greece police are investigating a brazen smash-and-grab robbery Monday night at Dubai Jewelry at The Mall at Greece Ridge. At 6:44 p.m., eight suspects entered the mall, according to the Greece Police Department, which on Tuesday afternoon posted surveillance video of the incident to social media. Six suspects made their way to the jewelry store near Entrance 8 and two remained near a vestibule. The suspects, who are believed to be 15 to 25 years old and were wearing masks and gloves, jumped the store’s counter, smashed display cases with baseball bats and made off with $90,000 worth of merchandise, police stated. A mall security guard confronted the suspects but was threatened with a bat, police said. In addition to the $90,000 theft, damage to the display cases is estimated to be $3,000. As the suspects fled through the food court toward the exit, another security guard narrowly avoided being struck by a thrown bat, police said. The suspects left in a dark Chevrolet Malibu, later found unoccupied by the Rochester Police Department.  democratandchronicle.com


Aurora, CO: Officer injured, 2 in custody for reportedly stealing narcotics from Walgreens
An Aurora Walgreens was robbed Tuesday night and an officer was injured, but police say two suspects from the robbery are in custody thanks to a GPS tracking device. At about 6:48 p.m. on Tuesday, Aurora dispatchers were notified of a “SIERRA” alarm following a robbery at the Walgreens located at 18620 E. Iliff Ave. Dispatchers were told two suspects had robbed the pharmacy minutes before and made off with about $5,000 in oxycontin. APD said that “SIERRA” refers to the GPS tracking device store employees had hidden inside the stolen medication. Oxycontin is the brand name for the narcotic oxycodone, a painkiller only available through prescriptions. Aurora 911 dispatchers were given a live feed for the tracking device and relayed its location to officers, according to a department spokesperson. The suspects were tracked heading to a second Walgreens near the intersection of East Smoky Hill Road and South Aurora Parkway.
When officers arrived at the second Walgreens, the suspects fled on foot. Officers pursued and took both suspects into custody, according to an agency spokesperson. Details about the suspects, including names and ages, were not available Tuesday. However, an officer was injured during the foot chase, and taken to a local hospital for medical care. The extent of the officer’s injuries was unknown as of Tuesday night.  kdvr.com


Houston, TX: USPS mail carrier investigated in large-scale mail theft and fraud scheme
A USPS carrier technician is at the center of a large-scale mail-theft and fraud scheme where investigators believe identities were stolen from the mail, according to an affidavit for a search warrant in the case. Cornelius J. Davis is charged with one crime and being investigated for several others, according to court documents. Webster police arrested Davis last month. They said in a press release:

"On Monday, December 9, 2024, at approximately 10:45AM, the Webster Police Department responded to Academy Sports and Outdoors (located in the 21300 block of IH 45 Freeway in Webster, Harris County, Texas) in response to a suspect possibly using stolen credit cards to pick up merchandise. An undercover Webster Detective was posed as an Academy employee when the suspect presented a fraudulent driver’s license. The suspect was identified as Jermain Davis, a 26-year-old Black male, and placed under arrest for tampering with a document (3rd degree felony)."

The press release goes on to confirm that Davis is a USPS employee and that the USPS Office of the Inspector General is investigating. "During the thorough investigation, a search warrant was executed at a storage unit rented by Davis and officers recovered additional stolen merchandise. A second search warrant was executed at Davis’ apartment which resulted in additional stolen merchandise being recovered. Altogether, $7,000 in stolen merchandise has been recovered fox26houston.com


Palm Springs, CA: Jewelry store owner speaks out after burglary in downtown Palm Springs
A Palm Springs jewelry store owner is sounding the alarm after a brazen burglary hit his shop, leaving him frustrated and calling for police action. James Fausett, Gold Buyers owner, said on Sunday, January 5, his store was targeted. He described the burglary as an elaborate distraction scheme involving three to four individuals. "Two of them enter the store and case the store acting to be interested in high end items/jewelry. During the process they want to see a number of items. They tend to be very touchy wanting to feel all of the items," Fausett said. Newburgh, NY: One man was shot and killed, another man stabbed at Auto part store
One man suffered a fatal gunshot wound and another was stabbed during a fight between the two men in the west end of the city on Monday. City police found two victims when they responded to a report of a stabbing in an auto parts store in the 500 block of Broadway on Monday. During a fight between the two, one man suffered an apparent gunshot wound and the other suffered apparent stab wounds, police said. Police did not release the names of the two men. The man who suffered a gunshot wound died. The man who suffered stab wounds was treated for what police said appeared to be non-life-threatening injuries.  recordonline.com


Bronx, NY: Update: Man sentenced to 40 years to life for fatal shooting of bodega clerk
Tykwan McLeod, 49, was convicted by a jury of second-degree murder, attempted assault in the first degree, and second-degree criminal possession of a weapon. Bronx Supreme Court Justice Ralph Fabrizio handed down the sentence on Monday, which also includes five years of post-release supervision. On February 16, 2021, at approximately 8:40 p.m., McLeod entered K’s Convenient Deli at 8 East Mount Eden Avenue and shot Donte Thomas, 33, in the face without provocation, killing him instantly. Prosecutors said McLeod fired two more shots into Thomas as he fell. The defendant then attempted to flee but was confronted by the store’s owner, who was shot in the chest at close range. The owner and another employee managed to wrestle the gun away from McLeod before an off-duty NYPD Auxiliary Officer secured the weapon.  shorenewsnetwork.com


