Dollar General to hit 10,000 stores next year and open 625 stores and remodel 550 stores.  This year they opened 600 and remodeled 550.  Family Dollar, with 6,800, will add 330 new stores next year and remodel between 600 and 800 next year. (Source Retail Fix)

The non-compete lawsuit that Wal-Mart has against a former Wal-Mart North President that took a position with CVS Drug Stores goes to trial in March and could have "far-reaching implications."  Wal-Mart asserts that Hank Mullaney "was in possession of valuable strategic information that would hurt its competitive position."  The judge sided with Wal-Mart and issued a temporary injunction and, barring an out-of-court agreement, is set to get to trial in March.  The two-year non-compete prohibits Mullaney from working for a competitor with annual sales of more than $5 billion.  This could write a new chapter in case law surrounding the enforceability of employment agreements and, for the time being, certainly causes some second thoughts for current Wal-Mart exec's contemplating a move.  (Source Retail Fix)

San Diego ORC ring leads to four arrests so far who are part of a larger ring that travels up and down the state of California.  Stolen items from Hollister and American Eagle Outfitters have been recovered.  (Source visaliatimesdelta.com)

Department of Justice report says nearly 12 million, about 5% of the U.S. population ages 16 and older, were victims of identity theft in the last two-year period reporting with the Bureau of Justice Statistics estimating that the crimes caused $17.3 billion in damages to U.S. victims.  Alarmingly, only 17% reported the crimes to police.  (Source latimes.com)

The High Tech Investigation Association, a 3,100-member global association that trains and connects law enforcement and corporate crime investigators, survey on their web site states "during the past five years, members have seen the biggest increases in specific types of crime including Internet fraud, identity theft, credit card fraud and the use of technology to commit more traditional offenses."  (Source cnn.com)

According to KPMG's "Counterfeit Christmas" index, London is the most expensive place to buy counterfeit goods in the world just as it was in 2007 when the survey began.  KPMG investigators shopped 11 cities worldwide for their "basket of counterfeit goods" which included luxury branded sunglasses and handbags, DVDs, cigarettes and alcohol.  (Source theretailbulletin.com)

Online sales are up 12% to $27.5 billion this holiday season according to research firm comScore.com and from Nov. 1 to Dec 17 four days surpassed $900 million in sales with Apple's iPad and laptop computers driving most of the growth.  (Source Reuters)

$6.5 million worth of stolen artwork including pieces by Picasso, Botero and Chillida were recovered Saturday when Spanish police found the stolen truck in an industrial section of Madrid.  The pieces were stolen Nov. 27 from a Madrid warehouse.  (Source Washington Post)

New York State Attorney General may be filing civil fraud charges against accounting firm Ernst & Young claiming that Ernst & Young did not act in the appropriate manner while Lehman Brothers misled investors about its financial condition before their collapse in 2008.  (Source Associated Press)

MasterCard Advisors' SpendingPulse says "This is the first normal Christmas in three years" and it's beginning to look like a pre-recession Christmas with healthy gains in virtually all categories.  (Source Associated Press)

Sometimes you've just got to draw the line on what advice to follow and who you ask.  Certainly getting advice is important on any issue or decision.  But at the end of the day you've got to own your own decision and listen to the bird on your shoulder.  We all have one and oftentimes it's muted by our friends and family members.  At 5 am staring into that mirror is usually when the bird whispers the clearest.  The only problem then is if you don't hear it because you're not listening.
