Two Director of Loss Prevention positions will be announced in Monday's D&D Daily.

John Holubowicz was named Director of Asset Protection at Saks Fifth Avenue.  They have 4 AP Directors that all report to Sam Edge the Asset Protection Director.

WG Security wins appeal in patent case over Sensormatic in District Court in Washington DC on Nov. 8th which upheld the original verdict.  The original suit, which was filed in April of 2004 and brought forth by Sensormatic, charged WG Security Products with infringing on Sensormatic patents, namely the technology found in WG's Supersensor tag and other WG EAS tags and detection systems.  Sensormatic sought to prohibit WG from selling these products and requested damages which a jury unanimously rejected all of Sensormatics claims.  (Source,)

SAP is fined $1.3 billion for downloading millions of rival Oracle's software/files and has "tarnished the German software maker's reputation and is set to undermine its sales and profitability in the U.S."  The judgment "shocked" SAP and is ten times the amount SAP had set aside.  It only took two days in deliberation to establish the $1.3 billion judgment and SAP may appeal.  (Source Reuters)

The true "holiday headwind" for retailers this Black Friday is the growing popularity of online shopping.  With eBay, Amazon and most others offering extremely discounted prices and Forrester Research predicting online sales in the U.S. to grow by 16% this holiday season, the discount stores may have a difficult battle.  (Source

New Commerce Department report shows consumer spending up 0.4% in October for the fifth straight month with Americans saving 5.7% of their disposable income up from just over 1% before the recession, showing Americans are spending just a little more, but saving more than they ever have.  (Source Associated Press)

New Associated Press-Gfk Poll shows people are changing their financial behavior and getting use to tough times with 59% saying they feel little stress from their family's debt up from 49% last year.  Consumer spending has grown at its fastest rate in four years, but still so modestly that it's having little impact on the economy.  With 7 in 10 saying they pay off last month's credit card bill and 8 in 10 saying they plan on using credit cards for holiday shopping and expect to pay it off when they get the statement, how far will the consumer go this weekend?  (Source Associated Press)

eBay Investigators Support Law Enforcement in $12M Credit Card Scheme

eBay Asset Protection investigators assisted the Metropolitan Police by providing specific details on multiple PayPal accounts on suspects under investigation for computer hacking and buying and selling information stolen by using trojan viruses or other exploits on the internet. The 19-year-old suspect sold stolen credit card details filched from 65,000 bank accounts, and made $12 million off the scam. The site has been linked to frauds across the world which saw an estimated 8million plundered from 65,000 bank accounts. Nick Webber and three others ran a website called, where he sold American account details for ~$3; EU account details for ~$5; and UK account details for ~$6. According to police, Webber's laptop had information taken from 100,000 credit cards. He and his friends were regular web-swindlers. They also offered other sketchy services on the site, like instructions on how to hack into bank accounts, use stolen cards on eBay, make crystal meth and develop computer viruses.
