Map of where Sears' and Macy's stores are going dark
Sears Holdings to close 103 more stores
Sears Holdings is closing an additional 103 stores around the country, as it
struggles to win over customers who are increasingly shopping online.
The beleaguered retailer on Thursday said it will close 64 Kmart stores and
39 Sears stores by early April. The company has shuttered more than 400
locations in the past year, leaving it with about 875 stores. The closures
include a Kmart store in Crofton, Md., as well as 13 Sears and Kmart locations
in Pennsylvania.

The company did not say how many employees would be let go as a result of the
closures but said it would provide severance to eligible workers. Liquidation
sales will begin as early as next week, with store closings expected to begin in
early March.

Macy's announces 5,000 job cuts, 7 new store closures
Macy's is planning 5,000 job cuts, including closure of seven previously
unidentified stores and other cuts at remaining locations, as it seeks stability
in a tumultuous climate for physical retail. The retailer's cost reductions come
after its holiday sales in stores open at least a year rose 1.1%.
The moves are part of a plan announced in August 2016 to close 100 stores.
Altogether, the company has now revealed 81 of the 100 locations.

Update on Macy’s AP Realignment
They combined the Operations positions and AP positions at the store, district
and regional levels, with keep investigations and ORC as a separate function.
They're also naming 3 Central AP VP’s responsible for stores.

significant consolidation ahead. There's going to be more store closings."
Storch is not totally bereft of hope, though, and he believes the toys and
games retailer will "survive in some form" as it evolves to take on the
Walmarts and Amazons of the world. He admitted it will require an investment
and a company-wide willingness to do things very differently than it has in
the past, however.
"It's going to take tremendous investment on the internet and in stores to
be a retailer in the future," "It got a lot worse when Amazon got in," he
noted.

Retailers are bracing for a surge in spending unlike anything we've seen in
17 years
US companies are putting more money in employee's pockets thanks to
corporate tax cuts, and it's likely to boost the retail sector, Barclays
says.
In a note to investors, Barclays highlighted the benefits of the GOP's
recent corporate tax cuts, which has encouraged companies to hand out
bonuses to employees.
The note likens the effects of the new tax legislation to that of the
Economic Growth and Tax Relief Reconciliation Act under President George W.
Bush in 2001, which was followed by a surge in consumer spending.
A range of companies have already announced plans to increase employees'
wages or give them special bonuses. Barclays is expecting these bonuses to
be spent on discretionary products and in particular, big-ticket items. This
is likely to give a welcome boost to the retail market.

Legal Review & Case of $40M Real Estate Fraud
Mattress Firm Lawsuit Proves Internal Monitoring Is Necessary in Business
Development
There is an old adage: “Pigs get fat while hogs get slaughtered.” In the case of
two of Mattress Firm’s former vice presidents, Colliers International Atlanta,
one of its former executives, and several developers nationwide, the outcome of
a recent lawsuit will determine whether and how badly they will be punished for
their alleged greed.
Per the lawsuit’s allegations, Bruce Levy (vice president of real estate and
construction) and Ryan Vinson (senior vice president of real estate, formerly
director of new market development), were the two senior managers at Mattress
Firm in charge of “real estate leasing and related construction” for the
company. Levy hired Alexander Deitch, of Colliers International Atlanta, as
Mattress Firm’s “master broker” for the assumption of “primary broker
responsibility for identifying, evaluating and brokering new site locations and
advising and negotiating new leases and lease renewals on behalf of Mattress
Firm.”
Developer defendants, like Oldacre McDonald, LLC, paid bribes and kickbacks
to Deitch, Levy and Vinson. As a result, these developers would get the largest
number of Mattress Firm leases with exceptionally favorable lease terms,
including above-market rents and longer than usual lease terms. The
developer defendants would then flip the properties “within weeks or months
after lease execution for millions of dollars in profits.
Described as a “nationwide bribery, kickback and fraud scheme to financially
enrich themselves” at Mattress Firm’s expense, the lawsuit alleges with
specificity spanning 37 pages the “pay-to-play loop” that connected all
of the defendants in a fraudulently symbiotic relationship. For all involved,
“the higher the rent and the longer the lease duration, the more valuable the
deal.”

