Daily president and longtime LP industry leader Gus Downing passed away
peacefully on Sunday, Jan. 5, leaving behind a legacy of leadership that
will not soon be forgotten in the LP industry.
Gus was the co-founder and President of Downing & Downing, Inc. and led
the industry's leading executive search and consulting firm, which he
co-founded in 1983. Through this work, he helped retailers staff more
than 2,800 LP executives, over 33% of the Top 100 Retailers' senior
leaders, and built and designed LP departments.
In 2010, Gus transformed the firm into the number one daily digital news
source for the retail LP/AP and IT security communities. The D&D Daily
e-newsletter aggregates and reports the industry news from over 2,500
sources and produces exclusive retail crime reports, including retail's
only "Violent Fatalities" report.
Gus, a second-generation retail LP expert who began his career in 1973
working for a retailer in the security program run by his father, Gus
Downing Sr., was a pioneer in the LP industry. He held LP leadership
roles at retailers including Children’s Palace, Lerner Shops and Gold
Circle Stores, spent 25 years leading the nation's number one search
firm and the last 15 years building the D&D Daily into the leading daily
digital news source for retail LP/AP and IT Security.
One
of Gus's proudest moments came in 2019 when he was recognized as the
National Retail Federation's Ring of Excellence Award winner. During his
acceptance speech, Gus said, "Anybody can make a splash but very few
can change the tide." It's safe to say that Gus will be remembered not
just for making a splash or two throughout his storied career, but also
for changing the tide and having a meaningful impact on an entire
industry.
Above anything else, the D&D Daily was Gus's passion over the past 15
years. He frequently told his dedicated team that he hoped to see it
thrive long after he was gone, and he made sure they were
well-positioned to make that a reality.
With the continued support of our partners and a commitment to the
mission Gus laid out 15 years ago, the D&D Daily that the LP community
has relied on for over a decade will continue its valuable work of
informing and educating this industry at a critical time.

Downing, a longtime leader in the loss prevention industry and a strong
supporter of NRF.
Downing's dedication to the industry began as a practitioner. His career
spanned more than five decades, during which he served as a leader,
mentor and advocate for professional growth and career development. As
co-founder and president of Downing & Downing Inc., the leading
executive search and placement firm for LP/AP professionals, Downing
helped build and staff many of the industry's top LP/AP departments.

California made major moves to address property crimes in 2024,
from shoplifting to cargo theft and organized retail crime. A historic
package made up of 11 bills was signed into law by Governor Gavin
Newsom in August, and voters took things into their own hands in
November, passing Prop. 36 by wide margins.
With the new year underway, that legislation has come into effect.
Retail theft and property crime
California’s felony theft threshold has been set at $950 since Prop. 47
was passed in 2014. Two new laws aim to address some of the
challenges with that precedent, which has become more controversial
over the past decade.
Retail Crime Up More Than 90% Since 2019, NRF
Says
AB 2943 will allow for the aggregation of the value of property
stolen from different victims across counties or jurisdictions to
reach the felony threshold. Similarly, AB 1779 permits the
consolidation of theft charges and associated offenses that take
place in different counties into a single criminal case.
Meanwhile, SB 905 allows for the aggregation of the value of property
stolen from vehicles during the course of multiple acts, supporting
a charge of automotive property theft for resale.
The Homelessness, Drug Addiction, and Theft
Reduction Act took effect in December, effectively rolling back certain
provisions of the hotly debated Prop. 47, which many believe
set the felony threshold for crimes like shoplifting too high. An
essential element of the law introduces the concept of “wobbler”
offenses, or crimes that may be charged as felonies or misdemeanors
depending on other mitigating factors. Now, petty theft or shoplifting
with two prior theft-related convictions may be charged as a felony.
Law enforcement now has more avenues to tackle shoplifting and petty
theft, too.
For one, AB 2943, also known as the Retail Theft Reduction Act, gives
an officer the right to arrest a person for shoplifting given there is
probable cause, even if they did not witness the act. The same law
doubles the allowable probation period for shoplifting and petty theft
from one to two years, and allows defendants under 25 to be sent to
rehabilitative programs.

