Blockbuster heads to bankruptcy court with two more offers in hand to pull them out.  One from Dish TV could be an interesting development with it giving them a retail platform and obviously with even fewer stores.

Family Dollar who recently held off a takeover bid reorganizes the entire company - laying off over 180 corporate executives including a senior vice president and a number of vice presidents including the vice president of loss prevention and as much as 10% of the LP field team, 12 to 15 executives.

Hackers obtained email addresses and names of the customer of Best Buy, Kroger, Walgreen, TiVo Inc., JP Morgan, Capital One, Barclays Bank, U.S. Bancorp and others in a data breach of a third-party company, Epsilon, who manages email programs.  This may lead to huge "phishing attacks."  Epsilon, which is a marketing services firm, sends out more than 40 billion emails annually and has more than 2,500 clients.   The list is growing and it may end up being the biggest breach ever in history.  More information will be released as this story develops over the next few days.  (Source kiiitv.com)

American Apparel stated in its 4thQ financial statement that there is "substantial doubt that the company will be able to continue as a going concern."  Over the last year, the company has installed RFID in 28 stores, installed traffic counters and security cameras in 100 stores, and completed installation of EAS tagging in 223 stores globally.  (Source theretailbulletin.com)

With State budgets in a tailspin, 22 states are now looking at their tough-on-crime era stiffer sentences and looking to revise them due to the increased cost of housing inmates.  The $12 billion cost in 1988 is more than $50 billion now and many are now looking at more drug and alcohol treatments programs for abusers and probation for petty thieves.  California's largest state prison population of 152,000 inmates now ships over 10,000 out of state as a way to improve medical treatment and meet a federal court order to reduce inmate population.  The tough-on-crime era may be over because at the end of the day who's going to pay for it?  (Source Associated Press)

Legal pharmaceutical drugs now account for 15% of the estimated $8 billion to $12 billion in annual cargo theft with law enforcement saying that the organized criminal gangs, many of them Cuban-American operating out of South Florida, have been dramatically increasing both the size and frequency of heists and it's the #1 most lucrative target.  With 54 major pharma thefts reported in 2010, the average haul was $3.7 million according to FreightWatch.  Tabacoo's next at $1.4 million a haul.  Last year's Easter heist of Lilly's warehouse in Conn. was a $75 million haul.  (Source fortune.com)

The second annual Guardian Analytics and Ponemon Institute study shows that 56% of businesses experienced payments fraud in the last twelve months.  Money is leaving accounts unnoticed at an alarming rate and corporate account takeover fraud is continuing to escalate.  (Source yahoo.com)

eBay Supports Investigation Leading to Jail Sentence for Canadian Fraudster

eBay Asset Protection investigators, working closely with Canadian law enforcement and tax authorities, leads to three-year jail sentence after guilty plea entered. The suspect pleaded guilty to two counts of income tax evasion, one count of fraud, one count of possession of property obtained by fraud and one count of laundering proceeds of crime and was sentenced to three years in jail and fined $223,849. The business involved selling equipment and services to enable customers to decode encrypted satellite television programming signals without paying a subscription fee and used online merchant accounts -- including PayPal, PaySystems, WorldPay and PayZip -- to process payments for the sale of the illegal products and services. As a result of the investigation, it was determined the taxable income was also understated by $626,331 between 2003 & 2007. The business operation defrauded lawful distributors of encrypted subscription programming signals in Canada & the U.S, and the suspect participated in money laundering activities exceeding $300,000. Sending and delivering the LP message in stores and at the corporate office is probably one of the most critical things one can do everyday.  How you communicate and how you deliver your message will determine how they respond and react.  If you expect to improve performance and influence change in the stores, then you've got to communicate in their words and their terms.  Each company has a message, a mission and core values and your message should fit all of them and be an extension of them and not an addition to them.  This breeds integration and results in inclusion, all of which are important elements of a successful executive.

Good Luck
Gus Downing