Former recruiters sentenced for defrauding Panda Express
restaurant chain of $1.5M
Derek Cyrus and Chuck Sandford have been sentenced for running a false invoicing
scheme that defrauded the Panda Express restaurant chain of nearly $1.5 million.
Derek Cyrus and Chuck Sandford both owned companies that ostensibly provided
recruitment services to corporations. Cyrus’s company was named “Diversified
Recruiters,” and Sandford’s recruitment company was named “Chuck Sandford
Consultants” (CSC). Cyrus also worked as an in-house recruiter for Panda
Express in 2012 and early 2013.
Beginning in about January 2013, Cyrus and Sandford submitted fraudulent
Diversified Recruiters and CSC invoices to the Panda Express accounts payable
department that falsely claimed that they had found qualified job candidates for
positions at Panda Express restaurants throughout the United States. In
actuality, the vast majority of the job candidates were either fictitious or
had never been recruited by Cyrus or Sandford. Cyrus also did not tell the
accounts payable department that Diversified Recruiters was actually his own
company, which allowed him to collect twice for the same recruit.
After Cyrus stopped working for Panda Express in March 2013, he continued to
send fraudulent Diversified Recruiters and CSC invoices to the accounts payable
department. Cyrus falsely told the accounts payable department that he was
still a Panda Express employee and was therefore authorized to submit these
invoices. Sandford paid Cyrus a kickback after the accounts payable department
issued payments for the fraudulent CSC invoices. All told, Cyrus and Sandford
netted nearly $1.5 million dollars during the course of this scheme.

California initiative aimed at increasing punishment for serial thieves and ORC
cleared for signature-gathering
Backers of an initiative to reduce the number of violent felons released early
from prison have received authorization to begin gathering signatures, Secretary
of State Alex Padilla announced Thursday.
What author Nina Salarno Besselman has dubbed “The
Reducing Crime and Keeping California Safe Act of 2018” would expand the
list of crimes considered violent, making those convicted of them ineligible
for early release.
The initiative would also make changes to laws related to theft in an attempt
to increase punishment for serial thieves and organized theft rings and
expand DNA collection from people convicted of drug, theft and domestic
violence-related crimes to help solve violent crimes and exonerate the innocent,
according to Besselman.

Milwaukee, WI: Retailers fight city proposal to require anti-theft systems for
shopping carts
Some Milwaukee retailers are pushing back against a city proposal that would
require them to install anti-theft systems for their shopping carts or face
fines of up to $1,000 per unprotected cart. The proposed ordinance is aimed at
reducing blight and the hazards that unattended shopping carts pose to traffic
and pedestrians.
The proposal gets it totally backward, retailers say, by threatening to punish
them for the actions of criminals. “Under this logic, the victim of a car theft
could be assessed a fine to help defray the cost to taxpayers relating to the
city's handling of the stolen vehicle," Brian Bucaro, retail vice president for
grocery store operator Piggly Wiggly Midwest, said in a letter to the city
opposing the proposed ordinance.

Isolated looting hits Mexico amid price rise jitters
Mexican authorities and media reported looting of stores in the states of Mexico
and Veracruz on Thursday following a flurry of social media posts about
increases in the prices of gasoline and tortillas this year.
At least 70 people were arrested in the state of Mexico on Thursday after
looting in two cities, a spokesman for state police said. At least 800 police
were deployed to deter looting at stores in the state, according to a Twitter
post by state police.

Claire's says lab results rebut asbestos claims
Jewelry store Claire's said Thursday that lab results certified its products as
asbestos-free, following allegations of the toxic substance in its products
last month.
"We are pleased to report that test results received to date from two certified
independent labs confirm that the products in question are asbestos free,
completely safe and meet all government requirements," the retailer said
Thursday.

But now they must survive this harsh winter weather
It has been a tumultuous few years for the nation’s department stores, but a
solid holiday season has provided at least a temporary reprieve for some as
shoppers stocked up on home goods, clothing and beauty products.
But now, major retailers are facing a new hurdle: The weather. On Thursday, the
same day that Macy’s and J.C. Penney reported better-than-expected holiday sales
growth, much of the East Coast was blanketed in snow and ice, leading to
hundreds of school closures and workplace delays. Consumers who might have
otherwise shopped at the local mall were hunkered down indoors, keeping tabs on
their children, shoveling their driveways or preparing for power outages.
And although some types of retailers - hardware stores, say, or grocery
chains - may see a rush of customers before and after major storms, analysts
said department stores, which rely heavily on foot traffic, are a different
story. (Online retailers aren’t immune either: A series of snow storms in
early 2015, for example, led to a $35 million decline in e-commerce sales,
according to data from Adobe Digital Index.)
“Department stores definitely take a hit when the weather turns bad,” said Anya
Cohen, a retail analyst at research firm IBIS World. “Bricks-and-mortar stores
are already struggling to get shoppers into their doors, and inclement weather
is one more reason to keep them at home.”