LAPD stats showed an uptick in robberies. Was it really just
shoplifting?
LAPD statistics showed an uptick in robberies in some areas this
year, partly caused by shoplifting incidents that led to felony charges.
Police officials say the increase in so-called “Estes robberies” is the
result of some retailers encouraging security guards to aggressively
confront thieves.
At the Los Angeles Police Department’s weekly crime briefings this fall,
its leaders tracked what seemed to be a troubling rise in robberies
in police divisions such as Southwest and Rampart. The numbers showed an
increase in stickups — if only on paper.
Upon closer inspection, department records obtained by The Times
indicate that most of the incidents may have started as shoplifting.
Under LAPD metrics, hundreds of thefts in which a suspect uses force
or fear in the commission of a crime are counted as robberies — even
if no weapons were used and no injuries occurred.
It’s a common scenario: A shoplifter, arms full of merchandise they
didn’t pay for, makes a beeline for the exit, only to have their escape
blocked by a security guard. A struggle ensues, and the thief knocks the
guard over or merely threatens to do so, triggering a potential
felony charge.
Through the first week of October, there were more than 1,200 such
incidents across L.A., according to department statistics released
through a public records request. This accounted for roughly 1 in 8
robberies, down slightly compared with the same period in 2023.
Some officials wonder whether the data reflect a shift by business
owners toward more aggressive loss prevention strategies, leading to
more in-store confrontations with security guards.

Inside the biggest police takedown ever at Shoppers Drug Mart
The surprising story of how police brought down a
multimillion-dollar crime ring selling stolen goods on Amazon.
In late summer 2022, the security team at Loblaw Companies, the
Canadian retail giant that owns Shoppers Drug Mart, realized the
situation was much worse than they thought.
A string of thefts had used the same handful of bank cards at the
self-checkout machines. So the analysts checked the Shoppers database
to see how many times the cards had been used. According to that
analysis, the cancelled receipt trick had been
used more than 1,000 times across Ontario, going back at
least six months.
“They hit us in 148 stores,” said Dean Henrico, the senior
vice-president of asset protection at Loblaw.
Using surveillance footage, Henrico’s team was able to piece together
images of a group of suspects they believed were hitting the stores over
and over. By late fall, Shoppers Drug Mart and police believed the
group had stolen more than $1.9 million worth
of merchandise.
Since the pandemic, big-box retailers say sophisticated, brazen crime
rings have been stealing millions of dollars worth of merchandise,
then reselling the stolen goods to unsuspecting customers on online
marketplaces like Amazon. And while stores and police sometimes catch
the runners, they rarely get close to whoever is at the centre of the
ring, making the real money.
“Capturing the kingpin, or the mastermind, is extremely difficult,”
Henrico said. But this time, Henrico said, his team caught a break —
leading to the biggest police takedown ever at Shoppers Drug Mart.

Major crimes in 2024 dropped 5% in NYC as murders, shootings down
New
York City experienced a 5% drop in major crime in 2024, Mayor
Adams and NYPD Commissioner announced Monday, as they moved to send 200
more cops into the subway system. The drop in crime was led by a dip
in murders, from 391 in 2023 to 377 last year, and 48 fewer people
shot.
“This translates to 3,362 fewer incidents of
major crime last year compared to the year before — and these
are not just numbers,” Tisch said. “We’re talking about thousands of
people who are not injured abused, attacked or targeted by criminals.”
There was also a 5% drop in major crime in the subway system and in
housing projects, Tisch and Adams announced in a press conference at
NYPD headquarters at One Police Plaza in Lower Manhattan. The
additional cops, Tisch noted, will be assigned to ride the trains
and patrol the platforms — the two places where 78% of subway crime
occurs.
Another move, already underway, Tisch said, is the
assignment of 650 cops to newly-designated “zones,” crime hotspots
across the city, with plans to create weekly internal reports
detailing “specific segments of neighborhoods, blocks and even
certain streets, where we see spikes in violence and disorder.” In
the summer months that 650 will grow to 1,000.
She noted the recent drop in retail theft on Fulton St. in Downtown
Brooklyn that followed the creation of such a zone.
Felony assaults also increased, by 5%, with spikes in stranger
attacks, domestic violence and cops assaulted, Tisch said.