Santa Ana, CA: Man Charged with Fatal Stabbing in Restaurant Parking Lot
A 43-year-old convicted felon was charged Tuesday with fatally stabbing a man and attacking a woman in a Santa Ana shopping center. Justin Anthony Carlin was charged with murder and two counts of assault with force likely to produce great bodily injury, all felonies, with sentencing enhancements for inflicting great bodily injury and the personal use of a deadly weapon. Carlin is accused of killing 43-year-old transient Noah William Ewing on Sunday. Officers were called to a McDonald’s parking lot at 3810 S. Bristol St. about 3 p.m. Sunday, police said. Louisville, KY: Dispute over french fries leads to Wendy's shooting
Customers of the Dixie Highway Wendy’s near Pages Lane ate lunch in the lobby Tuesday even with bullet holes in one of the window panes. The bullet holes were the result of a shooting before 11 Monday night, which injured one woman. It’s not clear what led to the shooting, but the call originally came in to police as a dispute over fries. “Dispute between customers over fries, subject put hands on the caller, suspect is a black male wearing jeans armed with a gun,” radioed dispatchers to LMPD Monday. Four bullet holes are what’s left visually following the possible dispute over french fries. Police said a 26-year-old woman was taken to the hospital after getting shot in the rear end. It’s not clear whether she was an employee or a customer. The shift manager working Tuesday declined to answer any questions. Phenix City, AL: Shooting prompts police presence at Phenix City gas station
Authorities swarmed a Phenix City gas station following a shooting late Tuesday afternoon. Our crew on the scene at Marathon, located at 1701 Crawford Rd., observed blood near the entrance of the convenience store. The owner of the business tells us the incident stemmed from an altercation between two individuals. The area was cordoned off with crime scene tape, stretching from the store to the gas station canopy. Gwinnett County, GA: Update: Mall of Georgia shooting leaves one injured, 18-year-old arrested
An 18-year-old has been arrested after a shooting that left one person injured at the Mall of Georgia, located in Buford, late Saturday night. Gwinnett County Police have charged the suspect with aggravated assault and possession of a firearm during the commission of a felony. The shooting took place just before 9:30 p.m. when an officer working a security detail inside the mall heard gunshots. The officer quickly ran toward the sound of the shots, where they apprehended one individual who was attempting to flee the scene. The victim, identified in warrants as Joel Lakee Bradford, was rushed to a nearby hospital for medical treatment. Authorities have not provided further details on Bradford's condition but specified in warrants that he was shot in the head.  11alive.com


Gulfport, MS: Authorities searching for suspect after shooting outside MS Coast strip mall
Police are searching for a suspect after a shooting Monday night outside a Gulfport strip mall left left one person in critical condition, authorities said. Gulfport Police were called at 5:51 p.m. to a shooting in the 11320 block of Highway 49, a news release said. “We have not made any arrests, and our detectives are still following leads,” Lt. Jason DuCré said. Authorities found a victim with multiple gunshot wounds in the strip mall’s parking lot, DuCré said. Police said the victim was airlifted to out-of-state hospital. DuCré said police are searching for one suspect who fired at the victim but have not ruled out the chance that others could be involved. Los Angeles, CA: Robbery suspect in Southern California flees in driverless Waymo vehicle
A robbery suspect who hit a grocery store in the Fairfax District and attempted to flee in a self-driving vehicle Monday night is in custody, police confirmed to KTLA. Details are limited, but the Los Angeles Police Department said the incident unfolded just before 8:30 p.m. at the Ralphs grocery store located at the intersection of West 3rd Street and La Brea Avenue. Details are limited and it’s unclear exactly what happened inside the store, with police saying the suspect, who stole an unknown amount of merchandise, got into an altercation with the store’s security guard before fleeing in an autonomous Waymo vehicle. There are unconfirmed reports that the suspect used pepper spray to evade the security guard, though police have yet to confirm that specific detail. Responding officers were informed that the suspect fled in a Waymo and were eventually able to locate the autonomous vehicle. According to Waymo, its software is designed to recognize police sirens and lights and “will pull over as appropriate.”   ktla.com

Accepting criticism and feedback is probably one of the hardest things to do especially if it's unexpected or from an individual or group that's not really informed well enough to offer constructive criticism. Coming from our superiors or client's criticism and feedback can truly be valuable and help mold the path a person needs to take in changing or modifying behavior and improving relationships. It all boils down to whether or not you're willing to accept it and really hear what they're saying or not saying. It's human nature to automatically respond defensively and rationalize what you're hearing thus avoiding having to own it. However, the wise person learns to listen and force themselves not to respond other than to acknowledge that they heard it.
