Eliot Green, TJX Assistant Vice President and National Investigations Director, and Dennis Dansak, Kroger's Corporate Manager of ORC, addressed the National Retail Federation's Big Show yesterday and talked about how ORC has become a serious national problem and how it's impacting their companies.  Eliot Green stating "Our primary goal is prosecution," and "We'll turn down restitution if it means giving up jail time."  (Source oregonlive.com)

7-11 is opening 20 stores in NYC this year and plans on opening 100 by 2016. This will be a new venture for the Dallas company and Mark Stinde, Sr. Dir of AP, will have his hands full with this expansion.

With 17.8 million consumers using their smart phones for mobile banking and the number expected to rise to 27.4 million this year, your smart phone may end up being the most dangerous possession you own if you lose it or it's stolen.  The ramifications will be dramatic! (Source cnn.com)

The old McDonald's phishing scam pops up using Coke as its front in the form of a "benign opinion poll" that's actually a ruse designed for identity theft that goes so far as to ask you for your driver's license numbers and credit card details.  Online scams like this are becoming almost daily occurrences.  (Source internetnews.com)

Sony Computer Entertainment has launched legal action against five hackers who recently released a set of tools that allows illegally copied games to run on the PlayStation 3 game console.  The group, called fail0verflow, gave a presentation at a hacker conference in Berlin in late December, saying they had figured out a way to bypass Sony's "technical protection measures" (TPMs) that stop unauthorized code from running on the system, including pirated games.  Hackers all over the world are taking pride in their ability to steal and at conferences no less.  (Source cio.com)

The global impact of online piracy to the US economy is $58 billion in lost income.  Last year, the Senate introduced legislation S. 3804, called the Combating Online Infringement and Counterfeits bill, which did not make it thru.  Congress should reintroduce and pass legislation to address the rogue-site issue this year. Readers who would like to learn more about this issue should visit www.fightonlinetheft.com.   Steve Tepp is Senior Director of Internet Counterfeiting and Piracy for the Global Intellectual Property Center (GIPC) at the US Chamber of Commerce.  Contact Steve for more on what your company can do to help fight this ever-growing problem.  (Source yahoo.com)

Louisiana Alcohol and Tobacco Control agents bust ORC ring in Hammond (New Orleans area) were convenience store owners were placing orders with boosters to steal from an Albertsons store.  Over 30 shoplifting incidents were recorded.  (Source nola.com)

An 80-year-old professional shoplifter?  Well it's true and she may even have a film made about her life!  The most recent case about Doris Payne is the alleged $8,900 ring she stole from Macy's in Mission Valley, California.  She loves stealing high-priced items and has a long list from Saks, Neiman Marcus, Macy's and who knows where else.  On one occasion, she was apprehended while out on parole from another.  She'll never learn.  (Source 10news.com)

Supervalu, who last week announced closing 15 stores, reported yesterday it lost $202 million in their 3Q.  (Source kentucky.com)

Downing and Downing announces that there will be a roundtable meeting for LP exec's only immediately prior to next year's annual D&D NYC Dinner party led by Bob Serenson to discuss current events impacting the region.  More to come!

Zales, the third largest jeweler in the U.S., reported same store sales for the holiday season of November and December were up 8.5%, after last year's holiday season when the number was down 12%.  The past two years, they've lost $280 million, but with these sales numbers and an increased sales team of "certified by the Diamond Council of America" members, are they coming back?  (Source bloomberg.com)

In the wake of the tragic shooting of the Arizona Congresswoman, House members of both parties are holding joint meetings to discuss security measures.  However the question of permanent security changes falls to the House Administration Committee which has jurisdiction over the U.S. Capital Police whom provide security for all members of Congress.  Passing a bill making threats against members of Congress or a federal judge the same as a threat against the President seems likely.  But with this incident being the case of "one nut," it seems unlikely that it will result in personal security for all 535 members of Congress.  However Committee Chairman Dan Lungren, R-Calif. did say that he felt "just the presence of a police officer" at town-hall style meetings was enough to "quell the tendency of someone to get out of control."  So we might see some tightening of requirements that call for off-duty police officers to be present at such events.  (Source USA Today)

This past Monday the federal law, the Genetic Information Nondiscrimination Act of 2008, became effective that makes it illegal for employers to discriminate against workers or job applicants based on their genetic information and it also covers discrimination in health insurance coverage as well.  Also, employers cannot request, require or purchase genetic information.  With genetic information advancing rapidly over the past 20 years, this was greatly needed to protect our civil rights.  It'll be interesting to see the cases that pop up. Staples found guilty in infringement case in federal court by jury stating that they infringed on Accentra's valid patents when making and selling Staples' OneTouch line of staplers.  A federal judge in Los Angeles is considering how much Staples must pay in damages and legal fees.  (Source Associated Press)

eBay Supports US Attorney's Office Investigation, Leads to Prison Terms

eBay PROACT Asset Protection investigators assisted the US Attorney's office with collecting user data information related to an investigation where parents used children to steal. The parents were recently sentenced to prison terms of three months for their actions in federal court. They were also ordered to pay $78,530 in restitution. The couple pleaded guilty to conspiracy to commit wire fraud after they were caught selling shoplifted merchandise, such as diabetic test strips, computer accessories and other expensive retail items. According to the United States Postal Inspection Service which investigated the crime, Lisa and Ross Knotts took their young children to various stores in West Virginia, Ohio, Kentucky and Indiana and instructed them to help hide the items in their shopping carts and strollers. "This was not an isolated incident. It was not simply to make ends meet," said US Attorney Booth Goodwin, who is handling the prosecution. Click here for full article.

How one resigns is absolutely critical in how you'll be viewed after you've left.  The actual act of resigning almost plays as critical a role as your performance does when you were in the position. Try to prepare the organization for it in advance without, obviously, telling anyone of your intentions, by including important people in projects, not volunteering for new initiatives and wrapping up loose ends.  Get ahead of the ball game so to speak, ever so cautiously as the employer may walk you out when you resign.  Make sure you make the resignation a face-to-face meeting that is professional, short and grateful.  Most everyone agrees that if you've reached this point, you should probably not leave the door open for counteroffers because if you stay, one day subconscious resentment may rear its head.  Lastly, always make the conversation with your boss a positive, emphasizing what you've learned, accomplished and how grateful you are for the opportunity.

Good Luck
Gus Downing