Did Costco just reset the narrative around DEI?
In contrast to a slew of companies, the warehouse retailer has
forcefully rejected an anti-DEI shareholder proposal as bad for
business.
With its recent rejection of a shareholder proposal that challenged
its diversity, equity and inclusion policies, Costco didn’t actually
break new ground. Even as anti-DEI campaigns have surged, most
companies have held on to their diversity policies because they foster
good decision-making and are conducive to their business goals.
However, the statement from Costco’s board of directors, urging
shareholders to reject the proposal and combating some of its specifics,
was notable in its forcefulness, experts say.
It was especially striking given high-profile moves last year by
major companies, including retailers like Tractor Supply and Walmart, to
retreat from their DEI programs, according to Dave Marcotte, senior
vice president at Kantar Retail.
“Overall this provides a media narrative of conservatives winning over
progressives which was a big theme for 2024. Costco has run directly
contrary to that narrative,” he said by email. “And its formal response
to an investor tactic (‘DEI raises stockholder risk’), is a statement
that [not only] refutes the premise but also states that these investors
are not doing so in the interest of Costco but a larger political
agenda. As the 5th largest retailer in the world, this is a loud
statement.”

US retail sales rose 3.8% this holiday season
Consumers were motivated by deals with last minute purchases
accounting for 10% of all holiday spending, per Mastercard.
U.S. retail sales for the last few weeks leading up to Christmas 2024
excluding automotive increased by 3.8% compared to last year,
according to Mastercard’s SpendingPulse report. The figure includes
sales from Nov. 1 to Dec. 24 and is not adjusted for inflation.
The last five days of the holiday season
accounted for 10% of all holiday spending as consumers
latched onto promotions set during the “November and Black Friday
shopping period,” per Mastercard data.
Online retail sales grew 6.7% year over year and in-store sales
increased 2.9%. Apparel led e-commerce sales growth by nearly 7%
compared to last year.

Store Closures Up 28% in the UK
Retail lost close to 13,500 stores in 2024, study finds
The number of shops owned by
independent retailers that shuttered in 2024 was up 45.5% year on year
Nearly 13,500 shops shut for good in 2024, according to data from
the Centre for Retail Research. This is a 28.4%
increase on the 10,494 which closed in the calendar year of 2023.
More than half of all stores closed, 7,537 in total, were closed through
retailers undergoing some form of insolvency proceedings.
A further 5,942 shops were closed through "rationalisation" as
part of cost cutting programs by large retailers or independents simply
shutting up shop for good. Independent retailers, typically those small
businesses with 1 to 5 stores, accounted for 84.1% of all store closures
during 2024.
In the previous calendar year independents were responsible for 74.5%
or 7,793 of all store closures. The number of shops owned by
independent retailers that shuttered in 2024 was up 45.5% year on year.
The Centre for Retail Research stated that it
expects store closures to rise to around 17,350 during 2025
with around 14,660 coming from independent retailers.

Only 26% of Europe’s top companies earn a high rating for cybersecurity
With the EU’s Digital Operational Resilience Act (DORA) deadline approaching on
17th January, 2025, Europe’s top 100 companies face an urgent cybersecurity
challenge, according to SecurityScorecard.
Europe’s largest organizations are facing mounting cybersecurity challenges,
with third- and fourth-party ecosystems emerging as significant points of
vulnerability. Alarmingly, 98% of European companies experienced third-party
breaches in the past year, leaving businesses exposed to operational
disruptions and reputational risks.
18% of companies reported direct breaches in the past year, illustrating
significant gaps in internal defenses. Only 26% of

AI's Massive Impact on Companies
What companies need to help secure AI
Experts say MLOps will bridge the gap between development and operations,
creating room for the inclusion of security and privacy practices, too.
For
as much as people talk about the impact of artificial intelligence in the
workplace, the overall AI and machine learning industry is still maturing.

