U.S. Senators re-introduced "The Protect IP Act" yesterday that would give U.S. authorities more tools to crack down on websites selling pirated movies, television shows, music, and counterfeit goods.  Its earlier version last year, which passed the Senate Judiciary Committee by a 19-0 vote in November, never made the Senate floor.  (Source

With retail sales per square foot at $580 in Canada and $309 in the U.S. coupled with 23-square-feet of shopping floor per capita in the U.S. vs. 14-square-feet per capita in Canada, little wonder why all but three of the top 10 U.S. retailers (Kroger, CVS, and Walgreen) have Canadian expansion plans.  This massive rush to Canada will cause a shift in the retail landscape as sales will be pulled from existing Canadian chains.  Given Target's "PFresh" grocery concept and Wal-Mart's superstore expansion, the grocery industry may be the one sector impacted the most with Loblaws possibly feeling the blunt of it.  (Source

U.S. retail sales rose for the 10th straight month in April and jumped 7.6% above the year ago period.  (Source owner, based in Brooklyn, New York, pleads guilty in federal court to mail fraud, wire fraud, and sending threatening communications after selling counterfeit luxury eyewear and stalking and threatening customers who had complained about the bogus eyewear.  (Source

Last week, Blockbuster Canada followed its American counterpart into bankruptcy after they missed a $67 million payment to the movie studios.  With 400 stores and a great brand name, new owners will surely line up to take advantage and diversify the business which the current owners never did.  Netflix recently entered the Canadian market and its impact has been felt.  The question will be how many stores will remain once the new owners takeover. Canada's new safety act, the Canada Consumer Product Safety Act, goes into effect June 20th and, similar to its American counterpart, this act gives the federal government new product recall powers, requires serious incident reporting standards not previously in place and increases fines for criminal offenses related to consumer product safety from $1 million to $5 million with higher fines possible.  (Source

Websense report says Canada's cybercrime servers hosting phishing sites increased four-fold last year, second only to Egypt in terms of growth of cybercrime activity.  With all the pressure on China and Eastern Europe to clean up their act, cybercriminals may be moving to safer locations.  (Source

Kohl's 1Q reports same store sales up 1.3% with revenue up 3% and online revenue up 47%
Burger King 1Q reports same store sales down 2.8% with reporting a loss of $6.8 million

Two Southern California men have been charged with illegally importing about $2 million worth of counterfeit "collectible" Disney pins from China and selling them over the Internet.  (Source Associated Press)

The Department of Homeland Security will be managing cybersecurity for the federal government's civilian computers and networks according to a new proposal yesterday released by the White House.  Obama is also calling for a federal data breach notification law with criminal penalties for cybercrimes and for establishing a new framework aimed at protecting individual's privacy.  (Source

Wal-Mart Express to open its first 15,000 square-feet store on May 26th just a half an hour from Wal-Mart's corporate office.  And while all the economists and journalists are talking about the impact this could have on the dollar stores, this first store will also have a pharmacy.  What about the impact this could have on the drug store industry and the c-stores?  How will they evolve it?  (Source

The Google article this week about their vaguely described $500 million dollar budget item for a possible settlement with the Justice Department sparked a Wall Street Journal article that "said the U.S. Attorney's office in Rhode Island and the U.S. Food and Drug Administration have been leading the criminal probe into whether Google improperly profited from ads promoting drug sales by pharmacies or people without the proper licensing."  Looks like rogue online pharmacies have been slipping in their advertising decks by merely intentionally misspelling drug names.  Google's ad network model generates more than $30 billion in annual revenue for them and critics have complained in the past that the company and other websites haven't been vigilant about policing pharmaceutical ads because they are so lucrative. Drug and health care advertising generated about $1 billion in Internet spending last year and is expected to grow to nearly $1.9 billion by 2015.  (Source Associated Press)

And here's a video from CBS with the FDA about counterfeit drugs being sold online

Soft-line retailers, according to Kohl's CEO, are expecting a 10% to 15% overall cost increase in all apparel categories this fall.  (Source Associated Press)

PayPal VP & Chief Information Security Officer Discusses On-Line Identity

PayPal (Subsidiary of eBay Inc.) Vice President & Chief Information Security Officer (CSO) Michael Barrett, discusses On-Line Identity, PayPal initiatives and the changing national environment. PayPal believes that genuinely trustworthy online identity is a key component of a healthy Internet ecosystem, and that we have a role to play in it. We’ve deployed some experimental services, and over the coming months, will be offering more services directly to our customers, merchants, and other relying parties. If you saw a news report suggesting that your federal government was contemplating such a thing, it would probably raise all sorts of instinctive reactions, at least in the U.S. Is my government trying to establish an online national identity card? Are they going to mandate that individuals and companies use it? This isn’t an abstract question, as the White House has been working on something called the National Strategy for Trusted Identities in Cyberspace (NSTIC) for more than a year. From every conversation I’ve had with the White House team, they’re simply trying to set the voluntary ground rules of an identity ecosystem that will allow the creation of a safer online experience, without a heavy handed “big brother” approach. Managing your career upwards requires a vision of where you want to go and how you're going to get there.  Other than personal performance, one of the primary factors is who you know and how you develop those relationships.  Everything you read talks about managing relationships around you in your current role, but the real key is the relationships you have outside your role or your company and not just in the LP community but with successful operators outside your current scope.  If you expect to truly excel in your career, you've got to expand your contacts and develop them as you would the operator beside you.  Obviously, this can be difficult and slow to progress.  But give it some thought and set some goals of meeting new executives and expanding your circle.  Because one person, one contact, can make a difference and you never know who that might be.

Just a Thought