'Bomb Cyclone' Leaves Retail Sector Exposed
Clothing retailers unlikely to be broadly affected. “While the snowstorm can
result in store closings and shoppers choosing to stay at home, it’s unlikely to
dent 4Q retail sales as it comes in a low-volume sales period,” BI analyst
Poonam Goyal says. Burlington Stores, TJX Companies, New York & Co. and
Abercrombie & Fitch are among apparel retailers with more than 30 percent of
their stores in the states that may be affected by the storm. “Food retailers
and mass merchants may get a sales bump from customers stocking up ahead of the
storm,” according to BI analyst Jennifer Bartashus. Mass merchants may try to
quickly move more winter-weather inventory into affected areas, particularly
those unaccustomed to the low temperatures and snow. Ingles Markets has 89
percent of its stores in East Coast states expected to see at least some storm
activity, followed by Weis Markets, Target, Wal-Mart, Kroger.

NRF: Following Job Gains in November, Retailers Scale Back in December
Retail industry employment decreased by 20,200 jobs in December from November,
the National Retail Federation said today. The number, which excludes automobile
dealers, gasoline stations and restaurants, reverses the increase of 20,500 jobs
seen in November over October, which the Labor Department revised upward from
the original estimate of a 12,900-job gain, likely because of a shift in
seasonal hiring patterns.

Vendors Rush to Issue Security Updates for Meltdown, Spectre Flaws
Wondering what to do in the wake of the revelation of newly discovered
critical design flaws in most modern microprocessors? Security experts say
the best bet is to apply patches for the side-channel attack vulnerabilities,
which were
disclosed this week.
The vulnerabilities impact a wide number of products from numerous vendors,
though not always with the same level of severity. Also impacted are servers,
and in many cases the underlying infrastructure hosting cloud services.
Vendors and security analysts have urged all organizations and customers to
apply patches, OS updates, and other workarounds as soon as they become
available, regardless of the severity of impact.
"Generally speaking, the patches to fix this move the balance back towards
security," said Paul Ducklin, senior security advisor at Sophos.
The catch, however is that some of the fixes could reduce performance a bit, he
said. "Sometimes, the price of security progress is a modicum of inconvenience.
In this case, the updates might slow you down a tiny bit, but think of it as
being for the greater good of all," he noted.

Cyber crime 'fastest growing' criminal activity
in the United States, study finds
Cyber crimes that include credit card fraud, identity theft, ransomware, and
email hacking are the “fasted growing” criminal activities in the United States,
according to a new study published this week.
The study broke down the attacks by state, finding that California was estimated
to have the highest number of cyber crime complaints in 2018, and that
California residents will lose a combined total of almost $330 million to cyber
crime, $200 million more than any other state.
Other findings from the study predicted that Florida will have the highest
growth rate of cyber crimes in 2018, while New York will have the highest
average number of dollars lost per reported cyber crime.

House committee leaders say a real push is coming
on breach notification legislation
The House Financial Services Committee is poised to be first out of the gate
with data-breach notification legislation this year, with language coming
probably in the first quarter, as lawmakers and various industry groups line up
for what some hope is a decisive push on a long-stalled issue.
The House Energy and Commerce Committee is also digging in and collecting input
from industry stakeholders that's due this week – while key senators are said to
be ready to move if the House actually advances a bill setting a national
standard for notifying consumers that their data has been breached.

Amazon turns over record amount of customer data to US law enforcement
Amazon has turned over a record amount of customer data to the US government in
the first-half of last year in response to demands by law enforcement.
The retail and cloud giant
quietly posted its latest transparency report on December 29 without notice
-- as it has with previous reports -- detailing the latest figures for the first
six months of 2017.
The report, which focuses solely on its Amazon Web Services cloud business,
revealed 1,936 different requests between January and June 2017, a
rise from the previous bi-annual report.
The company received:
● 1,618 subpoenas, of which the company fully complied with 42 percent;
● 229 search warrants, of which the company fully complied with 44 percent;
● 89 other court orders, of which the company fully complied with 52 percent.

'Big Brother' Jack Ma
China’s Alibaba under fire over use of customer data
Chinese e-commerce giant Alibaba has come under fire over its handling of user
data in an episode that underscores growing concerns for privacy in the hyper-digitised
country.
Alibaba affiliate Ant Financial was forced to apologise on Wednesday (Jan 3)
after users said they felt misled into allowing its Alipay service to share
data on their spending habits with its credit-scoring arm and other third-party
services.
Controlled by Alibaba co-founder Jack Ma, Ant Financial provides mobile payment,
lending, and credit services to millions of Chinese consumers, and the
controversy has featured prominently in China's state-controlled media this
week.
Consumers have come to expect a lack of privacy in a country where the
government collects a file of personal data on each person including financial,
education and other information, and where video surveillance is widespread.
But many Chinese internet users reacted with unusual outrage to learn that
Alipay, which is used by millions daily to make mobile and online purchases on
Alibaba's Taobao platform and elsewhere, had automatically checked a box and
hidden language showing they agreed to share their data.