US Treasury office sanctions firm connected to state-sponsored Flax Typhoon
threat group
A Beijing-based cybersecurity company, Integrity Technology Group Inc., is
linked to years of exploitation activity targeting U.S. critical infrastructure.
The Office of Foreign Assets Control has imposed sanctions on a Beijing-based
cybersecurity company linked to the state-sponsored threat group, Flax
Typhoon, the Department of Treasury said Friday.
The agency said Integrity Technology Group Inc. has engaged in a series of
malicious cyber activities against various critical infrastructure providers
and other targets in the U.S. Between the summer of 2022 and fall 2023, Flax
Typhoon engaged in exploitation activity using Integrity Technology
infrastructure, according to U.S. officials.
“The Treasury Department will not hesitate to hold malicious cyber actors and
their enablers accountable for their actions,” said Acting Under Secretary
for Terrorism and Financial Intelligence Bradley Smith, in a statement. “The
United States will use all available tools to disrupt these threats as we
continue working collaboratively to harden public and private sector cyber
defenses.”

Amazon vs. Fake Reviews
What Amazon is doing to fight fake reviews
Reviews are a cornerstone of Amazon’s business, so it is pushing back with
strict policies, proactive detection and enforcement action.
Reviews have been a cornerstone of Amazon since it introduced them on its
platform back in 1995. At the time, the move was controversial, according to
Rebecca Mond, head of external relations for customer trust and abuse prevention
at Amazon.
“When Amazon first pioneered customer reviews, a lot of people just didn’t
understand why it is that Amazon would have reviews and potentially negative
reviews next to a product that they are trying to sell,” Mond told sister
publication CX Dive. “But this was just important to Amazon for the long-term
value for a customer. We want to make sure that customers had accurate and
transparent information about what it is that they were considering buying.”
Today, consumers flock to reviews before purchasing items, making it a

But a new problem emerged: fake reviews.
While fake reviews have always been a risk, the difference is the scale at which
this bogus feedback has spread on online platforms. Fake reviews across
platforms — from Yelp to Tripadvisor to Amazon — threaten customers’ ability to
make what Mond calls “unregretted purchase decisions.”
Amazon is taking a four-pronged strategy to tackle the issue, beginning with
its strict policies on reviews and proactive detection and followed by
enforcement action and collaboration with other companies.
“It’s an ever evolving issue and an ever evolving landscape,” Mond said.

People looking to
score a better deal with a lookalike or knockoff item that resembles the
authentic original is certainly nothing new. Fake Rolex watches and
imitation Gucci or Prada bags being hawked on the sidewalk have been the
subject of many fictional plotlines in books, movies, and television shows in
countless combinations over the past decades, usually with comedic or dramatic
outcomes.
However, it appears that buying retail “dupes,” or near duplications, of iconic
brand products has come into fashion, as
Business Insider recently noted. With cash-strapped Americans turning to
alternatives in order to satisfy their craving for the latest and greatest, is
doing so actually a viable — or ethical — means of consumption?
As a
separate 2023 Business Insider report outlined, Gen Z may be behind the
bulk of interest in creating what can be called a dupe culture, with millennials
not far behind.

Johnson County, KS: 33 arrests after Kansas police effort to address
retail theft
In the days leading up to Christmas, police conducted a coordinated
operation to address retail theft in Lenexa. Multiple units within the
Lenexa police department collaborated on this effort, including the K9
Unit, Bike Unit, Directed Patrol Unit, Uniform Patrol, and Dispatch. The
operation utilized both uniformed and undercover officers, focusing on
high-traffic shopping areas near W. 95th Street and Quivira, according
to a media release. This proactive approach resulted in 33 arrests on
various charges, including theft, felony theft, possession of stolen
property, possession of narcotics including cocaine, fentanyl, and meth,
possession of a firearm by a felon, and possession of a stolen vehicle.
Among those arrested was a group suspected of involvement in an
organized retail crime ring, with over $13,000 worth of stolen
merchandise found in their vehicle. Additionally, several
individuals with outstanding warrants were taken into custody.

