New IRS rules this year may cramp some ORC fraudsters from auctioning more than $20,000 worth of goods on, an eBay company.  The rule now requires, and "other businesses that process payments" to file a Form-1099-K for all sellers with more than 200 transactions and $20,000 USD in sales per year.  This brings the tax man right to their door and that's something no fraudster wants.  Thanks to Scott Sanford, Dir of Inv. for Barnes & Noble, for supplying this info.  (Source

Obama to sign the $1.4 billion bill today that overhauls the food safety system giving Washington new power to increase inspections at food processing facilities and force companies to recall tainted products.  This is the biggest Food Safety bill in over 40 years and brings the food safety system into the 21st century.  However, the money to carry out the legislation is not guaranteed and may be difficult to obtain over the next 5 years.  (Source Associated Press)

With Karl Langhorst, Dir. of LP for Kroger's, joining the organization 3 years ago they've really focused on increasing the training levels of the 130 District LPM's and by the end of FY2011 all will have completed an in-house WZ Basic Interview Training program as well as a formalized management training program that includes operational aspects, financial aspects, and merchandising aspects of the business that will enable them to support the sales plans and increase the quality of the LP deliverable services. 

DeWitt, New York, a town near Syracuse, reports they've seen an increase in violent ORC activity and the DeWitt Police and several stores have formed a coalition that shares information, alerts, and strategies for stopping theft.  It seems that over the last several months a large number of the smaller communities are now reporting this increased ORC activity and are forming groups to combat the crimes.  Each LP executive should check with their local law enforcement agency and see if one exists in your community and, if not, see what you can do to start one, obviously after discussing it with your superior.  (Source

The Florida Department of Law Enforcement is investigating if three apprehended women, Remesa Buemer, Orlanda Slater and Brittany Brown, who were operating a sophisticated shoplifting ring out of Orlando, Florida, may be linked to other crimes throughout the state.  They were apprehended at the Prime Outlets on International Drive in Orlando and are trying to determine if they can add the charge of racketeering to the women by categorizing the thefts as organized crime.  Any information would be helpful.  (Source

With Border's announcing yesterday that it has stopped paying bills to some vendors as it seeks refinancing debt, one supplier temporarily halts shipments.   And today they announced that the EVP-general counsel & secretary of the company and the SVP & CIO both resigned yesterday for personal reasons and would not disclose the reasons.  There might be more here later.  (Source (Source Reuters)

Meanwhile Barnes & Noble reports Dec 23 was their biggest sales day in the company's history and that their positive same store sales growth for this quarter will be the first positive one in 12 straight quarters of declines.  Some say Barnes & Noble has been able to remold itself into more of a digital company with 20% market share in the e-reader business with their Nook.  While Borders "doesn't have the capital" and doesn't have it's own e-reader, Barnes & Noble may ultimately win this battle of the book stores.  Of interesting note is that their Loss Prevention efforts, headed by Jeff Fulmer VP of LP and his team, continue to be mentioned as a driving force in making their profit goals each year. In a move designed to help parent company eBay gain traction in the world's fastest-growing e-commerce market, PayPal inked a deal this week with China's largest municipal government to allow it to offer a foreign exchange settlement service to Chinese entrepreneurs selling to overseas consumers.  (Source

Macy's is adding 725 new positions over the next two years to grow its online business and building a new $150 million online fulfillment center near Martinsburg, W.Va and will hire 1,900 to staff that facility.  Online business is booming!  (Source Associated Press)

Two women in Greensburg, Pa., filed a federal law suit Monday claiming they had been taped by hidden cameras as they undressed at a southwestern Pennsylvania tanning salon and learned of it in July when one discovered a video of her disrobing at Sunkissed Tanning and Spa had been uploaded to pornographic websites.  The suit also claims other women were also taped through a hole in the ceiling of the East Huntington tanning salon between 2005 and 2007.  With technology what it is today, are your fitting rooms secure?  (Source Associated Press)

The National Inflation Association predicts that food inflation will become America's top crisis this year.  With a major shortage of farmers in the U.S. and a lot of old farm land now developed and Americans now competing on the international market for food, it will cause food prices to escalate significantly this year.  The Wal-Mart grocery price war is over!  (Source

In Memoriam

In a response to yesterday's Tip about how passion is the "most powerful ingredient" for an executive, one senior LP exec. commented that it's his opinion that "Intellectual curiosity trumps passion."  In that passion "inevitably subsides" in all things and that intellectual curiosity and exploration must take center stage in order to succeed and that there must be substance behind the passion.  That Passion is window dressing.

While I certainly agree with the premise that intellectual curiosity and mental exploration drives the long-term success of any executive and I agree that passion is window dressing to a certain extent, I submit that without it you don't even have a window to look thru.  Legitimate- true passion creates the window that ignites intellectual curiosity and motivates people to grow and take risks.  For what is intellectual curiosity without passion? It's like having a great plan with no execution.  So while passion does fade long term, does it ever really go away or has it merely matured and turned into intellectual curiosity?  Or are they merely equally important and the perfect combination?  You decide for yourself.