When online orders go back: Returns are a big
part of holiday retail
Online retailers could face $32B worth of returns
It’s an expensive ritual. According to the National Retail Federation,
returns account for about 8% of total annual retail sales. Online retailers
face an even heavier burden, with returns averaging 25% of all goods
purchased and as much as half of apparel. If those percentages hold through
the 2017 holidays, online retailers could face $32.1 billion worth of
returns on projected holiday-season sales of $107 billion, according to the
consulting firm CBRE.
That’s a heavy expense, and one reason that online retailers are proving to
be less profitable than the stores they are trying to replace. In part, the
problem is that online retailers traded one set of expenses—storefront real
estate—for costs that can turn out to be higher.
According to a 2016 UPS survey on online retail customers, 60% now consider
free shipping an essential element of the shopping experience. As of 2015,
roughly half of all online retailers, including Amazon, had free-return
policies.
The expense goes well beyond free shipping. Once a product is returned, a
retailer pays for it to be unpacked and assessed. According to Optoro Inc.,
a Nashville-based company that helps retailers including Target Corp., The
Home Depot Inc. and Best Buy Co. Inc. manage their returns, less than 10% of
the merchandise it processes goes back to retail shelves. And according to a
recent survey of 300 retailers, only 48% of what’s returned can be resold at
full price.
The burden of handling returns is one reason that e-commerce companies from
Amazon to Alibaba are investing in physical stores.

Online retailers warn of significant losses,
as chargeback loophole proves unstoppable
Retailers are losing significant revenue to online fraud, with some
techniques proving unstoppable, and authorities unwilling or unable to step
in.
One high-end online retail CIO who wished to remain anonymous described the
'chargeback loophole', a situation in which a fraudulent purchaser denies
receipt of goods, which leaves the selling organisation with no recourse but
to accept its losses.
Computing understands that cyber criminals can make a purchase online, sign
for the goods once they arrive, then call the retailer to report
non-delivery, demanding their money back. Whilst retailers can argue that
the delivery happened, if the purchaser states in writing to their card
company that the delivery didn't occur, and that the signature is not
theirs, the retailer loses all rights to the funds.
"This loophole has to potential to set the online payment industry back, as
this level of fraud continues to rise retailers will start to lose faith in
the system," said a CIO in the retail industry. "Banks do not lose any money
so have no interest in fixing the situation. The retail industry, merchants,
banks and the courier services need to work together to bring about new
standards in the same way as they did with [software-based authentication
process] 3D secure," the CIO added.

Tonawanda, NY: Alert Police Officer foils theft
of $40K in tools
Two men are facing a host of charges after they were caught with more than
$40,000 in Snap-On tools. City of Tonawanda police officials said Officer Thomas
Kitson was on patrol about 3:55 a.m. Thursday and spotted a shadow behind a
business. As he investigated, two men ran into nearby woods. Two men were
apprehended with the help of Erie County Sheriff’s Department K-9 unit. Officers
investigating a vehicle being used by the men found $42,000 worth of Snap-On
tools taken from the business. In addition, 29 baggies of crack cocaine and
marijuana was also found in the vehicle.

Calexico, CA: $2,000 of stolen Walmart
merchandise seized during traffic stop
Calexico Police said traffic stops are never routine. Antonio Delgadillo Jr. is
behind bars because of a traffic stop. In the trunk of the car, police found
over $2,000 dollars of alleged stolen items. “We needed to call the manager from
Walmart and we were able to transport him on scene. And Walmart management was
able to actually identify some of their products from the vehicle,” Officer Ruiz
said.

Rome, GA: 2 in custody facing Felony Shoplifting
charges for $900 theft from Walmart
Two Rome men were in jail without bond Thursday, accused of stealing more than
$900 worth of merchandise from Walmart. Devante Japal Daniels, 25, filled a cart
early Nov. 20 with $949.96 worth of PS4 games and equipment, an air purifier and
assorted beauty supplies.