Chambersburg, PA: Suspected organized retail theft ring busted in
Chambersburg after four Michiganders arrested
Four people from Michigan who “were on their way from Michigan to New
York” are now behind bars in Franklin County after PSP say they had
mixed results stealing from Chambersburg-area retailers. Jasmine
Adrianna Cockhern, Aaron Tamone Turner, Michael William-Scott, and
Amontaie Cincere Evans remain behind bars on $100,000 bail each after
being charged with felony conspiracy to commit theft of movable property
and misdemeanor conspiracy to commit retail theft. William-Scott also
was charged with misdemeanor possession of marijuana. Multiple
Pennsylvania State Police Troopers were called to the Walmart on Lincoln
Way East in Chambersburg on Sunday, January 5th around 8:44pm for a
retail theft. Troopers say they were told that four suspects matching
the descriptions of Cockhern, William-Scott, Evans, and Turner, were
stealing from the store. Those individuals were all transported back to
PSP Chambersburg for interviews. Just before that call, a PSP Troopers
was dispatched to the Dollar General for a retail theft. PSP say that
four suspects, matching the four in custody, “entered the store and
purchased several gift cards at the location using a card which she (the
manager) described as ‘having instructions on the back’.” In total, the
store said that they had lost about $3,500 from the fraudulent
transactions, coming in at $500 each on seven separate cards. After
interviewing Cockhern, Troopers say they learned that the group was
“driving from Flint, Michigan to New York to visit a friend”. Cockhern
told them that they “developed the idea of purchasing various gift cards
in the stores while they were on the road. Cockhern advised that
financial institutions return money approximately 50% of the time when
they request to have the money refunded.” When taken into custody,
Troopers say they gathered $3,300 worth of cash, 17 gift cards, and 12
financial cards.

Port Orange, FL: Stop sticks halt fleeing vehicle in Port Orange,
leading to arrest of retail theft trio
Three
suspects were arrested Monday after fleeing police in connection with a
series of retail thefts in the Daytona Beach and Port Orange area,
authorities said. According to the Port Orange Police Department,
detectives investigating an organized retail theft crew tracked the
suspects to a Bath & Body Works store in Port Orange. When officers
interrupted their alleged criminal activity, the suspects fled the scene
in a white Ford Fusion. The driver refused to stop during a traffic
stop, speeding away and running red lights, police said. Sergeant Rogers
deployed stop sticks, deflating the vehicle’s tires. The suspects began
throwing stolen merchandise out of the car windows before the vehicle
became inoperable.

Lindon, UT: 4 arrested in Lindon gun store robbery that claimed over 70
guns
Four men were taken into custody this week, accused of taking part in a
burglary that resulted in over 70 guns and several other items being
stolen from a Lindon gun store in late December. According to court
documents, the theft happened on the evening of Dec. 28 into the morning
of Dec. 29. Police say one suspect, identified as Edgar Cortez Mesa, 36,
was caught on surveillance footage loading several trash cans filled
with the stolen guns, power tools, and clothing items into the back of a
stolen business truck before fleeing the scene. Police were able to
track Cortez Mesa to a residence in American Fork where they reportedly
saw Cortez Mesa and a second suspect, identified as Carlos Andres
Raimondi-Perez, 44, loading items into a truck.

New Orleans, LA: Store owner killed in armed robbery on New Year's Eve
A New Orleans mother and business owner was killed in an armed robbery on New
Year's Eve. Ms. Maria, the owner of the Vietnamese Grocery store Viet My in New
Orleans East, was shot just after 6 p.m. on New Year's Eve after two men robbed
the store. Police say the men began grabbing cigarette cartons when she was shot
in the head. Police say the suspects ran away from the scene, and Ms. Maria was
taken to a hospital, where she later died. Viet My has been part of the
community for more than 30 years.

