The new Food Safety Modernization Act has a little-noticed or widely-known clause in it that protects whistleblowers against retaliation from their employers.  Employees can't be fired, demoted, or denied promotions or raises if they speak up about what they think are violations.  "Whistleblowers are the informational lifeline to warn the public when government-approved food might be a public health hazard," said Tom Devine, the Government Accountability Project legal director. "It occurs frequently because the regulatory system can't hope to catch all the violations through spot checks."  Obviously setting up internal reporting processes is critical and helping the workers feel safe in reporting will encourage companies to respond proactively before they become public health issues.  (Source Associated Press)

A former Coach employee decides to sell her Coach handbag she had bought legitimately with her discount, and posted it on eBay.  Soon afterward, Coach's outside law firm Gibney Anthony and Flaherty sent her a "cease and desist" letter and threatened her with up to $2 million in penalties, instructed her to sign a statement admitting to wrongdoing and demanded she pay Coach $300. Coach then complained to eBay and had her posting deleted.  With an attorney, the former employee wrote the law firm and soon afterwards received an email from eBay reinstating her ad.  Last week, the former employee's attorney filed suit "alleging violations of the state Consumer Protection Act, defamation, interference with her business relationship with eBay, and other claims. The lawsuit, which seeks class-action status, claims that Coach's real motive in sending out the letters was an attempt to suppress the online sale of used items and force people to pay top dollar directly to the company if they want a Coach handbag."  One of her attorney's says Coach should at least do "minimal investigation to see whether those claims are accurate" before sending out letters threatening $2 million lawsuits.  Coach's position is obviously that its a "frivolous" lawsuit and intends to "vigorously defend."  If this gets traction in the courts, this could be a game changer.  (Source Associated Press)

An ongoing dispute between Amazon and the state of Texas over sales taxes ends in Amazon announcing they're closing their Irving distribution center and scrapping Texas expansion plans.  Last year, Texas demanded $269 million in uncollected sales taxes which Amazon responded to by filing a suit demanding to see their audit that produced that number.  Amazon has been the target of numerous lawsuits filed by states seeking sales taxes for online sales and they're fighting it tooth and nail.  (Source cbslocal.com)

This week, a New Jersey judge ruled in favor of A&P and against Grocery Haulers Inc.'s teamsters drivers which allowed A&P to break the contract, save over $9 million and start using C&S Wholesale non-union drivers.  Meanwhile, C&S closed their 5 union warehouses in New Jersey simultaneously and started servicing A&P thru their Harrisburg facility.  This is a big loss for the union and rumors have it that they weren't even willing to negotiate during the months leading up to these actions.  This may have an impact on how other supermarkets deal with this year's upcoming union contracts across the U.S.  (Source supermarketnews.com)

According to a new report by Customer Growth Partners, the department stores gained market share last year for the first time in nearly three decades.  Fueled by innovation and execution and the last two years of lagging sales at Wal-Mart.  "Department stores from Macy's to Nordstrom, and mall operators from Macerich to Simon, have used the recession not just to cut costs, but to reinvent themselves, and they've emerged from the worst retail debacle in decades stronger and hugely more relevant to the needs and lifestyles of today's consumers," said CGP president Craig Johnson.   They've also cut prices, payroll, and inventory and are as promotional as anyone else.  (Source retailingtoday.com)


"A study of retail loss prevention executives commissioned by Axis Communications and conducted by the Loss Prevention Research Council (LPRC) finds that for those who have yet to adopt IP video technology, the No. 1 reported obstacle to deployment was the perceived higher cost (42 percent). Nonetheless, experts are quick to point out that cost will figure less prominently as the industry continues to see greater product innovation in this space, natural IT improvements (known as Moore's Law), improved storage and compression technologies, and the move to hosted video."  IP video technology is an inevitable evolution.  (Source storesnews.org)


The California Supreme Court unanimous decision stops retailers from asking for zip codes of customers who make credit card purchases because it violates consumer protection law and can be used as a "personal identification number."  While gas stations are exempt because they don't record the transaction, fraud prevention just took a major step back.  The Supreme Court returned the case to appeals court for further action which could include accessing damages to the merchants for infractions.  With identity theft being such a worldwide problem, the courts are starting to side with the consumers.  (Source Associated Press)

Former president and CEO of the New Jersey-based Charlie Brown's Steakhouse chain was sentenced to a two-year federal prison sentence for accepting more than $1 million in kickbacks from contractors and vendors back in 2008.  Since the CEO's resignation in Dec 08', that parent company CB Holding has closed 47 restaurants, filed for bankruptcy, and is selling its remaining 32 Charlie Brown's and Bugaboo Creek steakhouses.  (Source Associated Press)

eBay's PayPal Revenue to Double by 2013 -- Stock Soars 52 Week High

eBay's PayPal business is poised to surpass the core business in the next three to five years, CEO of the e-commerce giant said at Thursday's analyst meeting. Chief Executive John Donahoe said eBay was at an "inflection point" in e-commerce that the company would exploit, as consumers use smartphones -- a "store in their pocket" -- to shop and pay in one go. "This shift is creating new global opportunities for our company," said Donahoe. "We are driving the next generation of e-commerce. "Overall, revenue at PayPal is expected to grow from $3.4 billion in 2010 to between $6 billion and $7 billion in 2013, president of the division, Scott Thompson said. PayPal is also expected to meet its goal of $4.2 billion in revenue in 2011. PayPal is also looking to transform the way people use money. "I want to change money," says Sam Shrauger, vice president of global product and experience. "It could be so much better than it is now. Maybe in the future it can be cool. Right now, it's a pain." Loyalty is one of the most precious values there is and a loyal team that's unified in its goals and objectives, even in defeat, is strong and supportive.  Loyal teams can make the largest tasks seem effortless and they create a sense of ownership of family that inspires individual performance and comforts individual failure.  Earned slowly and grown daily, loyalty is a commodity no leader can be without because it fuels success, unifies purpose, and gives birth to exceptional performance.  Without loyalty, teams splinter and lose focus on the true objectives.  It's rare to build a truly loyal team and it's incredibly difficult to keep them together long term with private agendas always pressuring the balance.  And yes, even loyal teams require balancing because at the end of the day it's always about personal agendas.  Professional sports teams are constantly looking for that balance and the right players to fit as a team and the same holds true in business.  With the right team, anything is possible and conversely one team member can destroy the entire balance.  So being a team player is important even when you decide not to be.