High Point, NC: Man punches 34-year-old to death
in Walmart
A man has been arrested after police said he punched another man to death after
a fight broke out at Walmart. Witnesses saw Shah and 34-year-old Raymond S.
Collier get into a verbal altercation that quickly escalated. Eyewitnesses said
Shah punched Collier, knocking him unconscious. Store surveillance video showed
Shah also went through the victim's pockets before fleeing the scene. Samed Ali
Shah, 25, was arrested on Thursday and charged with murder.

Casa de Oro, CA: Man Fatally Shot During Fight
Outside Spring Valley Albertsons
A homicide investigation was underway Friday in the Casa de Oro area of Spring
Valley after a man was shot and killed during a fight outside a grocery store on
Campo Road. Several men were seen running from the shooting scene around 9 p.m.
Thursday outside the Albertsons grocery store.

Waco, TX: Gunman on the loose after Strip Mall
Shooting
Waco Police say the incident happened in the parking lot of Waco Creek Center on
2405 West Waco Drive around 4:00 p.m. Thursday. They say two men walked up to
the victim and opened fire. They missed, and instead hit a car near the scene.
Witnesses from businesses within the complex said they heard 4-5 gunshots. One
suspect remains on the loose, the other was detained about a block away from the
scene. No one, including the targeted victim, was hurt during the shooting.

Oxnard, CA: Man accused of Firing Gun at Von’s
Loss Prevention; several shots fired over beer
An Oxnard man has been arrested after police say he fired multiple gunshots at a
loss prevention officer following an attempted shoplifting at Von’s in Oxnard.
On New Year's Eve, two men entered Vons, grabbed two cases of beer and left the
store without paying. A loss prevention officer confronted the men and grabbed
one of the suspects by his shirt, causing him to drop the stolen beer. The
suspect pulled a gun from his waistband and fired at the head of the loss
prevention officer, narrowly missing and causing temporary hearing loss. The
suspect ran to a nearby vehicle and again shot at the loss prevention officer,
missing again. The suspects got away from the scene before police could
arrive.

Columbus, MS: Police investigate Shooting outside
Leigh Mall
One person is listed in stable condition after a shooting Thursday afternoon at
Leigh Mall in Columbus. It happened in the parking lot between Hobby Lobby and
Burke's Outlet. Police were called to the mall around 4 p.m. and say the shooter
and victim knew one another. One victim was reported shot and wounded. No
arrests have been made in the case.

Surrey, BC, Canada: Man injured in hatchet attack
at Central City Mall in Surrey
Police in Surrey responded to a man attacking another man with a hatchet at
Central City Mall on Thursday afternoon. The assault happened at about 12:45
p.m., and several police vehicles attended the scene. Witnesses say they saw a
shirtless man covered in blood stumble through the food court.
The victim, a 50-year-old man, was taken to hospital with non-life threatening
injuries. Witnesses helped officers find and arrest the suspect, a 34-year-old
man, who was still in the vicinity. Police say the two people knew each other,
but are unsure what led to the altercation. The small, handheld axe used in the
attack could be seen inside an evidence bag on the hood of a police vehicle at
the scene.

Chicago, IL: Bloomingdale’s Shoplifter beats Mag
Mile Loss Prevention with a Tire Iron
Struck in the head with a tire iron, a security guard on the Magnificent Mile
needed stitches after a run-in with a woman he says was shoplifting. The
incident happened a few days before Christmas at Bloomingdale’s, located on six
floors of 900 North Michigan Shops. The guard told police he saw a woman slip a
$365 purse into a shopping bag and head for an exit at around 4:30 p.m. on
December 22. He stopped the woman from leaving the store and started to walk her
back to the department store’s loss prevention office, but she pulled a tire
iron from her sleeve and repeatedly hit the guard in the head with it.
Police identified the woman as 21-year-old Sierra Copeland (left) of the
Washington Park neighborhood south of the Loop. She was charged with retail
theft, aggravated battery with a deadly weapon, aggravated battery causing great
bodily harm, and two counts of aggravated battery of a merchant.

New Albany, IN: Verizon robbery suspect found
guilty
Livan A. Ruibal, 51, was found guilty Wednesday of one count of (felony)
burglary, one count of criminal mischief and one count of theft. Also charged in
the Oct. 4 incident were Alexis Aleman, 53; Roberto Hernandez-Castro, 31; and
Augusto Mirano, 56. Ruibal and Aleman both had Florida addresses at the time of
the incident. Mirano pleaded guilty Dec. 12 to level 5 felony robbery and was
sentenced to one year and 245 days. Ruibal's sentencing is scheduled for 10 a.m.
Jan. 31.

Healthy debate in any industry spurs growth, understanding, and challenges the