South Fulton, GA: 1 dead, 1 injured in shooting at South Fulton shopping center
Police are investigating a deadly double shooting at a shopping center in South
Fulton on Sunday night. Officials say the shooting happened shortly after 8 p.m.
in a parking lot on the 7400 block of Old National Highway. Officers responded
to the area after reports of a shooting and found an adult man lying in the
parking lot with a gunshot wound. While investigating, police learned that a
second man who had been shot in the leg and the hand had driven himself to
another location to look for help. Medics rushed both victims to the hospital.
Police say one of the men died from his injuries. They have not specified which
one or identified either person. Details about the shooting are limited, but
investigators believe the shooting happened after a fight in the parking lot.

Boston, MA: Charlestown man arrested in fatal shooting at 7-Eleven parking lot
David Menezes, 45, of Charlestown, was arrested Sunday around 10:41 p.m. in
Roxbury, officials said in a release. He is expected to be arraigned in
Charlestown District Court on a murder charge. No other information was
immediately available. Boston police responded to the convenience store at 140
Main St. around 10:30 p.m. on Jan. 4 to a report that a pedestrian was struck,
according to a news release from the department.
Officers found a 46-year-old adult man with gunshot wounds, later identified as
Joseph Donahue of Charlestown. He was pronounced dead at the scene.

Albany, GA: 1 man hospitalized, another charged after shooting outside Georgia
Walmart
One man is facing charges and another is recovering after a shooting outside a
Georgia Walmart store. According to the Albany Police Department, officers were
dispatched Sunday to the Walmart on Slappey Boulevard in reference to a
shooting. Witnesses said a man was seen shooting at another man, who was driving
a purple Tahoe. The victim was found after a police pursuit. Police say William
Larry Hagan was found with a gunshot wound to his side and taken to Phoebe
Putney Memorial Hospital. The suspect, later identified as Joseph Jackson Jr.,
was detained and interviewed. Police say he admitted, during the interview, to
shooting the Tahoe. He was charged with aggravated assault and taken to the
Dougherty County Jail.

Milwaukee, WI: Armed robbery suspect at large after allegedly shooting Milwaukee
convenience store worker
According to the Milwaukee Police Department, authorities were alerted to the
attempted armed robbery at 9:10 p.m. CST on Friday, December 20. The masked man
is accused of entering a convenience store on W. Good Hope Rd near the
intersection with N 78th St armed with a handgun. Police say the man pointed his
firearm at an employee of the convenience store, demanding that they turn over
money from the cash register. Authorities say the suspect shot at the victim and
fled the store.

New York, NY: NYC robbery crew hits nearly 50 stores — taking ATMs and tens of
thousands of dollars

money-hungry robbery crew has hit 49 storefronts across the Big Apple, taking
off with ATMs and netting tens of thousands of dollars — as part of a
three-month spree that spanned four boroughs, cops said. The trio of perps
boosted cars to use as getaway vehicles before each of the heists in upper
Manhattan, The Bronx, Brooklyn and Queens between Sept. 19 and Dec. 26,
according to police. Inside the stores, they looted ATMs and other goods before
bolting in various vehicles, authorities said. During two robberies in
September, cops said the group got away with nearly $40,000 in cash from ATMs.
But police were unable to provide a total amount for all of the ATMs stolen. On
Dec. 23, surveillance cameras captured two of the perps around 1:20 a.m.
removing wires from an ATM inside a grocery store at 75-10 31st Ave. in Jackson
Heights, Queens, according to video released by the NYPD Friday.

Toronto, Canada: Smash-and-grab Jewelry robbery at Burlington mall
Halton Regional Police are looking for several suspects after a smash and grab
at Mapleview Shopping Centre in Burlington on Saturday afternoon at 4 p.m.
Several masked bandits targeted the Charm Diamond Centre store at the mall in
the Fairview St.-Queen Elizabeth Way mall. There were no injuries and no suspect
descriptions. It is unclear how much merchandise was stolen.
